The juvenile involved in the
Mercedes hit-and-run case that claimed the life of a 32-year-old man was charged with culpable homicide not amounting to murder and destruction of evidence.
Delhi Police submitted the charge sheet at the
Juvenile Justice Board (
JJB) in which it requested the juvenile be tried as an adult.
The presiding officer of JJB has kept the charge sheet which will be up for consideration on June 2. If convicted, the juvenile is liable to a sentence of 10 years (maximum) in jail.
The juvenile has been charged under sections 304 and
201 of the
Indian Penal Code that deal with culpable homicide not amounting to murder and destruction of evidence. The JJB will decide on the cognizance of the chargesheet on June 2.
"During our investigation, it came to light that the juvenile was instrumental in sending the family driver to take the blame for the incident. Hence we have charged him with destruction of evidence," said Madhur Verma, deputy commissioner of police (
North).
The
DCP added, "The juvenile was four days short of turning major when the incident took place. We believe that he was physically and mentally grown up and aware of the consequences of his actions. Hence we have requested the JJB to try him as an adult." Keeping the amended
Juvenile Justice Act, 2016 in mind, police officials have requested the JJB to prepare a preliminary assessment report that is a pre-requisite for the juvenile to be tried as an adult under section 15.

Evidence from
Close Circuit Television (
CCTV) camera footage recording the incident have also been included in the chargesheet. According to witness statements and the footage, it is clear that the Mercedes was going at a high speed and the driver did not even attempt to break or avoid collision. "The lack of skid marks at the scene of incident is telling. We have also taken statements of two witnesses who narrowly avoided collision with the car moments before the incident took place," Verma said.
The
CCTV footage has been sent for
Forensic Science Laboratory (
FSL) examination to determine the exact speed of the car at the time of the incident.
Rough estimates project that the silver Mercedes was traveling at a speed of 80 kms/hour. When the victim was hit by the car at that speed, the impact threw him 15-20 feet up in the air before he hit ground.
Sources state that the chargesheet that runs more than
300 pages includes statements from more than 50 witnesses including the juvenile's friends who were with him in the car.
Almost all the friends traveling in the vehicle have attested that the Mercedes was being driven at a very high speed. At least two friends claim that they wanted to "get out of the car because it was going too fast for them."
While the operative part of the chargesheet is merely 25-30 pages, the remaining pages are related to annexure documents that include a fitness report and an accident report done by Mercedes
.
In the chargesheet, the juvenile has been declared as a repeat offender since three traffic challans were issued to him along with an accident at
Maurice Nagar in
December 2015 which was mutually settled between the parties.
The police plans to file a separate chargesheet against the juvenile's father charging him with abetment. This charge sheet will be filed in the
Tis Hazari district courts where the matter is ongoing.
On April 4,
Siddharth Sharma was killed as he was hit by a speeding Mercedes that was being driven by the then 17-year-old. Both father and son were arrested for the crime and are currently out on bail.
