The U.S. Government lied to a federal judge, misrepresented facts and illegally gave 100,081 illegal aliens immigration status despite a pending lawsuit and an injunction. That is the argument that attorneys representing Texas and more than two dozen other states made.
During the heated court hearing Andrew Hanen, a U.S. District Court Judge, said that the apparent violation had made him look like an idiot since he initially believed the U.S. Government.
In a heated court hearing Angela Colmonero from the Texas Attorney General’s office stated that Texas had acted promptly in November 2014 upon learning of President Barack Obama’s executive amnesty and had followed all the timelines set forth with a sense of urgency.
“This was done to preserve the status quo and to prevent irreparable damage to the state,” Colmonero said referring to the cost that the individuals would bring and to the incentive for further illegal immigration. “You can’t put toothpaste back in the tube.”
During the hearings leading to an injunction handed down by Judge Hanen, attorney’s with the Department of Justice claimed that if an injunction was filed nothing would be done. That wasn’t the case, the Texas attorney said.
“The defendant did the exact opposite and gave 100,000 renewals for a term of three years under the expanded DACA,” Colmonero said. “The defendant didn’t inform the court until March 3—15 days after the injunction was filed.”
According to Colmonero’s statements, the program known as DACA (Deferred Action for Childhood Arrival) was implemented in 2012; however in November 2014 it was expanded, changing the time of the permits from two years to three years. Therefore the permits issued by the U.S. Government are a violation.
The coalition of states asked the court to give them early access as to the defendant’s documents and files since they couldn’t be taken at their word, Colmonero said.
DOJ attorney Kathleen Hardeck appeared nervous as she stuttered her response saying it was the terminology used that led to confusion, but once they saw that things could be misinterpreted they had tried to notify the court.
“When I asked you what would happen and you said nothing I took it to heart,” Hanen said. “I was made to look like an idiot. I believed your word that nothing would happen.”
During the hearing Hanen talked about possible penalties if, in fact, the evidence proved that the government had lied. He said it would probably not be financial since the taxpayer would be footing the bill over damages already made to them.
After hearing the arguments from both sides Hanen said he would issue a ruling in the near future.

The U.S. Government lied to a federal judge, misrepresented facts and illegally gave 100,081 illegal aliens immigration status despite a pending lawsuit and an injunction. That is the argument that attorneys representing Texas and more than two dozen other states made.
During the heated court hearing Andrew Hanen, a U.S. District Court Judge, said that the apparent violation had made him look like an idiot since he initially believed the U.S. Government.
In a heated court hearing Angela Colmonero from the Texas Attorney General’s office stated that Texas had acted promptly in November 2014 upon learning of President Barack Obama’s executive amnesty and had followed all the timelines set forth with a sense of urgency.
“This was done to preserve the status quo and to prevent irreparable damage to the state,” Colmonero said referring to the cost that the individuals would bring and to the incentive for further illegal immigration. “You can’t put toothpaste back in the tube.”
During the hearings leading to an injunction handed down by Judge Hanen, attorney’s with the Department of Justice claimed that if an injunction was filed nothing would be done. That wasn’t the case, the Texas attorney said.
“The defendant did the exact opposite and gave 100,000 renewals for a term of three years under the expanded DACA,” Colmonero said. “The defendant didn’t inform the court until March 3—15 days after the injunction was filed.”

After hearing the arguments from both sides Hanen said he would issue a ruling in the near future.

The U.S. Government lied to a federal judge, misrepresented facts and illegally gave 100,081 illegal aliens immigration status despite a pending lawsuit and an injunction. That is the argument that attorneys representing Texas and more than two dozen other states made.
During the heated court hearing Andrew Hanen, a U.S. District Court Judge, said that the apparent violation had made him look like an idiot since he initially believed the U.S. Government.
In a heated court hearing Angela Colmonero from the Texas Attorney General’s office stated that Texas had acted promptly in November 2014 upon learning of President Barack Obama’s executive amnesty and had followed all the timelines set forth with a sense of urgency.
“This was done to preserve the status quo and to prevent irreparable damage to the state,” Colmonero said referring to the cost that the individuals would bring and to the incentive for further illegal immigration. “You can’t put toothpaste back in the tube.”
During the hearings leading to an injunction handed down by Judge Hanen, attorney’s with the Department of Justice claimed that if an injunction was filed nothing would be done. That wasn’t the case, the Texas attorney said.
“The defendant did the exact opposite and gave 100,000 renewals for a term of three years under the expanded DACA,” Colmonero said. “The defendant didn’t inform the court until March 3—15 days after the injunction was filed.”

