Arson^[1] is the crime of intentionally or maliciously lighting structures, wildland areas,^[2] cars^[3][4] or other property on fire. It may be distinguished from other causes such as spontaneous combustion and natural wildfires. Arson often involves fires deliberately set to the property of another or to one's own property as to collect insurance compensation.^[5]

Arson has four elements.

The elements are:

1. The malicious
2. burning
3. of the dwelling
4. of another

The malicious - for purposes of common law arson "malicious" means action creating a great risk of a burning. It is not required that the defendant acted intentionally or willfully for the purpose of burning a dwelling.

burning - at common law charring to any part of dwelling was sufficient to satisfy this element. No significant amount of damage to the dwelling was required. On the other hand mere discoloration from smoke was insufficient. Actual damage to the material from which the structure was built is required.^[6] Damage to surface coverings such as carpets and wallpaper is insufficient.^[6] Arson was not limited to the burning of wooden structures. Any injury or damage to the structure caused by exposure to heat or flame is sufficient.

of the dwelling - dwelling means a place of residence. The destruction of an unoccupied building was not considered as arson, "[s]ince arson protected habitation, the burning of an unoccupied house did not constitute arson." At common law a structure did not become a residence until the first occupants had moved in and ceased to be a dwelling if the occupants abandoned the premises with no intention of resuming their residency.^[7] Dwelling includes structures and outbuildings within the curtilage.^[8] Dwellings were not limited to houses. A barn could be the subject of arson if it was occupied as a dwelling.

of another - burning one's own dwelling does not constitute common law arson. However, for purposes of common law arson possession or occupancy rather than title determines whose dwelling the structure is.^[8] Thus a tenant who sets fire to his rented house would not be guilty of common law arson,^[8] while the landlord who set fire to a rented dwelling house would be guilty.

Furthermore, "[t]he burning of one's own dwelling to collect insurance did not constitute common law arson. It was generally assumed in early England that one had the legal right to destroy his own property in any manner he chose."^[9]

United States[link]

In the U.S., the common law elements of arson are often varied in different jurisdictions. For example, the element of "dwelling" is no longer required in most states, and arson occurs by the burning of any real property without consent or with unlawful intent.^[10] Arson is prosecuted with attention to degree of severity^[11] in the alleged offense. First degree arson^[12] generally occurs when persons are harmed or killed in the course of the fire, while second degree arson occurs when significant destruction of property occurs.^[13] While usually a felony, arson may also be prosecuted as a misdemeanor,^[14] "criminal mischief", or "destruction of property."^[15] Burglary also occurs, if the arson involved a "breaking and entering".^[16] A person may be sentenced to death if arson occurred as a method of homicide, as was the recent case in California of Raymond Lee Oyler and in Texas of Cameron Willingham.

Some states, such as California, prosecute the lesser offense of "reckless burning" when the fire is set recklessly as opposed to willfully and maliciously.^[17] The study of the causes is the subject of fire investigation.

England and Wales[link]

In English law, arson was a common law offence^[18] dealing with the criminal destruction of buildings by fire. The offence was abolished by the S.11(1) Criminal Damage Act 1971.^[19]. The 1971 Act makes no general distinction as to the mode of destruction except that s.1(3) requires that if the destruction is by fire then the offence will be charged as arson; s.4 of the Act provides a maximum penalty of life imprisonment for conviction under s.1 whether or not the offence is charged as arson.

Scotland[link]

Scotland has no offence known as arson. Events constituting arson in English Law might be dealt with as one or more of a variety of offences such as Wilful Fire-Raising, Culpable and Reckless Conduct, Vandalism or other offences depending on the circumstances of the event. The more serious offences (in particular Wilful Fire-raising and Culpable and Reckless Conduct) can incur a sentence of life imprisonment.

Young Yonny has been producing music since 2005 for major Hip-Hop and R&B artists such as Lil Mo, Trina,^[1] Lil Wayne, Rick Ross,^[2] Trey Songz and many more. His first major placement was with Lil Wayne, on his multi platinum album: Tha Carter II.^[3] In the same year he teamed up with duo 216 (also Cleveland natives) to produce “U Should Know” which landed a spot on the soundtrack for MTV Films highest grossing film, The Longest Yard.

