BROWNSVILLE, Texas — The federal judge in South Texas who temporarily blocked President Barack Obama's executive action on immigration once accused the Obama administration of participating in criminal conspiracies to smuggle children into the U S by helping reunite them with parents who live here illegally. U S District Judge Andrew Hanen, who regularly handles border cases but wasn't known for being outspoken on immigration until that previous case, on Monday granted a request by a coalition of 26 states led by Texas to block Obama's action on immigration while a lawsuit to permanently stop the order goes through the courts. Obama's executive action could spare from deportation as many as 5 million people who are in the U S illegally. Hanen, who's been on the federal court since 2002 after being nominated by President George W. Bush, spent several years handling the federal government's land condemnation cases to build the border fence, many times compelling government lawyers to slow down and take necessary procedural steps. He expressed frustration, however, in a December 2013 order in an immigrant-smuggling case that he'd had four situations in a month in which children who arrived in the U S illegally alone were reunited with parents who were themselves in the country illegally. Hanen sentenced a smuggler to 10 months in prison in that case but saved his most withering words for the U S government for not arresting and deporting the mother who hired the smuggler to get her 10-year-old daughter into the U S from El Salvador. The government has generally been temporarily reuniting such children with their relatives inside the United States pending deportation proceedings. Instead of arresting (the child's mother) for instigating the conspiracy to violate our border security laws, the (Homeland Security Department) delivered the child to her — thus successfully completing the mission of the criminal conspiracy, Hanen wrote. The judge compared the cases to the government seizing weapons being smuggled across the border and delivering them to the criminals inside the United States who ordered them. DHS has simply chosen not to enforce the United States' border security laws, Hanen wrote. He said the government's failures to enforce immigration laws were both dangerous and unconscionable, although he separately noted, This court takes no position on the topic of immigration reform, nor should one read this opinion as a commentary on that issue. Hanen grew up in Waco, Texas, graduated from Denison University in Ohio in 1975 and went to Baylor University School of Law in Waco, where he graduated first in his class in 1978, according to a biography provided by his office. He practiced civil trial law for more than 20 years in Houston. Lawyers for Texas filed the latest lawsuit in Brownsville, where Hanen is one of only two judges in that division of the U S District Court for the Southern District of Texas. Hanen, who gets half of all civil cases filed there, was assigned the case through an automated system. It's not unusual for plaintiffs in sensitive civil cases to shop for a court jurisdiction friendly to their point of view, but the location of the court generally must have some connection to the case. In this case, just about any court in Texas would suffice.

Attorney General Eric Holder says the Justice Department is reviewing a ruling by a federal judge in Texas that temporarily blocks President Barack Obama's executive action on immigration. Holder says the department is confident the matter will ultimately be taken up by a higher court, possibly the U.S. Supreme Court. The ruling yesterday put on hold Obama's orders that could spare as many as 5 million people who are in the U.S. illegally from being deported. It gave a coalition of 26 states time to pursue a lawsuit aiming to permanently stop the orders. An official with an advocacy group for low-to-moderate-income Texans says the ruling is just a "temporary setback." He says the group will "continue getting immigrants ready to apply for administrative relief." But the Department of Homeland Security says until further notice, it is stopping preparations for a program to protect parents of U.S. citizens or legal permanent residents. House Speaker John Boehner says the ruling isn't a surprise -- and underscores that Obama had acted beyond his authority. Boehner and Senate Majority Leader Mitch McConnell are calling on Senate Democrats to give up their opposition to a Homeland Security Department spending bill that overturns Obama's actions. Nevada Attorney General Adam Laxalt is one 25 other attorneys general across the nation in the lawsuit challenging the president's executive order to suspend federal immigration laws. Immigration advocates here say it also puts some 53,000 Nevadans in limbo. They say those in the program already should continue with their path, but today's ruling could stop the proposed expansion of the program that was supposed to start Wednesday. "It will impact those who were planning to apply for the expansion of the Protection of Children Act and the parents of those children who would be