North Perth child sex attack trial takes priority over accused's domestic charge

The man accused of luring two children away from a North Perth child care centre and sexually assaulting them has appeared in court on unrelated domestic violence charges.

Vincenzo Mule, 53, has been charged with the sexual assault of two children in April, a four-year-old girl and five-year-old boy.

He is accused of luring the children away from an out-of-school child care centre, sexually assaulting them in front of each other, and then dumping them in Hyde Park on April 19.

However, when Mr Mule was first arrested by police on April 20, it was for allegedly breaching of a violence restraining order and setting fire to a car and property linked to his former partner - acts which police claim occurred on April 16.

While in custody, police questioned him about the alleged North Perth incident and child sex attack charges were laid against him the following day, on April 21.

The Supreme Court of Western Australia's proceedings into Mr Mule's criminal damage by fire and breach of a violence restraining order charges were adjourned on Monday to allow the North Perth child sexual assault charges to be dealt with first.

State prosecutor Amanda Forrester requested the matter be adjourned for two weeks, to allow Mr Mule to appear in the Perth District Court on Friday where he has pleaded not guilty to three counts of sexual penetration of a child under 13 and two counts of deprivation of liberty.

The matter is expected to be listed for trial shortly.

"The state's position is that those matters are more appropriately dealt with due to the young age of the complainants," Ms Forrester said.

Justice Lindy Jenkins allowed the adjournment in order to await clarification on the proceedings.

Mr Mule, who appeared in court via video link from prison, was remanded in custody to reappear in the Supreme Court in December.

A suppression order remains in place prohibiting the media from publishing images of Mr Mule.
