1. General

This document, hereinafter referred to as the "Policy", outlines the rules that Member must adhere to when using any or all parts of the Doteasy Hosted Applications ("Software"). Doteasy may terminate your account(s) at any time, without notice, for conduct that is in breach of the Agreement and/or the Policy.

Doteasy reserves the right to modify the Policy at any time, effective upon posting of the modified Policy to this URL: http://www.doteasy.com/terms/hosted-applications-policy.cfm. You are responsible to read this document from time to time to ensure that your use of the Software remains in compliance with the Policy.

2. Usage

Doteasy provides Members with a non-exclusive, non-transferable, limited license to use the Software, which Members agree to use in accordance with the Agreement and the Policy. The Software is developed and owned by Doteasy and any reproduction, modification, creation of derivative works from or redistribution of the Software is expressly prohibited. The Software, its structure, sequence, organization and source code are considered trade secrets of Doteasy and are protected by trade secret laws.

3. Member Responsibility

Upon using the Software, you may be asked to select a username and a password. The username and password will be used for administrative purposes, including setting up, activation, and administrative functions of the Software on the Member's account. You acknowledge and agree that it is your responsibility to safeguard the username and password you select from any unauthorized use. In no event will Doteasy be liable for any loss or damage resulting from Member's failure to comply with this requirement.

4. Content

Doteasy does not claim ownership and is not responsible for any of the information, code, data, text, software, music, sound, photographs, pictures, graphics, video, message, files or other materials ("Content") submitted using the Software. Member is entirely responsible for all Content uploaded, posted, emailed or otherwise transmitted via the Software.

You further acknowledge and agree that all Content are non-transferable and non-transportable. Doteasy will not assist any Members with any reproduction, recovery, or distribution of any Content. Upon service cancellation or termination for any reasons, the Software will be removed by Doteasy, including all Content, third party content, and user information uploaded, posted, emailed, or otherwise transmitted via the Software.

Doteasy makes no representations or warranties, either expressed or implied, with respect to the images offered through the Software ("Images").

In the event of a dispute regarding any Image obtained via the Software, you hereby release Doteasy, its officers, directors, owners, agents, and employees from claims, demands, and damages, actual and consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any connection with such disputes. Doteasy is not a party to, and shall not be involved in or responsible for, transactions, agreements, and/or disputes between you and any third party.

You may only use the Images on your website, while the website maintains an active service subscription with Doteasy.

5. Disclaimer of Warranty

You agree and acknowledge that your use of the Software is entirely at your own risk, and that Doteasy makes no implied or express warranties about the reliability of the Software. Doteasy is not responsible for any damages caused by or resulting from the use of the Software.

6. Advertisements

You agree and acknowledge that parts of the Software may contain advertising banners.

7. Limitation of Liability

The Software and any associated content is provided on an "as is" and "as available" basis and use of the Software is at your own risk. Doteasy makes no representations or warranties, either expressed or implied, with respect to the Software or any content, service or information provided through the Software. Doteasy is not responsible for any damages, injury or loss arising from the use of the content or Software provided by Doteasy.

In no event shall Doteasy be liable for any damages, injury or losses whatsoever, arising out of or in connection with, but not limited to, the following:

1. The use or inability to use the service.
2. The provision of or failure to provide services.
3. Any information, data, products, services, images or graphics obtained through the Software or the use of the Software.
4. Any other matter relating to the Software or the use of the Software.
