Circuit court is the name of court systems in several common law jurisdictions.
King Henry II instituted the custom of having judges ride around the countryside ("ride circuit") each year to hear cases, rather than forcing everyone to bring their cases to London (see Assize of Clarendon). Thus, the term "circuit court" is derived from the practice of having judges ride around the countryside each year on pre-set paths − circuits − to hear cases. Especially on the United States frontier, a judge might travel on horseback along with a group of lawyers. Abraham Lincoln was one such attorney who would ride the circuit in Illinois. In more settled areas, a stagecoach would be used. Eventually the legal caseload in a county would become great enough to warrant the establishment of a local judiciary. Most of these local judicial circuits (that is, in terms of the actual routes traveled by judges) have been thus replaced by judges regularly stationed at local courthouses, but in many areas the legacy term remains in usage.

This week Craig Benzine is going to talk about the structure of the U.S. court system and how exactly it manages to keep things moving smoothly. We’’ll talk about trial courts, district courts, appeals courts, circuit courts, state supreme courts, and of course the one at the top - the U.S. Supreme Court. It’s all quite a bit to manage with jurisdictions and such, but it's important to remember that the vast majority of cases never even make it to court! Most are settled out of court, but also terms like mootness and ripeness are used to throw cases out altogether. On Friday, a federal appeals court is preparing to reintroduce a lawsuit, that will demand for the State Department to set in motion a process to recover additional emails sent or received by Hillary Clinton during her tenure as secretary of state. The D.C. Circuit Court of Appeals is seeking to force Secretary of State John Kerry, to formally notify the National Archives, saying that Clinton's emails were unlawfully removed from government custody. If such a movement were to occur, the Justice Department could receive a lawsuit and force Clinton and her aides to return any government records in their possession. According to Cause of Action lawyer John Vecchione, the formal notice of unlawful removal of records would also be sent to Congress, under the law. http://www.politico.com/blogs/u...

Merrick Garland, current chief judge of the DC Circuit Court of Appeals, was nominated to fill the Supreme Court vacancy 232 days ago. Since Justice Antonin Scalia’s death in February, Obama has been trying to fill the spot with the liberal judge in a court that has been historically dominated by Republicans. The court, still Republican-dominated, prefers the next President choose Scalia’s replacement. However, Clinton is considering choosing an even more liberal candidate: President Obama. Andrew Langer is the president of the Institute for Liberty, an organization dedicated to promoting freedom and individual rights. He and Cam Edwards of NRANews discusses the ruling in the long awaited appeal of the Peruta decision in the Ninth Circuit. He points out that the court deliberately bypassed California’s current infringement of Second Amendment rights. The dissent describes the decision as an “elaborate straw man argument” with regard to the “good cause” requirement. Langer says that the manner in which the decision was made is politically cynical.
