International Court of Justice

The International Court of Justice (French: Cour internationale de justice; commonly referred to as the World Court or ICJ) is the primary judicial branch of the United Nations (UN). Seated in the Peace Palace in The Hague, Netherlands, the court settles legal disputes submitted to it by states and to provides advisory opinions on legal questions submitted to it by duly authorized international branches, agencies, and the UN General Assembly.

Activities

Established in 1945 by the UN Charter, the Court began work in 1946 as the successor to the Permanent Court of International Justice. The Statute of the International Court of Justice, similar to that of its predecessor, is the main constitutional document constituting and regulating the Court.

The Court's workload covers a wide range of judicial activity. After the court ruled that the United States's covert war against Nicaragua was in violation of international law (Nicaragua v. United States), the United States withdrew from compulsory jurisdiction in 1986 to accept the court's jurisdiction only on a case-by-case basis.Chapter XIV of the United Nations Charter authorizes the UN Security Council to enforce Court rulings. However, such enforcement is subject to the veto power of the five permanent members of the Council, which the United States used in the Nicaragua case.

International court

International courts are formed by treaties between nations or under the authority of an international organization such as the United Nations and include ad hoc tribunals and permanent institutions but exclude any courts arising purely under national authority.

Early examples of international courts include the Nuremberg and Tokyo tribunals established in the aftermath of World War II. Three such courts are presently located at The Hague in the Netherlands: the International Criminal Tribunal for the former Yugoslavia (ICTY), the International Court of Justice (ICJ), and the International Criminal Court (ICC). Further international courts exist elsewhere, usually with their jurisdiction restricted to a particular country or issue, such as the one dealing with the genocide in Rwanda. In addition to international tribunals created to address crimes committed during genocides and civil war, ad hoc courts combining international and domestic strategies have also been established on a situational basis. Examples of these “hybrid tribunals” are found in Sierra Leone, Lebanon, East Timor, and Cambodia.

The case arises from a claim by Mogadishu, filed before the court, requesting it to determine the boundary, separating all the maritime areas between the two nations in the Indian ocean. Kenya will be represented by lawyer Karim Khan of the queens counsel, backed by a team of five other senior international lawyers.

You need someone to come in and for domestic political reasons maybe you don't want to give up this little island that somebody else is claiming, and the ICJ is very good at sort of just drawing a line and making a decision that seems neutral and acceptable to both sides. The problem with the ICJ is when it wades in to more controversial issues so recently it had a decision about the wall in Israel, it had a decision about nuclear weapons a few years ago, and it tends to have a hard time with those decisions. And so for that reason it's not as effective. It lacks some of the enforcement powers that we might want. You might compare the World Trade Organization's court, the appellate body, so that court is considered to be more effective in part because it has at its disposal enforcement measures and it's got a pretty good compliance record. So when it hands down a ruling and it says to even the United States, "You're violating a law," usually those countries comply. So not all international courts are the same and I'd say the ICJ is good at certain things, not everything. Question: What's your advice regarding the Rome Statute?Kal Raustiala: It's a difficult question because the U.S. does have a unique role in the world and we are far and away the most powerful military power and we are very much viewed as the country that's going to- when there is something happening, a genocide unfolding, we have the capacity to act. We don't always act but we have the capacity to act and people do look to us to play that role so we do have some unique concerns that other countries don't necessarily have. That said, the ICC is widely accepted around the world and I think it would go a long way--  I think many of the concerns against the ICC, the idea that there's going to be a rogue prosecutor who will go after American service- or that we need--  Congress passed this law, the Hague Invasion Act, so if any American ends up in the brig of the ICC we're authorized to go in and invade the Netherlands and get them out. I think those kind of fantasies are really unfounded and so far the ICC has been very cautious. And I think it's again a mostly symbolic issue for us to join because I don't see--  The ICC's principle is that if a country tries in good faith its own soldiers the ICC won't step in and we have a well-functioning military justice system. So I don't imagine the ICC ruling over Americans but I think symbolically it'd be hugely important and particularly after the Bush administration's last seven plus years of being seen as a rejectionist of every international initiative, pulling out of the ABM Treaty, unsigning the International Criminal Court Rome Statute, denigrating the Kyoto Protocol. We've lost so much good will, and remember after World War II we were really the architects of this international system. We've lost so much of that that I think these symbolic steps like signing the Rome Statute would go a long way towards restoring our- I think our traditional image in the world, which is tarnished at this point.

On the western side of theHajar Mountains an oasis village developed that contains more than two hundred springs and wells. The oasis was once frequently occupied by Saudi Arabia but in 1974 the International Court Of Justice in the Hague ruled against the Saudi occupation. Today, Oman and the United Arab Emirates share the nine oasis villages of the Buraimi Oasis and live together in peace. Abu Dhabi is the largest of the seven Emirates and means, Father Of The Gazelle, a name derived from an ancient legend. The seventy three thousand square kilometres of the Abu Dhabi region cover eighty-six per cent of the United Arab Emirates and in the 1960’s the city had a population of five thousand that has now grown to almost a million. As the oil supplies gradually trickle away the sheiks are becoming increasingly cautious with their spending and the oil boom has now been followed by tourism in this fairy-tale holiday paradise that is full of desert romance.

