Yashika Bageerathi from Mauritius deserves to have a chance in the UK (United Kingdom). Why is Yashika Bageerathi being sent back to Mauritius? The Home Office says her case doesn't pass the asylum test.
The law is quite clear that an asylum application must be based on the internationally-agreed criteria of the 1951 Refugee Convention.
That means an applicant needs to show that they need protection from persecution on one of the following grounds:
Political opinion
Race, religion or nationality
Membership of a particular social group that puts them at risk because of the particular situation in the country they are fleeing
This is where the problems started for Yashika Bageerathi. Her - and her family's - application to stay in the UK relates to the fact that they are fleeing an abusive relative. On face value, that doesn't appear to be covered by that core of refugee law. It was not designed to end all of human misery, wherever it may be found.
But that's not the whole story - the law is much more nuanced.
It has developed down the years as judges have dealt with specific and complex cases which have forced them to look long and hard at what we mean by asylum and humanitarian protection.
'Social group' test
So while each case has to fit into what appear to be basic constraints of asylum law - it all depends on how you interpret those constraints and the UK's international obligations to care for genuine refugees.
Let's go back to those core tests. One of them is membership of a particular "social group".
The courts have said quite clearly that in certain specific scenarios women can constitute a social group that needs protection under refugee law.
In 1999, the Law Lords issued a landmark judgement in favour of two women from Pakistan, called Shah and Islam.
The women had escaped from terribly violent husbands and argued that if they returned to their home country, they would be accused and convicted in a local sharia court of adultery. They could face either public lashing or stoning. Critically, that court's judgement would give more weight to the claims of their husbands simply because they were men.
The asylum claims were rejected - but the Law Lords said that was wrong.
They ruled that the Pakistani women were part of a social group that was persecuted because they had no means to defend themselves. .
In other words, in that specific context, domestic violence and abuse against women warranted refugee protection because the state exposed the women to persecution.
There have been many developments down the years to further expand on this concept - but none of them have ever said that anybody can just come to the UK and get protection because they have a horrible relative.

My daughter Shasmeen Banon 4yrs old in the video clip. She is living with my wife at my mother in law place, 200m away from my residense at Valley Pitot, Port-Louis, since 2 July - OB:1356/15. Together with my other 2 kids name: Muhammad Sajjad and Nazahah Banon.
On 13 July, I visited my kids, where I notice she was injured in her forehead(gros bos blue lor so front). Her mum said she was injured while playing.
On 24 July, one of my friend give me the news, one of my kid was injured and saw her at V.Pitot Community health centre. I phone mother in law, she said no kids was injured(I have call recording).
On 29 July, I visited my kids and saw my last kids having injury in her forehead. This is the video clip. She was crying asking me to take her away with me. I tried to take her away but my wife snatch her from my arms.
I realized that my kids are being mistreated again as she used to beat them regularly at my residence. At CDU there are records of my kids being mistreated since 2008 -2010 by my wife.
I went to V.Pitot Police Station, they said they could do nothing as it concern CDU. I went to CDU in person to report the case. They noted and nothing were done till late evening. I went at their residence to fetch my 3 kids, but I was assaulted and my right hand's bone was broken. I went to Police Station, they refuse to take my declaration concerning my kids being mistreated by my wife and the assault they done on me.
Its really mysterious that all concerning departments are closing eyes on whats happening to me and my kids. WHO IS PROTECTING MY WIFE ???? Now I know who is that Honourable person.
On 13 August, I phone at CDU again to see what are they doing concerning my case. But nothing was done.
On 14 August, I reported the assault made by my mother in law and wife at Police Station OB:1640/15.
On 15 August, my wife send 2 bouncers at my residence, I was sleeping. They talked to my sister saying they will come to meet me in some hours again. I was sleeping and one my neighbor heard them saying they will break my another hand and saw them entering the residence of my mother in law. That neighbor bring me to Police Station and we give the police Officers their name and address. They noted nothing officially and replied they will find them and will talk to them. Some hours later around 2pm, I receive a call from V.Pitot Police Station, they said they talked to them and now they will not come(I have the call records). Then I went to Police Station to make a declaration of what is happening since morning about the 2 bouncers, but the police officers refused to note down at start and finally he drafted the declaration as he wanted OB: 1645/15.
On 17 August, school was resume and I went to their school. They refused to give my kids because of dispute. I went to Plaine Verte Police Station to help me fetch my kids but they didn't helped me but they helped my wife because of a so called HONOURABLE helping my wife. A police officer phoned me from V.Pitot Station requesting me to come regarding a contravention which I never made. He said he can help me to forge some information to help me(I have full recording of the calls). I phoned ICAC about this matter. Soon I will report all corrupt officers with proofs at ICAC.
On 21 August, I went in person again to CDU regarding my kids. Why no actions had not yet been taken???? My kids life is in danger with such mother. I went to see senior CDU Officers regarding this matter, but nothing yet. On 24 August, at 10:30am I have appointment at CDU Edith Cavell, Port-Louis.
My kids are living in a very BAD ATMOSPHERE and they are being mistreated. My kids fear their mom and do whatever she say and say whatever she dictate them to say. I didn't wanted to mention this harsh truth about my wife and her mum. But a whole region at V.Pitot knows very well, what is taking place at my mother in law's place.

