Rejecting a defence motion, an Israeli court ruled on Thursday that it has the right to try Marwan Barghouti, a prominent leader of the Palestinian uprising.
Barghouti's defence lawyers had argued that their client should have immunity as a member of the Palestinian parliament and that he was snatched illegally by Israeli troops from a West Bank home eight months ago.
However, Israel says Barghouti helped finance the Al Aqsa Martyrs' Brigade, a militia linked to Yasser Arafat's Fatah movement, and that he played a role in the killings of 26 Israelis.
Barghouti appeared briefly in a Tel Aviv district court. He was led shackled into court in brown prison uniform as he entered.
Barghout's lawyers said he should be considered a prisoner of war, rather than a criminal defendant.
In ruling against the defence, Judge Garfinkel cited previous Israeli Supreme Court rulings, the Israeli penal code and the Geneva convention.
"Terror is not an act of war and therefore it does not fall within the rules of war," the judge said.
The judge ordered Barghouti held until the end of legal proceedings.

STORYLINE:
The trial of Palestinian uprising leader Marwan Barghouti opened in an Israeli court on Thursday.
Barghouti, the most senior Palestinian to be tried by Israel, said he did not recognise the court's jurisdiction and would not be represented by a lawyer.
The trial will become a platform for the conflicting narratives of Israelis and Palestinians about the events of the past two years, commentator Hemi Shalev wrote in the Maariv daily.
Barghouti decided not to be represented by a lawyer, to underscore his claim that the Tel Aviv District Court has no jurisdiction in his case.
At the start of the proceedings, Barghouti's three children caught a glimpse of their father in the courthouse.
They tried to reach him, but were pulled back by security guards.
Barghouti's youngest son, who is about 11, began crying.
In the hallway outside, there were scuffles and shouting matches between Jewish and Arab spectators.
Israel accuses Barghouti of having orchestrated terror attacks that killed scores of Israelis.
Israel has said it will also try to show that senior Palestinian Authority officials were involved in violence against Israelis.
In a court appearance last month, during which the indictment was filed, Barghouti said he remained committed to a peace deal with Israel.
He said Israel would only win security once it withdrew from the West Bank and Gaza.

STORYLINE:
The trial of Palestinian uprising leader Marwan Barghouti opened in an Israeli court on Thursday.
Barghouti, the most senior Palestinian to be tried by Israel, said he did not recognise the court's jurisdiction and would not be represented by a lawyer.
The trial will become a platform for the conflicting narratives of Israelis and Palestinians about the events of the past two years, commentator Hemi Shalev wrote in the Maariv daily.
Barghouti decided not to be represented by a lawyer, to underscore his claim that the Tel Aviv District Court has no jurisdiction in his case.
At the start of the proceedings, Barghouti's three children caught a glimpse of their father in the courthouse.
They tried to reach him, but were pulled back by security guards.
Barghouti's youngest son, who is about 11, began crying.
In the hallway outside, there were scuffles and shouting matches between Jewish and Arab spectators.
Israel accuses Barghouti of having orchestrated terror attacks that killed scores of Israelis.
Israel has said it will also try to show that senior Palestinian Authority officials were involved in violence against Israelis.
In a court appearance last month, during which the indictment was filed, Barghouti said he remained committed to a peace deal with Israel.
He said Israel would only win security once it withdrew from the West Bank and Gaza.

Gisele Halimi, a Tunisia-born Jewish lawyer who made a name for herself by defending Algerians fighting French rule, says she will represent Palestinian uprising leader Marwan Barghouti at his trial in Israel for alleged terrorism.
Halimi, 75, said at a press conference in Jerusalem Sunday that she had already met Barghouti in prison for an hour and he agreed that she should defend him at his next court appearance, on October 3.
Halimi, who is a French citizen, said the Israeli charges against the Palestinian leader are not backed by hard evidence.
In Barghouti's defence, she quoted work he submitted for a master's degree in political science in 1998 where he speaks of "two peoples, two free and independent states."
She said Palestinians should adopt some of the tactics of Algerian insurgents of the 1950s, among them strikes and mass demonstrations.
She added that she believed it was possible for Israelis and Palestinians to live together, side-by-side. That belief, she said, was based on her experience as a Jew in Tunisia.
During a brief but stormy court appearance on Thursday, Barghouti represented himself and challenged the Tel Aviv court's right to try him, saying he is being prosecuted for his political activities.
Israel says it has evidence linking Barghouti to the murder of Israelis and therefore has the right to try him.
Barghouti, 43, leader of Yasser Arafat's Fatah movement in the West Bank, is the most senior Palestinian to be tried by Israel. He is charged with organising attacks that killed 26 people, ranging in age from eight months to 79 years.

