Here's something we can all agree on. Liberty is a wonderful thing. The American Constitution says so, right in the Preamble: The Framers established the Constitution to "secure the Blessings of Liberty."
So, why doesn't that offer a clear answer to most of the constitutional questions that face America today? Aren't lawmakers, who swear to uphold the Constitution, obliged by their oaths to vote for liberty?
The problem is that liberty, like equality or justice, is a complicated idea that means different things to different people. Consider, for instance, one simple question: Whom do we want liberty from?
Well, we want liberty from a tyrannical government. That's why we have a Bill of Rights, and that's why the Constitution was designed to impose powerful constraints on the federal government (and, eventually, state governments).
But we also want liberty from foreign tyrants, right? What's the point of having a government that won't oppress us, if it can't protect us from foreign invaders who would oppress us even more? That's why the Preamble also says the Constitution is set up to "provide for the common defense."
Yet to protect ourselves against foreign tyranny, we may need to restrict domestic liberty. At the very least, the government has to impose taxes to pay for the military. Throughout American history, the government has also been seen as having the power to draft men to fight in wars; that's certainly a restriction on individual liberty. But it's long been seen as consistent with the Constitution.
We can see other examples, too.
The Fourth Amendment bans "unreasonable searches and seizures." That's a powerful protection for liberty. But it doesn't ban all searches and seizures; reasonable ones are allowed. That's in part so the law can better protect us from criminals intruding on our liberty.
Likewise, the Fifth Amendment provides that private property shall not "be taken for public use, without just compensation." But that means that sometimes your property can be taken for public use with compensation, however much this limits your liberty to, say, continue living in your family house that has been condemned to make room for a highway. Sometimes liberty does yield to public benefit.
What's more, everyone agrees that my liberty doesn't extend to violating your rights. But where do my rights stop and yours start?
The Constitution itself doesn't tell us, since it lists pretty much just those rights that are protected against government intrusion like the free exercise of religion. People disagree about what rights should be protected from supposed intrusion by others—for instance, by employers, or by large businesses that might try to stifle competition.
So, what do we do about this? How do we resolve all these hard questions about liberty?
First, the Framers of the Constitution explicitly protected certain liberties, such as the freedom of speech and the right to keep and bear arms.
Second, the Framers gave the courts a major role in defining the scope of those liberties.
Third, the Framers set up the structures of government—such as separation of powers—that would help protect liberty, by making sure that no single branch of government could unduly restrict liberty.
But then, fourth, they left the rest of the debate about liberty to the political process. Indeed, even the gravest violation of basic natural liberty in American history—slavery—was ultimately abolished by the political process, as well as of course by the Civil War, which was started and conducted by elected officials.
The Framers also believed that most decisions in people's lives would not and should not be made by the government. They should be made by ordinary people: which job to take, which business to start, whom to associate with, how much to sell or buy things for, and innumerable other choices.

- Well, you ask one of the deepest philosophical questions of physics. The question of free will.
- For billions of years on this planet, there was life, but no free will. Physics hasn't changed, but now we have free will.
- The brains are automatic, but people are free.
- Our ability to choose is often confused.
- Human choices will not be predictable in any simple way.
- In reality, I don't think there's any free will at all.
DANIEL DENNETT: For billions of years on this planet there was life, but no free will. Physics hasn't changed, but now we have free will. The difference is not in physics. It has to do with, ultimately, with biology. Particularly evolutionary biology. What has happened over those billions of years, is that greater and greater competences have been designed and have evolved. And the competence of a dolphin, or of a chimpanzee, the cognitive competence, the sort of mental competence, is hugely superior to the competence of a lobster, or a starfish. But ours dwarfs the competence of a dolphin or a chimpanzee, perhaps to an even greater extent. And there's an entirely naturalistic story to say, to tell about how we came to have that competence, or those competences. And it's that, "Can do." It's that power that we have which is natural, but it's that power which sets us aside from every other species. And the key to it is that we don't just act for reasons. We represent our reasons to ourselves and to others. The business of asking somebody, "Why did you do that?" And the person being able to answer, it is the key to responsibility. And in fact, the word, "responsibility," sort of wears its meaning on its sleeve. We are responsible because we can respond to challenges to our reasons. Why? Because we don't just act for reasons, we act for reasons that we consciously represent to ourselves. And this is what gives us the power and the obligation to think ahead, to anticipate, to see the consequences of our action. To be able to evaluate those consequences in the light of what other people tell us. To share our wisdom with each other. No other species can do anything like it. And it's because we can share our wisdom that we have a special responsibility.
That's what makes us free in a way that no bird is free, for instance. There's a very sharp limit to the depth that we as conscious agents can probe our own activities. This sort of superficial access that we have to what's going on, that's what consciousness is. Now, when I say, who's this, "we," who's got this access? That's itself part of the illusion because there isn't a, sort of, boss part of the brain that's sitting there with this limited access. That itself is part of the illusion. What it is, is a bunch of different subsystems, which have varying access to varying things and that conspire in a sort of competitive way to execute whatever projects it is that they're, in their, sort of, mindless way executing.
STEVEN PINKER: I don't believe there's such a thing as free will in the sense of a ghost in the machine, a spirit, or soul that somehow reads the TV screen of the senses and pushes buttons and pulls levers of behavior. There's no sense that we can make of that. I think we are...our behavior is the product of physical processes in the brain. On the other hand, when you have a brain that consists of a hundred billion neurons, connected by a hundred trillion synapses, there is a vast amount of complexity. That means that human choices will not be predictable in any simple way from the stimuli that have impinged on it beforehand. We also know that that brain is set up so that there are at least two kinds of behavior. There's what happens when I shine a light in your eye and your iris contracts, or I hit your knee with a hammer and your leg jerks upward. The debate over whether or not humans have free will is centuries old and ongoing. While studies have confirmed that our brains perform many tasks without conscious effort, there remains the question of how much we control and when it matters.
According to Dr. Uri Maoz, it comes down to what your definition of free will is and to learning more about how we make decisions versus when it is ok for our brain to subconsciously control our actions and movements.
"If we understand the interplay between conscious and unconscious," says Maoz, "it might help us realize what we can control and what we can't."

