Conditions of Use

The following terms and conditions apply to all transactions on the Elephantart.com website. Please read through these carefully before placing an order and print a copy for future reference.

1. Effect of agreement

Viewing of Elephantart.com is free, but when you use this website, this agreement becomes effective and you reaffirm the agreement every time you use the site.

2. Incorrect information

The prices you pay are the prices displayed on the website at the time of placing the order, plus any applicable shipping and taxes.

3. Insurance:

All shipments are insured with the shipping company. Please ensure that you inspect the delivered package before signing for it.

5. Availability of goods

The artwork displayed on this site has all been physically created by elephants in Southeast Asia. All available paintings on the site are in stock at our New York office. Paintings marked "SOLD" are not available for purchase. Paintings marked "RESERVE" are either on exhibit at a gallery or being held for a buyer. Please inquire with us before attempting to purchase a reserved painting. In the event that we are unable to supply goods on time we will inform you as soon as possible. A full refund will be given immediately if we are not able to fulfill your order and another painting cannot be found as a replacement.

6. Damaged goods during transportation

You must inspect the goods for visual damage on delivery. In cases of damaged goods, this fact must be communicated to the delivery company at time of receiving your delivery. This will allow us to apply our shipping insurance coverage with the shipping company. You should then email Elephantart.com within 7 days of delivery and we will advise you accordingly. In cases where we advise you to return the goods, Elephantart.com will reimburse you for the delivery costs. You will then have the option of accepting replacement goods, or receiving a full refund, including the initial cost of delivery. Reimbursement for shipping costs is only valid for items damaged during transportation.

7. Security of your payments

For processing your payments we use the well established PayPal system. We do not have or hold any access to any information related to your credit cards or your PayPal Checkout accounts. In addition, all private information such as name, address and other supplied to us during the checkout process is encrypted by using dedicated SSL (Secure Sockets Layer protocol) at PayPal. We do not have the means to process credit cards here at our office which is why we use PayPal.

8. Payments by check

We accept payments only in US Dollars ($). Checks must be made payable to the Asian Elephant Art & Conservation Project or AEACP. Please send the check to the address indicated on our website with quotation of the product name and reference number of the goods you are paying for. Also give us clear instruction for the delivery address. Purchased goods will be mailed out as as soon as your check is cleared by our bank (3-5 business days).

9. Website compatibility

Our website is a very standard format but we can not guarantee that it will be compatible with your PC/computer and we accept no liability for any corruption or loss of data held on your PC/computer, or any liability for any kind of loss or damage caused to your PC/computer resulting from the use of this website.

10. Links To Third Party Websites

The AEACP website does include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that Elephantart.com or any companies associated with AEACP is not responsible for the content or availability of any such sites.

11. Copyright

All images and designs used on this website are property of AEACP. You can not use, reproduce, modify, or distribute images and content from this website in any form without written authorization from the AEACP.

12. Reasonable control

AEACP shall not be liable for any failure to perform its obligations in cases where the failure was caused by matters beyond our reasonable control.