The plight of Palestinian political prisoners in Israeli jails was highlighted on Sunday by South Africans who served lengthy prison sentences under the old apartheid regime.
Ahmed Kathrada, one of Nelson Mandela's codefendants in the notorious 'Rivonia Trial', is leading a renewed call for the release of the political prisoners.
Kathrada, a friend of Nelson Mandela's and fellow Robben Island inmate, served twenty-six years behind bars.
"Today we are reaffirming what Mr Mandela and our government have said. The PLO (Palestine Liberation Organisation) and the Palestinian people were our allies in the struggle, whilst they themselves were struggling, they did not forget us," Kathrada said.
Kathrada and Ronnie Kasrils, a prominent member of the African National Congress (ANC) and former cabinet minister, hosted the wife of Marwan Barghouti at the infamous prison, on Ribben Island, off Cape Town.
Fadwa Barghouti's husband, Palestinian prisoner Marwan Barghouti, was detained in 2002 and later sentenced to five life terms and an additional forty years by an Israeli court, for murder and attempted murder.
A declaration calling for the release of Palestinian prisoners was signed in Nelson Mandela's former cell.
During the visit, Mrs Barghouti read out a message from her imprisoned husband.
"I have been reminded of a great man who did not only see the horizon of freedom, but shaped it with his companions from the very prison, the great Nelson Mandela, the source of inspiration for all those who seek freedom around the world," she said.
A series of rallies with Mrs Barghouti as speaker is planned for three South African cities under the banner "Free Marwan Barghouti and all the Palestinian Political Prisoners."
Israel's position is that Barghouti and others are not political prisoners, but have been imprisoned after being convicted of murder and other offences.
Ronnie Kasrils is one of a handful of South African Jews who achieved high office within the ANC who regularly criticise Israel and compare it to the old apartheid regime.
Sunday's event is the start of a series of actions in South Africa which Kathrada hopes will reignite a campaign to have Barghouti released.
Several international bodies including the European Parliament have called for Barghouti and other imprisoned members of the Palestinian Legislative Council to be set free.

Kleiman, a 23 year old US citizen who worked as a kindergarten teacher for Downs Syndrome children, was killed in a shooting attack near Ramallah in 2002.
The suit alleges that Barghouti was directly involved in Kleiman's death because he was the leader of the Tanzim, a militia linked to Fatah.
In 2004 an Israeli court sentenced Barghouti to five consecutive life terms and 40 years for his role in attacks that killed four Israelis and a Greek monk - the maximum sentence.
Israel alleges he also played a leading role in Fatah's violent offshoot, the Al Aqsa Martyrs' Brigades.
Barghouti is a popular Fatah leader who has been tipped as a future leader of an independent Palestine.

STORYLINE
Palestinian President Mahmoud Abbas officially wrapped up his Fatah party convention on Saturday after the announcement of election results for the 120-seat Revolutionary Council, Fatah's legislative body.
Abbas said that "several tasks" remained the priorities of his party, first of all what he defined as "the Palestinian national dialogue", meaning talks with the Islamic militant group Hamas, which controls the Gaza Strip.
Hamas were democratically elected in a 2006 Palestinian parliament vote.
Hamas then broke off with the government of Palestinian President Mahmoud Abbas following months of conflict over power-sharing with the new government.
The group eventually took control of the Gaza Strip in June 2007, leaving Abbas' government and Fatah party in nominal control of the occupied West Bank only.
Official results of voting for Fatah's main policy-making body, the Central Committee, were announced earlier this week.

STORYLINE
Palestinian President Mahmoud Abbas officially wrapped up his Fatah party convention on Saturday after the announcement of election results for the 120-seat Revolutionary Council, Fatah's legislative body.
Abbas said that "several tasks" remained the priorities of his party, first of all what he defined as "the Palestinian national dialogue", meaning talks with the Islamic militant group Hamas, which controls the Gaza Strip.
Hamas were democratically elected in a 2006 Palestinian parliament vote.
Hamas then broke off with the government of Palestinian President Mahmoud Abbas following months of conflict over power-sharing with the new government.
The group eventually took control of the Gaza Strip in June 2007, leaving Abbas' government and Fatah party in nominal control of the occupied West Bank only.
Official results of voting for Fatah's main policy-making body, the Central Committee, were announced earlier this week.

According to the Israelis, the Palestinian was working in a greenhouse in the Jewish settlement of Netzarim in the Gaza Strip and was killed by Palestinian gunfire aimed at a nearby military post.
Palestinian officials said he was killed by Israeli bullets.
At least 341 people, most of them Palestinians but including 13 Israeli Arabs and 39 other Israelis, have been killed in the Palestinian uprising that began nearly three months ago.
While the violence raged, Palestinian officials spoke of a crisis in Middle East peace talks in Washington that had earlier appeared to show signs of progress.
Marwan Barghouti, the head of Palestinian leader Arafat's Fatah movement in the West Bank, said the fighting will only intensify.
The uprising is a strategic choice of the Palestinian people, and it can't be stopped, Barghouti said.
Barghouti has also added that they prefer Sharon because the international protection would be easier to get.

