Venue (law) is the location where a case is heard.
The perceived abuse of English criminal venue law was one of the enumerated grievances in the United States Declaration of Independence, which accused George III of the United Kingdom of "transporting us beyond Seas to be tried for pretended offenses."Article Three of the United States Constitution provides: "Trial of all Crimes . . . shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed."
The "where the said Crimes shall have been committed" language refers to the locus delicti, and a single crime may often give rise to several constitutionally permissible venues. "[T]he locus delicti must be determined from the nature of the crime alleged and the location of the act or acts constituting it." Thus, venue may be constitutionally permissible even if an individual defendant was never personally present in the relevant state. For example, conspiracy may be prosecuted wherever the agreement occurred or wherever any overt act was committed.
Law is a system of rules that are enforced through social institutions to govern behavior. Laws can be made by a collective legislature or by a single legislator, resulting in statutes, by the executive through decrees and regulations, or by judges through binding precedent, normally in common law jurisdictions. Private individuals can create legally binding contracts, including arbitration agreements that may elect to accept alternative arbitration to the normal court process. The formation of laws themselves may be influenced by a constitution, written or tacit, and the rights encoded therein. The law shapes politics, economics, history and society in various ways and serves as a mediator of relations between people.
A general distinction can be made between (a) civil law jurisdictions (including Catholic canon law and socialist law), in which the legislature or other central body codifies and consolidates their laws, and (b) common law systems, where judge-made precedent is accepted as binding law. Historically, religious laws played a significant role even in settling of secular matters, which is still the case in some religious communities, particularly Jewish, and some countries, particularly Islamic. Islamic Sharia law is the world's most widely used religious law.
Civil procedure is the body of law that sets out the rules and standards that courts follow when adjudicating civil lawsuits (as opposed to procedures in criminal law matters). These rules govern how a lawsuit or case may be commenced, what kind of service of process (if any) is required, the types of pleadings or statements of case, motions or applications, and orders allowed in civil cases, the timing and manner of depositions and discovery or disclosure, the conduct of trials, the process for judgment, various available remedies, and how the courts and clerks must function.
Some systems, including the English and French, allow governmental persons to bring a criminal prosecution against another person, prosecutions are nearly always started by the state, in order to punish the accused. Civil actions, on the other hand, are started by private individuals, companies or organizations, for their own benefit. In addition, governments (or their subdivisions or agencies) may also be parties to civil actions. The cases are usually in different courts, and juriescases. However this is distinguished from civil penal actions.
David Hogg (August 21, 1886 - October 23, 1973) was a U.S. Representative from Indiana.
Born near Crothersville, Indiana, Hogg attended the common schools. He was graduated from Indiana University College of Liberal Arts at Bloomington in 1909 and from the law department of Indiana University in 1912. He was admitted to the bar in 1913 and commenced practice in Fort Wayne, Indiana. He served as chairman of the Allen County Republican Committee 1922-1924.
Hogg was elected as a Republican to the Sixty-ninth and to the three succeeding Congresses (March 4, 1925 – March 3, 1933). He was an unsuccessful candidate for reelection in 1932 to the Seventy-third Congress and for election in 1934 to the Seventy-fourth Congress and in 1936 to the Seventy-fifth Congress. He resumed the practice of law. Organized a mutual life insurance company in 1939. He served as president of Goodwill Industries of Fort Wayne 1940-1943. Co-publisher of an interdenominational newspaper from 1941 to 1946. He again resumed the practice of law. Resided in Fort Wayne, Indiana, until his death there October 23, 1973. He was interred in Lindenwood Cemetery.
