Time to end this noose around the Fiji media’s neck

PROFESSOR BIMAN PRASAD has long been outspoken about the state of the media in Fiji. He had a simple but staunch line throughout the election campaign about the Media Decree: It had to go.

Back in 2008, two years after the Bainimarama military coup, he teamed up with University of the South Pacific journalism academic Shailendra Singh, to produce a courageous book pulling together a collection of papers about democracy and the media in Fiji.

So it was no surprise that would he would test the decree by tabling a motion in the Fiji Parliament last week to remove or modify the invidious and misguided legislation.

And although it was defeated,  24-17, it was interesting to see the number of absentions (9 on the government side). The motion wasn’t defeated as heavily as it might have been.

Worth another shot soon.

A Fiji democratic mandate for the coup leader – what now for the media?

IN THE END, it was no real surprise. For 2006 coup leader Josaia Voreqe Bainimarama, who retired recently as the military strongman with the rank of rear admiral, it was a foregone conclusion that he would emerge as the triumphant victor in Fiji’s first general election in almost eight years.

Just as it was inevitable in 1992, when the original coupster - who staged two coups in the same year, 1987 -  Brigadier-General Sitiveni Rabuka made the transition from military backed prime minister to civilian leader.

A major difference is that Rabuka was elected in 1992 on an indigenous supremacy platform of “Fiji for Fijians” while Bainimarama’s Fiji First party is pledged to a multiracial “Fiji for all Fijians”.

The hope is that Bainimarama’s authoritarian streak will gradually mellow and he will come to recognise as an elected leader the critical importance of a civil society discourse with a strong non-government organisation sector and an independent Fourth Estate.

The media was once a proud and feisty part of Fiji democracy. It can achieve that credible status again.

The lies of Marc Edge, 'counterpropagandist'


BENJAMIN FRANKLIN once said that “half a truth is often a great lie”, but in the past few weeks the blog Fiji Media Wars has been treating readers to a steady smear campaign. Café Pacific publishes here a statement by journalist and media educator David Robie:

Canadian Marc Edge projects himself as a dispassionate scholar. In fact, he is a polemicist and “counterpropagandist” – as he admits proudly on his website – who has regularly used his position at a Pacific university over the past year and since to peddle self-serving disinformation. For those who wondered why I was departing from the usual editorial line of Café Pacific to make a rare personal public condemnation with my “Vendetta journalism” article last Wednesday, the answer is quite simple: To make the truth known.

When I heard Dr Marc Edge’s distortions on his Radio Australia interview late last month blaming Fiji’s military backed regime as the sole cause of his demise at the University of the South Pacific, I decided I could no longer remain silent. In my capacity as a regional journalism educator and journalist, I had the misfortune to cross paths with Marc Edge several times and over varied projects over several months at his university last year. I quickly learned he had his own personal agenda and little of it was to do with the truth or journalism education. In fact, I am now convinced that he never had the welfare of students or the USP journalism programme at heart. He merely wanted to use USP as a pawn in gathering fodder for his proposed “Fiji Media Wars” blog book to trash Fiji and portray himself as a media freedom “hero”. It backfired.

Fiji without The Fiji Times is unthinkable

AS A riposte to the armchair media freedom critics from afar in Australia and New Zealand, safely beyond the regime's attention and the tentacles of the media decree, new Fiji Times editor Fred Wesley has penned this editorial. The editorial, headlined BREATH OF FRESH AIR, was published yesterday.
It is time to share with our readers where we are and where we plan to go.

Today we stand poised in an ocean of moments, reaching out for the reigns of change so that we may take hold of our own destiny.


Rich in history, we look forward with positive minds, eager to shrug off unwanted perceptions.


For some time now, we have been tagged as a newspaper hell-bent on being a pain in the b
ack of the State. It was an unwanted tag, one that brimmed with negative vibes.

To be seen as anti-government or pro-government are charges that do us no favour as a responsible media organisation.


We would rather be seen as a newspaper that takes no side; simply a newspaper of integrity.


Integrity is regarded as the quality of having an intuitive sense of honesty and truthfulness. Further, it is the opposite of hypocrisy.

We are not a newspaper hell-bent on hurting a government. Our passion is to ensure our readers know we have a sense of fairness about us.


Our charter is to strive for accuracy and balance with the intention to do justice to every story we print and picture we use. We are not anti-government and we are not pro-government.


We are very, very pro-Fiji and living proof of this is our 141-year record as recorders of history in this nation. In short, we are
The Fiji Times, neutral and striving to ensure any perception that paints us otherwise is easily washed off.

We will endeavour to make sure our readers see in us a newspaper that is easy to read, has entertaining and educational infor

Pacific 'dictatorship of the publishitariat'?

SPEAKING at the 2010 Pacific Islands Media Association (PIMA) conference in Auckland on Friday, the keynote speaker, well known and respected Tongan media publisher and media freedom activist 'Eakalafi Moala said: "Press freedom in the Pacific Islands is under constant threat" while "New Zealand journalists ... took freedom of the press for granted."

He said threats to Pacific media freedom were due not only to "government blocking" (he was especially critical of Fiji's Media Decree, where, incidentally, the Fiji Broadcasting Corporation reported his speech!) but also to "the social and cultural fabric of the local community" that accepted government actions less critically than in Western countries. "Media freedom," he said, "operated more easily within a Western-educated social structure and conduct.”

Taken at face value, most would agree. But I wonder. Is it as straightforward as this? In an ideal world, would press freedom always prevail? Or, to play devil's advocate, should it ever prevail? What, exactly, is media freedom? Can a case be made that restrictions should be placed on the media in some situations? What are those situations? 'Eakalafi talked of cultural constraints in the Pacific but are there no cultural or other constraints in Western societies?

How free, really, is the New Zealand media? Does it truly provide access to information the people need to know? Who decides what we will read and hear and how it is presented? Who decides the news? I'm reluctant to write about Fiji again in this context, but when did the NZ media last report a contrary view on the situation there? How have they helped to explain what is happening, and why? How do they decide who to interview? Do they ever verify their stories?

