An international tribunal has sided with the Philippines,... overruling China's claims in the South China Sea.
Ji Myung-kil provides a closer look at the first ruling on the cluster of overlapping claims in the disputed region by an international court, as well as China's anger-charged response.
The Permanent Court of Arbitration based in the Hague ruled in favor of the Philippines and concluded that China has no legal basis to claim historic rights to resources within the South China Sea.
The Philippines welcomed the landmark decision.
"The Philippines strongly affirms its respect for this milestone decision as an important contribution to ongoing efforts in addressing ongoing efforts in addressing disputes in the South China Sea."
China published a map in 1947 which outlined its claims to the South China Sea -- the basis of its so-called "nine-dash line" -- stretching 3-point-5 million square kilometers from China's southern coast.
The arbitration court said China had interfered with traditional Philippine fishing rights at Scarborough Shoal and breached the Philippines' sovereign rights by exploring for oil and gas near the Reed Bank.
But China refuses to acknowledge the tribunal's ruling.
"I should say the so-called arbitral tribunal was based on the illegal action and claim of the Philippines from the very onset. So its very existence is not legitimate."
Manila asked the court to mediate on the rights it has to the disputed waters under the United Nations Convention on Law of the Sea in 2013.
Experts said the ruling will have deep implications.
"This is an absolutely huge decision, it doesn't come as a complete surprise but to have the international court rule on the illegitimacy of the Nine-dotted line is a huge development."
Although the international tribunal ruled in favor of the Philippines, the court has no mechanism to enforce the decision, be it through military action or economic sanctions.
But analysts predict the ruling could prompt other neighboring countries like Taiwan, Malaysia, Vietnam and Brunei to file similar claims,... putting increased diplomatic pressure on Beijing to reduce its presence in the South China Sea.

The importance of international law rises in the wake of the Bush administration.
Question: How effective is the ICJ?Kal Raustiala: We've had a mixed record with it so- but the ICJ- the problem with the ICJ is it's effective at certain things. What it tends to do, kind of the bread and butter, would be a territorial dispute about where the border is and a river between two countries, and what you kind of need in that situation is just a neutral arbiter. You need someone to come in and for domestic political reasons maybe you don't want to give up this little island that somebody else is claiming, and the ICJ is very good at sort of just drawing a line and making a decision that seems neutral and acceptable to both sides. The problem with the ICJ is when it wades in to more controversial issues so recently it had a decision about the wall in Israel, it had a decision about nuclear weapons a few years ago, and it tends to have a hard time with those decisions. And so for that reason it's not as effective. It lacks some of the enforcement powers that we might want. You might compare the World Trade Organization's court, the appellate body, so that court is considered to be more effective in part because it has at its disposal enforcement measures and it's got a pretty good compliance record. So when it hands down a ruling and it says to even the United States, "You're violating a law," usually those countries comply. So not all international courts are the same and I'd say the ICJ is good at certain things, not everything.
Question: What's your advice regarding the Rome Statute?Kal Raustiala: It's a difficult question because the U.S. does have a unique role in the world and we are far and away the most powerful military power and we are very much viewed as the country that's going to- when there is something happening, a genocide unfolding, we have the capacity to act. We don't always act but we have the capacity to act and people do look to us to play that role so we do have some unique concerns that other countries don't necessarily have. That said, the ICC is widely accepted around the world and I think it would go a long way-- I think many of the concerns against the ICC, the idea that there's going to be a rogue prosecutor who will go after American service- or that we need-- Congress passed this law, the Hague Invasion Act, so if any American ends up in the brig of the ICC we're authorized to go in and invade the Netherlands and get them out. I think those kind of fantasies are really unfounded and so far the ICC has been very cautious. And I think it's again a mostly symbolic issue for us to join because I don't see-- The ICC's principle is that if a country tries in good faith its own soldiers the ICC won't step in and we have a well-functioning military justice system. So I don't imagine the ICC ruling over Americans but I think symbolically it'd be hugely important and particularly after the Bush administration's last seven plus years of being seen as a rejectionist of every international initiative, pulling out of the ABM Treaty, unsigning the International Criminal Court Rome Statute, denigrating the Kyoto Protocol. We've lost so much good will, and remember after World War II we were really the architects of this international system. We've lost so much of that that I think these symbolic steps like signing the Rome Statute would go a long way towards restoring our- I think our traditional image in the world, which is tarnished at this point.