Dr. Uri Maoz is an assistant professor of computational neuroscience at Crean College of Health and Behavioral Sciences at Chapman University. His research lies at the intersection of volition, decision-making, and moral choice. Dr. Maoz also directs Neurophilosophy of Free Will, an international project comprising 17 neuroscientists and philosophers, who aim to understand how the brain enables conscious control of human decisions and actions.

URI MAOZ: We all kind of go around with this feeling that we are the authors of our lives and we are in control, that I could've done otherwise. To what extent is the conscious we are we in control?
NARRATOR: The subconscious is a force that looms large below the surface of our conscious minds, and it's controlling our lives much more than we're aware.
MAOZ: Free will is at the basis of a lot of our social pillars. Our legal system presumes some kind of freedom. There are economic theories that assume that people are free to make their decisions. So for all those things, understanding how free we are, the limits of our freedom, how easy it is to manipulate our freedom and so on I think is important. If we understand the interplay between conscious and unconscious, it might help us realize what we can control and what we can't. My name is Uri Maoz, I study how the brain enables things like consciousness and free will.
INTERVIEWER: Okay, Uri, what is free will?
MAOZ: Sure, that's easy. Generally, humans have a sense that they control themselves and sometimes their environment more than they do. You don't try to control every contraction of every muscle in your hand. And if you did try (laughs) to control that, well good luck to you because if you try to concentrate exactly on how it is that you're walking, it's even hard to walk. So there are certain places in the brain that if you stimulate there a person begins to laugh. You ask them, "Wait, why are you laughing?" And they say, "Oh, I just remembered this really funny joke." The brain kind of puts together some reasons for something that you did while we think they are under our full conscious control they are not.
There is a famous experiment made in the early '80s by Benjamin Libet. The idea is that a person is holding their hand and they're told whenever they have the urge to do so, you flex whenever you want. However at the same time, there is this rotating dot on the screen and your job is to look at the screen and say where the dot was when you first had the urge to move. So then you have this weird situation, only 200 milliseconds before you move do people say, "I'm aware that I've decided to move." But if you look into their brain, you can see something there a second before they do.
So what happens in that interval? Some kind of nefarious neuroscientist that would an electrode on you would say, "Aha, you're about to move now." But you would not be conscious of it, and some people interpret the Libet experiment to suggest that all of these big important life decisions are maybe unconscious.
NARRATOR: Libet's experiment proved controversial, but inspired subsequent tests. Dr. Maoz's own research attempted to observed the brain signals Libet measured in real time by directly monitoring the brain of epilepsy patients.
MAOZ: We approach some of these patients and we say, "Would you please play something like a two choice version of rock, paper, scissors? At the go signal we each raise a hand and, let's say, if we raise the same hand, I win, if we raise different hands you win." We had a system that was processing the whole thing in real time, and just before we got the go signal, I got a beep in my earphones telling me which hand to raise so I would beat the subject. We could predict them about 80%...