One can also ask what is meant by information when so much of what we see is sensationalism and trivia. What real balance exists in their coverage? Even media people ask what's happened to investigative journalism. We've never before had so much access to information, but we've also never has access to so much wrong or useless information. Sometimes I ask, do I know more about any matter of consequence because of the media, or am I merely more misinformed? And then I ask myself about the supposed role of the media in a democracy and what it actually does.

Who really is this freedom for? I am not an advertiser or a shareholder in the media. I don't vote for their boards or sit on their appointment committees. I have no say whatsoever in what they choose to publish or not to publish. I am not part of the media or any other establishment. I cannot vote them out with a letter to the editor or an appeal to the Broadcasting Standards Authority.

When it comes down to the hard questions, we should ask how significantly different are the NZ and Pacific media? Different masters, different circumstances and different stories, but I suspect that whoever pays the piper still calls the tune. My only freedom is the choice to switch off the TV and radio and not read the newspapers. Sometimes, not always of course, I wonder how they dare claim a special, elevated place -- the Fourth Estate -- in a democracy when their power is more akin to a "dictatorship of the publishitariat."

Freedom of the media, by the media, for the media? An overstatement, perhaps. But by how much?

Opening eyes to a Fiji 'free press' blindside

AN ITEM that popped up today on Croz Walsh's Fiji blog taking the mickey out of a "profound shame" article by a former Fiji Times editor-in-chief, Rory Gibson, in the Brisbane Courier-Mail. It ran under this heading:

Don't give me that nonsense about the media freedom in the Mickey Mouse press

Q. What does the Fiji Times, the Townsville Bulletin, the Australian and the Courier-Mail have in common?

A. They are all owned by Rupert Murdoch's News Ltd and they've all employed Rory Gibson as editor, editor-in-chief, chief subeditor or senior journalist at some time or other.

Rory has the reputation of writing humourous articles. If you're a kookaburra, you'll really laugh at his latest effort, Australian tourists turn a blind eye as Fiji's best people persecuted in the Brisbane Courier-Mail.

He writes that "it should be a source of profound shame to our country that Australians are going on holidays to Fiji in record numbers".

Why? Because they are gifting "dollars to the coffers of a nation that is run by a military dictatorship little better than any apartheid regime operating in South Africa's dark ages".

Forget that most of the dollars stay in Oz and that thousands of ordinary Fijians live on what's left. Just think back to Soweto, S. Africa, 1976. Police open fire on 10,000 protesters. Fiji today: No guns fired. Apartheid South Africa: All ANC leaders, including Nelson Mandela imprisoned, many for life. Fiji: Short-term arrests but no political prisoners; former Prime Ministers drinking coffee in Downtown Suva.

And who is the cause of the shame in Fiji? "We can all laugh," he writes unblushingly, "that our Melanesian neighbours are ruled by a bloke with a name that sounds like an '80s girl band, and assuage our consciences by believing Commodore Bainimarama's claptrap about restoring fairness to Fiji's racist electoral system." Girl band? Claptrap? Restoring? It wasn't a racist electoral system?

And what are the effects?

"This Pacific tragedy isn't about whether the Fiji Times is being edited under the baleful glare of one of Bainimarama's gun-toting thugs [Oh, No?], or that an expat gets his marching orders.[Definitely not!] It's about people like Imrana Jalal and her husband Ratu Sakiusa Tuisolia."

And the rest of his long story is about these "best people" and a court case in which Jalal was acquitted.

His conclusion? "Going on holiday there while this sort of abuse is happening would be like sitting in a cafe sipping a coffee while a mugger attacked a pregnant woman on the footpath next to you, and you ignored it."

So, that's all for the moment from Rory Gibson, former editor-in-chief of the Fiji Times, defender of media freedom. One wonders what his journalist colleagues think about this.

Fijilive left off 'legal' media list, news editor quizzed

FIJI police have picked up the news editor of the Fiji web news pioneering agency Fijilive, Richard Naidu, for questioning – and then released him.

State-owned Fiji Broadcasting Corporation News reported that he was questioned over a story that was published by the online news agency on Thursday.

Criminal Investigations Department (CID) director Adi Sen was quoted as saying the police questioned Naidu overnight and released him at about 11am Saturday.

Naidu was reportedly questioned over a story alleging the suspension of the Police Commissioner Commodore Esala Teleni, a story the police say was incorrect.

The questioning happened on the same day that the regime announced the news organisations that have been registered under the new Media Decree – minus Fijilive. Related, or did Fijilive simply fail to meet the deadline?

Fijilive was offline all weekend but resumed publication again on Monday, August 2, without explanation. The regime denied any responsibility for the Fijilive "whiteout".

The media groups named by Attorney-General Aiyaz Sayed-Khaiyum, as reported by the FBC News, include:

Active Media, ALSA Ltd as Mai Life Magazine, Bula Namaste, Communications Fiji Ltd, Fiji Broadcasting Corporation, Fiji Sun, Fiji Times, Fiji TV, Half Times Publications, Islands Business, Mai TV and Sporting Pulse.

The membership of the new Media Industry Development Authority, also announced by Sayed-Khaiyum, is intriguing. It includes several strong civil society advocates for a more “responsible” news media and several literary figures.

One thing they can be counted on is to be committed to working towards a higher quality media for Fiji.

It also includes the manager of a Suva-based regional news organisation widely accused of failing to defend Pacific media freedoms by staying in Fiji and "kowtowing" to the regime.

Highly respected author and academic Professor Subramani is now the chairman of authority, replacing Satendra Nandan who withdrew over health issues.

Pacific Islands News Association (PINA) manager Matai Akauola is also a member of the authority, as well as the Solicitor General Christopher Pryde.

The other three members are: Aselika Uluilakeba, representing the interests of the children; Peni Moore representing women’s interests; and Jimaima Schultz, representing consumer interests.

