Section 377 of the penal code in 42 former British colonies criminalizes anal sex between men and other homosexual acts. The provision was introduced by British colonial authorities in the British Raj as section 377 of the Indian Penal Code, and was used as the model for sodomy laws in many other British colonies, in many cases with the same section number.
The prohibition of homosexual acts is provided for in section 377 of the penal codes of India, Malaysia, Singapore (see Section 377A of the Penal Code of Singapore), Pakistan, Bangladesh, Burma, Maldives and Jamaica. It is the model for similar laws that remain in force in Bhutan, Brunei, Kiribati, Marshall Islands, Nauru, Papua New Guinea, Tonga, Tuvalu, Samoa, Malawi, Mauritius, Seychelles, Sierra Leone, Somalia, Sudan, Solomon Islands, Sri Lanka, Ghana, The Gambia, Botswana, Kenya, Nigeria, Tanzania, Uganda and Zambia. It was the model for since-repealed laws in Australia, Fiji, Hong Kong, and New Zealand.
Section may refer to:
The Indian Penal Code (IPC) is the main criminal code of India. It is a comprehensive code intended to cover all substantive aspects of criminal law. The code was drafted in 1860 on the recommendations of first law commission of India established in 1834 under the Government of India Act 1833 under the Chairmanship of Thomas Babington Macaulay. It came into force in British India during the early British Raj period in 1862. However, it did not apply automatically in the Princely states, which had their own courts and legal systems until the 1940s. The Code has since been amended several times and is now supplemented by other criminal provisions. Based on IPC, Jammu and Kashmir has enacted a separate code known as Ranbir Penal Code (RPC).
After the partition of the British Indian Empire, the Indian Penal Code was inherited by its successor states, the Dominion of India and the Dominion of Pakistan, where it continues independently as the Pakistan Penal Code. After the independence of Bangladesh from Pakistan, the code continued in force there. The Code was also adopted by the British colonial authorities in Colonial Burma, Ceylon (modern Sri Lanka), the Straits Settlements (now part of Malaysia), Singapore and Brunei, and remains the basis of the criminal codes in those countries. The Ranbir Penal Code applicable in Jammu and Kashmir is also based on this Code.
A criminal code (or penal code) is a document which compiles all, or a significant amount of, a particular jurisdiction's criminal law. Typically a criminal code will contain offences which are recognised in the jurisdiction, penalties which might be imposed for these offences and some general provisions (such as definitions and prohibitions on retroactive prosecution).
Criminal codes are relatively common in civil law jurisdictions, which tend to build legal systems around codes and principles which are relatively abstract and apply them on a case by case basis. Conversely they are rare in common law jurisdictions.
The proposed introduction of a criminal code in England and Wales was a significant project of the Law Commission from 1968 to 2008. Due to the strong tradition of precedent in the jurisdiction and consequently the large number of binding judgements and ambiguous 'common law offences', as well as the often inconsistent nature of English law - the creation of a satisfactory code became very difficult. The project was officially abandoned in 2008 although as of 2009 it has been revived.

In this session, Vani explains the Section 377 of the Indian Penal Code for us to understand this section and its implications. The Section 377 of the Indian Penal Code dates back to 1860, introduced during the British rule of India, criminalises sexual activities "against the order of nature", arguably including homosexual sexual activities. The section was decriminalised with respect to sex between consenting adults by the High Court of Delhi on July 2009. That judgement was overturned by the Supreme Court of India on 11 December 2013, with the Court holding that amending or repealing Section 377 should be a matter left to Parliament, not the judiciary. On 6 February 2016, the final hearing of the curative petition submitted by the Naz Foundation and others came for hearing in the Supre...

An archaic British law, dating back over a hundred and fifty years is before the top court in India. The Supreme Court now needs to decide whether it is indeed time to scrap Section 377 of Indian Penal Code that criminalises homosexuality and makes gay sex illegal thereby infringing on the fundamental rights of the individual. Though attitudes towards homosexuality have undergone significant changes, it would only be fair to acknowledge that it is nonetheless a deeply divisive issue in India. Is this a matter of a majoritarian morality infringing upon the rights of the minority? Will the top court uphold its own legacy as a counter-majoritarian institution? Is the question of morality irrelevant when it comes to protecting the fundamental rights of an individual? We debate all this and mor...