This first comprehensive biography of Thomas Goode Jones records the life of a man whose political career reflects the fascinating and unsettled history of Alabama and the Deep South at the turn of the twentieth century. Often overshadowed by the pharaonic antebellum period, the Civil War, and the luminous heights of the civil rights movement, the deceptively placid decades at the turn of the century were, in fact, a period when southerners fiercely debated the course of the Souths future. In tracing Joness career, Brent J. Aucoin offers vivid accounts of the great events and trends of that pivotal period: Reconstruction, the birth of the solid South, the Populist Revolt, and the establishment of racial disenfranchisement and segregation. Born in 1844, Jones served in the Confederate army and after the war identified as a conservative bourbon Democrat. He served as Alabama's governor from 1890 to 1894 and as a federal judge from 1901 until his death in 1914. As a veteran, politician, and judge, Jones embodied numerous roles in the shifting political landscape of the South. Jones was not, however, a reflexive conformist and sometimes pursued policies at odds with his party. Joness rhetoric and support of African American civil rights were exceptional and earned him truculent criticism from unrepentant racist factions in his party. His support was so fearless that it inspired Booker T. Washington to recommend Jones to Republican president Theodore Roosevelt as a federal judge. On the bench, Jones garnered national attention for his efforts to end peonage and lynching, and yet he also enabled the establishment of legalized segregation in Alabama, confounding attempts easily to categorize him as an odious reactionary or fearless progressive. A man who both represented and differed from his class, Thomas Goode Jones offers contemporary readers and scholars an ideal subject of study to understand a period of southern history that still shapes American life today.

Most-Cited Judge In America Criticizes Drug War As 'Absurd' A widely respected federal judge called for the legalization of marijuana in a lecture at Elmhurst College in Illinois on Thursday. Judge Richard A. Posner of the influential Seventh U.S. Circuit Court of Appeals in Chicago "is an intellectual giant who is the most-cited judge in America," reports Larry Bodine at Lawyers.com. "His call for legalization is considered significant because Posner is considered a legal conservative," Bodine wrote. "I don't think we should have a fraction of the drug laws that we have," Posner said. "I think it's really absurd to be criminalizing possession or use or distribution of marijuana. I can't see any difference between that and cigarettes."

An increasing number of federal judges are publicly expressing dismay with federal sentencing policy. Critics express concern that mandatory minimums take much needed discretion away from judges. Reform advocates have also cited mandatory minimum sentences, particularly those for non-violent drug offenses—along with the sentencing guidelines—as contributing to the country’s mass incarceration crisis. Have the guidelines and mandatory minimums contributed to the explosive growth in the federal prison population over the past few decades? Do they achieve the goal of fairer, race-neutral sentencing, or exacerbate existing racial disparities? This panel will examine how judges engage these issues.

"The Behavior of Federal Judges" presents a panel discussion on the findings and criticisms of the breakthrough 2013 book by the same name, authored by Professor Lee Epstein (formerly with USC and now Washington University in St. Louis), Circuit Judge Richard Posner of the Seventh Circuit Court of Appeals, and Professor William Landis of the University of Chicago School of Law.
The panel's discussion addresses the central role of federal judges in the American legal system, and the fact that their behavior as decision-makers is not well understood, even among themselves. Because the system of judicial decision-making lacks full transparency, indirect methods may be required to make sense of judges' behavior. The landmark book, by a political scientist, an economist, and a judge working together, constructs a unified theory of judicial decision-making. Using statistical methods to test various hypotheses, they attempt to dispel the mystery of how judicial decisions in district courts, circuit courts, and the Supreme Court are made.

"His call for legalization is considered significant because Posner is considered a legal conservative," Bodine wrote.
"I don't think we should have a fraction of the drug laws that we have," Posner said. "I think it's really absurd to be criminalizing possession or use or distribution of marijuana. I can't see any difference between that and cigarettes."