Draft Fiji media decree in profile on 95bFM

Coup 4.5 reports on what it says are casualties of the decree climate:
Two senior journalists at Fiji TV have been moved to lesser roles under claims they were biased against the Frank Bainimarama government.

It is believed Merana Kitione and Anish Chand were sidelined because of their links to the National Federation Party. Kitione, Fiji TV's manager news current affairs and sport, is married to former
Fiji Times journalist and administrative officer for the National Federation Party, Kamal Iyer.

She is now acting training and development manager.
Another senior journalist, and close colleague, has been moved with her - desk editor and team leader news, Anish Chand, who is now in production.

Chand has friends in the National Federation Party.
Kitione's old job has been filled by Tukaha Mua, who used to manage the programmes and distribution section, while Chand's position has been filled by Emily Moli.

Wise counsel and fresh view of Fiji media role needed

FIJI WATCHER Crosbie Walsh has come up with his own assessment of the draft Fiji Media Industry Development Decree and concludes "wide counsel" is needed to address the plethora of issues raised in this proposed law. Among the many considered points he makes is how sections of the Fiji media - particularly the Fiji Times - have in his view failed to report fairly the changes taking place in the country. Excerpt:
The [Fiji regime's] Roadmap aims to develop the institutional and economic infrastructure to benefit Fijians irrespective of race; it has taken a number of measures to reduce poverty and promote rural development; expose and punish rampant corruption and abuse of office; produce more harmonious relations between the major races; and in the 2014 elections all votes will be of equal value.

In pursuit of these objectives, those who used their office or status to gain preferential advantage for sections of the ethnic Fijian elite (not all ethnic Fijians as they claimed), such as the SDL [
Soqosoqo Duavata ni Lewenivanua] party, the Great Council of Chiefs and the upper echelons of the Methodist Church, and their counterparts in the civil service have been effectively sidelined.

How was all this reported by the Fourth Estate? Between 2006 and the the Abrogation of the Constitution and the imposition of the Public Emergency Regulations (PERS) in 2009, the media - but most especially the
Fiji Times - was totally hostile.

On any reported issue, my count was that about four anti-government people to one government spokesman would be cited. On no controversial issue was the government position fairly reported.

The
Fiji Times position was that this was an illegal government, and by definition, nothing it did could be "good." Following the imposition of PERS, the Fiji Times published almost nothing (positive or negative) about what the government was doing.

The de facto government had ceased to exist. But when, on the rare occasion, mention had to be made, the PM and other government people were referred to without their proper titles. This, however justifiable, was a deliberate insult that unwisely invited government retaliation.
Walsh makes a wide-ranging assessment in his analysis and also critiques Western assumptions about the role of the media in a developing country such as Fiji, espousing the need for a development communication model rather than the more familiar Pacific "watchdog" approach. In this context, the Singaporean-inspired model for Fiji isn't quite as extreme as it has been portrayed in Australia and New Zealand:
A third assumption is that western notions of media freedom usually provides the public with access to all information, presented in a fair and balanced manner.

This is only partly true. Most media organisations are run as businesses, owned by businessmen and big business shareholders, and directed by people appointed by these same businessmen and shareholders.

Rarely do we see the media speaking up for the poor, the underprivileged, consumers, the trade unions, workers on strike, or left-leaning governments.
The Fiji Times most certainly did not when Fiji Labour Party-led government was in power. Media ownership and the extent of media freedom are linked.

Ruthlessly chilling decree no way to improve Fiji media



SO Jim Anthony has had the last laugh. And at least two critical components from his discredited 2007 "Freedom and independence of the media in Fiji" report have found their way into the draft Media Industry Development Decree 2010. No surprise, of course. All the signs have been there for the past couple of years. It was a sure bet that the regime would adopt a Singapore-inspired Media Development Authority and a Media Tribunal with draconian powers (see p. 6 of Anthony's executive summary). But at least his crazy idea of a 7 percent development tax was ditched.

The tragedy of the Anthony report and the public slanging match with the media that ensued is that neither should have never taken place. Had the Fiji news media got their act together and improved things on their own accord, rather that persevering with the "toothless tiger" Fiji Media Council with all its overdue faults, this draconian draft might have been headed off. The independent Media Council review in February 2009 was a job well done - but it was more than three years too late to have any impact.

Now we have a ruthlessly chilling climate of self-censorship being imposed in post-coup Fiji. A year of censorship since the 1997 constitution was abrogated on April 10 is taking its toll. Soon we will have a generation of journalists (average age in Fiji is less than 25)that will barely know what it was like to work in a genuinely free press.

The regime is systematically destroying what had been traditionally one of the strongest media industries in the Pacific.

Media improvements were needed, true. Especially over "fairness and balance". But government authorities have ignored the commonsense independent Media Council review recommendations last year and instead been influenced too heavily by the harsh proposals of the discredited 2007 Anthony report.

Ironically, one "success" of the council is to have its code of ethics adopted in the decree - "lifted word for word", as Fiji Broadcasting Corporation's news director Stanley Simpson points out. Summing up today's media "consultation", he said:
Among the major sticking points during today's discussions was the make up and independence of the Media Development Authority, the imposition of fines for breaching certain provisions under the decree, and the ability of the media to appeal or seek redress from the courts if the Media Tribunal ruled and imposed fines against them.

Limits on foreign ownership of media organisations in Fiji also featured, with the proposed decree set to take out Australia’s News Ltd’s ownership of the
Fiji Times.
Actually, the foreign ownership limitation would gain widespread sympathy. Many believe that Rupert Murdoch's News Ltd and the Fiji Times have not been "in tune" with Fiji for many years. Nevertheless, a 10 percent limit is to punitive. Perhaps 49 percent and a reasonable adjustment window to divest shares would have been more realistic - and fairer.

Café Pacific's colleagues at the media consultation provided this feedback:

S4(1): The Authority shall consist of a director appointed by the Minister.

