INTRODUCTORY TERMS

Please review the following terms & conditions carefully before using this website, which is operated by NewsLifeMedia on behalf of Vogue Australia (“NewsLifeMedia”, “we” or “us”).

You should also read the NewsLifeMedia Privacy Policy for an explanation of our practices and policies related to the collection, use, and storage of users' information.

Your access to this website, including participation in its bulletin boards, forums, personal ads and chats (collectively, the “Website”) is conditional upon your acceptance and compliance with the terms and conditions contained in this document and any other notices displayed elsewhere on the Website (known collectively as the "Terms of Use"). Your use of, and/or access to, the Website constitutes your agreement to the Terms of Use.

NewsLifeMedia reserves the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, please check back and review this document from time to time. Your continued access to the Website after each amendment will constitute your acceptance of that amendment.

Your failure to comply with the Terms of Use may result in suspension or termination of your access to the Website, without notice, in addition to NewsLifeMedia's other remedies.

USER AGREEMENT, CLUB VOGUE & FORUMS

Member Names, User Information & Avatars

To protect your privacy, we encourage the use of usernames on Club Vogue (e.g: Fashion_Gal) rather than your actual name. NOTE: We will NOT accept business names, registered companies, email addresses, websites, names which we consider offensive, or any form of self-promotion as a Club Vogue username, and we reserve the right to cancel any user which does not comply with these requirements.

The username field is compulsory and must be unique. If the name you select is already in use you will be prompted to choose a different one. Please think carefully when choosing your Vogue Forum username. Once your chosen username has been submitted you will not be able to change it.

We require members to include the following Club Vogue Registration information:
First name
Surname
State
Gender
Date of birth
Email address

Failure to include correct information outlined above and to update it as necessary, will be seen as a breach of these Terms of Use.

Members must be 16 years of age and over, to be eligible to use the Website.

Never post a message under another person's name or pretend to be another person. When posting a message on the Vogue Forum, your username is the only personal information that is displayed. Your real name and email address will never be displayed publicly unless otherwise specified by you.

Avatars : an avatar is a small image that represents you online. The avatar you select in your Vogue Forum profile will appear on any Forum post you make.

As with usernames, avatars considered by us to be inappropriate or offensive will not be permitted on the Vogue Forum and we reserve the right to remove any user with an inappropriate avatar. We ask that you please be considerate to other members in the Forum when selecting your avatar image.

Please ensure avatars are 80x80 pixels and are no larger than 19.5 KB. Any avatars that exceed this specification will be removed.

The Vogue Australia team updates Club Vogue members with invites and special offers via email; therefore please ensure that your details are inputted correctly into your Club Vogue profile. Should we continue to receive bounce-back emails after an e-broadcast, your Club Vogue profile may be cancelled without prior notification.

Inappropriate Posts

The use of inappropriate or offensive language is not permitted on the Vogue Forum. Inappropriate or offensive language includes, but is not limited to, any language or content that is sexually oriented, sexually suggestive, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, bigoted, incites violence or other unlawful behaviour, encourages breach of these Terms of Use, or contains racially, ethnically or otherwise objectionable material of any kind. This includes, but is not limited to, the use of punctuation characters or symbols to simulate swearing. The Vogue Forum is designed to be accessed by people of all ages 16 and over, and foul language will not be tolerated. Posts which we consider to be inappropriate in this way or otherwise unlawful, will not be accepted and may be deleted without prior notification.

Messages that are factually wrong, misleading, off-topic or threads that don’t fall into any category provided, may also be deleted.

We reserve the right to reject contributions that have been widely canvassed in the forum, are unconstructive or inconsistent with the Vogue Australia brand, or which seek to dominate the discussion.

Contributions that seek to endorse commercial products or activities or solicit business will not be accepted.

We ask that you please be considerate to other members in the Vogue Forum when posting your messages. We encourage every user to treat every other user with mutual respect. Do not use the Vogue Forum to threaten, harass, stalk, or abuse others participating in any discussion.

To avoid spam and unwanted communication you should always exercise judgment when revealing personal information in public forums. Sensitive and confidential information should not be sent via posts or Private Messaging.

The Vogue Forum Private Messaging System
All information passing through the Private Messaging System, or PM, may legally be viewed by and disclosed within NewsLifeMedia and otherwise in accordance with its privacy policy.  

Please be reassured access is only made to carry out investigations against any complaints/queries where the content of the Private Messaging may breach the Terms of Use or the law.

Stay Inside the Law
Vogue Australia does not allow any illegal activities on its Forum. You cannot use the Forum to publish, post, distribute, or disseminate defamatory, infringing, obscene, or other unlawful material or information.

Do not upload files or post messages that contain photos, software, text, music or other material protected by intellectual property laws (including copyright, trade mark, trade secrets), rights of privacy or publicity or any other personal or proprietary rights or applicable laws unless you own or control the rights to that material or have received all necessary consents.

No Spam - No Selling
Vogue Australia does not tolerate Spamming in the Forum. Spamming includes sending identical and irrelevant submissions to many different Forum areas or promoting blogs, services, businesses or other enterprises outside of topics where relevant. Usually such postings have nothing to do with the particular topic of the group or are of no real interest to other forum members. Spamming also includes misrepresenting the source of anything you say or post. Spamming is a serious violation of online etiquette.

Vogue Australia no longer supports Selling or Swapping in the Vogue Forum. The For Sale section was removed on December 15, 2009. Vogue Australia will not condone users seen to be selling or otherwise conducting material transaction in these Forums, using their Forum signature as an advertising mechanism and/or emailing or private messaging our users with advertisement/spam regarding their goods/services. Vogue Australia reserves the right to suspend, ban or give a final warning to users violating this clause.