A Thin Dividing Line
Well known independent journalist and educator, Paranjoy Guha Thakurta’s latest documentary, “A Thin Dividing Line” brings out how tax havens or low tax jurisdictions blur the dividing line between legal forms of tax avoidance, euphemistically called tax planning, and illegal forms of tax evasion or money laundering. The hour-long documentary includes views from high ranking Indian tax officials, academicians, politicians and an array of top Mauritian officials including its former prime minister on the infamous treaty signed in 1982.
Ever since Indian economic liberalisation in 1991, over 40% of investments via foreign institutional investment (FII) and foreign direct investment (FDI) have been routed through Mauritius. But why is Mauritius more popular than other tax havens? The film suggests it is the proximity to India and the fact that over 60% of Mauritius residents are from Indian origin. The corporates in Mauritius pay effective tax of 2%. In India, laws and rules have been created and defended ostensibly because these have helped attract foreign investments. However, India has not necessarily benefitted from all these foreign investments to the extent envisaged or anticipated. Greater transparency in financial transactions, stricter regulation and more effective implementation of existing laws are needed. Even if certain financial transactions adhere to the letter of the law, not all of these are desirable or beneficial for humankind.
With the treaty, India has given up its right to levy capital gains tax under article 13. Mauritius does not charge capital gains tax allowing foreign investors to take advantage of the treaty to avoid paying taxes. Mr Thakurta said, “An estimate done by a study puts a figure of many tens of thousands crores in loss for Indian exchequer.”
Mauritius authorities interviewed in the documentary talk about due diligence, compliances and safe guards to ensure clean business, the need for resident directors and other checks. However, it is an open secret that Mauritius is packed with ‘nameplate’ companies with top accountants and lawyers in India helping to set them up from India itself. The process of hiding the trail of beneficial ownership through layers of shell companies that sometimes transmit money through multiple tax havens is also well known to the government and Indian authorities.
Mr Thakurta’s film discusses “round-tripping” to make it legal. He says, “It’s not like laws in India cannot be enforced, but there are loopholes that are not plugged. Those responsible are incapable or deliberately not doing it.”

Mr Thakurta’s film discusses “round-tripping” to make it legal. He says, “It’s not like laws in India cannot be enforced, but there are loopholes that are not plugged. Those responsible are incapable or deliberately not doing it.”

