Wrongful death is a claim against a person who can be held liable for a death. The claim is brought in a civil action, usually by close relatives, as enumerated by statute. Under common law, a dead person cannot bring a suit, and this created a loophole in which activities that resulted in a person's injury would result in civil sanction but activities that resulted in a person's death would not.
The standard of proof in the United States is typically preponderance of the evidence as opposed to clear and convincing or beyond a reasonable doubt. In Australia and the United Kingdom, it is 'on the balance of probabilities'. For this reason it is often easier for a family to seek retribution against someone who kills a family member through tort than a criminal prosecution. However, the two actions are not mutually exclusive; a person may be prosecuted criminally for causing a person's death (whether in the form of murder, manslaughter, criminally negligent homicide, or some other theory) and that person can also be sued civilly in a wrongful death action (as in the O.J. Simpson murder case). Wrongful death is also the only recourse available in the United States when a company, not an individual, causes the death of a person; for example, historically, families have tried (both successfully and unsuccessfully) to sue tobacco companies for wrongful deaths of their customers.

In the 2000s, he gained further recognition for his portrayal of the Grinch in How the Grinch Stole Christmas (2000), as well as Bruce Almighty (2003), Eternal Sunshine of the Spotless Mind (2004), Lemony Snicket's A Series of Unfortunate Events (2004), Fun with Dick and Jane (2005), Yes Man (2008), Horton Hears a Who! (2008) and A Christmas Carol (2009).
Paul William Walker IV (September 12, 1973 – November 30, 2013) was an American actor. Walker began his career guest-starring in several television shows such as The Young and the Restless and Touched by an Angel. Walker gained prominence with breakout roles in coming-of-age and teen films such as She's All That and Varsity Blues. In 2001, Walker gained international fame for his portrayal of Brian O'Conner in the street racing action film The Fast and the Furious, and would reprise the role in five of the next six installments. He also starred in films such as Eight Below, Timeline, Into the Blue, Joy Ride and Running Scared.
Besides acting, Walker was the face of The Coty Prestige fragrance brand Davidoff Cool Water for Men, and starred in the National Geographic Channel series, Expedition Great White. He also founded the charity "Reach Out Worldwide" (ROWW), an organization providing relief efforts for areas affected by natural disasters. He was often praised for his off-screen charity work, and as a performer.

Leaked footage from a police shooting in Fayetteville, North Carolina has stirred up controversy in the case of Officer Aaron Hunt, who shot and killed 22-year-old Nijza Lamar Hagans in January of 2013. The footage shows Hunt fire shots, four of which hit Hagans, while he was trying to escape. Hagans was armed with a loaded .380 pistol, and an autopsy uncovered small baggies of crack cocaine in his sock. The initial police report groups the officer's five shots together, but the footage clearly shows that the first three shots were fired immediately as Hagans exited the vehicle. The two subsequent shots that Hunt fired into Hagans' back were not mentioned in the report that cleared Hunt of any wrongdoing. A San Diego family plans to file a wrongful death lawsuit, claiming MTS employees did not do enough to help their dying son. Video shows the last minutes of the man's life, as passengers alert the bus driver of his sickness. MTS employees continue to walk by the man, electing to not call 9-1-1 for nearly 15 minutes.