Response: This is putting too much power in the hands of the minister. It could open the door to political appointments, and jeopardise the independence of the authority. The person appointed as director should be one who enjoys the confidence of all the stakeholders, not just that of the minister or the government of the day. There needs be more consultation; it's too risky to leave such a crucial appointment in the hands of one person or one party.

4(3): Director must be remunerated in a manner and at rates subject to terms and conditions determined by the Minister.

The civil service and statutory bodies have clear and transparent salary structures based on academic qualifications and experience. These guidelines should be used to determine the salary of the director, which should be made public. This will instill confidence in the process and the
authority, and it will protect the integrity of the minister also.

5(1) & (2): The authority appoints its own officers and servants and will determine its own salaries and conditions with the Minister as the approving authority.
Appointments and salaries and conditions should be determined independently and in accordance with clearly stipulated procedures to avoid compromising the process, and to instill confidence in the authority.

Terms of office (p. 7)
6(2): The Minister may remove the Director of the Authority at any time from office if the Minister considers it appropriate in the public interest.

The sole authority to remove the Director (coupled with the sole authority to appoint and remunerate) gives the Minister almost sweeping powers over this body which is cause for unease.

Part 4: Content regulation (p. 12)
Offences relating to content regulation

23. The fines and jail terms stipulated (F$100,000 to $500,000; or imprisonment for five years or both) for breaches of content regulation are too draconian. It will have a chilling effect and stop the media from reporting issues of national interest. It is a disincentive for new entrepreneurs wanting to enter the sector. It will also scare away people who may want to join the profession.

Part 5: Enforcement of media standards (p. 12)
25. Power to require documents for information

This is the authority duplicating what the courts are already empowered to carry out. This is outdated, and contrary to whistleblower protection legislation being mooted nowadays as a safeguard against corruption. This is not something that will encourage investigative reporting, which is something this government claims it is keen to promote.

26. Power to enter premises and search, seize under warrant

This is the authority duplicating police work.

27. Offences relating to enforcement (p. 15)
Any person who fails to disclose documents faces maximum fines of $100,000 and jail terms of up to five years, which are quite harsh. This will put an end not only to the whistleblowing culture, but media disclosure of confidential documents in the public interest.

63. Power of the Tribunal on hearing of complaint (p. 28)

The tribunal can order the media organisation or any employee to pay monetary compensation to aggrieved complainants. We already have defamation and other laws for compensatory damages. Why duplicate this function and waste resources? This is something best left to the courts.

Summing up: The decree gives too many sweeping powers to the minister which can be dangerous. There is duplication of the work that courts have been set up to do, which is an unnecessary waste of resources.

The fines and jail terms stipulated are extremely harsh. The media has been denied the freedom it needs to inform the public and to act in its interest.

How the Fiji regime's censorship contradicts the People's Charter

For more than three years, the Bainimarama regime has been in effective control of the governance of Fiji, and even recognised as such by international organisations such as the International Monetary Fund (IMF), World Bank and Asian Development Band.

Bainimarama says he will not hold elections until 2014, by which time he thinks the principles of his “People’s Charter” will have been fully entrenched in all processes of government.

But the current media censorship not only takes away our citizens’ basic human right to freedom of expression, it totally undermines the values, commitments and pledges made in the military government’s own Charter.

Since this military regime will, by 2014, have been the effective government for eight years (longer than any elected government), why does it not follow the good governance principles laid down in its own Charter- the need for every government to be open, transparent and accountable to the public, which, in the absence of a democratically elected Parliament, can only be through full media freedom.

Full media freedom is even more vital for public service efficiency, given that the civil service is being gradually militarised in key positions, posing serious problems for the Public Service Commission and the use of tax-payers funds: how ensure that these military personnel behave as fully professional civil servants and not as army personnel, uncritically taking orders from their superiors?

How will the military government be judged by history, if the public service and the economy fail to perform, cocooned by the media censorship?

Surely, both the military government (however long it stays in power) and Fiji have everything to gain and little to lose, if the Public Emergency Decree and the media censorship are removed.

The continuing media censorship
For several months now, the military government has totally censored the media - television, newspapers and radio, removing any news item deemed to be critical of government, their policies and their performance.

At a personal level, Fiji TV or the radio stations no longer bother to interview me for comments on economic issues; while most of my newspaper articles are censored.

Most recently, the military’s censors stopped the publication of an article pointing out the pervasive economic implications of Fiji’s long term demographic changes relating to our ethnic mix: the effects on our education system, the composition of our labour force,
future entrepreneurship, dependency ratios (a key demographic factor in wealth accumulation), and ethnic patterns of consumption, of great relevance to the businesses world. There was nothing overtly political in this article.)

But this military government’s censors decided that the Fiji public will not be allowed to read this article.

The irony is that while they keep repeating that their Charter will guide this country for the foreseeable future, their media censorship contradicts their Charter at every turn.

Do not forget that the Charter started off (page 2) that “We the People of Fiji affirm that our Constitution represents the supreme law of our country, that it provides the framework for the conduct of government and the people”.

But any protection that the 1997 Constitution may have provided against unfair media censorship, went out the window, when Bainimarama abrogated the Constitution in 2009.

But the rest of the military government’s Charter is still a great supporter of our fundamental right to freedom of expression, even if the Military Censors are not.

The Charter Values
Among the values that the Charter espouses (page 4) is “respect for the diverse cultural, religious and philosophical beliefs”. The section on “Moving Forward Together” says “our nation is in urgent need of genuine, trust-based dialogue and peace building for which qualities of humility, compassion, honesty and openness to other views and interests are essential”.

But some people’s views and philosophical beliefs are not respected by the military censors, and will not be allowed to be aired in public, however genuine, constructive and peace building.

Then the Charter states (page 6) “our nation must have a freely and fairly elected Parliament...” and “we believe in an executive government answerable to the Parliament, an independent judiciary, and Security Forces that ... are answerable to the government and Parliament in accordance with our Constitution”. But given that Bainimarama will not give the people of Fiji an elected Parliament until 2014, only media freedom can ensure accountability to the public.