Africa - Mysterious Continent - Mauritius, The Ingredients of Paradise - Part 14
Mauritius, officially the Republic of Mauritius (French: République de Maurice), is an island nation in the Indian Ocean about 2,000 kilometres (1,200 mi) off the southeast coast of the African continent. The country includes the island of Mauritius, Rodrigues (560 kilometres (350 mi) east), the islands of Agalega, and the archipelago of Saint Brandon. The islands of Mauritius, Rodrigues, and Réunion (172 km (107 mi) southwest) form part of the Mascarene Islands. The area of the country is 2,040 km2. The capital and largest city is Port Louis.
Mauritius claims sovereignty over the Chagos Archipelago (United Kingdom) and Tromelin Island (France). The United Kingdom excised the Chagos Archipelago from Mauritian territory prior to Mauritian independence in 1965. The UK gradually depopulated the archipelago's indigenous population and leased its biggest island, Diego Garcia, to the United States. The US soon thereafter established a military base on Diego Garcia.
The island of Mauritius was visited during the medieval period by the Arabs and then by the Portuguese, who named it Dina Arobi and Cirne, respectively. The island was uninhabited until the Dutch Republic established a colony in 1638, with the Dutch naming the island after Prince Maurice van Nassau. The Dutch colony was abandoned in 1710, and, five years later, the island became a French colony and was named Isle de France. Due to its strategic position, Mauritius was known as the "star and key" of the Indian Ocean.
Mauritius became an important base on the trade routes from Europe to the East before the opening of the Suez Canal and was involved in the power struggle between the French and the British. The French won the Battle of Grand Port, their only naval victory over the British during these wars, but they could not prevent the British from landing at Cap Malheureux three months later, and formally surrendered on the fifth day of the invasion, 3 December 1810, on terms allowing settlers to keep their land and property, the use of the French language, and the law of France in criminal and civil matters. Under British rule, the island's name reverted to Mauritius. The country became an independent state on 12 March 1968, following the adoption of a new constitution and became a republic within the Commonwealth in 1992.
The people of Mauritius are multiethnic and multicultural. Most Mauritians are multilingual; Mauritian Creole, English, French, and Asian languages, particularly languages from India and China, are used. The island's government is closely modelled on the Westminster parliamentary system, and Mauritius is highly ranked for democracy and for economic and political freedom. Along with the other Mascarene Islands, Mauritius is known for its varied flora and fauna, with many species endemic to the island. The island is widely known as the only known home of the dodo, which, along with several other avian species, was made extinct by human activities relatively shortly after the island's settlement.

"THE SHAME OF AUSTRALIA CRUEL LIVE EXPORT TO "UNDERDEVELOPED COUNTRIES"
✦✦THE FACTS:
✦Here again Australian bulls are being illegally sold in breach of Australians regulations..During this year's Festival of Sacrifice Australian animals were documented by investigators being illegally and indiscriminately sold from an 'approved' feedlot in Mauritius, in breach of Australian regulations...Filmed in October 2013.
➨PLEASE READ HERE THE DETAILS (IF YOU DON'T WATCH THE ENTIRE VIDEO)
✦✦Animals were roughly dragged on and off trucks.young evil people tease those poor bulls on the truck before the departure to the final destination where they will be slaughtered..They were tied to walls and left to struggle and to wait, throughout a night and another day and without any water or food before the 'Festival' starts.Newt,On their last day of life, terrified bulls stumbled frantically as ropes were tied around their legs, tripping them to the ground. When they had used every last ounce of energy struggling against their restraints, they collapsed in exhaustion...Having already endured so much, the worst was yet to come▬►their throat cut by untrained hands a bunch of young uneducated savage people.. their bound legs kicking out in desperation...
At a recent live export conference in Queensland, the author of an industry-commissioned report called on the live export trade to 'take back control' and for a return to the days of self-regulation.
✦The end for these three bulls was very violent and tragic. Sadly, on the streets of Mauritius, countless other Australian bulls also suffered terribly. None of this should ever have happened !
✦The unfortunate bulls in Mauritius were delivered to this horror direct from the importer's feedlot — in blatant contravention of Australia's live export regulations. This industry cannot be trusted to play by the rules, let alone write them.
Our new Prime Minister(of Australia) says live export "is a good industry". But no government can support an industry that continually breaches regulations...
✦✦THE AUSTRALIAN LIVE EXPORT COMPANIES ARE ACCOMPLICE TO THESE CRIMES!!
Every year millions of Australian animals are exported live for slaughter. Cattle, sheep and goats are sent all through the Middle East and South East Asia — to countries where animal welfare laws do not protect them. Tens of thousands of animals don't survive the sea journey and those that do, disembark into countries where they are transported, handled and then slaughtered in appalling ways. Most animals slaughtered overseas have their throats cut while they are fully conscious, leading to an incredibly painful and prolonged death.we must do everything we can to stop immediately these gruesome exports of terror into these underdeveloped countries where there is no rule of law protecting animals and where the government are corrupted and are closing their eyes and where the local authorities has no control over its people's lack of empathy towards innocents animals !
For the bulls who were abandoned to suffer in Mauritius, make your voice heard!
Please sign & share these 3 petitions if you really care and want to stop in the future these kind of unjustified "Live Export " of terror from Australia to countries with not laws towards animals.. watch the video (3 parts) until the end and you will understand why you need to make your duty on this..

