The Secretary of Defense (SecDef) is the head and chief executive officer of the Department of Defense, an Executive Department of the Government of the United States of America. This position corresponds to what is generally known as a Defense Minister in many other countries. The Secretary of Defense is appointed by the President with the advice and consent of the Senate, and is by custom a member of the Cabinet and by law a member of the National Security Council.
Secretary of Defense is a statutory office, and the general provision in 10 U.S.C. § 113 provides that the Secretary of Defense has "authority, direction and control over the Department of Defense", and is further designated by the same statute as "the principal assistant to the President in all matters relating to the Department of Defense." Ensuring civilian control of the military, an individual may not be appointed as Secretary of Defense within seven years after relief from active duty as a commissioned officer of a regular (i.e., non-reserve) component of an armed force.

Robert Michael Gates (born September 25, 1943) is the 24th Chancellor of the College of William and Mary and a retired civil servant and university president who served as the 22nd United States Secretary of Defense from 2006 to 2011. Prior to this, Gates served for 26 years in the Central Intelligence Agency and the National Security Council, and under President George H. W. Bush as Director of Central Intelligence. Gates was also an officer in the United States Air Force and during the early part of his military career, he was recruited by the CIA. After leaving the CIA, Gates became president of Texas A&M University and was a member of several corporate boards. Gates also served as a member of the Iraq Study Group, the bipartisan commission co-chaired by James A. Baker III and Lee H. Hamilton, that has studied the Iraq War. He was also the first pick to serve as the first Director of National Intelligence (DNI), but he declined the appointment in order to remain President of Texas A&M University.

"It was not -- it was not a vital national interest to the United States, but it was an interest and it was an interest for all of the reasons Secretary Clinton talked about. The engagement of the Arabs, the engagement of the Europeans, the general humanitarian question that was at stake," he said.
The Constitution prescribes the rules about how the United States is to enter a war, and the Obama administration has violated those rules.
The administration argues that the hostilities, because limited, do not rise to the level of "war," as the Constitution uses that word. But that position is almost surely wrong: Founding-Era dictionaries and other sources, both legal and lay, tell us that when the Constitution was approved, "war" consisted of any hostilities initiated by a sovereign over opposition.
