How do you help people to buy property in Italy?
Well I am an Italy lawyer and I help typically non Italian buyers looking to their obligations and their rights as per
Italian law applicable even when not written in a contract.
So is buying a property in Italy a very complex process?
Tell me through it.
There could be some very complex aspects and it is very important to look into the transaction details before signing a piece of paper.
Do lot of people
sign away and then you say "Why did you do that?"
That's true! And at that
point there is not much to do almost
...it's not too late but I have to work more and sometimes we cannot get the highest result for the lowest cost possible.
There are always problems that are typical of every country. So what are the pitfalls of buying in Italy?
A very important thing before buying is to be well aware of all legal aspects that apply, no matter there is an agreement or not. Like...the deposit. They pay a deposit, they have been told there is a deposit but they don't know the consequences. So they decide to pull out.
But in Italian we have different words to define the "deposit": it could be "acconto", "caparra", "cauzione" and depending on the definition there are different consequences. If you pull out you'll loose all of it, you'll loose a portion of it, you'll loose something only if the vendor can prove he got some kind of damage.
So this means that if people don't have an expert to point them the right directions...
Yes, it is very important to be well guided.
