After open carry of my handgun and walking around my state capitol building with no problems at all (see part one of this video). I asked them if I could bring my rifle in and take a few pictures in the building with it. I was told that I could only carry a unloaded firearm in the building.
I then took a small walk to the
North Building and got a copy of my
New Mexico State Constitution and began to educate them and also go over the laws concerning a loaded gun in NM. They called the
State Police and the state police know the laws and were not going to infringe on my rights. It was the most positive experience I have had open carrying and dealing with law enforcement.
As far as him not getting the open carry thing
....I told him the
difference many times, this is part two of the video. He already know the difference, just wanted me to leave. He was hoping that I didn't know the law and would be worried about getting arrested. I had a long discussion about what I was doing before I even walked in with the long gun. I went as far as calling the state police and governor's security before I got there and told them I was going to open carry inside the building.

INFO on how to conceal carry UNLOADED with out a permit in NM:
Like most things in western law, there has to be something that actually states it is illegal. So anything that does not have a law saying it is illegal is good to do. The main problem is there is nothing in the gun laws for NM that defines ‘loaded’ and the word only appears in the handgun regulations one time.
If you look at the
PDF in the site below and reference the definition of a ‘concealed handgun’ you find that it has to be loaded to fit that definition. So that does not leave a person to say you can have a full magazine in the gun or a round in the chamber. When I wanted to conceal carry before I got my permit I would just keep the loaded mag in my pocket and the gun on my hip without a magazine in it. But I don’t recommend that, it was just something that I was comfortable doing. NM is an open carry state so if you choose you can just have a fully loaded one on your hip.