In 2007 Young Yonny signed a publishing deal with Royalty Network and appeared on BET's 106&Park, as a guest judge for Freestyle Friday

In 2009 Young Yonny produced^[4] Trey Songz "Say Aah" featuring Fabolous (Asst.by Troy Taylor). The fourth single from the Grammy Nominated album Ready,was released in January 2010, "Say Aah" gained Trey Songz his first Top 40 record off of Ready; reaching #9 on the Hot 100 and #3 on the Hot R&B/Hip-Hop Songs chart. “Say Aah” climbed the Billboard Charts (Hot 100, R&B and Radio). The music video for "Say Aah" was featured on MTV2 as Jam of the Week. The single has received platinum standing and is Trey Songz highest charting single on the Hot 100 and one of his most successful singles on the Hot R&B/Hip-Hop Songs chart.

George Celino Barnes (July 18, 1895 – July 18, 1954), better known as "Machine Gun Kelly", was an American gangster during the prohibition era.^[1][2] His nickname came from his favorite weapon, a Thompson submachine gun. His most famous crime was the kidnapping of oil tycoon and businessman Charles Urschel in July 1933 for which he, and his gang, earned $200,000 ransom. Unfortunately, their victim had collected and left considerable evidence that assisted the subsequent FBI investigation that eventually led to Kelly's arrest in Memphis, Tennessee on September 26, 1933.^[2] His crimes also included bootlegging and armed robbery.

Career[link]

During the Prohibition era of the 1920s and 1930s Kelly worked as a bootlegger for himself as well as a colleague. After a short time, and several run-ins with the local Memphis police, he decided to leave town and head west with his girlfriend. To protect his family and escape law enforcement officers, he changed his name to George R. Kelly.^[3] He continued to commit smaller crimes and bootlegging. He was arrested in Tulsa, Oklahoma, for smuggling liquor onto an Indian Reservation in 1928 and sentenced for three years to Leavenworth Penitentiary, Kansas, beginning February 11, 1928. He was reportedly a model inmate and was released early. Shortly thereafter, Kelly married Kathryn Thorne, who purchased Kelly’s first machine gun and went to great lengths to familiarize his name in the underground crime circles. She was known to hand out the expended .45cal cartridge casings from his Tommy Gun as souvenirs. Some historians claim that Kathryn even went so far as to plot some small bank robberies.^{[citation needed]}

Nonetheless, Kelly’s last criminal activity proved disastrous when he kidnapped a wealthy Oklahoma City resident, Charles F. Urschel and his friend Walter R. Jarrett. Urschel, having been blindfolded, made sure to foil his kidnappers by noting all possible evidence of his experience such as background sounds, counting footsteps and leaving fingerprints on every surface in reach. This in turn proved invaluable for the FBI in their investigation, as they learned that Urschel had been held in Paradise, Texas.

An investigation conducted at Memphis disclosed that after 56 days on the run, the Kellys were staying at the residence of J.C. Tichenor. Special Agents from Birmingham, Alabama, headed by Special Agent in Charge, William "ash" Rorer, were immediately dispatched to Memphis on the orders of J. Edgar Hoover, where, in the early morning hours of September 26, 1933 a raid was conducted, led by agent Rorer. George and Kathryn Kelly were taken into custody and Memphis police officers Sergeant William Raney and officer Thomas Waterson. Caught without a weapon, George Kelly supposedly cried, "Don’t shoot, G-Men! Don’t shoot, G-Men!" as he surrendered to FBI Agents. The term (which had applied to all federal investigators, meaning simply 'Government Men') became synonymous with FBI Agents. Reports of the raid, however, indicate that George Kelly came to the door, dropped his pistol and said, "Okay, boys, I’ve been waiting for you all night." Recent research revealed a 1933 newspaper interview with one of the federal agents at the arrest. He commented that, upon their arrest, Kathryn Kelly put her arms around George and said, "These G-men will never leave us alone." The FBI press machine generated the G-Man story to build its own reputation.^[4] The arrest of the Kellys, however, was overshadowed by the escape of John Dillinger's gang from Michigan City, Indiana.

In October 1933, George and Kathryn Kelly were convicted and sentenced to life imprisonment. The trial was held at the Post Office, Courthouse and Federal Office Building in Oklahoma City. Kathryn Kelly and her mother had all charges dropped and were released in 1958 from prison in Cincinnati.

