On 9 September, the Haryana police raided the luxury apartment of a Saudi Arabian diplomat in Gurgaon, near New Delhi, after a tip-off from an NGO.
There, they found two Nepali women, employed as domestic workers, who told the police they had been forcibly confined, starved and repeatedly raped by the diplomat and other men over several months.
A medical examination confirmed that the women had been anally and vaginally raped and brutally beaten. The Haryana police filed a criminal case against unnamed people, and say they are still investigating the case.
The Saudi Arabian embassy in New Delhi denied the allegations, and complained that the ‘intrusion’ into the diplomat’s home breached diplomatic conventions.
On September 16, the diplomat left India for Saudi Arabia. The Indian Ministry of External Affairs said that the diplomat was protected by the Vienna Convention on Diplomatic Relations.

Even more recently, missions in Saudi Arabia have faced security concerns, and have closed down for periods of time in response. The security of foreign missions is inevitably tied to legal matters. Specifically, there is gray area when it comes to the responsibilities of a host country versus those of an embassy. According to the Vienna Convention on Diplomatic Relations, it is the duty of the receiving nation to protect the mission from any intrusion or damage and prevent and disturbance of peace. However, recent events have planted seeds of doubt of the ability of host nations to protect embassies from outside attacks by rogue groups. Although the issue of diplomatic mission security is not without U.N. precedent, those guidelines have proven to do little to stop threats to embassies. The Global Network for Rights and Development (GNRD) appreciates that the Qatari Ministry of Foreign Affairs has now responded to GNRD’s enquiry about the safety and security of its staff: British citizens Krishna Upadhyaya and Gundev Ghimire. However, GNRD notes that it did not receive a clear response about the safety and security of its employees, who were subjected to enforced disappearance in Qatar as they were on their way to board a flight home from Doha Airport.
The Global Network for Rights and Development wishes to remind the State of Qatar about the Vienna Convention on Diplomatic Relations (1961) which affirms the sanctity of the Nepalese Embassy and the inviolability of the diplomatic mission’s premises (the embassy). GNRD’s employees acted according to the international treaty by not interacting with anyone outside the embassy and their task was confined within the embassy’s premises.
GNRD and the families of Krishna Upadhyaya and Gundev Ghimire are extremely concerned about their fate. The GNRD legal team is in the final stages of compiling a case to submit to the relevant International legal bodies, as well as to working groups specialising in arbitrary detention and enforced disappearances.
GNRD calls for the immediate disclosure of the location of both employees and demands that authorities allow a legal and medical delegation to meet with them.
Finally, GNRD would like to reiterate its clear position that the authorities in Qatar bare full responsibility for the safety and security of its employees. GNRD is increasingly concerned about its employees especially as the Qatari authorities reject their responsibility on the matter. This denial can open the possibility of them being in real danger and therefore GNRD will hold the relevant authorities legally to account.
