Miami-Dade Police Officer on trial after off-duty car crash
Tonight, the courtroom conclusion to a 7News exclusive. Was an off-duty Miami-Dade Police Officer drinking behind the wheel and given special treatment by another police department? Investigative Reporter Carmel Cafiero is back on the case.
It was around 10 at night on March 15, 2014. Miramar Police Officer Yahmed Yema says he saw a Ford truck driving through a residential neighborhood at 50 miles per hour, twice the speed limit. Yema says he saw the truck run a stop sign and strike a small palm tree. The driver of that truck was off-duty Miami-Dade Police Officer Kevin Thomas.
Prosecutor: "Now you're here because the Defendant Kevin Thomas has been charged with reckless driving with property damage."
Now, more than a year later, Thomas faced a jury on that reckless driving charge, but he was not charged with DUI or tested that night, even though Officer Yema wrote in his report that alcohol may have played a role in the incident.
Yahmed Yema: "He smelled like alcohol. He was drenched in liquid which I thought to be beer. He had slurred speech and bloodshot eyes."
But Thomas had a different version of what happened that night. He said his driving appeared erratic because he dropped a lit cigar in his lap and that he was not drinking.
Kevin Thomas: "No sir, I don't drink beer."
Juan Gonzalez: "So you were not drinking that night?"
Kevin Thomas: "No sir."
Juan Gonzalez: "What was inside the cup?"
Kevin Thomas: "It was a red solo cup with some sweet tea that I had earlier when I was driving."
In essence, the case came down to one officer's word against the other. But it didn't have to. As 7News first reported last October, the Miramar Police Chief admitted it was a mistake that Thomas was not tested.
Carmel Cafiero: "Instead, the Miramar Officer called his sergeant, who arrived and called a Miami-Dade Police Sergeant, who showed up with additional supervisors."
With his own department on scene, Thomas was given four traffic tickets and let go. Did he catch a break?
Ryan Galka: "Instead of conducting a criminal investigation, is it fair to say since you had a more lenient option, you chose that option?"
Yahmed Yema: "Yes ma'am."
Thomas' attorney implied the Miami-Dade Officer was stopped because of his race.
Juan Gonzalez: "You take him down and you handcuff him like a dog on the street because he's a black man sir. That wasn't because he was a black man? Are you kidding me?"
Yema denied it. The jury took only 15 minutes to make a decision.
Court Clerk: "Defendant is not guilty, so say we all."
Judge Melinda Brown also dismissed his traffic tickets, but it was not all good news for Thomas. 7News has learned he was fired from the Miami-Dade Police Department in April involving an unrelated crash in his unmarked police car.
Even though he is no longer with the department, there is still an open internal affairs investigation into the Miramar incident.
Carmel Cafiero, 7News.

Now look at the video and see all the other people that was closer then me, especially the young lady in red short that one feet away from him and the young men that was closer then me. I guess the camera made him fear for his life or he is still made at me for exposing him months ago. Is this the intimidation and retaliation part coming from officers Diaz, badge # 5940. Now my girlfriend is in fear for her and her children safety from this officer. The video had been send to my lawyer and I guess once again, I'm getting ready for more false arrest. STAND-UP and FILM AWAY my citizens. Officer Diaz, badge # 5940 work out of station 4. So please call his boss, Lieutenant Lee and ask him about the situation. Look at the video first please. Miami Dolphins Player's Wife Miko Grimes Arrested After Game
Miami Gardens, Fla. - A Miami Dolphins player's wife was arrested Sunday as fans were walking out of Sun Life Stadium following the Dolphins 41-14 loss to the Buffalo Bills. Miami-Dade police arrested Miko Grimes, 40, after the game. She is the wife of Dolphins cornerback Brent Grimes. A video posted on Twitter showed Miko Grimes was shouting: "Get off my f**** leg! Are you f***** serious right now?" A male is heard saying, "She tried to walk through." According to a report, Miko Grimes broke through a barricade of police bicycles and entered a restricted area after disobeying several orders from officials to stop. Police said Miko Grimes became belligerent, screaming, "F*** you, cops. You can't tell me what to do." She then started at an officer in an aggressive manner. Miami-Dade police officers pinned her face down on the parking lot's concrete floor.
As Miko Grimes continued being combative, an officer activated a Taser and threatened to use it on her if she did not calm down, at which point she did, police said. But after being handcuffed, Miko Grimes head-butted a female officer. When police were able to get her into the car to be transported, she continued kicking and swinging her elbows. When Miko Grimes arrived to the police department, she was treated for injuries to her right arm, knee and forearm. She is charged with battery on a police officer, disorderly conduct and resisting arrest with violence. Meanwhile, Brent Grimes did not talk to reporters after the game. Hours earlier on her Instagram, Mike Grimes posted a picture of "Grimey's Corner" tent at the parking lot. A sign read, "Best Corner in the NFL."

