Chamber hearings concerning Romania and Lithuania

The Court has held separate Chamber hearings in the cases of Al Nashiri v. Romania and Abu Zubaydah v. Lithuania.

Both cases concern the alleged “rendition” of the applicants, suspected of terrorist acts, to CIA secret detention sites, where, according to their submissions, illegal interrogation methods amounting to torture were used.

Before the two public hearings, on 28 June 2016, the Court held two fact-finding hearings and heard evidence from four experts in the case of Al Nashiri v. Romania and three experts in that of Abu Zubaydah v. Lithuania, all experts having been summoned by the Court. Those hearings were confidential and held in a closed sitting.

    The case concerns the complaint by a businessman about his arrest and detention pending trial on charges of defrauding a State company.

  • Forthcoming judgment

    The Court will be delivering its Grand Chamber judgment in the case of Jeronovičs v. Latvia on 5 July 2016.

    The case concerns the Latvian authorities’ refusal to reopen the criminal proceedings relating to the applicant’s ill-treatment, following a unilateral declaration in which the Government had acknowledged, among other breaches, a violation of Article 3 of the Convention.

    Judgment concerning Hungary

    In the case of Baka v. Hungary, the Court held that there had been a violation of the right of access to a court and freedom of expression.

    The case concerned the premature termination of the mandate of the applicant, President of the Hungarian Supreme Court, following his criticism of legislative reforms and the fact that he was unable to challenge that decision before a court.

    The case concerned the refusal by the Italian authorities to grant a residence permit to a gay couple on family grounds.

    Judgment concerning Turkey

    In the case of Halime Kılıç v. Turkey, the Court found a violation of the right to life and the prohibition of discrimination.

    The case concerned the death of the applicant’s daughter, a victim of domestic violence, who was killed by her husband in spite of four criminal complaints, three protection orders and injunctions.

    The Court found it unacceptable that the applicant’s daughter had been left powerless and without protection against her husband’s violence. It took the view that by ignoring the repeated acts of violence and death threats against the victim, the authorities had created a climate that was conducive to such violence.

  • Judgment concerning Italy

    In the case of Brambilla and Others v. Italy, the Court held that there had been no violation of freedom of expression.

    The case concerned the conviction of three journalists who intercepted radio communications between carabinieri in order to arrive quickly at crime scenes and report on them for a local newspaper.
