By starting a free trial, subscribing and or becoming a member of Eureka Report you are agreeing to the following terms and conditions:

Eureka Report, despite our best efforts to get it through to you, does not guarantee delivery of the service via email notification. We accept no liability for lack of email delivery due to third parties, such as Internet Service Providers (ISP's) preventing the email coming through to you. We strongly recommend that you put 'subscriptions@eurekareport.com.au' into your safe receivers / safe senders list in your email system. Please refer to your settings in your email inbox to do this, this changes from system to system.

Contributed articles and research notes, such as those that appear in Eureka Report's Weekend Briefing, are copyright to their respective authors and may not be reproduced, distributed or published by any person for any purpose without the author's prior written consent. Delivery policy

Eureka Report is published electronically by Eureka Report Ltd (“ER”). The publication is wholly online and is accessible by subscribers using their personal username and password to login to the subscription page of Eureka Report. Subscribers may from time to time be sent email updates and reminders of information that can be found via the website subscription service.

Eureka Report's editorial team takes an annual summer break at the end of each year during which no reports are published. The exact dates of the editorial break are announced in early December each year via e-mail and posted on our homepage. The Eureka Report website and all publication archives are accessible at all times.

The information published on the website subscription service can be downloaded by the subscriber and can be printed for personal use only.

Online payment security

Subscribers to Eureka Report Pty Ltd (“ ER ”) may make online subscription payments using direct debit (Eureka Report takes funds from your bank account for one calendar year's subscription or else automatically on a monthly basis for monthly subscriptions) or credit card (you are charged for your subscription to Eureka Report for one calendar year or else on a monthly basis).

Monthly subscribers to Eureka Report will make regular monthly payments via their preferred mode of payment (direct debit or credit card). Monthly subscriptions will be renewed automatically unless subscribers request otherwise. Credit card details or bank account details of all subscribers are retained by SecurePay Australia which is the payment gateway used by Eureka Report to process payments. Renewal payments are triggered by Eureka Report and actioned by SecurePay using these details. Eureka Report does not have access to these banking details at any time. Monthly subscribers can enter changed credit card or bank account details at any time. Subscribers will be personally responsible for the security of their personal username and password, which gives access to personal details other than banking details, e.g. name, address telephone etc.

Subscription dues to Eureka Report are in Australian Dollars ($AUD) only.

Credit card payments:

Annual subscribers to Eureka Report will pay the current annual subscription price in advance for the subscription service. The subscriber's credit card or direct debit details are retained by SecurePay Australia. 

Eureka Report does not have access to these banking details at any time.

Your rights:

You may terminate your association with us by giving notice to us in writing.

Notice given to us should be received by us at least 5 business days prior to the due date of the next drawing.

Client service agreement for direct debit requests (Cheque/Savings Accounts NOT Credit Cards)

Drawing arrangements:

You will authorise the monthly drawing arrangements when you enter your banking details into the form on our website. The first payment will be drawn immediately. Where the due date falls on a non-business day, we will draw the amount on the next business day. We will not change the amount or frequency of drawings arrangements without at least two weeks prior notice to you at the email address registered with us. In the event of any drawing being returned unpaid by your nominated Financial Institution your access to Eureka Report will terminate immediately. You will need to enter new banking details via the Eureka Report website to recommence your subscription. We will keep all information pertaining to your nominated account at the Financial Institution, private and confidential.

Your rights:

You may terminate the Direct Pay Plan drawing arrangements at any time by giving written notice directly to us, or through your nominated Financial Institution. Notice given to us should be received by us at least 5 business days prior to the due date of the next drawing. You may stop payment of a drawing under the Pay Plan by giving written notice directly to us, or through your nominated Financial Institution. Notice given to us should be received by us at least 5 business days prior to the due date of the next drawing.  You may request change from monthly to annual or vice versa of the Direct Pay Plan drawings by contacting us and advising your requirements no less than 5 business days prior to the due date.  Where you consider that a drawing has been initiated incorrectly you may take the matter up directly with us, or lodge a Direct Debit Claim through your nominated Financial Institution.

Your commitment to us, your responsibilities:

It is your responsibility to ensure that sufficient funds are available in the nominated account to meet a drawing on its due date. It is your responsibility to ensure that the authorisation given to draw on the nominated account is identical to the account signing instruction held by the Financial Institution where the account is based. It is your responsibility to advise us if the account nominated by you to receive the Direct Pay Plan drawings is transferred or closed. It is your responsibility to arrange with us a suitable alternate payment method if the Direct Pay Plan drawing arrangements are cancelled either by yourselves or the nominated Financial Institution.

Subscription and membership definitions

Annual subscription & annual membership:

An annual subscription, also known as annual membership, is an agreement whereby the individual joins and has access to Eureka Report for a period of 12 months. From time to time there may be offers and or bonuses associated with joining on an annual basis. Eureka Report will invoice the individual on a repeating annual basis; the individual needs to take action to confirm do not wish to renew their annual membership after the 12 month period.

Monthly subscription & monthly membership:

A monthly subscription also known as monthly membership is an agreement whereby the individual joins, and has access to, Eureka Report for a minimum period of 12 months, billed monthly via a valid credit card. From time to time there may be offers and or bonuses associated with joining on a monthly basis. Eureka Report will invoice the individual on a repeating monthly basis, the individual needs to take action to stop their membership after the 12 month period.

