A defendant is a person or entity accused of a crime in criminal prosecution or a person or entity against whom some type of civil relief is being sought in a civil case.
Terminology varies from one jurisdiction to another. For example, Scots law does not use the term "defendant"; the terms "accused" or "panel" are used instead in criminal proceedings, and "defender" in civil proceedings.
In a criminal trial, a defendant is any person accused (charged) of committing an offense (a crime; an act defined as punishable under criminal law). The other party to a criminal trial is usually a public prosecutor, but in some jurisdictions, private prosecutions are allowed.
Criminal defendants are often taken into custody by police and brought before a court under an arrest warrant. Criminal defendants are usually obliged to post bail before being released from custody. For serious cases, such as murder, bail is often refused. Defendants must be present at every stage of the proceedings against them. (There is an exception for very minor cases such as traffic offenses in jurisdictions which treat them as crimes.)

A man accused of taking part in a gang rape caused chaos in the courtroom during his routine hearing Thursday. Twenty-year-old Jayvon Woolfork stands accused of beating and raping a then 16-year-old girl inside his Hollywood home, back in 2013. During his hearing Thursday, Woolfork challenged the judge's sentence and yelled profanities for several minutes. "Where's the DNA at? ... Where's the so-called video they have?" he said. "What evidence do you have? Let me know." "I was surprised that he was animated," said Woolfork's attorney, Barry Butin, "because he's always been very well behaved in court. This was the first time. I'm thinking his frustration of being in jail for so long -- November of 2013 -- and the other four co-defendants resolving their cases about two or three weeks ago...

A woman was reportedly brought into a Kentucky courtroom with no pants and the presiding judge was not happy about it. The unidentified inmate was brought into the Jefferson District Court on Friday, where Judge Amber Wolf was prepared to sentence her for failing to complete a diversion program following a shoplifting conviction. That is, until the attorney informed Wolf that the woman was wearing no pants. The woman told the judge she'd been denied pants as well as feminine hygiene products for her three-day stint behind bars.
