Here is the classic scam that members of the community board have been engaging in to get at the table with the Department of City Planning to do a CB9 study. They have been trying to get small blocks within the community vested in getting rezoning, then they take these people and do a presentation and of course pass the request to go to DCP and do a rezoning. They make the claim that DCP can’t change the parameters, which is a ball face lie! Not only can DCP change the parameters, but the very board members that would attend those secret meetings with DCP, such as Warren Berke, Tim Thomas and Michael Liburd would agree to the wider parameters, which would include Empire Blvd, Nostrand Ave etc..., as a trade off to get this block down zoned. It is clear that this block is already protected by its own deeds and that there is no serious threat, because what developer will want to buy a multi-million dollar home to build another one family building. That doesn’t even make sense! Also the deed restriction wins over the zoning! What is important however is that on 28:14, the Chairman of the ULURP committee has read out the members of the committee which are 22 members. However, when it came time to vote there was only 10 or 11 members present (there was some discrepancy about this). Regardless, if it is 10 or 11, they did not have quorum, because quorum is 50% plus one, also known as the majority. This would mean they needed to have 12 members present to have quorum. Thus this vote is not valid. Now the question is, does the community have to file another lawsuit, or will they admit to their mistake?