The little island, lying in the center of the Indian Ocean is a real tropical paradise. Along the white sand beaches, shaded by coconut palm trees there are many luxury hotels. We can take excursions to the nearby islands, or take a dive in the turquoise blue water. In the center of the island, on the top of a vulcanic plateau, emerald green sugar cane plantations can be found. On the Domaine Les Pailles estate we can have a glimpse at how rum and sugar are produced from sugar cane. We can try the Indian dishes and take a look at the colorful Hindu temple. We might enjoy the Sega dance and taste the teas from the Bois Cheri plantation. We mig

Mauritius Vacation Travel Video Guide • Great Destinations
We might also take a Jeep Tour through the Black River National Park and take a look at the marvellous waterfall of Chamarel, while in the zoo the famous pink pigeon and the golden bat can be found. In the city there is the Blue Penny Museum and one of the worlds most beautiful tropical parks, the Pamplemousses Botanic Garden to visit.

Port Louis , the capital of Mauritius, was founded by the French governor and colonist Bertrand-François Mahé de La Bourdonnais in 1735.
Situated on the north-west coast, Port Louis is the business and administrative capital of Mauritius. Packed with office-workers during the day, it quickly quietens down after office-hours – allowing visitors to enjoy a night out along the famous Caudan Waterfront.
Those arriving during daylight hours should head for the bustling Central Market or Champ de Mars: the oldest racecourse in the Indian Ocean region.
Port Louis (French: Port-Louis) is the capital city of Mauritius, located in the Port Louis District, the western part also lies in the Black River District. The city is the country's economic, cultural, political centre and most populous city, it is administered by the Municipal City Council of Port Louis. According to the census made by Statistics Mauritius in 2012, the population was at 148,001.

Auckland Vacation Travel Guide | Expedia
http://www.expedia.com/Auckland.d178233.Destination-Travel-Guides
With 1.5 million lucky people calling Auckland home, this North Island gem is the most populous city in New Zealand. Auckland tourism is quite diverse, giving visitors a bounty of choices for how to spend their time. The city marries modern buildings and art with nature, and the surrounding region has plenty of its own attractions to offer.
Auckland is called the City of Sails, boasting more boats per capita than anywhere else in the world. Nestled between two natural harbors, it’s no wonder residents and visitors alike enjoy spending time on the water. After a breakfast in Elliott Stables, take off on a boat cruise from downtown to explore the sights of Hauraki Gulf.
With your feet back on solid ground, enjoy Auckland sightseeing and shopping along Queen Street. Jet over to Ponsonby, which is considered one of the more hip neighborhoods in Auckland. When lunchtime rolls around, find your way to Devonport, a lovely harborside suburb where you can enjoy a seafood lunch.
With a contented stomach, spend some time at Auckland Domain, the city’s oldest park. Watch a game of cricket, walk through the Formal Gardens, or take a leisurely stroll through the mature trees. If you’re interested in even more of New Zealand’s natural landscape, head just outside the city for rolling hills, jagged cliffs, and forests with towering treetops. Walk through the Hauna Ranges and you’ll be rewarded with the Hunua Falls, an impressive waterfall rushing over a volcanic edge.
Visitors interested in adventurous Auckland tours must head to the downtown Sky Tower before leaving New Zealand. This is the tallest man-made building in the entire country – and it offers a breathtaking base jump from the top. If you’re not in the mood for that much adrenaline, head to the observation platform to take in sweeping views of the city and harbor.
What do you most look forward to doing in Auckland?