The Charter states (page 7) “we believe in a strong and free civil society as vital to democracy, good and just governance....”. But for the military government refuses freedom of speech or assembly.

Then again that Charter states “we aspire for Fiji to be an educated, knowledge-based society where all our people have access to education and continuous learning...”. But
the military government decides what knowledge the people have access to, through their censorship of the media.

While the Charter says “we must use our individual and collective knowledge and skills to develop our country”, the military censors are deciding that the skills and knowledge of some individuals (anyone who disagrees with the military government) will not be made available to the public.

The Charter goes on (page 8) “We reaffirm our recognition of the human rights and fundamental freedoms of all individuals and groups, safeguarded by adherence to the rule of law”.

But Military Decrees, including the Public Emergency Decree which implements the media censorship, now define the law - when there is no emergency at all in the country.

The Charter’s key pillars
Pillar 1 of the Charter talks about “sustainable democracy and good and just governance”. It states (page 11) “The government must be fully accountable to the people of Fiji through Parliament and its procedures”.

The Charter says that to oversee governments, there must be independent and well resourced offices of the Ombudsman, Human Rights Commission, Auditor-General, and FICAC. And “The government must publish timely public reports with adequate details so that the people of Fiji are aware of what is being done in their name and with their taxes”.

But the current military government does not abide by this Pillar: it will not make public the Auditor-General’s Reports for 2007 or 2008. And it is unlikely that there will be any Auditor-General’s Report on government expenditure and revenues for 2009.

The Charter’s Pillar 3 on “ensuring effective, enlightened and accountable leadership” points out that a critical problem in the past has been that “our leaders in most cases have failed to involve us in making the major decisions that affect our well-being and our daily lives”. But this criticism applies equally to our current leaders.

The military government does not consult any of our people’s chosen leaders on major decisions on taxation, government expenditure, sales of government assets, control of public companies and assets through board appointments, and hiring and firing of civil servants. Even the workers’ pension fund is in the control of the current military government, without any accountability to the workers or the pensioners, or the public.

While the Pillar identifies amongst the ideal qualities necessary for any future leaders of Fiji to include “openness” and “accountability”, the media censorship will not allow it.

Militarisation of the civil service
It is clear that the military government is steadily appointing military personnel to key civil service positions, perhaps in the hope that there will be increased efficiency.

But this poses a major problem for the Public Service Commission. Civil servants are required to give their professional advice to their superiors, disagreeing if necessary with their superiors, a vital mechanism to protect tax-payers’ interests from wrong political decisions.

But professional military personnel have been drilled all their lives to blindly obey orders coming from their superiors, without question, even if they think that the orders or decisions are wrong. So how can the PSC and Jo Serulagilagi convert these military appointees into professional civil servants?

The PSC has another problem. Military personnel are trained for military duties, not complex public service. Some may be good, some may be unsuitable. How can the PSC, which has little role in the appointment of these military civil servants, remove any for non-performance?

Pillar 4 of the Charter on “enhancing public sector efficiency” wants a public service which is “accountable”. But how can the public sector be accountable to the Fiji public, when the media is not allowed to publish many stories highlighting problems in the public sector?

While the Charter aims (page 21) to “remove political interference in the public sector”, what the public continues to see is the military government’s frequent hiring and firing of civil servants and board members.

It is well known that most civil servants and board members, for fear of losing their positions, are afraid to disagree with the decisions made by the military government.

Over the last three years, some of this military government’s policy mistakes which have wasted taxpayers’ valuable funds (remember the initial school bus-fares fiasco?), may not have occurred if civil servants’ advice had been followed from the beginning, and the public had been freely allowed to express their views through the media.

With the pervasive media censorship, the public currently has little knowledge of any other bad policy decisions which might also be wasting tax-payers’ funds. But by the time the public finds out the facts, it will be too late- like the National Bank of Fiji (NBF) disaster or all our agricultural scams which have cost tax-payers hundreds of millions of dollars.

It should be obvious to the public that Bainimarama is now performing like all the previous elected or unelected prime ministers we have had (Mara, Rabuka, Chaudhry, and Qarase): regularly getting in touch with people throughout the country, promising tax-payers’ funds for roads, bridges, water, disaster assistance and advocating development initiatives in general. He is also (unilaterally) tackling long-standing problems like the reform of land tenure and national identity.

But if he ever stands for elections down the line (he would only be following in the footsteps of Rabuka and Qarase!) he will be judged not just on the goodies he hands out today, but also by his performance in managing the economy and taxpayers’ funds.

Note that despite Rabuka’s absolute and populist rule in his first few years in power after 1987 (Fiji oldies, remember that period?), eventually he was voted out. And just read today what indigenous Fijians themselves are writing (albeit anonymously) about Rabuka on the blog sites.

It will be in Bainimarama’s long term political interest or his personal historical record, that his military government does not waste taxpayers’ funds.

For that, an important safety mechanism is accountability to the public through full media freedom, especially when there is no elected parliament which can hold government to account as is so powerfully advocated by the Charter.

The Charter’s commitments and pledges
On pages 37 and 38 of the Charter document, there is a long list of what we, the people of Fiji agree to “Commit to”.

We can agree with every single one of them- even where it says we “support the Constitution and the People’s Charter” as the foundation for building a better Fiji.

We can also agree with the Charter where it requires that “we hereby pledge, as citizens of Fiji”, to uphold and be guided by all these commitments through “our own individual conduct and conscience” while “holding responsible and accountable those who hold positions of leadership and responsibility” (i.e. including the current military government).

I believe that my media contributions are fully in keeping with what the Charter requires us to commit to and pledge as responsible Fiji citizens.

So why do the military censors ban my articles from the Fiji media, even the recent innocuous one on the economic implications of Fiji’s long term demographic changes?

Drawing the line
Where do we draw the line?

Friends tell me: “Why get distressed over this little issue. Accept that you are living under a military dictatorship. Just do your work and enjoy your life."

