You’ve probably seen them before: internal border checkpoint refusals, now a popular YouTube genre. Some are funny. Others are hostile. But for Greg Rosenberg, a naturalized U.S. citizen who speaks accented English, an encounter with South Texas border patrol resulted in weeks of jail time without a single charge being prosecuted.
Rosenberg immigrated to America 10 years ago from Armenia. Memories and family stories of Soviet rule in his country of origin infused him with strong political beliefs and a reverence for individual rights.
"Back then [in Soviet-controlled Armenia], if you complained about the government, they took you to Siberia," says Rosenberg.
So perhaps it’s no surprise that Rosenberg is a checkpoint protester. As a long-haul trucker, he has to drive through these all the time. After all, there are about 170 of them scattered across the United States. And keep in mind, these checkpoints aren’t on an actual border. They just have to be within 100 miles of one. The ACLU estimates that roughly two-thirds of the nation’s population lives within this 100-mile zone.
Rosenberg's ordeal began in the border town of Laredo, TX. He and his friend pulled onto I-35 North at around midnight on September 26 in a truck carrying a load of Xerox machines destined for Ft. Worth. But only 29 miles north of the border, they’d encounter the Laredo North Border Patrol Station. And Greg would undergo a checkpoint interrogation like he’d never experienced before.
"They arrested me for what I looked like, but they pressed the charges because of my beliefs," says Rosenberg.

Thank you in advance:) WARNING!!!! have the volume on low at 0:30 This is an internal U.S. Border Patrol checkpoint on state route 86 about 50 miles from the Mexico border in southern Arizona near the Papago indian reservation. This is a typical BP encounter in which a BP supervisor in this case is less than honest in her statements. I would like to make a disclaimer that NOT all BP agensts I encounter are dishonest. I have met a handful that fully support citizens rights NOT to answer questions from law enforcement and they have my full respect and admiration for keeping their oaths to defend the constitution. I have video of one such individual stating that in fact I do NOT have to answer ANY of their questions. I can't put it up here because they requested I dont and I will honor that request. Know your rights folks and be safe!
Last thought. Notice the male agent who doesnt look very pleased. He also could have easily stated at any point,"hey buddy, the law your looking for is such and such so look it up and learn it, we do this all day so we know that law and thats why I CAN TELL YOU where to find it because I do this all day and I need to know the law that I'm enforcing". Instead of correcting me with FACTS to my questions they....dont.

On 08/09/2014 in Los Angeles, I went through what looked like a construction zone, only to realize it was an unconstitutional checkpoint. I was not drinking or under the influence of anything else. --- more ---
I did not initiate or premeditate this encounter as you can see I started the video documentation AFTER I was already stopped. During and throughout this ordeal you will hear and see the cops making up the “rules” along the way. At first, it was a DUI Checkpoint. If that’s the case, why ask for my Driver License? How does showing a license determine sobriety? Then, it was a DUI/Driver License checkpoint, which is unlawful.
Throughout, I was cool, calm, lucid, and articulate. I properly exercised my right to not answer questions. Note the female cop say I was required to have a California Driver License (without even knowing that I don’t live in California) I was threatened multiple times, NOT with arrest but, damage to my vehicle. I asked numerous times if I was under arrest, of what crime I was being accused of and got no response to my direct and appropriate questions.
After exiting the car on my own, you can see the abuse by the cop who had no reason to lock cuffs on me so tightly I have nerve damage to my left wrist and hand. Hear me ask and them say I was under arrest but not say for what charge. Note the cop belittling me when he says, “Make sure you notify the FAA when you’re convicted of a DUI” (This guy already had me CONVICTED of a DUI during this stop without due process, before a trial, before a conviction).
I spent the night in jail, released the next day with a ticket, being charged with two counts of “Refusing to Comply”, even though I actually did, one count of "Possession of Marijuana", and NO charges for DUI! -- All charges were eventually DISMISSED!
These are bullshit checkpoints, and they know it! Don't fold under their threats!

