R (on the application of Wang Yam) (Appellant) v Central Criminal Court and another (Respondents)
On appeal from the High Court (Queen’s Bench Division)
The appellant was charged with murder in 2007. At trial, the prosecution successfully applied to the Judge, Ouseley J, for large parts of the case to be heard ‘in camera’ (closed hearing). The appellant's attempt to appeal the Order to the Court of Appeal was unsuccessful. He was ultimately found guilty of murder and his appeal against conviction was also unsuccessful. He now seeks to make an application to the European Court of Human Rights on the basis that holding parts of his trial in secret was a breach of his rights under art.6 ECHR. In February 2014, Ouseley J refused to vary the Order to permit the appellant to deploy information covered by the Order in his application. The appellant then applied for judicial review of Ouseley J's decision. Permission for judicial review was granted, but the appellant's substantive application was dismissed. The Divisional Court certified a question for a 'leapfrog' appeal in accordance with s.1(2) of the Administration of Justice Act 1960, but refused permission to appeal. The issue before the Supreme Court was whether there is a power under the common law or under s.12 of the Administration of Justice Act 1960 to prevent an individual from placing material before the European Court of Human Rights. If so, whether the power could be exercised where the domestic court is satisfied that it is not in the interests of state for the material to be made public even to the Strasbourg Court.
The Supreme Court unanimously dismisses Wang Yam’s appeal.

Criminal justice
Criminal justice is the system of practices and institutions of governments directed at upholding social control, deterring and mitigating crime, or sanctioning those who violate laws with criminal penalties and rehabilitation efforts. Those accused of crime have some protections against abuse of investigatory and prosecution powers.
Goals
In the United States, criminal justice policy has been guided by the 1967 President's Commission on Law Enforcement and Administration of Justice, which issued a ground-breaking report "The Challenge of Crime in a Free Society". This report made more than 200 recommendations as part of a comprehensive approach toward the prevention and fighting of crime. Some of those recommendations found their way into the Omnibus Crime Control and Safe Streets Act of 1968. The Commission advocated a "systems" approach to criminal justice, with improved coordination among law enforcement, courts, and correctional agencies. The President's Commission defined the criminal justice system as the means for society to "enforce the standards of conduct necessary to protect individuals and the community."

Monty Python
Monty Python (sometimes known as The Pythons) were a British surreal comedy group who created the sketch comedy show Monty Python's Flying Circus, that first aired on the BBC on 5 October 1969. Forty-five episodes were made over four seasons. The Python phenomenon developed from the television series into something larger in scope and impact, spawning touring stage shows, films, numerous albums, several books, and a stage musical. The group's influence on comedy has been compared to The Beatles' influence on music.
Broadcast by the BBC between 1969 and 1974, Flying Circus was conceived, written, and performed by its members Graham Chapman, John Cleese, Terry Gilliam, Eric Idle, Terry Jones, and Michael Palin. Loosely structured as a sketch show, but with an innovative stream-of-consciousness approach (aided by Gilliam's animation), it pushed the boundaries of what was acceptable in style and content. A self-contained comedy team responsible for both writing and performing their work, the Pythons had creative control which allowed them to experiment with form and content, discarding rules of television comedy. Their influence on British comedy has been apparent for years, while in North America, it has coloured the work of cult performers from the early editions of Saturday Night Live through to more recent absurdist trends in television comedy. "Pythonesque" has entered the English lexicon as a result.

Had the pleasure of not Christopher Moss as I made a mistake but actually a new QC Judge that had just started in June 2007 who's responsibility was to take high profile murder cases and serious terrorism cases! His initials are P.W! When the jury believe you and not the victims/witnesses , he gets the right hump and undermines the juror's by abusing his authority and directly insults them!!!! and he gets away with it cause no member of the jury are going to complain are they!!!! I think now he sits in court no, 16! there is only 1 judge with the initials P.W!!!! Trust me....BEWARE!!!! Don't believe me then contact the first 12 Juror's who were at my first trial who were honest and never fell for the court's corruptness!!!...

Speaking on behalf of the Court of Appeal, Mr Justice George Birmingham said it was an “unacceptable strategy” to raise the arguments O’Reilly had raised at this point.
O’Reilly’s application was based on events that occurred on the third day of his Central Criminal Court trial when a portion of the book of evidence was found in the jury room, the judge said.
It was clear, from the way in which the issue was approached by the trial judge and counsel at the time, that O’Reilly was fully informed and fully engaged with what was happening at the time, he said.
Having been so aware and so engaged, to raise the argument now after the trial and after his earlier appeal, was an “unacceptable strategy,” Mr Justice Birmingham said.
Accordingly, Mr Justice Birmingham, who sat with President of the Court of Appeal Mr Justice Sean Ryan and Mr Justice John Edwards, dismissed the appeal.
As a result, O’Reilly’s application under section 2 of the Criminal Procedure Act will not now proceed to full hearing.
Counsel for the Director of Public Prosecutions, Brendan Grehan SC, had asked the Court of Appeal to dismiss O’Reilly’s application as an “abuse of process” because it was not based on any new or newly discovered facts as required under the Act.
On day four of O’Reilly’s trial for murder the court registrar was advised that a portion of the book of evidence had been left in the jury room.
Trial judge Mr Justice Barry White had made it clear, Mr Grehan said, that he would discharge the jury if any of them had read any portion of the book of evidence, otherwise the trial would continue.
The foreman of the jury was then asked whether any juror had read any portion of the book of evidence and his reply was: “not to my knowledge, no”.
Mr Grehan said that exchange took place with 11 jurors, the trial judge, O’Reilly and all counsel present in court.
The suggestion that one of the jurors simply sat there and stayed dumb did not arise because the “eyes of everybody in court” would have been looking at their reactions.
Mr Grehan said O’Reilly met with his legal team before the court sat, he was informed of what had transpired and informed that if any of the jurors had read any part of the book of evidence the jury would be discharged.