But, a decent life, even according to this military government’s Charter, requires freedom of expression and freedom of the media.

And it distresses me deeply and daily, that these basic human rights have been removed from my life, while there are other erosions of freedoms, some subtly, some openly.

At my workplace, where we should expect an uncompromising defence of academic freedom, one can find oneself unreasonably excluded from politically sensitive situations, such as a university meeting with an international mediator on Fiji’s political crisis, or the university’s participation in an international meeting (where the Fiji government representatives may be present) to discuss the impact of the global financial crisis on the Pacific.

A few weeks ago, an anonymous telephone caller from the army (“Jack”- no surname) warned me that somewhere (he mentioned the Fiji Golf Club) I had been overheard saying negative things against the “government of the day”.

Jack told me to remember what had happened to relatives of mine who had been deported back to Australia. I said, “sorry, I am a Fiji citizen, without any PR elsewhere. And in any case, if I disagree with the government of the day, it is on policies and principles”. But Jack called again the next day and repeated the same message.

It is distressing that we do not even have the freedom to speak among friends at public places, in case someone overhears and conveys some garbled version to the military intelligence who can then threaten you, for no reason at all.

What does this powerful military government have to fear from elderly academics like me?

And why are military personnel being encouraged by their superiors into this kind of unethical and unprofessional behavior? Once entrenched, such disregard for basic human rights will be difficult to eradicate. Who doubts today that had it not been for the successful 1987 coup by Rabuka, those of 2000 and 2006 would have been far less likely.

The Fiji public placidly accepts the media censorship’s erosion of our freedom of speech- a fundamental human right. Surely this is not some “minor issue”.

We forget that just as small waves can slowly erode a solid shore, grain by grain, until the mighty coconut tree falls over, so also can a good society deteriorate into misery and a climate of fear, if we fail to defend every single one of our precious basic human rights.

I am happy to follow this military government’s Charter, but all of it, not just the bits that this military government chooses to follow.

It is a sad indictment of all those people who formulated and supported the Charter, that they remain totally uncritical of this military government’s media censorship, which contradicts their Charter at every turn.

Surely this Military Government (and the FTIB) know that investors cannot have full confidence about investing in an economy where there is pervasive media censorship?

And without this investment, our economy will stagnate (as currently), leaving this military government with an uphill task of dealing with our increasing problems of unemployment and poverty, while undermining the military government’s record as an efficient manager of the economy.

Surely, both this military government (however long it stays in power) and Fiji, have everything to gain and little to lose, if the Public Emergency Decree and the media censorship are removed. And there is an end to personal intimidation.

Fiji censors, bloggers and the future of free expression



EIGHT days ago, Café Pacific made a New Year honours award to the University of the South Pacific's Wansolwara in the "independent newspaper" category. The academic staff person currently steering this journalism student publication is Shailendra Singh, a former editor of The Review news magazine. Global Integrity, an independent governance watchdog, has just caught up with him and interviewed him on his views over Fiji under the military censorship boot. The interview is reproduced here with the Pacific Scoop, Café Pacific and other links cited:

WE ARE GLOBAL: FROM FIJI, A JOURNALIST'S STAND ON CENSORS, BLOGGERS AND THE FUTURE OF FREE EXPRESSION

In the South Pacific, I found a case study in modern censorship, as Fiji’s three-year-old military government collides with a once free local press, an emerging blogging culture and an ambivalent international community. Some basic facts are contested, but it is clear that free expression in Fiji is under intense pressure, in a sharp departure from Fijian cultural and political tradition. I talked over email with journalist and media academic Shailendra Singh, based in capital of Suva, about the future of free expression in Fiji.

Despite increasing government control over print media, Shailendra is determined. Journalists get heat from all sides, as even reporting the government’s arguments for media regulation has become controversial. But Shailendra argues for free exchange over partisanship. “It is absurd to fight censorship with censorship” Shailendra told me.

Shailendra worked with Global Integrity as a lead journalist in 2008, writing the Corruption Notebook: Fiji. As a senior lecturer on journalism, Shailendra encourages his fellow journalists and students to pursue stories to the greatest extent possible under the current restrictions. Bainimarama’s government, who seized power in a 2006 coup d’etat, has clamped down on the media. In a 2006 radio address, Bainimarama advised pro-democracy advocates to "shut their mouth," lest the military "shut it for them.” The arrest or deportation of prominent journalists followed.

This has never before been seen in the island nation, with the brief exception of a period during the 1987 coup staged by then military strongman, Sitiveni Rabuka. After the 1987 takeover, the media eventually regained full reporting rights. The future does not seem as certain now and Fijians turn to regional “parachute journalists” or anonymous bloggers for independent yet at times questionably reliable news. “In many cases the blogs are vitriolic and abusive,” Shailendra said. “On the other hand, some credible commentators who can no longer publish their articles in the local dailies have set up blogsites.”

Shailendra worries about the spill-over effect Fiji’s censorship may have on the region and he has spoken out on the need for Australia and New Zealand to put pressure on Pacific island governments that threaten press freedom: “Hopefully, they [AUS and NZ] will soon come to see that their own interests are at risk when basic freedoms are removed, and they will act accordingly instead of remaining aloof.”

“If you are looking for a silver lining,” Shailendra said, “the situation in Fiji has not only offered journalism an opportunity for self-reflection and improvement, but also a chance to focus attention on some very important areas that were overshadowed and neglected due to the heavy emphasis on politics. Local media is running a lot more human-interest stories. There is greater coverage of ordinary people, rural news and development issues.”

An inner-determination comes through in Shailendra’s responses, reflecting the fact that while open, public dissemination of information may be quelled for now, Fiji’s legacy of an active media will outlast the current crisis.

Norah Mallaney: Your Corruption Notebook: Fiji centered on the feeling of disillusionment among journalists and citizens who might have once hailed the 2006 coup as positive progress. Has this trend continued? Is current political dissent published in newspapers and other media outlets (radio etc)? Or is this more spoken of in private circles?