protected from deportation as part of this. That's 53,000 Nevadans!" says Bob Fulkerson of Progressive Leadership of Nevada. The White House says it will appeal today's ruling to the 5th Circuit Court in New Orleans. There's no immediate word on where Nevada will be in terms of appeals or further action. Nevada Senator Harry Reid released the following statement following the decision of a U.S. District Judge in Texas in the case of the State of Texas v. United States of America: "President Obama is well within his established Constitutional authority and the legal process will bear that out. The only effect of this ruling is to delay justice for thousands of families in Nevada and across the country. Governors, mayors and law enforcement officers have emphasized that these programs are good public policy, help our economy and keep our communities safe. "Courts are only involved in the first place because Republicans have spent years blocking Congress from fixing our broken immigration system. Congress should live up to its responsibility and pass an immigration bill that secures our borders, keeps families together and provides an earned path to citizenship. "There is nothing stopping the Senate from debating immigration legislation immediately. Unfortunately, the Senate is mired in a completely avoidable impasse over funding the Department of Homeland Security. Senate Democrats have a simple solution for getting out of this jam: take up and pass a clean bill to fund Homeland Security, then move on to a robust debate on immigration legislation. "Democrats' offer to first fund Homeland Security and then debate immigration stands. All Republicans have to do is say yes." Gov. Rick Perry today issued the following statement regarding a U.S. District Court ruling on President Obama's executive action on illegal immigration: "Yesterday's ruling by U.S. District Judge Andrew Hanen rightly blocked President Obama's executive action on illegal immigration. The president's action was a blatant overreach of executive power, an affront to the rule of law, and put partisan politics in front of lasting solutions. He put the legal status of millions of immigrants in question, adding confusion - not clarity - for these individuals. "The U.S. needs competent leadership on illegal immigration, and I urge Congress to act quickly to pass a bill to secure the border once and for all."

The court purposely created difficulties for defense lawyers and defendants’ family members by sitting in on the trial in an illegal and reckless manner. When a defendant’s family member questioned the court’s violation of law, she was forced out of the court by guards. Let’s look at the following report to see what and why the Aimin district court did what they did. At 9 a.m. on Feb. 13, Xi Xiangdong and Shi Fulong, defense lawyers for Falun Gong practitioners Guan Rian and Zhang Yutang, were held by court guards and forced to undergo security inspection at the court entrance. Xi Xiangdong: ”We were also required to leave the laptop out of the court, as the guard said ‘this is a recording and videotaping equipment.’ Of course we didn’t agree. Wherever we go, lawyers are exempt from security check according to law. Our laptop is also a necessary tool for our work during trial.” Xi Xiangdong said court guards completely ignored the rules issued by the Supreme Court which were displayed on the court wall. The judge Jiang Bingbing even placed inquisition records on them, claiming that the lawyers ‘did not follow security inspection rules.’ The judge further intimidated lawyers by claiming that they would be regarded as giving up defense rights if they did not enter the court immediately. The two lawyers tried their best to argue the issue. At 10 a.m., they were finally given access to the court after the court’s vice dean intervened. Xi Xiangdong futher revealed the story when they visited the district court this January to read case records. At that time, Judge Jiang Bingbing also told them that lawyers had to undergo security check, and only allowed the lawyers to take manual notes instead of taking photos or making copies of the documents. The Aimin district court is also accused of conducting many illegal procedures during the trial. Two more defense lawyers, Tang Jitian and Jiang Tianyong, were not notified of the trial. The court also allowed up to two family members for each defendant to sit in on the hearing, which is also unlawful. Defense lawyers Xi and Shi reminded the judge that holding a court session without the other two lawyers is violation of law. However, the chief judge ignored the warning, and further expelled Zhao Xin, defendant Guan Rian’s wife, from the court during the trial. The judge forcibly stopped the trial three times, without any reason for two of the stoppages. During recess, Zhang Yutang and Guan Rian were taken out of the court for over 10 minutes. When the two defendants returned to court, their mental status had significantly changed. According to family members of Zhang and Guan, Zhang Yutang was aided by court a guard when entering the court and Guan Rian walked in by himself. Both