The kidnapping of Urschel and the two trials that resulted were historic in several ways: 1) they were the only federal criminal trials in the United States in which moving cameras were allowed to film; 2) the first kidnapping trials after the passage of the so-called Lindbergh Law, which made kidnapping a federal crime; 3) the first major case solved by J. Edgar Hoover’s evolving and powerful FBI. For that, Kelly got sent into Alcatraz; 4) the first crime in which defendants were transported by airplane. At the time, it was the largest ransom ever paid in the United States.

Machine Gun Kelly spent his remaining 21 years in prison. During his time at Alcatraz he got the nickname "Pop Gun Kelly." This was in reference, according to a former prisoner, to the fact that Kelly was a model prisoner and was nowhere near the tough, brutal gangster his wife made him out to be. He spent 17 years on Alcatraz, working in the prison industries, and was quietly transferred back to Leavenworth in 1951. He died of a heart attack at Leavenworth Federal Prison, Kansas on July 18, 1954, his 59th birthday. He is buried at Cottondale Texas Cemetery with a small headstone marked "George B. Kelley 1954".^[5]

Arsonists Get All the Girls is an American deathcore band from Santa Cruz, California. Founded in 2005, they are currently signed to Century Media Records and have recorded and released four full-length studio albums, Hits from the Bow, The Game of Life, Portals and Motherland.

Biography[link]

Arsonists Get All the Girls was founded in Santa Cruz, California during mid-2005, originally as a joke band between friends. The band first wanted to develop a sound similar to Horse the Band. In November 2007, bassist Patrick Mason died of alcohol poisoning.^[1]

Arsonists Get All the Girls have toured with Darkest Hour, Carnifex, and Bleeding Through, among others, in the Thrash and Burn European Tour 2009 in April and May 2009 in Europe, spanning regions from Germany, Poland, the Czech Republic, Hungary, Austria, Italy, Switzerland, Spain, France and England. They have close ties with fellow bands Tony Danza Tap Dance Extravaganza, Heavy Heavy Low Low, Despised Icon, Impending Doom, Knights of the Abyss and Elysia.

Death of Patrick Mason[link]

On the morning of November 30, 2007, the day after his 21st birthday, bassist Patrick Mason was found dead in a friend's house. He died from alcohol poisoning. The band posted a note on their MySpace profile^[2][3]:

"We can't describe the pain and sorrow that we all are feeling right now. Last night/early this morning our bassist, Pat Mason, passed away. Pat was an amazing person and brother to all of us. It was his 21st birthday and we all got to see him at band practice. He then proceeded to go out to the bars. He went to sleep at a friend's house. We don’t know the full details but when friends tried to wake him up this morning he didn’t wake up. We could never trade him for the world and could never replace him. We will always love him and will always be in our hearts. We are going to continue with the band cause that is what Pat would have wanted. There will be a donation account set up soon for his family and possibly a local benefit show as well. Thanks for everyone for the support that the band has since the beginning. We love you all and Pat loves you all as well."

Departure of vocalist Cameron Reed[link]

The band had this to say: "If anyone has seen us in the past couple of months you may have noticed that we have a new vocalist. We would like to welcome Jared Monnette to the band, but first we must address the departure of Cameron Reed. Cameron decided to leave the band shortly after recording vocal tracks and prior to a Mexican tour, his explanation being God told him to leave the band because he was acting selfishly and wasn’t putting enough time into focusing on God. This put us in a really rough situation, in which we decided to go on the Mexico tour without a vocalist.. Guitarist Derek Yarra stepped up to vocal duties for the Mexico tour and honestly, it couldn’t have gone better due to the situation at hand. While on tour in Mexico we were overlooking our options for a new vocalist where Sean recommended former band mate Jared Monnette. Within three days Jared had written lyrics and had sent us a rough vocal track of one of the new songs, and we were completely blown away! We couldn’t have been more satisfied with his voice over the new material. He is definitely the new voice of AGATG and is a perfect match for the direction we were going musically. We headed back into the studio to lay down the new vocal tracks, and it went wonderfully! The new CD entitled “Portals” is due to hit stores July 14. We can’t wait for everyone to hear this record, old and new fans alike. We feel that the planets have aligned and that they helped us create the best album we have written, and definitely not the last. This is only the beginning, so get ready for this! Listen to the new record whether you like us or not, there will be something for you! "

Between the Buried and Me is an American heavy metal band from Raleigh, North Carolina. They have released a total of five studio albums, as well as a cover album, an EP and a live DVD/CD. A majority of the group's releases were made through Victory Records, until their shift to Metal Blade in 2011 where they released their first EP, The Parallax: Hypersleep Dialogues through the label on April 12, 2011.