Shailendra Singh: The Fiji government currently censors the news media. As a result, political dissent is not published. There is no law stopping people from discussing politics in private. But people would naturally be more cautious than they used to be about what they say, and who they say it to. Apart from a brief period after the coups of 1987, Fiji has always had a free media. The country was on a par with Australia and New Zealand when it came to media freedom and freedom of speech. There was, of course, the usual ranting by politicians and occasional threats in Parliament to shut down newspapers, or to bring in new laws to curb “irresponsible” reporting when sex scandals or corruption involving politicians were exposed. But until recently, no such laws were implemented, and journalists, by and large, went about doing their work without fear.

Now, for the first time, the media is under full censorship, which is an alien experience for us. Current censorship is by decree. But government plans to bring in a new media promulgation that will curb some of the freedoms that we took for granted in the past. The government says tighter media regulations are needed to curb abuses by journalists. It blames the media for inciting racial animosities. It says such journalistic transgressions often go unpunished.

These assertions cannot be dismissed out of hand. Media has made mistakes. Some of these mistakes have been costly. But rather than censorship, training for journalists and supporting the setting up of independent media monitoring organisations, or media accountability systems, would be the proper thing to do.

Pio Tikoduadua, the permanent secretary in the Prime Minister’s Office, recently said that Fiji’s media would no longer be self-regulatory under the new media decree, which is expected to come in force in 2010. Under the new promulgation, it is expected that a new body will be formed to hear grievances by people who feel they have been unfairly treated by the media. This new body will either replace or work alongside the Fiji Media Council, a self-regulatory body set up by Fiji’s news media industry.

So self-regulation, which is practised by most democracies, could become a thing of the past in Fiji. The government’s argument is that the media cannot be judge and jury of its own conduct. It says the Fiji Media Council has failed to uphold ethics and improve standards. The media argues that excessive laws and punitive measures by government will only shackle the media, which could have grave repercussions in future. For instance, this government is strongly against corruption. Draconian media laws would be counterproductive for government’s anti-corruption drive.

Future governments may not be as well intentioned as the current government, and they may inherit a media law that they can use to shield their corrupt activities.

Norah: Blogs (both Fiji-based and in the broader Pacific region) seem to have taken on an identity as the “critical eyes” of the current government. Who is their intended audience? Considering internet penetrability rates, who is actually reading? How high is their credibility in Fiji and in the broader region?

Shailendra: Blogs have become an outlet for opponents of the present government to vent their frustrations, as they do not have any other avenue to voice their opinions. Blogs offer anonymity, thus safety from arrest and possible prosecution in court. Media consumers in Fiji are used to an outspoken and fairly aggressive media. Currently the media in Fiji has been tamed through a decree that the government introduced to encourage “a greater degree of responsibility” from the media. Journalists that fall foul of the decree face jail as well as stiff fines.

Readers in Fiji know that the media is being censored. They understand that the media is not able to report everything that goes on. There is a vacuum concerning government and political news, so a good number of readers are turning to blogs as an additional, or alternative, source of information.

Many blogs are based on opinion, hearsay or rumour. Ordinarily, such rumours would be investigated and reported by the mainstream news media. But presently this is not the case. So there is a lot of rumour mongering. People who read blogs choose to either trust or distrust the information.

It cannot be claimed that the blogs have taken on an identity as the “critical eyes” of the current government. For one, the bloggers are anonymous so their credibility becomes an issue. Some bloggers clearly have sinister motives. The bloggers are not bound by any journalistic principles, guidelines or ethics. They often publish without checking. In many cases the blogs are vitriolic and abusive. Many commentators and commentaries are racist.

On the other hand, some credible commentators who can no longer publish their articles in the local dailies have set up blogsites. This includes an economist and political commentator, Professor Wadan Narsey, who used to write regular columns in the papers. But the newspapers have stopped running his articles due to censorship. Professor Narsey posts his blogs under his names. His most recent posting was an analysis of the 2010 budget. In this instance the blog is playing the role of “critical eyes” on government as you put it. New technology has enabled Narsey to publish his work in an instant and makes it harder for governments to silence people.

However, internet penetrability is low in Fiji, so it would be mostly the urban educated who have access to and read these blogs.

Norah: How has the shift in media censorship impacted on the lessons, training and student population at the Journalism School at University of the South Pacific?

Shailendra: In terms of media education and research, we have a unique, real life case study of censorship at work to examine and test against textbook theories. We cannot report freely, but we can debate the situation in class presentations and seminars, and write essays and research reports.

Also, we invited the Attorney General Aiyaz Sayed-Khaiyum as a speaker recently. Our students had an opportunity to question him. They wrote news reports about what he said. The AG’s comments were widely reported, and they generated a major debate among regional media observers and commentators.

Some people were of the view that the AG should not have been invited as a speaker. Our view is that it is absurd to fight censorship with censorship. We as journalists should be aware that there are two or more sides to an issue. Furthermore, had we not invited the AG and reported his comments, there would have been no discussion or rekindling of interest, awareness and generating continued publicity about Fiji.

If you are looking for a silver lining, the situation in Fiji has not only offered journalism an opportunity for self-reflection and improvement, but also a chance to focus attention on some very important areas that were overshadowed and neglected due to the heavy emphasis on politics. Local media is running a lot more human-interest stories. There is greater coverage of ordinary people, rural news and development issues.

For instance, a recent issue of USP journalism’s training newspaper, Wansolwara, had a front-page report on how gaming centers in Suva were luring young people to play and spend money there. The story led to a police crackdown on 24-hr gaming centers. The article received a high commendation at the 2009 Journalism Education Association of Australia and New Zealand student awards in Perth, Australia, last month (December '09).

Another story on how the legal marriageable age for girls at 16 was leading to their exploitation has resulted in the law being changed in Fiji. We have also focused on the environment with students researching and writing stories on coral reef degradation, shark-fin fishery and climate change impacts.