In a 15-1 ruling in The Hague, the court found that Greece's veto breached a 1995 deal under which Greece had agreed not to block Macedonia's membership in international organisations if it used the name "The Former Yugoslav Republic of Macedonia," or FYROM, while the matter was submitted to further negotiations. More than 15 years later, mediation over the name is still unresolved. The ruling was read out at the UN Court, formally known as the International Court of Justice, by Presiding Judge Hisashi Owada. Although the question of Macedonia's name is sometimes seen as superficial by outsiders, it is a matter of deep concern for both sides. The young country has used the name in one form or another since shortly after World War II, when it was a province of Yugoslavia, but Greece sees the use of the name as historically inaccurate at best and a potential threat to its territorial integrity at worst. The victory is mostly symbolic but it may make it politically difficult for Greece to block Macedonia's entry into NATO if it reapplies. It also lends moral weight to Macedonian protests that Greece's moves to block it from joining the European Union are unfair. BACKSTAGE Hello! Welcome to Luxembourg for a visit to the Court of Justice of the European Union. In your country, a court is a tribunal with judges and lawyers. It hands down justice. It settles disputes of all kinds, not only crimes. The Court of Justice of the European Union plays a special role. It only deals with cases concerning the rules of European law. And that's quite something. Let's go to the library. You have to see it! The shelves are huge. They contain every subject to do with European law. Explanation. The European Union makes law. It creates a set of rules which must be applied in all EU Member States. The aim is to make sure the goals of the Union are achieved. For example, to protect the environment, or so that Europeans can travel freely between Member States. So it must be verified that EU law is respected everywhere. Let's imagine. If an EU Member State doesn't respect a rule of European law, it can be summoned here, to this courtroom. And then, like in a detective film, it will find itself on trial, with defence lawyers and one or more judges. It may be punished financially if it doesn't obey the decision at the end of the trial. The Court of Justice settles disputes concerning one of the EU institutions, one Member State, or even several Member States. And there's a court to deal with cases affecting EU citizens or companies. But it must still directly involve European law. But most of the time the Court of Justice's work consists of interpretation. Doesn't it, Your Honour? That's how you have to address a judge. In addition to the treaties and legislation by the EU's political institutions, there is jurisprudence, which contains clarifications of the treaties and this legislation. It's not easy. National judges aren't always sure they understand EU rules, so they ask the European judges for clarification. What does this jurisprudence look like? The jurisprudence is behind me. It's available in the 23 languages of the European Union, each of which is represented by a colour. Indeed, this jurisprudence colours the daily lives of European citizens who travel, who work, who stay, who study in a Member State other than their own. That's what I said. European law covers a good deal of our everyday lives. In total, over 1,000 cases per year are analysed here. That's a lot of work. Right, time for a quick recap. The Court of Justice of the European Union is used: 1. to resolve Member States' disputes with each other or with one of the EU institutions; 2. to resolve certain disputes involving EU citizens or companies, but only in the area of European rules; and 3. to help national judges understand European law better in order to apply it better. Situated on the Arabian Peninsula between the Persian Gulf and the Gulf of Oman, the United Arab Emirates is a fairy-tale of the One Thousand And One Nights.In just a relatively few years the region has been catapulted from the Middle Ages into the 21st century and it is now an international financial centre within an ancient desert region. It contains seven sheikdoms that are united both politically and economically. Dubai is a wonderful holiday paradise with a romantic desert and a long history in which the past unites with the present. Dubai is the second largest state in the United Arab Emirates and is situated on the north coast of the Arabian Peninsula. Fifteen kilometres from Dubai is the tiny Emirate of Sharjah where life continues according to age-old Arabian tradition. Tourism was once popular on this former pirate coast but the Saudi king subsequently prohibited the consumption of alcohol and thus the tourists stayed away. On the western side of theHajar Mountains an oasis village developed that contains more than two hundred springs and wells. The oasis was once frequently occupied by Saudi Arabia but in 1974 the International Court Of Justice in the Hague ruled against the Saudi occupation. Today, Oman and the United Arab Emirates share the nine oasis villages of the Buraimi Oasis and live together in peace. Abu Dhabi is the largest of the seven Emirates and means, Father Of The Gazelle, a name derived from an ancient legend. The seventy three thousand square kilometres of the Abu Dhabi region cover eighty-six per cent of the United Arab Emirates and in the 1960’s the city had a population of five thousand that has now grown to almost a million. As the oil supplies gradually trickle away the sheiks are becoming increasingly cautious with their spending and the oil boom has now been followed by tourism in this fairy-tale holiday paradise that is full of desert romance.