Promotional Posts
Vogue Australia may from time to time post on behalf of third-parties. These threads will clearly be marked as sponsored or promoted.

Banning
We reserve the right to ban users who breach these Terms of Use. Users may be banned at any time, without notice.

Your responsibilities

You are responsible and liable for all your activities while participating in the Vogue Forum. Remember that you are responsible for anything you say or post.

Once a post has been made live in the Vogue Forum, unless it is brought to the attention of one of our moderators as being in breach of these Terms of Use, and is edited or deleted, it is not a service we offer to remove users’ posts, therefore please consider your post carefully prior to making it go live.

Vogue Australia does not tolerate any argumentative, derogatory or hurtful remarks regarding designers, fashion and beauty houses, retail outlets, companies or individuals. Any such remarks should be sent directly to the company or individual concerned and not posted on this Forum. Any such remark deemed unacceptable will be edited or deleted without prior notification.

Some content and links on the Internet may contain adult content and may not be suitable to some age groups. Please do not post links of that sort to the Vogue Forum. Any user found to be doing so will be banned.

You are responsible for any actions you may take based on advice or information you receive online. Use your own good judgment when evaluating information provided through any Forum post, remember that the information provided could be from people from any experience level. The decision to conduct transactions with anyone is your own and you should conduct your own research prior to making any decisions.

We do not necessarily endorse, support, sanction, encourage, verify, or agree with the comments, opinions, or statements posted by any user on the Website. Nor do we or our third party service providers make any warranties as to any of the merchandise featured or mentioned on the Website. Any information or material placed online, including advice and opinions, are the views and responsibility of those who post the statements, and do not necessarily represent the views of Vogue Australia or its third party service providers.

Moderation
The Vogue Forum is moderated daily, and we reserve the right to refuse to post, or to edit or delete any posts without prior notice, for any reason whatsoever.  However, we do not and cannot review all information posted to the Forum by users and we are not responsible for such information.

Intellectual Property
Any material on the Website may not be reproduced, distributed, transmitted, cached or otherwise used, except with the prior written permission of NewsLifeMedia.. This includes (but is not limited to) Moderators’ Private Messages, Forum threads and posts.

Reporting Undesirable Posts or Users
To report undesirable posts or to bring to our attention users who may not be following the Terms of Use, please notify the Vogue Fashion Police via Private Message or contact the Vogue Team on vogue@vogue.com.au - your comments will remain anonymous. Please DO NOT post your grievances in this Forum.

GENERAL TERMS

Use of the Website
The Website is not intended for users under the age of 16, and NewsLifeMedia does not knowingly collect personally identifiable information from users under the age of 16. Such users are expressly prohibited from submitting their personally identifiable information to us, and from using our forums and chat areas.  

You agree to use the Website only for lawful purposes and you acknowledge that your failure to do so may lead to suspension or cancellation of your membership without further notice, and may also subject you to civil and criminal liability.

The Website contains copyright material, trade marks and other information that is proprietary information. You acknowledge that Vogue Australia, GQ Australia, and Vogue Living are trade marks licensed by NewsLifeMedia, and that you may not use them without written permission from NewsLifeMedia.

You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching, or otherwise, of material obtained through the Website, except as permitted by the Copyright Act or other law or as expressly permitted in writing by these Terms of Use or by NewsLifeMedia.

You agree not to disrupt, modify or interfere with the Website or its associated software, hardware and/or servers in any way, and you agree not to impede or interfere with others' use of the Website. You further agree not to alter or tamper with any information or materials on or associated with the Website.

Other than connecting to NewsLifeMedia's servers by http requests using a Web browser, you may not attempt to gain access to NewsLifeMedia's servers by any means - including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Website or otherwise.

You acknowledge that NewsLifeMedia has not reviewed and does not endorse the content of all sites linked to from this Website and is not responsible for the content or actions of any other sites linked to from this Website (including links posted by other users). Your linking to any service or site is at your sole risk.

By posting messages, uploading files, inputting data, or engaging in any other form of communication through the Website, you grant us a royalty-free, perpetual, non-exclusive, unrestricted, worldwide licence to use, reproduce, modify, adapt, translate, enhance, transmit, distribute, publicly perform, display, or sublicense any such communication (including your identity and information about you) in any medium (now in existence or hereinafter developed) and for any purpose, including commercial purposes, and to authorise others to do so.

Copyright Complaints
NewsLifeMedia respects the intellectual property of others, and we ask our users to do the same. We may, in appropriate circumstances and at our discretion, suspend or terminate the access of and take other action against users who infringe the copyright of others.

You agree that NewsLifeMedia and its third party service providers are not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive or illicit material, even material that violates these Terms of Use.

Indemnity
You agree to indemnify NewsLifeMedia and its affiliates, employees, agents, representatives and third party service providers, from any and all claims and liabilities (including attorney’s fees) which may arise from your submissions, from your unauthorised use of material obtained through the Website, or from your breach of these Terms of Use, or from any such acts through your use of the Website.

Termination Of Access

NewsLifeMedia has the right to terminate your ability to access the Website, for any or no reason, without notice.

Competition and Consumer Act 2010

NewsLifeMedia does not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act 2010 (Cth) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, NewsLifeMedia excludes all rights, remedies, guarantees, conditions and warranties in respect of goods or services from your use of the Website whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible:
(a) NewsLifeMedia does not warrant the accuracy of the content on the Website. The content is provided to you “as is” and on an “as available” basis and on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk. Jurisdiction

NewsLifeMedia makes no representation that materials on the Website are appropriate, available or legal in any particular location. Those who choose to access the Website do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
You agree that this Agreement, for all purposes, is governed and construed in accordance with the laws of Australia and any action based on or alleging a breach of this Agreement must be brought in an appropriate court in Australia.
