The Spanish Ambassador to the UK, Federico Trillo, has been summoned by the Foreign Office to complain about the Spanish research vessel, Ramon Margalef, which has been undertaking survey activity in British Gibraltar Territorial Waters for over twenty hours. Europe Minister, David Lidington has described this as a provocative incursion and says the UK stands to do whatever is required to protect Gibraltar's Sovereignty, economy and security.
The Gibraltar Government, meanwhile, says the latest incident is an escalation of Spanish action, and a clear violation of the UN law of the sea.
The 'Ramon Margalef' was back for more this morning. It spent a considerable time off the South Mole shadowed by the Royal Navy's HMS Scimitar before heading south towards Europa Point. Once there, there was a standoff involving three Guardia Civil patrol boats, several Royal Gibraltar Police vessels and HMS Scimitar.
The vessel, when challenged, said it was conducting survey work with the permission of the Spanish Authorities, and in the interests of the European Community.
The Gibraltar Government says it condemns the latest incursion, and describes the Spanish vessels' manoeuvres as 'dangerous'. Number Six says the lengthy duration of the incursion is something new, and this development, with the Spanish State vessel remaining in British waters overnight, and ignoring the Royal Navy warnings, is serious.
The Government says it considers that the actions of the Ramon Margalef represent an intolerable intrusion into British Gibraltar Territorial Waters, and a clear UNCLOS violation.

3 JULY 2015 - Incursion by Spanish survey vessel Angeles Alvarino
Both the Government and the Convent have described as “unacceptable” an unlawful incursion, which saw a Royal Navy RHIB struck by a survey probe from a Spanish state research vessel on Friday. The Angeles Alvarino entered British Gibraltar Territorial Waters on more than one occasion this afternoon, in what the Government has called “a three-hour stand-off”.
According to the Government, the Angeles Alvarino attempted to take executive action in British Gibraltar Territorial Waters, by trying to drop probes into the sea to take readings: one of these hit a Royal Navy patrol boat as it sought to prevent it. Royal Navy, Royal Gibraltar Police and Gibraltar Defence Police vessels were all dispatched to the scene, with a Guardia Civil patrol boat also called in by the survey vessel.
The Government describes the incident as “dangerous and reckess nonsense”, adding it marks the start of the summer season when the current Spanish Government uses Gibraltar as a distraction to divert attention from problems at home. It says it’s absurd that Spain should provoke an incident of this kind, engaging law enforcement vessels from both sides when there’s much more important work to be done in the fight against organised crime, human trafficking and terrorism.
For its part, the Convent has reiterated its concern about the “dangerous manner” in which the Angeles Alvarino acted. In a statement, it said it’s very fortunate that no-one was hurt and that no serious damage was done, adding it’s made clear its disappointment that this was a repeat of a similar incident last October. The Convent says it’s protested the incursion directly to the Spanish authorities at a senior level, making clear that such violations of the UK’s sovereignty are unacceptable. It’s restated its position that such incursions do not weaken the international legal basis for UK sovereignty over BGTW.

The Foreign Office has wasted no time in reporting an incursion by the Spanish Fisheries Research Vessel, the Emma Bardan, to London and Madrid. The Vessel appears to have been carrying out a survey in Gibraltar Waters this morning, shadowed by the Guardia Civil. All local Essential Services were present at sea.
The speed of the complaint to London and Madrid could give some indication of the importance they're giving the incident. It started at around eleven o'clock this morning, with the Emma Bardan, off the detached Mole and then moving towards Rosia Bay. It was seen carrying out a survey and putting equipment into the sea. The vessel, however, left nothing behind as opposed to a similar incident in 2010 when buoys sank in British Territorial Waters, were only removed by Spain following a month of negotiations with the Foreign Office.
Although Spain believes she has a right to exercise environmental control in our waters, Britain has in the past, said it's made its position clear to the Spanish Government. In a written Ministerial statement by the Foreign Secretary, following the European Court of Justice's judgement to dismiss the UK's appeal to reverse The European Commission's decision to designate a Site of Community Importance, William Hague said the British Government took a grave view of any attempts by Spain to exert any authority or control within British Gibraltar Territorial Waters as part of implementation of a Special Area of Conservation management plan or for any other reason. He added that any attempt by a Spanish State vessel, or vessel acting on behalf of the Spanish State, to exercise jurisdiction within British Gibraltar Teritorial Waters is a violation of British Sovereignty and will respond accordingly. He added the British Government will continue to take whatever action it considers necessary to protect British Sovereignty and the interests of Gibraltar.
The Emma Bardan was also in Gibraltar two days ago and was also challenged by the Royal Navy then.