The Tribunal issued its Award Tuesday after several months of hearings and submission of documents. China was absent throughout the proceedings, refusing to recognize the case.
“The Tribunal concluded that there was no legal basis for China to claim historic rights to resources within the sea areas falling within the ‘nine-dash line.’” the statement said.
“Having found that none of the features claimed by China was capable of generating an exclusive economic zone, the Tribunal found that it could—without delimiting a boundary—declare that certain sea areas are within the exclusive economic zone of the Philippines, because those areas are not overlapped by any possible entitlement of China,” it added.
BACKSTORY: The heart of the dispute over the West PH Sea
The Tribunal also said that China has violated Philippine sovereign rights.
“Having found that certain areas are within the exclusive economic zone of the Philippines, the Tribunal found that China had violated the Philippines’ sovereign rights in its exclusive economic zone by (a) interfering with Philippine fishing and petroleum exploration, (b) constructing artificial islands and (c) failing to prevent Chinese fishermen from fishing in the zone,” the tribunal statement said.
“The Tribunal further held that Chinese law enforcement vessels had unlawfully created a serious risk of collision when they physically obstructed Philippine vessels,” it said.
The Spratly Islands and its many reefs are being claimed by China under its “nine-dash line” claim that covers nearly the entire South China Sea including parts of the Philippines’ Exclusive Economic Zone (EEZ).
China insists it has “historic rights” in asserting its ownership of the region believed to be rich in natural gas resources and also a vital trade route for international cargo ships.
Philippines filed its case in January 2013 following a tense standoff between Chinese and Philippines ships at Scarborough shoal in April 2012.
Since the initiation of the arbitration case, China has conducted several massive reclamation projects to turn submerged reefs into artificial islands capable of hosting military structures and equipment.
China’s reclamation activities have alarmed other Southeast Asian nations, particularly Vietnam, that also have competing claims in the South China Sea.

The International Criminal Court (ICC) is the world's first permanent international criminal court, which is established and governed by the Rome Statute. It is located in The Hague, the Netherlands.
The adoption of the Rome Statute in 1998 was a historic step, reflecting the determination of the world community to put an end to impunity and to contribute to the prevention of crimes which threaten the peace, security and well-being of the world.
The ICC has jurisdiction over the most serious crimes of concern to the international community: genocide, crimes against humanity and war crimes committed after 1 July 2002.

International court
International courts are formed by treaties between nations or under the authority of an international organization such as the United Nations and include ad hoc tribunals and permanent institutions but exclude any courts arising purely under national authority.
Early examples of international courts include the Nuremberg and Tokyo tribunals established in the aftermath of World War II. Three such courts are presently located at The Hague in the Netherlands: the International Criminal Tribunal for the former Yugoslavia (ICTY), the International Court of Justice (ICJ), and the International Criminal Court (ICC). Further international courts exist elsewhere, usually with their jurisdiction restricted to a particular country or issue, such as the one dealing with the genocide in Rwanda. In addition to international tribunals created to address crimes committed during genocides and civil war, ad hoc courts combining international and domestic strategies have also been established on a situational basis. Examples of these “hybrid tribunals” are found in Sierra Leone, Lebanon, East Timor, and Cambodia.

