U.S. judge upholds U.N. immunity in Haiti cholera case
BOGOTA (Thomson Reuters Foundation) - A U.S. federal appeals court has upheld the United Nations' immunity from a damage claim filed by human rights lawyers on behalf of thousands of Haitians killed or sickened by a cholera epidemic they blame on U.N. peacekeepers.
In a decision late on Thursday, the U.S. Second Circuit Court of Appeals in New York upheld a lower court's January 2015 dismissal of a lawsuit brought by lawyers seeking compensation and a public apology for 5,000 Haitian cholera victims.
"We have considered all of plaintiffs' arguments on appeal and find them to be without merit," the U.S. appellate judges concluded.
Cholera, a water-borne disease, has killed more than 9,000 Haitians and infected over 770,000 since the outbreak began in 2010, U.N. figures show.
The court's decision came shortly after Farhan Haq, spokesman for U.N. Secretary-General Ban Ki-moon, admitted the U.N.'s possible involvement in the introduction of cholera to Haiti.
"...over the past year the U.N. has become convinced it needs to do much more regarding its own involvement in the initial outbreak and the suffering of those affected by cholera," he told reporters on Thursday.

In an expletives-laden tirade against the UN on Sunday, Mr Duterte branded the experts "stupid", saying they should count the number of innocent lives lost to drugs.
"I do not want to insult you. But maybe we'll just have to decide to separate from the United Nations," he said.
"If you are that rude, we might just as well leave," he said.
"So take us out of your organisation. You have done nothing. Where were you here the last time? Never. Except to criticise," he said.
Mr Duterte said the UN should refund its contribution "so we can go out".
Mr Duterte said the UN had been unable to combat hunger and terrorism and had failed to end the killing of civilians in Iraq and Syria.
"You now, United Nations, if you can say one bad thing about me, I can give 10 [about you]. I tell you, you are [useless]. Because if you are really true to your mandate, you could have stopped all these wars and killings."
UN Secretary General Ban Ki-moon and the UN's Office on Drugs and Crime (UNODC) have both condemned Mr Duterte's "apparent endorsement of extrajudicial killings, which is illegal and a breach of fundamental rights and freedoms".
Mr Duterte was sworn in as president in June, after winning a landslide election victory.
He had previously been mayor of the country's third biggest city, Davao, for 22 years where his tough approach and controversial comments earned him the nickname "The Punisher".

Rodrigo "Rody" Roa Duterte (born March 28, 1945), nicknamed Digong, is a Filipino lawyer and politician of Visayan descent. Duterte is among the longest-serving mayors in the Philippines. He has been mayor of Davao City, a highly urbanized city on Mindanao island, for 7 terms, totalling more than 22 years. He has also served as vice-mayor and congressman in the city.
On November 21, 2015, Duterte declared his candidacy for President of the Philippines in the upcoming 2016 election after a period of banter.
Early life
Duterte was born on March 28, 1945 in Maasin, Leyte in the Philippine Commonwealth to Vicente G. Duterte, who served as Governor of (the then-undivided) Davao and Soledad Roa, a native of Cabadbaran, Agusan who was a school teacher and a civic leader. Duterte's father Vicente, prior to being provincial governor of Davao, was once a mayor of Danao in Cebu. Rodrigo's cousin Ronald, on the other hand, served as Cebu City mayor from 1983 to 1986. Ronald’s father, Ramon Duterte, also held the position from 1957 to 1959. The Dutertes consider the political families of the Durano and the Almendras clan as relatives.

In an expletives-laden tirade against the UN on Sunday, Mr Duterte branded the experts "stupid", saying they should count the number of innocent lives lost to drugs. "I do not want to insult you. But maybe we'll just have to decide to separate from the United Nations," he said. "If you are that rude, we might just as well leave," he said. "So take us out of your organisation. You have done nothing. Where were you here the last time? Never. Except to criticise," he said. Mr Duterte said the UN should refund its contribution "so we can go out". Mr Duterte said the UN had been unable to combat hunger and terrorism and had failed to end the killing of civilians in Iraq and Syria. "You now, United Nations, if you can say one bad thing about me, I can give 10 [about you]. I tell you, you are [useless]. Because if you are really true to your mandate, you could have stopped all these wars and killings." UN Secretary General Ban Ki-moon and the UN's Office on Drugs and Crime (UNODC) have both condemned Mr Duterte's "apparent endorsement of extrajudicial killings, which is illegal and a breach of fundamental rights and freedoms". Mr Duterte was sworn in as president in June, after winning a landslide election victory. He had previously been mayor of the country's third biggest city, Davao, for 22 years where his tough approach and controversial comments earned him the nickname "The Punisher".

BOGOTA (Thomson Reuters Foundation) - A U.S. federal appeals court has upheld the United Nations' immunity from a damage claim filed by human rights lawyers on behalf of thousands of Haitians killed or sickened by a cholera epidemic they blame on U.N. peacekeepers.
In a decision late on Thursday, the U.S. Second Circuit Court of Appeals in New York upheld a lower court's January 2015 dismissal of a lawsuit brought by lawyers seeking compensation and a public apology for 5,000 Haitian cholera victims.
"We have considered all of plaintiffs' arguments on appeal and find them to be without merit," the U.S. appellate judges concluded.
Cholera, a water-borne disease, has killed more than 9,000 Haitians and infected over 770,000 since the outbreak began in 2010, U.N. figures show.
The court's decision came shortly after Farhan Haq, spokesman for U.N. Secretary-General Ban Ki-moon, admitted the U.N.'s possible involvement in the introduction of cholera to Haiti.
"...over the past year the U.N. has become convinced it needs to do much more regarding its own involvement in the initial outbreak and the suffering of those affected by cholera," he told reporters on Thursday.

In an expletives-laden tirade against the UN on Sunday, Mr Duterte branded the experts "stupid", saying they should count the number of innocent lives lost to drugs.
"I do not want to insult you. But maybe we'll just have to decide to separate from the United Nations," he said.
"If you are that rude, we might just as well leave," he said.
"So take us out of your organisation. You have done nothing. Where were you here the last time? Never. Except to criticise," he said.
Mr Duterte said the UN should refund its contribution "so we can go out".
Mr Duterte said the UN had been unable to combat hunger and terrorism and had failed to end the killing of civilians in Iraq and Syria.
"You now, United Nations, if you can say one bad thing about me, I can give 10 [about you]. I tell you, you are [useless]. Because if you are really true to your mandate, you could have stopped all these wars and killings."
UN Secretary General Ban Ki-moon and the UN's Office on Drugs and Crime (UNODC) have both condemned Mr Duterte's "apparent endorsement of extrajudicial killings, which is illegal and a breach of fundamental rights and freedoms".
Mr Duterte was sworn in as president in June, after winning a landslide election victory.
He had previously been mayor of the country's third biggest city, Davao, for 22 years where his tough approach and controversial comments earned him the nickname "The Punisher".