Dade County PBA's Fallen Officer Tribute
In honor of law enforcement officers who have died in service to the residents of Miami-Dade County, the Dade County PBA commissioned the “Fallen Officer Tribute” to serve as a visual reminder of the sacrifices made by law enforcement officers, members of our community, who gave their lives so that we could live in peace.
The Dade County PBA’s “Fallen Officer Tribute” is on display each September in the lobby of the Stephen P. Clark Government Center (111 NW 1 Street). Along with life size photographs and informational boards, the lobby is filled with mannequins representing every fallen officer across Miami-Dade County. Each mannequin is wearing a black t-shirt with the words “I Died for You”. Each shirt is also inscribed with the fallen officer’s name and date of death.
Our fallen officers represent departments from across the County. The names of their departments were left off symbolically to represent unity. It doesn’t matter what agency an officer works for because they all share the same calling and paid the ultimate sacrifice.
It takes a special person to walk down a dark alley uncertain of what awaits at the end; or to advance into a gunfight when common sense and self-preservation say otherwise. It is our officers, these special people, who are the ones running into danger when everyone else is running from it.
These brave men and women were coaches, volunteers, loving family members, friends and our neighbors. Representing ever race and every gender, they entered law enforcement because they wanted to give back. They wanted to serve their community and make it a better, safer place for all of us.
“It was their duty to serve. It is ours to remember.”

ATV Riders Invade Miami (January 19, 2015) WTVJ | WFOR | WSVN
MIAMI (CBSMiami) – Thousands of people on ATV’s and dirt bikes flooded South Florida to celebrate Martin Luther King Jr. Day.
The bikers were seen driving the wrong way on streets, popping wheelies, taking red lights and cutting off other drivers.
“We gonna catwalk, we going to one hand we are going to step on our seats we going to run every light there is to run,” one rider told CBS4’s Travell Eiland.
We don’t mean no harm or cause no pressure we are just out here celebrating Martin Luther King Jr. birthday,” one Miami resident said.
But that’s not how authorities saw it.
“Those who do this, you don’t have any respect, no respect for what we have fought for for all these years,” said Florida Highway Patrol Officer Joe Sanchez.
FHP troopers said at least three crashes resulted from the reckless riders and at least three bikers were arrested.
While law enforcement officers are aware of the situation a Highway patrol spokesperson said they have tried to do traffic stops but some of the bikers pull off.
Troopers can’t case after them because it’s against department policy to give chase for a traffic violation and they fear pursuing would endanger more lives.
The large group of motorcyclists and ATV riders apparently met up at a gas station near NW 151st St. and 7th Ave. before hitting the road.
Police monitored the situation closely, as the bikers moved all over town.
The group had been through I-95 State, State Road 112 and various streets of Northwest Miami-Dade.
Several police departments confirmed they had received calls from other angry drivers who said this was a danger.
CBS4’s Jim DeFede caught up with some of the riders at a Sunoco gas station on 119th Street.
Some of the bikers told him they had come down from Palm Beach to participate in the ride.
Another person told DeFede that people should be happy because the kids are making a choice to “put down the guns and pick up the bikes.”
Throughout social media, #bikesupgunsdown and #bikelifemiami trended.
Some of the riders did commit traffic infractions like running red lights and blocking intersections. Officials also said it is illegal to ride ATVs on public roadways. One rider said even if their message was lost to commuters, it was a better alternative to violence and was able to bring people together. "Well I know that's kind of tough. But I mean, this brings everybody together. It's better than being in the club fighting with each other," a rider said.
But, ambulance vehicles had difficulty getting through streets and one woman ended the holiday with minor injuries. "It's crazy. It's like somebody's going to get hurt," a man said.
A young women was taken to the hospital after she fell from a bike that had just struck a car. The biker took off before medical professionals arrived. "It's ridiculous. You just leave somebody for dead like that," one woman commented from her car.
On Northwest 49th Street and 17th Avenue, a dirt bike smashed into a vehicle. No major injuries were reported.
