A maritime boundary is a conceptual division of the Earth's water surface areas using physiographic or geopolitical criteria. As such, it usually includes areas of exclusive national rights over mineral and biological resources, encompassing maritime features, limits and zones. Generally, a maritime boundary is delineated through a particular measure from a jurisdiction's coastline. Although in some countries the term maritime boundary represent borders of a maritime nation and are recognized by the United Nations Convention on the Law of the Sea, they usually serve to identify international waters.
Maritime boundaries exist in the context of territorial waters, contiguous zones, and exclusive economic zones; however, the terminology does not encompass lake or river boundaries, which are considered within the context of land boundaries.
Some maritime boundaries have remained indeterminate despite efforts to clarify them. This is explained by an array of factors, some of which illustrate regional problems.

The Somali Government has now disowned a memorandum of understanding signed with Kenya on a maritime boundary dispute. Somalia maintains that the International Criminal Court of Justice should hear and determine the case it has filed at The Hague in spite of Kenya’s objection that the matter does not fall within the jurisdiction of the court.

The Kenya Government has now blamed the Somalia Government for the frequent terrorist attacks in the country and maintained that the instability in the neighbouring country means it has no capacity to patrol its maritime borders. Making their final submissions today the Kenya legal team led by Attorney General Githu Muigai told the International Criminal Court of Justice to dismiss the maritime boundary dispute case filed by Somalia saying it doesn’t fall in its jurisdiction.

A territorial dispute pitting Kenya against its northern neighbour Somalia continued at the Hague with the Horn of Africa country accusing Kenya obstructing efforts to resolve a long running dispute over the maritime boundary. Somalia has slammed claims by Kenyan Attorney General Prof. Githu Muigai accusing her of jumping the gun when it filed the case at the International Court of Justice, saying it turned to the Hague based court as a last resort after negotiations failed. Somalia claims the 2009 agreement did not bar it from exploring alternative ways of resolving the deadlock.