PERFECTO YASAY PRESSCON ON THE RULING OF PERMANENT COURT OF ARBITRATION ON THE WEST PHILIPPINE SEA CASE The Tribunal issued its Award Tuesday after several months of hearings and submission of documents. China was absent throughout the proceedings, refusing to recognize the case. “The Tribunal concluded that there was no legal basis for China to claim historic rights to resources within the sea areas falling within the ‘nine-dash line.’” the statement said. “Having found that none of the features claimed by China was capable of generating an exclusive economic zone, the Tribunal found that it could—without delimiting a boundary—declare that certain sea areas are within the exclusive economic zone of the Philippines, because those areas are not overlapped by any possible entitlement of China,” it added. BACKSTORY: The heart of the dispute over the West PH Sea The Tribunal also said that China has violated Philippine sovereign rights. “Having found that certain areas are within the exclusive economic zone of the Philippines, the Tribunal found that China had violated the Philippines’ sovereign rights in its exclusive economic zone by (a) interfering with Philippine fishing and petroleum exploration, (b) constructing artificial islands and (c) failing to prevent Chinese fishermen from fishing in the zone,” the tribunal statement said. “The Tribunal further held that Chinese law enforcement vessels had unlawfully created a serious risk of collision when they physically obstructed Philippine vessels,” it said. The Spratly Islands and its many reefs are being claimed by China under its “nine-dash line” claim that covers nearly the entire South China Sea including parts of the Philippines’ Exclusive Economic Zone (EEZ). China insists it has “historic rights” in asserting its ownership of the region believed to be rich in natural gas resources and also a vital trade route for international cargo ships. Philippines filed its case in January 2013 following a tense standoff between Chinese and Philippines ships at Scarborough shoal in April 2012. Since the initiation of the arbitration case, China has conducted several massive reclamation projects to turn submerged reefs into artificial islands capable of hosting military structures and equipment. Ji Myung-kil provides a closer look at the first ruling on the cluster of overlapping claims in the disputed region by an international court, as well as China's anger-charged response.
The Permanent Court of Arbitration based in the Hague ruled in favor of the Philippines and concluded that China has no legal basis to claim historic rights to resources within the South China Sea.
The Philippines welcomed the landmark decision.
"The Philippines strongly affirms its respect for this milestone decision as an important contribution to ongoing efforts in addressing ongoing efforts in addressing disputes in the South China Sea."
China published a map in 1947 which outlined its claims to the South China Sea -- the basis of its so-called "nine-dash line" -- stretching 3-point-5 million square kilometers from China's southern coast.
The arbitration court said China had interfered with traditional Philippine fishing rights at Scarborough Shoal and breached the Philippines' sovereign rights by exploring for oil and gas near the Reed Bank.
But China refuses to acknowledge the tribunal's ruling.
"I should say the so-called arbitral tribunal was based on the illegal action and claim of the Philippines from the very onset. So its very existence is not legitimate."
Manila asked the court to mediate on the rights it has to the disputed waters under the United Nations Convention on Law of the Sea in 2013.
Experts said the ruling will have deep implications.
"This is an absolutely huge decision, it doesn't come as a complete surprise but to have the international court rule on the illegitimacy of the Nine-dotted line is a huge development."
Although the international tribunal ruled in favor of the Philippines, the court has no mechanism to enforce the decision, be it through military action or economic sanctions.
But analysts predict the ruling could prompt other neighboring countries like Taiwan, Malaysia, Vietnam and Brunei to file similar claims,... putting increased diplomatic pressure on Beijing to reduce its presence in the South China Sea.

The importance of international law rises in the wake of the Bush administration.
Question: How effective is the ICJ?Kal Raustiala: We've had a mixed record with it so- but the ICJ- the problem with the ICJ is it's effective at certain things. What it tends to do, kind of the bread and butter, would be a territorial dispute about where the border is and a river between two countries, and what you kind of need in that situation is just a neutral arbiter. You need someone to come in and for domestic political reasons maybe you don't want to give up this little island that somebody else is claiming, and the ICJ is very good at sort of just drawing a line and making a decision that seems neutral and acceptable to both sides. The problem with the ICJ is when it wades in to more controversial issues so recently it had a decision about the wall in Israel, it had a decision about nuclear weapons a few years ago, and it tends to have a hard time with those decisions. And so for that reason it's not as effective. It lacks some of the enforcement powers that we might want. You might compare the World Trade Organization's court, the appellate body, so that court is considered to be more effective in part because it has at its disposal enforcement measures and it's got a pretty good compliance record. So when it hands down a ruling and it says to even the United States, "You're violating a law," usually those countries comply. So not all international courts are the same and I'd say the ICJ is good at certain things, not everything.
Question: What's your advice regarding the Rome Statute?Kal Raustiala: It's a difficult question because the U.S. does have a unique role in the world and we are far and away the most powerful military power and we are very much viewed as the country that's going to- when there is something happening, a genocide unfolding, we have the capacity to act. We don't always act but we have the capacity to act and people do look to us to play that role so we do have some unique concerns that other countries don't necessarily have. That said, the ICC is widely accepted around the world and I think it would go a long way-- I think many of the concerns against the ICC, the idea that there's going to be a rogue prosecutor who will go after American service- or that we need-- Congress passed this law, the Hague Invasion Act, so if any American ends up in the brig of the ICC we're authorized to go in and invade the Netherlands and get them out. I think those kind of fantasies are really unfounded and so far the ICC has been very cautious. And I think it's again a mostly symbolic issue for us to join because I don't see-- The ICC's principle is that if a country tries in good faith its own soldiers the ICC won't step in and we have a well-functioning military justice system. So I don't imagine the ICC ruling over Americans but I think symbolically it'd be hugely important and particularly after the Bush administration's last seven plus years of being seen as a rejectionist of every international initiative, pulling out of the ABM Treaty, unsigning the International Criminal Court Rome Statute, denigrating the Kyoto Protocol. We've lost so much good will, and remember after World War II we were really the architects of this international system. We've lost so much of that that I think these symbolic steps like signing the Rome Statute would go a long way towards restoring our- I think our traditional image in the world, which is tarnished at this point.

