Tribunal Practice and Procedure by Edward Jacobs
THE FIRST LEGAL TEXT TO COVER THE INTEGRATED TRIBUNAL SYSTEM CREATED BY THE TRIBUNALS, COURTS AND ENFORCEMENT ACT 2007
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers
If youve ever contemplated appearing before a tribunal, or you represent professionally those who do, this book is essential reading.
Accounting for more than 500,000 cases a year, (as pointed out in Sir Andrew Leggatts Report of 2001) tribunals play an important role in the UK justice system, which is why Leggatt called for a harmonization of the disparate sets of rules governing different tribunals. His recommendations led to the creation of a Tribunal Service in 2006, now a part of the Ministry of Justice, and the enactment of a flexible legislative framework in the Tribuna...

His recommendations led to the creation of a Tribunal Service in 2006, now a part of the Ministry of Justice, and the enactment of a flexible legislative framework in the Tribunal Courts & Enforcement Act 2007.
The author, Edward Jacobs is one of the founding judges of the Upper Tribunal assigned to the Administrative Appeals Chamber. Published by the admirable Legal Action Group (LAG) his book is the first to cover the integrated system created by the Act. Commenting in the foreword, Robert Carnwath, Senior President of Tribunals remarks that Jabobs new work seems destined to make a major contribution to achieving improved substantive coherence for the legal framework within which tribunals operate.
True to the LAGs tradition of producing legal reference books embodying rigorously high standards of research as well as practicality and ease of use, this book approaches the procedure and practice of tribunals logically, examining the context of the nature of tribunals and their jurisdiction, as well as proceedings. Tribunals differ from courts, says the author, but the essential nature of different types of proceedings does not. Nor do the basic principles of procedure. This book, he continues, seeks to identify the general principles that unite proceedings and the rules of procedure for both courts and tribunals and across jurisdictions.
So, whether you are a tribunal judge, a member of a tribunal panel, a representative, or someone who will appear before a tribunal, this book will forewarn and forearm you for the possible confrontations that can occur.
Presented in a logical, readable way, the contents offer entirely practical advice, including an introduction to the Tribunals Service, and reviewing the following content:
jurisdiction, procedure, appeals, referrals, judicial review and ADR, proceedings, hearings, representatives, tribunal advocacy, evidence, findings, disposal, precedent and decisions.
If you have little, or limited access to law reports, the book contains particularly useful appendices which include the full text of the Tribunals, Courts and Enforcement Act 2007 and the Tribunal Procedure (Upper Tribunal) Rules 2008 as amended.
Although the book was sent to the publishers in late July 2009, some later developments have also been incorporated to make this work the first legal text to cover the new legislation in such useful detail.