Automatic renewal service: 
 

At the end of your subscription period your credit card will be charged for a renewal term of either one month or one year depending on your membership status. Your subscription will continue to automatically renew for successive terms according to your status and your credit card will be charged for each such renewal at the then current subscription rate. We will send you an email within a reasonable time before the expiry of your subscription to let you know your subscription is close to ending – and will also notify you of any changes to the price of subscription that will apply upon this renewal. You can opt-out of this service at any time during your membership, in the ‘Update my details’ section of your account. If you do not opt out at least 4 working days before the expiry date of your subscription, your subscription will automatically renew on the subscription expiry date, at the then current subscription rate, and your credit card will be charged. We will charge the subscription using the same card that you previously used.  To change your credit card details please call our customer service team on 1800 458 656.

It is the sole responsibility of the subscriber to ensure that there are sufficient funds available from the chosen payment method. A subscription can be also cancelled by virtue of non-payment (after the initial 12 month period). To re-activate an annual or monthly subscription after non-payment a new subscription must be started either within the same account as before or by starting a completely new account with a new email address.

Refund and subscription suspension policy

Eureka Report offers a 100% money back guarantee on both annual and monthly subscriptions within 30 days of taking out a membership.

Each subscriber acknowledges that once an annual subscription period commences, membership can be suspended for a maximum of 3 months (12 weeks) over the life of the annual subscription.

Monthly subscriptions can be suspended for a maximum of 1 month (4 weeks) at any one time, within a 12 month period.

Free trial information

Anyone new to Eureka Report will be entitled to a time limited, no obligation - free trial. For access to the free trial, users will have to register their name and e-mail address with Eureka Report Pty Limited (“ER”) via the Eureka Report website.

After registration, the user will be given a temporary login username and password (which can only be used for the time period of the trial). The free trial commences when the registered user first logs in to the Eureka Report website.

Free trial access provides the user with the full service that Eureka Report offers to its current paying subscribers. The purpose of the free trial is for the user to experience Eureka Report first hand so as to make an informed decision on whether to take up a Eureka Report subscription.

The free trial is only available once per registered user.

Commissions

Eureka Report Pty Ltd will engage with third parties from time to time and provide a mutually agreed commission or 'spotter’s fee' where the third parties bring in new subscriber to Eureka Report.

Employees and/or associates of InvestSMART Publishing Pty Ltd may hold one or more of the stocks reviewed on this website. These holdings should not be seen as a recommendation. Staff must adhere to our Staff Trading Policy, which you can find below.

Staff trading policy

We do our utmost to avoid conflicts of interest with subscribers. We therefore impose restrictions on staff trading and require disclosure of staff holdings. Trading restrictions are as follows.  Approval for all staff trades is to be obtained from one of InvestSMART Publishing Pty Ltd's responsible managers or the compliance manager.  Approval is at the complete discretion of the Head of Research or the compliance manager.  Where a recommendation changes, staff will not be permitted to trade for one day either side of publication. This means the day of online publication, and the day after.  Staff must not trade against a buy or sell recommendation.  Approval to trade against a buy or sell recommendation will only be granted in exceptional circumstances.  Staff must hold all stocks for at least one month.  Approval to sell within one month will only be granted in exceptional circumstances.  We welcome comments on our Staff Trading Policy.

Special offer terms and conditions

Terms and conditions - Eureka Report membership special offers

I.          Information on how to claim and the offer form part of these terms and conditions. Participation in the offer is deemed acceptance of these terms and conditions and the general terms and conditions for subscribers contained on the www.eurekareport.com.au website. Offers are open to anyone aged over 18 who has a valid email address. This offer is not valid in conjunction with any other offer.

II.          From time to time Eureka Report will run special offers for its members, readers and expired members (“Special Offers”).

III.         To receive the Special Offers provided by Eureka Report Pty Ltd ABN 84 111 063 686  (“Eureka”) as specified via a Special Offer email (“Eureka Bonuses”), you must purchase a membership to Eureka Report on the eurekareport.com.au website during the offer period, which will be clearly outlined in the offer email, on the offer promotional website and on the subscription form.

IV.        The annual membership fee is disclosed on the eurekareport.com.au website and must be paid upfront in full to be eligible for this offer, using a valid credit card.

V.         The monthly membership fee is disclosed on the eurekareport.com.au website and is recurring for 12 months and must be paid using a valid credit card. Your credit card will be automatically debited monthly on the same day every month, from the date first paid. If a card error notification is received by us from your bank causing payment failure, your monthly membership will be terminated and you will be notified accordingly.

VI.        After payment has been processed, Eureka Report will send you an email with your tax invoice that will include instructions on how to redeem your Eureka Bonuses. 
For offers that include a physical item requiring mailing please allow up to 6 weeks for delivery.

VII.       If any of the Eureka Bonuses are unavailable for any reason, Eureka, in its discretion, reserves the right to substitute the bonus with a gift of similar value. Bonuses are not transferable or exchangeable and cannot be taken as cash.

VIII.       If and Special Offers are interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason, Eureka reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the  Special offers.

IX.        Any cost associated with accessing the websites referred to in these Terms and Conditions is your responsibility. Eureka makes no guarantee of the availability of any web service and will not be held responsible for interruption of service that may interfere with the ability to take advantage of any Special Offers.

X.         Except for any liability that cannot be excluded by law, Eureka and its associated companies (including their officers, employees and agents) exclude all liability (including in negligence) for any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of or in connection with this offer or accepting or using the Eureka Bonuses.

XI         Eureka collects personal information in order to conduct the offer, provide you with the subscription service and promote its services and those of its sponsors and business partners.