Biography[link]

Between the Buried and Me was founded in 2000 in Raleigh, North Carolina by vocalist Thomas Giles Rogers Jr., guitarist Paul Waggoner, drummer Will Goodyear, guitarist Nick Fletcher (formerly of Empire Falls), and bassist Jason King. The band's name is derived from a section of lyrics in the Counting Crows song, "Ghost Train;" "Took the cannonball down to the ocean/Across the desert from the sea to shining sea/I rode a ladder that climbed across the nation/Fifty million feet of earth between the buried and me."^[1]

Between the Buried and Me's first release was a three-song demo, containing the tracks "Use of a Weapon", "What We Have Become", and "More of Myself to Kill". These three tracks were re-recorded for the band's self-titled debut album, released through Lifeforce Records in 2002. The album includes the track "Arsonist", a protest against the beliefs and practices of the Westboro Baptist Church in Topeka, Kansas. The song "Aspirations" became the band's first music video. At the time, the release was not widely known, but did manage to catch the attention of Victory Records, to which they later signed. Victory reissued the album in 2004 as an enhanced CD. Today, songs from the album are rarely played live.

In 2003, the band released their second studio album, The Silent Circus, featuring the singles "Mordecai", "Aesthetic", and "Camilla Rhodes".^[2] "Mordecai" was produced as their second music video. The album was re-released in 2006 with a live DVD of the band's performance at The Cat's Cradle in Chapel Hill, North Carolina on July 17, 2005. Mark Castillo played drums on The Silent Circus, replacing Will Goodyear, though for the live DVD Blake Richardson, Dustie Waring, and Dan Briggs had already joined the band, and recording for the third Between the Buried and Me album, Alaska, was already finished.

After the release of The Silent Circus, the band went through numerous members before the current lineup was assembled for Alaska. On drums, Mark Castillo was replaced by Jason Roe, and later by Blake Richardson. On guitar, Nick Fletcher was replaced by Shane Blay, and later by Dustie Waring. And on bass, Jason King (not to be confused with their engineer/producer Jamie King) was replaced by Kevin Falk, and later by Dan Briggs. This remains the current lineup.

In the summer of 2005, Between the Buried and Me released their third studio album, Alaska. The title track "Alaska" became their third music video. The album released the songs "Selkies: The Endless Obsession", "The Primer", and "Backwards Marathon" as singles. Then in the following year, the band released The Anatomy Of, a collection of covers of bands that influenced Between the Buried and Me, including Metallica, King Crimson, Pantera, Queen, Pink Floyd, Earth Crisis, Counting Crows, and Soundgarden.

In September 2007, the band released their fourth studio album, Colors. Band members have said that "it's a 65 minute opus of non stop pummeling beautiful music... we have described this release as 'new wave polka grunge'."^[3] The band has also described the album as "adult contemporary progressive death metal".^[4]

On November 6, 2008 the song "Prequel to the Sequel" was made available as downloadable content for the video game Rock Band 2, for free download to users who redeemed a one-time use code in new copies of the game.^[5] Since then, the tracks "Mordecai", "Obfuscation", "Alaska" and "Selkies: The Endless Obsession" have also been made available via the Rock Band Network.

On May 31, 2009, the group went into the studio to record their fifth original album, The Great Misdirect. They have described one song as having "a noisy Coalesce breakdown, 3/4 Mastodon groove, 9/8 The Mars Volta, Queen chromatic build up, and Megadeth chorus".^[6] Tommy Giles Rogers had stated that they planned to "out do Colors".^[7]

In early fall 2010, the group confirmed that they were recording an EP, which was cited as being a possible precursor for their next full-length album.^[8] In October 2010, they put up a video on their YouTube account with the band in the studio.^[9] January 18 a second teaser with them in the studio was posted.^[10]

On February 21, 2011, Between the Buried and Me stated their move from Victory to Metal Blade Records, on which they released their EP entitled, The Parallax: Hypersleep Dialogues on April 12, 2011.^[11] In May, Victory Records announced the release of a greatest hits album as a three-disc set.^[12] On January 16, 2012, Between the Buried and Me revealed that work on the part two to The Parallax has begun and it will be a full-length album rather than an EP.^[13]