A man has been rushed to hospital after being injured in a suspected assasination attempt against a prominent Palestinian official.
Mohammed Abu Halawi, a Palestinian security official, was travelling in a car when it was engulfed in the blast of a shell or missile which hit another car belonging to Marwan Barghouti, a leader of Yasser Arafat's Fatah movement.
Mr Barghouti and his driver managed to escape from the car because the first missile missed its target and exploded in front of his car
A second projectile hit, destroying the car and causing the injuries to Mr Halawi, who was in a nearby car.
Mr Barghouti later went to visit the injured man in hospital.
The Israeli military had no immediate comment on the incident in the West Bank town of Ramallah, just north of Jerusalem.
Palestinians claim the attack, which appeared to come from Psagot, a nearby Jewish settlement, was an attempt to kill him.

Israel is highlighting the work of a special project under which Palestinian babies - including an infant related to jailed Fatah leader Marwan Barghouti - are being saved by Israeli doctors through complex heart surgery.
Israeli doctors at Wolfson Hospital presented their latest patients to the media on Monday, including Karim Barghouti, a relative of Marwan Barghouti, who is a senior member of Yasser Arafat's Fatah party .
Marwan Barghouti is currently being held by Israeli security forces. He is accused of masterminding terror attacks against Israeli civilians.
Karim Barghouti is now being released from hospital after a string of heart operations. His mother Aida Barghouti told reporters that that the project proves Palestinians and Israelis can live together in peace.
Since the project started in 1993, organisers say over 700 operations have been performed saving the lives of babies from all over the world.
The project, funded solely by donors until Israel's Ministry of Regional Coordination got on board in December 2001, focuses specifically on infants from third world countries. Transportation of the sick children, along with all pre and post operative care is financed by the project.
When the Regional Coordination ministry became involved last year it insisted that an increased number of babies from Jordan and Palestinian areas be treated. At the time baby Barghouti was released, 10 other Palestinian babies were receiving treatment on the ward.
The specialised heart operations are carried out by Israeli surgeons and doctors, using some of the latest technology and treatments available.

Fadwa Barghouti, who was accompanied by her husband's lawyer, told reporters she could shed no light on reports that efforts were being made to include her husband in a complex prisoner-swap involving an Israeli businessman being held by Hezbollah in Lebanon.
She emerged from the prison in tears after spending just under and hour with her husband. Speaking through her husband's lawyer, she said her husband had been in solitary confinement for 95 days. The Israeli police say Mr Barghouti is sharing a cell.
Barghouti, who is the senior West Bank leader of Yasser Arafat's mainstream Fatah movement, and considered a leading Palestinian politician, is being held in Jerusalem's police lock-up, part of a former pilgrim's hospice called the Russian compound, which was built in the mid 1800s.
Mrs Barghouti, who lives in the West Bank town of Ramallah, which is presently under Israeli military occupation, needed a special permit to make the journey to Jerusalem.

Marwan Barghouti, one of the most visible Palestinian leaders of the current violent conflict with Israel, went on trial Wednesday on charges he orchestrated widespread terror attacks that killed scores of Israelis.
It was the first major court case against a Palestinian leader.
Barghouti, wearing a dark brown prison uniform, raised his cuffed hands triumphantly as he was led into the crowded courtroom.
Gesturing excitedly with his tied hands, he told reporters that Israelis could only have security after withdrawing from Palestinian lands, adding that he continued to support a peace deal with Israel.
In the trial, Israel will try to show that senior Palestinian Authority officials were involved in planning and funding attacks against Israelis.
The indictment said Barghouti, 43, headed terror groups in the West Bank and reported directly to Palestinian leader Yasser Arafat.
Barghouti's lawyers said he wants to draw attention to Israel's actions as an occupying power.
Prosecutor Dvora Chen said her case would be based on testimony of Al Aqsa regional commanders and field activists, including Nasser Awais and Nasser Abu Hmeid, two senior militiamen captured by Israel in recent months.

Israeli Foreign Minister Shimon Peres on Wednesday denied the trial of the Palestinian leader Marwan Barghouti was political, and said he would receive a fair hearing.
Barghouti, one of the most visible Palestinian leaders of the current violent conflict with Israel, went on trial Wednesday on charges he orchestrated widespread terror attacks that killed scores of Israelis.
It was the first major court case against a Palestinian leader.
However, the Palestinian's chief negotiator Saeb Erekat said the trial reflected the intention of the Israeli government to escalate the situation on the ground.
Meanwhile in Ramallah, Palestinian leader Yasser Arafat met the UN Secretary-General Kofi Annan's Human Rights envoy to the Middle East, Catherine Bertini.
Annan appointed Bertini earlier in August amid concerns that the West Bank and Gaza is facing a severe and mounting humanitarian crisis.
Bertini, former head of the World Food Programme, is in the region to assess the nature and the scale of the humanitarian crisis, and to review aid needs in light of recent developments.