appeared to be in a good mental state. Guan Rian also asked why the other two defense lawyers were not present. However, when the trial re-convened at 1 p.m., Zhang Yutang had to use a wheelchair to enter the court; Guan Rian looked sedated and frequently gave no response to lawyers’ questions. Zhang also struggled when reading his defense statement. Chief judge Ji Ming asked Zhang to drink some water. However Zhang could hardly speak soon after that, holding his head in pain. The chief judge demanded a hasty medical examination but then continued the trial, announcing that, “nothing is wrong with Zhang’s health.” Zhang Yutang’s wife Zhang Cuixia stood up to contest the court decision. However, she was forced out of the court by four or five guards. Zhang Yutang did not react to the incident. During the previous hearing, Zhang had acted very different as he protested for a long time when his wife was violently treated. Lawyer Tang Jitian commented that the court tried all possible ways to obstruct lawyers’ work as well as suppress rights of defendants and their families. The authority intended to scare away lawyers and defendants to stop them from uncovering the party’s crimes and unlawful acts, said Tang. Tang Jitian: ”Strictly speaking, Guan Rian and Zhang Yutang’s cases are not really legal. The family of a 17-year-old German exchange student who was shot to death last spring in Montana has filed a lawsuit against the shooter and his girlfriend. Celal Dede sued Markus Kaarma and Janelle Pflager in U.S. District Court in Missoula late Wednesday as a representative of the estate of his son, Diren Dede. The lawsuit seeks damages for Diren Dede's medical and funeral costs, pain and suffering, wrongful death and lost earnings. Kaarma was sentenced Thursday to 70 years in prison for deliberate homicide in Diren Dede's death and won't be eligible for parole for 20 years. UPDATE: 2/13/2015 9:30 A.M. MOBILE, AL - Alabama counties are deciding whether to issue marriage licenses to gay couples after a federal judge ordered them to do so. Only a third of the state's 67 counties have issued the licenses despite a federal ruling striking down Alabama's same-sex marriage ban. On Thursday, U.S. District Judge Callie Granade ruled that Mobile County had to order the licenses, signaling to probate judges statewide that they should follow suit. Baldwin County Probate Judge Tim Russell is among the judges who previously refused to issue licenses but say they'll begin Friday. Many judges declined to grant the licenses because of an order from Alabama Chief Justice Roy Moore that said the federal ruling didn't apply to the state. ORIGINAL STORY: Mobile, AL - A federal judge is considering whether to force the Mobile County Probate Court to issue marriage licenses to same-sex couples. The license window at the probate court has been closed since Monday. A January decision by U.S. District Court Judge Callie V.S. Granade ruled Alabama's ban on same-sex marriage unconstitutional, clearing the way for marriages to begin Monday, February 9th. Late Sunday night, Alabama Chief Justice Roy Moore issued an order to probate judges across the state, telling them not to issue marriage licenses to same-sex couples. Tuesday, couples from Mobile filed a complaint with the U.S. District court, asking Judge Granade to force the probate court to issue marriage licenses. Moore insists he will resist the the legalization of same-sex marriage in Alabama. "I think that gay marriage is an alteration of the definition of marriage and the United States Supreme Court does not have the authority or the Federal Courts do not have the authority to interpret a word that disputes the Constitution," said Moore.

A federal judge has declared Puerto Rico's debt restructuring law unconstitutional, leaving the commonwealth without a formal framework for restructuring its debt. Judge Francisco Besosa of the U.S. District Court for the District of Puerto Rico ruled that the Puerto Rico Public Corporation Debt Enforcement and Recovery Act violates the U.S. Constitution, as it is pre-empted by the federal Bankruptcy Code and thus rendered void by the constitution's Supremacy Clause, which states that federal law trumps state and commonwealth law. Puerto Rico's government appealed the ruling on Feb. 10. Puerto Rico passed the Recovery Act in June as the financial position of its electric utility, the Puerto Rico Electric Power Authority or PREPA, became increasingly precarious and officials wanted to make sure an orderly way existed to restructure its debt. District Court is the name given to the intermediate court in most Australian States. They hear indictable (serious) criminal offences excluding treason, murder and, in some States, manslaughter. Their civil jurisdiction is also intermediate, typically being for civil disputes where the amount claimed is greater than a $75 000 but less than $750 000. The limits vary between Australian States. In Victoria, the equivalent Court is called the County Court. Below them is the Magistrates' Courts, known as the Local Court in New South Wales. Above them are the State Supreme Courts.
