Stadtler had been out celebrating his 24th birthday that night. Jackson has been charged with aggravated battery. He was fired from the Daytona Beach Police Department shortly after the incident. Charges Filed - The State Attorney’s Office on March 16 filed a formal charge against Jackson of aggravated battery causing great bodily harm with a weapon. The great bodily harm and the use of a weapon enhanced the charge to a first-degree felony punishable by up to 30 years in prison. New Smyrna Beach Police had charged Jackson with attempted premeditated murder, which is also punishable by up to 30 years in prison. While both charges carry the same penalty, the enhanced aggravated battery does not require that prosecutors prove that Jackson intended to kill the victim, making it easier for them to get a conviction. Jackson has pleaded not guilty. He is free on $25,000 bond and was ordered to have no contact with the victim. Name Change — Shane Jackson was known as Shane Cote before he changed his name. Jackson revealed in his Daytona Beach Police employment application that he had changed his last name from Cote to Jackson. Cote was also charged with "assault III" in 1995 in Essex, Connecticut, according to his application for employment with Daytona Beach Police. That charge was dismissed and expunged, according to the application. Two years later in 1997, Jackson was charged with assault III and breach of the peace, which were also dismissed in Essex. That charge was also dismissed and expunged, according to his application. “Regarding the assault charge with it being dismissed and expunged, it is like the arrest never happened. Mr. Jackson disclosed the incident and it wasn’t a disqualifier for his employment at the time,� Whittet wrote. “Mr. Jackson didn’t have anything in his history either personal or professional that disqualified him at the time from employment with the Police Department,� she added. Port Orange Police — Jackson (then named Cote) was the subject of a complaint from a man named N. Watson, who said he was “assaulted� after he accidentally bumped into Jakson/Cote at an Applebee’s restaurant on Sept. 22, 2005. Watson said the man grabbed him by the throat before he was able to break away and leave, according to a complaint form. The complaint was determined to be “unfounded,� according to a document dated October 2005. In another complaint, a motorist said that he was stopped by Jackson/Cote on Sept. 27, 2005. The motorist said Jackson/Cote had been rude, exceeded his authority and made a false accusation, according to documents. The man said that after he denied what he was being accused of, Jakson/Cote said “Then I’ll just charge you with something else.� But investigators found the motorist’s statements inconsistent and a tape recorder Jackson/Cote had switched on when the man became argumentative did not record such a statement. The end result was that Jackson/Cote was counseled on the use of “shut your mouth.� He was also the subject of a complaint on Nov. 9, 2004 in which a man said Jackson/Cote warned him that he should “have kicked your ass� but he was new to the job and the man was the first person Jackson/Cote had fought with, according to the document.