STORYLINE:
In a highly charged atmosphere, the trial of Marwan Barghouti, leader of Palestinian leader Yasser Arafat's Fatah movement, opened in an Israeli court on Thursday.
Barghouti's young family were there as were families of the victims of some suicide bombings which Israel says Barghouti helped organise.
He denies the accusations, saying he is a political leader and has said he hopes to turn the trial into a showcase for what he said were the crimes of Israeli occupation.
Israel, in turn, was expected to try to show a link between the Palestinian Authority, headed by Yasser Arafat, and attacks on Israelis by Palestinian militias.

STORYLINE:
In a highly charged atmosphere, the trial of Marwan Barghouti, leader of Palestinian leader Yasser Arafat's Fatah movement, opened in an Israeli court on Thursday.
Barghouti's young family were there as were families of the victims of some suicide bombings which Israel says Barghouti helped organise.
He denies the accusations, saying he is a political leader and has said he hopes to turn the trial into a showcase for what he said were the crimes of Israeli occupation.
Israel, in turn, was expected to try to show a link between the Palestinian Authority, headed by Yasser Arafat, and attacks on Israelis by Palestinian militias.
00 02 The Tel Aviv courtroom was packed ahead of the start of Marwan Barghouti's trial.
00 06 Three of Barghouti's four children were present .
00 11 But not only his supporters turned out.
00 14 This woman's son and her daughter-in-law were killed in a shooting blamed on the Al Aqsa Martyrs' Brigade - a Fatah-affiliated militia.
00 23 Israel has charged Barghouti, leader the Fatah movement, with helping to orchestrate 37 attacks that killed 26 Israelis in the past two years.
00 31 Once the trial started, Barghouti said he did not recognise the court's jurisdiction and would not be represented by a lawyer.
00 38 He said the court did not have the right to prosecute him because he is an elected political figure, not a criminal.
00 46 Barghouti, who is the most senior Palestinian to be tried by Israel, has said he supports driving Israel out of the West Bank and Gaza Strip by force, but that he has not been personally involved in attacks.

The trial of Palestinian uprising leader Marwan Barghouti opened in an Israeli court on Thursday.
Barghouti, the most senior Palestinian to be tried by Israel, said he did not recognise the court's jurisdiction and would not be represented by a lawyer.
The trial will become a platform for the conflicting narratives of Israelis and Palestinians about the events of the past two years, commentator Hemi Shalev wrote in the Maariv daily.
Barghouti decided not to be represented by a lawyer, to underscore his claim that the Tel Aviv District Court has
no jurisdiction in his case.
At the start of the proceedings, Barghouti's three children caught a glimpse of their father in the courthouse.
They tried to reach him, but were pulled back by security guards.
Barghouti's youngest son, who is about 11, began crying.
In the hallway outside, there were scuffles and shouting matches between Jewish and Arab spectators.
Israel accuses Barghouti of having orchestrated terror attacks that killed scores of Israelis.
Israel has said it will also try to show that senior Palestinian Authority officials were involved in violence against Israelis.
In a court appearance last month, during which the indictment was filed, Barghouti said he remained committed
to a peace deal with Israel.
He said Israel would only win security once it withdrew from the West Bank and Gaza.

Op 20 september organiseerden intal en Geneeskunde voor het Volk (GVHV) op ManiFiesta een conferentie met Fadwa Barghouti. Na enkele vragen van Hanne Bosselaers (GVHV), sneed de advocate en echtgenote van de opgesloten leider Marwan Barghouti een hele reeks thema’s aan. De emoties waren voelbaar, maar stonden een gedachtewisseling over mogelijke acties van internationale solidariteit niet in de weg.

Omar Barghouti gave this keynote talk to the 2015 Peace Works Conference sponsored by the The Rachel Corrie Foundation for Peace and Justice. Omar Barghouti is an independent Palestinian researcher and human rights activist. He is a co-founder of the Palestinian Campaign for the Academic and Cultural Boycott of Israel (PACBI) and the Palestinian Civil Society-led Boycott, Divestment and Sanctions (BDS) movement against Israeli occupation. Omar is a Research Fellow at the International Institute of Social Studies in The Hague. He holds bachelor’s and master’s degrees in electrical engineering from Columbia University and a master’s in philosophy (ethics) from Tel Aviv University. He is the author of, BDS: The Global Struggle for Palestinian Rights. His commentaries and interviews have appeared in the New York Times, The Guardian, and on Bloomberg, CNN, and BBC, among others.