Top

Note the female cop say I was required to have a California Driver License (without even knowing that I don’t live in California) I was threatened multiple times, NOT with arrest but, damage to my vehicle. I asked numerous times if I was under arrest, of what crime I was being accused of and got no response to my direct and appropriate questions. After exiting the car on my own, you can see the abuse by the cop who had no reason to lock cuffs on me so tightly I have nerve damage to my left wrist and hand. Hear me ask and them say I was under arrest but not say for what charge. Note the cop belittling me when he says, “Make sure you notify the FAA when you’re convicted of a DUI” (This guy already had me CONVICTED of a DUI during this stop without due process, before a trial, before a conviction). I spent the night in jail, released the next day with a ticket, being charged with two counts of “Refusing to Comply”, even though I actually did, one count of "Possession of Marijuana", and NO charges for DUI! -- All charges were eventually DISMISSED! These are bullshit checkpoints, and they know it! Don't fold under their threats! -

Rosenberg immigrated to America 10 years ago from Armenia. Memories and family stories of Soviet rule in his country of origin infused him with strong political beliefs and a reverence for individual rights.
"Back then [in Soviet-controlled Armenia], if you complained about the government, they took you to Siberia," says Rosenberg.
So perhaps it’s no surprise that Rosenberg is a checkpoint protester. As a long-haul trucker, he has to drive through these all the time. After all, there are about 170 of them scattered across the United States. And keep in mind, these checkpoints aren’t on an actual border. They just have to be within 100 miles of one. The ACLU estimates that roughly two-thirds of the nation’s population lives within this 100-mile zone.
Rosenberg's ordeal began in the border town of Laredo, TX. He and his friend pulled onto I-35 North at around midnight on September 26 in a truck carrying a load of Xerox machines destined for Ft. Worth. But only 29 miles north of the border, they’d encounter the Laredo North Border Patrol Station. And Greg would undergo a checkpoint interrogation like he’d never experienced before.
"They arrested me for what I looked like, but they pressed the charges because of my beliefs," says Rosenberg.

Thank you in advance:) WARNING!!!! have the volume on low at 0:30 This is an internal U.S. Border Patrol checkpoint on state route 86 about 50 miles from the Mexico border in southern Arizona near the Papago indian reservation. This is a typical BP encounter in which a BP supervisor in this case is less than honest in her statements. I would like to make a disclaimer that NOT all BP agensts I encounter are dishonest. I have met a handful that fully support citizens rights NOT to answer questions from law enforcement and they have my full respect and admiration for keeping their oaths to defend the constitution. I have video of one such individual stating that in fact I do NOT have to answer ANY of their questions. I can't put it up here because they requested I dont and I will honor that request. Know your rights folks and be safe!
Last thought. Notice the male agent who doesnt look very pleased. He also could have easily stated at any point,"hey buddy, the law your looking for is such and such so look it up and learn it, we do this all day so we know that law and thats why I CAN TELL YOU where to find it because I do this all day and I need to know the law that I'm enforcing". Instead of correcting me with FACTS to my questions they....dont.

On 08/09/2014 in Los Angeles, I went through what looked like a construction zone, only to realize it was an unconstitutional checkpoint. I was not drinking or under the influence of anything else. --- more ---
I did not initiate or premeditate this encounter as you can see I started the video documentation AFTER I was already stopped. During and throughout this ordeal you will hear and see the cops making up the “rules” along the way. At first, it was a DUI Checkpoint. If that’s the case, why ask for my Driver License? How does showing a license determine sobriety? Then, it was a DUI/Driver License checkpoint, which is unlawful.
Throughout, I was cool, calm, lucid, and articulate. I properly exercised my right to not answer questions. Note the female cop say I was required to have a California Driver License (without even knowing that I don’t live in California) I was threatened multiple times, NOT with arrest but, damage to my vehicle. I asked numerous times if I was under arrest, of what crime I was being accused of and got no response to my direct and appropriate questions.
After exiting the car on my own, you can see the abuse by the cop who had no reason to lock cuffs on me so tightly I have nerve damage to my left wrist and hand. Hear me ask and them say I was under arrest but not say for what charge. Note the cop belittling me when he says, “Make sure you notify the FAA when you’re convicted of a DUI” (This guy already had me CONVICTED of a DUI during this stop without due process, before a trial, before a conviction).
I spent the night in jail, released the next day with a ticket, being charged with two counts of “Refusing to Comply”, even though I actually did, one count of "Possession of Marijuana", and NO charges for DUI! -- All charges were eventually DISMISSED!
These are bullshit checkpoints, and they know it! Don't fold under their threats!

According to current federal law, border patrol agents currently have the authority to stop and conduct searches on vessels, trains, aircraft, or other vehicles anywhere within “a reasonable distance from any external boundary of the United States.” This “reasonable distance” is defined as 100 miles from any border, including coastal boundaries.
In this 100-mile zone, the US Border Patrol has claimed certain extra-constitutional powers, such as, claiming the authority to operate inland immigration checkpoints.