The Tribunal issued its Award Tuesday after several months of hearings and submission of documents. China was absent throughout the proceedings, refusing to recognize the case.
“The Tribunal concluded that there was no legal basis for China to claim historic rights to resources within the sea areas falling within the ‘nine-dash line.’” the statement said.
“Having found that none of the features claimed by China was capable of generating an exclusive economic zone, the Tribunal found that it could—without delimiting a boundary—declare that certain sea areas are within the exclusive economic zone of the Philippines, because those areas are not overlapped by any possible entitlement of China,” it added.
BACKSTORY: The heart of the dispute over the West PH Sea
The Tribunal also said that China has violated Philippine sovereign rights.
“Having found that certain areas are within the exclusive economic zone of the Philippines, the Tribunal found that China had violated the Philippines’ sovereign rights in its exclusive economic zone by (a) interfering with Philippine fishing and petroleum exploration, (b) constructing artificial islands and (c) failing to prevent Chinese fishermen from fishing in the zone,” the tribunal statement said.
“The Tribunal further held that Chinese law enforcement vessels had unlawfully created a serious risk of collision when they physically obstructed Philippine vessels,” it said.
The Spratly Islands and its many reefs are being claimed by China under its “nine-dash line” claim that covers nearly the entire South China Sea including parts of the Philippines’ Exclusive Economic Zone (EEZ).
China insists it has “historic rights” in asserting its ownership of the region believed to be rich in natural gas resources and also a vital trade route for international cargo ships.
Philippines filed its case in January 2013 following a tense standoff between Chinese and Philippines ships at Scarborough shoal in April 2012.
Since the initiation of the arbitration case, China has conducted several massive reclamation projects to turn submerged reefs into artificial islands capable of hosting military structures and equipment.
China’s reclamation activities have alarmed other Southeast Asian nations, particularly Vietnam, that also have competing claims in the South China Sea.

On 9 March 2012, five judges of the International Criminal Court (ICC) were sworn in at a ceremony held at the seat of the Court in The Hague. Judges Howard Morrison (United Kingdom), Anthony T. Carmona (Trinidad and Tobago), Olga Herrera Carbuccia (Dominican Republic), Robert Fremr (Czech Republic) and Chile Eboe-Osuji (Nigeria) were elected at the latest session of the Assembly of States Parties to the Rome Statute (ASP) in December 2011 for nine-year terms. Judge Miriam Defensor-Santiago (Republic of the Philippines), who was also elected in December 2011, was unavailable due to personal circumstances. On 9 March 2012, five judges of the International Criminal Court (ICC) were sworn in at a ceremony held at the seat of the Court in The Hague. Judges Howard Morrison (United Kingdom), Anthony T. Carmona (Trinidad and Tobago), Olga Herrera Carbuccia (Dominican Republic), Robert Fremr (Czech Republic) and Chile Eboe-Osuji (Nigeria) were elected at the latest session of the Assembly of States Parties to the Rome Statute (ASP) in December 2011 for nine-year terms.
Judge Miriam Defensor-Santiago (Republic of the Philippines), who was also elected in December 2011, was unavailable due to personal circumstances. The solemn undertaking for her will take place at a later date.
In accordance with article 45 of the Rome Statute, founding treaty of the ICC, the ceremony was held in open court. Each judge made a solemn undertaking before the President of the ASP, H.E. Tiina Intelmann, stating: "I solemnly undertake that I will perform my duties and exercise my powers as a judge of the International Criminal Court honourably, faithfully, impartially and conscientiously, and that I will respect the confidentiality of investigations and prosecutions and the secrecy of deliberations".
