States jurisdiction in international law : concept, types and examples.
State jurisdiction, reflects the international law general principles ,
of state sovereignty, equality of states , and non-interference in other states domestic affairs, and it means that a government and its courts , have general power to exercise authority, over all persons and things, within its territorial boundaries ,
however, there must be a link , between the individual , the offence
and the state court exercising jurisdiction over that person.
while it's primarily territorial, jurisdiction of states may be based on
other grounds, like national security , and citizenship of the victim or the offender, however , the enforcement of such jurisdiction, is restricted by territorial factors.
State jurisdiction, reflects the international law general principles ,
of state sovereignty,
equality of states ,
and non-interference in other states domestic affairs.
and it means that a government and its courts ,
have general power to exercise authority,
over all persons and things,
within its territorial boundaries ,
in relation to civil and criminal matters.
however, there must be a link ,
between the individual ,
the offence ,
and the state court exercising jurisdiction over that person.
while it's primarily territorial, jurisdiction of states may be based on
other grounds,
like national security ,
and citizenship of the victim or the offender,
however , the enforcement of such jurisdiction, is restricted by territorial factors
the first base of jurisdiction, is the territorial principle , and it means that the local court power, is geographically restricted, within the borders of that state.
However, As one offence may take place in more than one single country, the territorial jurisdiction is divided into 2 categories, subjective and objective.
the subjective principle, is exercised by the state in which the offence is started , while the objective principle, is exercised by the state in which the offence is completed.
For example, a fraud can be committed by someone in ireland,
against another in england. or a shooting incident , can take place on the borders of two countries,
on the other hand, the state power is not absolute within its territory , as certain persons, like diplomats. are immune, from the local courts jurisdiction, the nationality of the parties, is the second ground for state jurisdiction, as a state can exercise its jurisdiction, beyond its territory ( boundaries ) , regardless where the person is located, subject that the offender or the victim ( the passive personality ) is a national of the claimant country.
The 3rd ground is the protective or security principle, and it allows a State , to exercise jurisdiction over foreigners, outside its territory , regardless of their citizenship , when there is a threat to its national security.
And lastly, the universality principle , is the fourth ground for state jurisdiction, and it allows any state , to punish certain international offences abroad , like piracy, slavery , torture , crimes against humanity and genocide, whether committed by or against foreign nationals.

It is all about jurisdiction. If they do NOT have jurisdiction, they have nothing!!! The ONLY way they get jurisdiction is if you consent! Everything they are using to obtain jurisdiction is hearsay and inadmissible unless you provide it!

A big congrats to Jerry in Ohio and John in New York for standing up to the predators and getting complaints kicked out. While both are traffic, Jerry's dismissal is the more important because the judge spelled out exactly why the complaint was thrown out. Much to the critics' chagrin who falsely claim I've never had a judge agree with my argument on jurisdiction, this time as they can do is claim, "It's just traffic."
Such efforts to marginalize this evidence are without merit. The same jurisdictional claims are made by prosecutors whether traffic, drugs or taxation, felony or misdemeanor. Doesn't matter, they make the same claim as did the prosecution in Jerry's proceedings.
Claims of territorial, personal and subject matter jurisdiction all hinge on the same false opinion: if you're physically in Arizona, then the constitution and laws apply. There's no evidence to prove this; claims the constitution and laws apply are just blunt assertions of power, based on neither argument nor evidence.
The judge did lie and force a trial knowing the prosecutor had no evidence of jurisdiction. The Ohio judge pulled out the frivolous argument that jurisdiction is a trial issue. If you hear this line, object immediately and call the judge in this blatant lie. It's also grounds to disqualify the judge.
As shown in the video, the judge dismissed the complaint on grounds that after the trial the prosecution failed to establish jurisdiction. This disproves a couple of persistent claims: 1. The complaint is evidence of jurisdiction and 2. physical presence in the court is enough to establish jurisdiction. Both claims are false, as is the claim no judge has ever accepted my argument there is no evidence proving jurisdiction.
If you are attacked by government predators, then you definitely want to challenge the prosecutor' argument the constitution and laws apply to you. There is no evidence to prove it and without jurisdiction nothing else is relevant.

You can't usually challenge jurisdiction at an arraignment. You simply enter a plea. When you refuse to enter a plea, the judge will enter a 'not guilty' plea for you. The 'practicing law from the bench' objection is nonsense. Never works, never has, never will.

Think about that how can it not apply when the whole idea is to challenge the jurisdiction, and until they have the jurisdiction then their jurisdiction does not apply to you. Please remember when doing legal research, that all the law books are written for attorneys who can not use and are not taught how to use this type of law as they are always representing persons to the court.

Jurisdiction
Jurisdiction (from the Latin ius, iuris meaning "law" and dicere meaning "to speak") is the practical authority granted to a legal body to administer justice within a defined area of responsibility, e.g. Michigan tax law. Areas of jurisdiction apply to local, state, and federal levels, e.g. the court has jurisdiction to apply federal law.
Colloquially it is used to refer to the geographical area to which such authority applies, e.g. the court has jurisdiction over all of Colorado. The legal term refers only to the granted authority, not to a geographical area.
Jurisdiction draws its substance from public international law, conflict of laws, constitutional law, and the powers of the executive and legislative branches of government to allocate resources to best serve the needs of its native society.
International dimension
International laws and treaties provide agreements which nations agree to be bound to.
Political issue
Supranational organizations provide mechanisms whereby disputes between nations may be resolved through arbitration or mediation. When a country is recognized as de jure, it is an acknowledgment by the other de jure nations that the country has sovereignty and the right to exist.

A big congrats to Jerry in Ohio and John in New York for standing up to the predators and getting complaints kicked out. While both are traffic, Jerry's dismissal is the more important because the judge spelled out exactly why the complaint was thrown out. Much to the critics' chagrin who falsely claim I've never had a judge agree with my argument on jurisdiction, this time as they can do is claim, "It's just traffic."
Such efforts to marginalize this evidence are without merit. The same jurisdictional claims are made by prosecutors whether traffic, drugs or taxation, felony or misdemeanor. Doesn't matter, they make the same claim as did the prosecution in Jerry's proceedings.
Claims of territorial, personal and subject matter jurisdiction all hinge on the same false opinion: if you're physically in Arizona, then the constitution and laws apply. There's no evidence to prove this; claims the constitution and laws apply are just blunt assertions of power, based on neither argument nor evidence.
The judge did lie and force a trial knowing the prosecutor had no evidence of jurisdiction. The Ohio judge pulled out the frivolous argument that jurisdiction is a trial issue. If you hear this line, object immediately and call the judge in this blatant lie. It's also grounds to disqualify the judge.
As shown in the video, the judge dismissed the complaint on grounds that after the trial the prosecution failed to establish jurisdiction. This disproves a couple of persistent claims: 1. The complaint is evidence of jurisdiction and 2. physical presence in the court is enough to establish jurisdiction. Both claims are false, as is the claim no judge has ever accepted my argument there is no evidence proving jurisdiction.
If you are attacked by government predators, then you definitely want to challenge the prosecutor' argument the constitution and laws apply to you. There is no evidence to prove it and without jurisdiction nothing else is relevant.