Norah: In a recent interview you did with Radio Australia, you spoke of the need for greater pressure from Australian and New Zealand aid donors to keep media freedom high in the region.

Shailendra: Australia and NZ are the largest aid donors and regional superpowers. As such they have a lot of influence with Pacific Island countries. The two nations are understandably reluctant to be seen as meddling in the internal affairs of their smaller neighbours. But these two countries should not keep silent, or make token gestures, when fundamental freedoms are threatened.

For instance, the Laisenia Qarase government that was ousted from power in Fiji by the military in 2006 had declared its intention to bring in a new media law, and also to introduce legislation to pardon people behind the 2000 coup. In my view, Australia and New Zealand did not do enough to try and deter the Qarase government from taking these apparently unconstitutional actions.

Some Pacific Island governments often threaten to restrict media freedoms. When they do this, Australia and New Zealand should speak out, not only because it is the morally correct thing to do, but also because their own interests are threatened when regional governments move to place unreasonable curbs on basic human rights. Apart form the massive aid the two countries pour into the region, they have a lot of investments in Pacific Island countries. If the media is muzzled, it will not be able to report on government corruption, and also, how efficiently aid is utilised.

Corruption is rife in some regional countries, and aid is also hijacked and diverted on a regular basis. The media often reports this, and this is why some governments are so keen to silence the media. In the absence of a free media, the corrupt will become even more emboldened, and the scale of the problems will only increase. So Australia and NZ need to be proactive rather than reactive when it comes to such issues. They need to persuade, sometimes coerce leaders, into institutionalizing transparency and accountability, if for no other reason, than for the sake of their own taxpayers and investments.

Australia and New Zealand are not averse to arm-twisting and riding roughshod over Pacific Island sensitivities when they feel that their interests are directly threatened, or when they are trying to gain an advantage, such as in trade talks. Aid has been used both as a carrot and stick. Examples of this abound.

The recent Julian Moti saga is a case in point. An Australian court dropped child-sex charges against Moti, a former Solomon Islands attorney general, last month (December). The Australian Federal Police (AFP) had resurrected the charges nearly 10 years after they were dismissed by a court in Vanuatu. The Supreme Court in Brisbane found that the prosecution was an abuse of process by police because its payments to the alleged victim's family in Vanuatu, totaling $AUD150, 000, brought the administration of justice into disrepute. The judge ruled against Moti's claim that the case against him was politically motivated as a result of the Australian government's concerns that his role as Solomon Islands attorney general would undermine a peacekeeping mission Australia was heading in the Solomons.

But many respected commentators believe this is precisely the reason the AFP went after Moti with such extraordinary determination. So it is not for nothing that Australia and New Zealand are sometimes referred to as “bullies” by their smaller neighbours. I am guessing that these two countries do not feel that freedom of the media is an important enough issue requiring their diplomatic intervention. Why else would they remain silent when media freedoms are threatened? Hopefully they will soon come to see that their own interests are at risk when basic freedoms are removed, and they will act accordingly instead of remaining aloof.

Croz's blast at 'undemocratic' Dominion Post editorial on Fiji

JUST four days after being included in Café Pacific's New Year honours list for his blogging on Fiji, Croz Walsh has launched an attack on "media abuse of power and influence" by anonymous leader writers, singling out a Dominion Post editorial as an example. He writes:
I've always thought there's something more than a little undemocratic and cowardly that those writing editorials do not reveal their identity, especially in a proudly democratic country like New Zealand.

All we know is that an editorial contains opinions (not always backed by facts or fully researched thoughts) that are usually written by the publisher, the editor or one of the editorial team. I see no good reason why these people, and journalists in general, who so often demand access to private information, hide behind anonymity. Why are so many media sources "usually reliable" or "our correspondent in X." Why does the law permit them to publish anonymous "leaked reports," even of personal emails? Why do we allow them these powers when we, their readers, do not even know who they are?


I'm also unsure why they think we should be interested in their anonymous opinions when we know nothing about their knowledge of the topics they discuss? We would not accept this from a doctor, a lawyer or accountant, so why should it be acceptable from journalists who play with our minds, mould our opinions, and set the boundaries of our democracy?


If the so-called Fourth Estate is entitled to a special, protected, place in our society, searching out hidden truths and using its "freedoms" to keep citizens and voters properly informed, then the media must be far more open, accountable and known.


The latest
Dominion Post editorial, "Dictators must not hold sway in the Pacific", is a case in point. We know nothing of the writer who presumes to advise Prime Minister John Key what to do about our relationship with Fiji other than that he, she or it thinks it wrong for us to ease up on Bainimarama who "took power at the point of a gun and deposed a democratically elected government" and who since then has "tightened his grip on the country." Et cetera. Et hackneyed cetera. Nothing was written on anything even remotely wrong with the old "democracy" and nothing about anything good on the de facto government.

"Whatever else he does [the editorial states]... Mr Key should not accept advice such as that from Auckland academic Dr Hugh Laracy or, presumably, anyone else who thinks the travel ban and other measures have failed." Yet these measures, imposed three years ago, have brought about no change in Bainimarama's position; they are hurting many innocent Fiji citizens, and they've prevented many qualified people applying for civil service positions, even in positions not remotely political. The editorial thinks Mr Key is "right to try to make a new start with the commodore [but] that does not mean forgetting that he is a dictator. The aim must be that dictatorships do not become the 'Pacific way.'"


With this sort of inane, patronising advice, Key could well fall back on Laracy: after all, he is not anonymous; he has studied the Pacific for close to 40 years and, although not enamoured with coups, he does have a plausible alternative to our initially well intended but now obviously failed policy.
I'm sure Professor Laracy will join me in issuing a public challenge to the Dom Post editor(s).

* Come out from behind your masks.

* State your qualifications and Pacific experience.


* Publish balanced statements on Fiji's past and present.


* Provide your readers with sufficient background for them to form their own independent judgments.


* Comment on at least some of the positive actions taken by the Bainimarama government.
