Newspaper Subscription Terms and Conditions

DELIVERIES

Subscriptions to The Australian Financial Review is available in Australia where a normal home delivery service exists. For more information on the applicable delivery areas, please contact Customer Service on 1800 646 990.

We may cancel or discontinue subscription services by notice to you (with a pro-rata refund) if normal home delivery services cease to be available in any area.

Please allow up to 3 working days from the date of application for daily and weekly publication subscriptions to commence.

FEES AND PAYMENT

You may elect to pay for a fixed term subscription upfront, or to pay for a subscription by auto-renewal by your nominated payment method.

For upfront subscriptions, the full, fixed term payment is payable by cheque, money order or credit card prior to the commencement of deliveries. At the end of the fixed subscription term, you can renew your subscription by contacting Customer Service on 1800 646 990, faxing back the form provided with renewal notices or by following any other method specified by the publication at time of renewal.

For auto-renew subscriptions we will debit the cost of your subscription from your nominated payment method each month in advance unless and until your subscription is cancelled or terminated in accordance with these terms and conditions. We may change your payment amount provided that we give you at least 14 days’ prior written notice. Unless you notify us in writing that you wish to cancel your subscription as a result of such change, you authorise us to debit your nominated payment method for the new amount from your next billing date.

1.5% fee will be added to your monthly subscription cost if you pay by MasterCard, Visa, or American Express card. 

Subscription charges quoted are GST-inclusive for subscriptions within Australia. Where GST applies to any supply made to you, we will deduct the applicable GST and issue you with a Tax Invoice. GST means the Australian goods and services tax charged under A New Tax System (Goods and Services Tax) Act 1999 (”Act”). Tax invoice means tax invoice as defined by the Act.

MANAGING YOUR SUBSCRIPTION

When registering as a subscriber, you must provide us with accurate, complete and up-to-date information, as requested.

We may at any time request a form of identification to verify your identity.

It is your responsibility to inform us of any changes to your subscription details. If you wish to change any of your subscription details, you will need to contact Customer Service on 1800 032 577.

To have your subscription redirected to a new address, you must give us at least 3 business days’ notice for newspapers.

SUSPENSIONS

To temporarily suspend your subscription, you must give us at least 3 business days’ notice. You will need to tell us the date that you want to suspend your subscription from and the date that you would like your subscription to restart. If you do not specify a restart date, we will be entitled to restart your subscription at any time after the expiration of 60 days.

 

CANCELLATIONS

No refund will be paid in relation to direct debit subscriptions or trial subscriptions.

Upfront subscriptions may be cancelled prior to the expiry of the fixed subscription term, in which case you will generally be entitled to a pro rata refund of the subscription amount less.

Auto-renew subscriptions will continue until you notify us that you wish to cancel your subscription, in which case, you must notify us at least 3 business days in advance of your next billing date.

We reserve the right to suspend or cancel your subscription for any reason, provided that we give you written notice of such suspension or cancellation and, in the event of cancellation, pay you a pro-rata refund for the outstanding portion of your subscription.

PRIVACY

You agree that your name, address, email address and telephone number will be collected and stored by us and may be used for, among other things, the purposes of fulfilling your subscription and communicating with you about your subscription.

WARRANTY AND DISCLAIMERS

We expressly reserve the right to change or discontinue any part or feature of our publications at any time.

To the extent permitted by law, we exclude all conditions and warranties relating to your subscription that are not expressly set out in these terms and conditions.

To the extent that our liability for breach of any implied warranty or condition cannot be excluded by law our liability will be limited, at our option, to:

  1. in the case of services supplied or offered by us:
    1. the re-supply of those services; or
    2. the payment of the cost of having those services re-supplied; and
  2. in the case of goods supplied or offered by us:
    1. the replacement of the goods or the supply of equivalent goods;
    2. the repair of the goods;
    3. the payment of the cost of having the goods replaced; or
    4. the payment of the cost of having the goods repaired.

Excluding liability for negligence, our liability to you will be limited to the amount(s) paid by you in respect of your subscription within the last 12 months.

In no circumstances will we be liable to you for any indirect, incidental, special and/or consequential losses or damages or loss of profits loss of income, profits, goodwill, data, contracts, use of money, of whatever nature howsoever arising.

PERSONAL USE ONLY

Unless expressly agreed by us, subscriptions are strictly for personal or internal business use only.

GENERAL

We cannot guarantee the delivery of promotional items to home delivery subscribers. Promotional items may be available for collection at your local newsagency or at our offices.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure by us to assert any right under these terms and conditions shall not constitute a waiver of such right.

You must not transfer your subscription to any third party without our prior written consent.

You acknowledge that we may change these terms and conditions from time to time. If we do, any amendments will be posted on http://www.afr.com/subscribe. If you object to any changes to these terms and conditions, your only remedy is to cancel your subscription. If you do not promptly cancel your subscription as a result of such changes, you will be deemed to have accepted such changes.

These terms shall be governed exclusively by the laws of New South Wales, and the Courts of New South Wales shall have exclusive jurisdiction to determine any matter or dispute which arises under these terms and conditions.