In early 2006, Between the Buried and Me was on tour supporting Bleeding Through along with Every Time I Die and Haste the Day. They were also on the Ozzfest 2006 Second Stage.^[14] In late 2006, they were on the Radio Rebellion Tour headlined by Norma Jean.^[15]

In September 2007, after the release of Colors, the band went on tour with Animosity and Horse the Band. Giant (now known as BraveYoung) also supported their shows in the USA. The run concluded with their November 4 appearance at the Saints and Sinners Fest in Asbury Park, New Jersey. In December 2007, they again embarked on a headlining tour, supported by August Burns Red and Behold... The Arctopus. The band were also the main support on The Dillinger Escape Plan's 2008 U.K. tour. Between the Buried and Me were one of the acts that took part at "Progressive Nation '08", the first in what became an annual progressive music festival, also featuring Dream Theater, Opeth, and 3.

Starting in summer 2008 and continuing in the fall, they performed as a supporting act for Children of Bodom's US headlining tour, alongside The Black Dahlia Murder. In early December 2008, they went on a short 4-show tour around the Carolinas and Georgia (US) with other Carolina-based bands, such as He Is Legend, Advent, and Nightbear. Between the Buried and Me finished a month-long tour of Australia on January 9 with headliners Bleeding Through, As Blood Runs Black, In Trenches and The Abandonment. In September 2009, Between the Buried and Me performed a Canadian Tour with Killswitch Engage and In Flames co-headlining, along with the support of Protest the Hero.^[16]

In early 2010, Between the Buried and Me toured across North America with Cynic, Devin Townsend, and Scale the Summit.^[17] Afterwards, they traveled to Europe supporting Lamb of God, along with Job for a Cowboy and August Burns Red.

In February 2010, Between the Buried and Me supported Mastodon along with Baroness on their US headlining tour. During the summer of 2010, they were on the Cool Tour with As I Lay Dying, Underoath, War of Ages, The Acacia Strain, Architects, Cancer Bats and Blessthefall.^[18]

In February 2011, Between the Buried and Me were confirmed to play at the New England Metal & Hardcore Festival on Saturday, April 16 in Worcester, MA. They will be main support for Hatebreed. In April and May 2011 they will headline a tour featuring Job for a Cowboy, The Ocean and on select dates Cephalic Carnage.

Between the Buried and Me also announced a headline European tour beginning in Paris, France on 02 Sept 2011 and continuing throughout the mainland and into the UK, ending up in Moscow, Russia on September 30. The tour was be supported by Animals as Leaders.

In July 2011, Between the Buried and Me announced their headlining North American tour, "Saints&Sinners Tour" playing throughout November and December with Animals as Leaders and Tesseract. The band created a few medleys just for this tour, and performed songs that they hadn't played in years.

They are confirmed to play on the 2012 Summer Slaughter tour with bands like Cannibal Corpse, Periphery, and Job For A Cowboy.

Musical style and influence[link]

Between the Buried and Me's general musical style has been stated by critics to be primarily a blend of metalcore,^[19] progressive metal^[19] and death metal,^[19][20][21] along with various musical styles: "One minute the band may be playing thrash metal and the next they're flowing into death metal growls and thick guitar riffs... the metal take on things can seemingly change in a flash as lead singer Tommy Rogers flashes out his vocals and utilizes the keyboards to create something that sounds more like it should be on a Smashing Pumpkins album".^[22]

On the band's cover album, The Anatomy Of, the band pays tribute to many of their diverse influences, including Metallica, Queen, King Crimson, Soundgarden, Pantera, Pink Floyd, Earth Crisis, and The Smashing Pumpkins.^[23]

• Tommy Giles Rogers has an electronica side project named Giles. A music video for the song "Slumber Party" is featured on the DVD that is included on the re-release for Between the Buried and Me's second album The Silent Circus. Rogers also released a solo album on February 1, 2011, entitled Pulse. The album is credited under the name Thomas Giles.
• Dustie Waring and Blake Richardson are members of the deathcore band Glass Casket.
• Rogers and Jacob Troth run a clothing line named Jacob Rogers.
• Dan Briggs and members of Fear Before and Abigail Williams are members of an experimental supergroup named Orbs.
• Will Goodyear is now the drumline instructor for the East Carolina University Marching Pirates.^[24]
• Shane Blay is now in the Christian metalcore band Oh, Sleeper.
