The commission says 15 of those who died in custody were white, one was black, and one Asian. The overall number of deaths is reported to be six more than in 20-13 and 20-14, making it the highest in five years.

Britain’s policing watchdog on Monday announced that it will investigate a claim that detectives failed to follow up a complaint of child sex abuse made against former Prime Minister Edward Heath in the nineties.
As Conservative prime minister between 1970 and 1974 he secured the UK’s entry into the European Community.
He lost the leadership of his party in 1975 to Margaret Thatcher but stayed on as an MP.
He was knighted in 1992 and eventually stood down from parliament in 2001, dying four years later.

The police watchdog is to investigate whether officers failed to pursue allegations of child abuse made against former Prime Minister Sir Edward Heath.
A retired detective has alleged that claims were made in the 1990s but not followed up.

The Independent Police Complaints Commission (IPCC) is to investigate Wiltshire Police's handling of an alleged claim of child sexual abuse made about former Prime Minister Sir Edward Heath.
The probe was launched following allegations that were made about the force's handing of the original investigation, which dates back to the 1990s.

Nick Hardwick, chairman of the Independent Police Complaints Commission, said that his investigators had crucial closed circuit footage from the subway station where Jean Charles de Menezes was shot seven times in the head.
He didn''t elaborate on whether that included footage from all cameras in the station, but called what he had "very helpful."

'Not fit for purpose'

"The IPPC report recognises the limitations of what the organisation can do and that only a Hillsborough-style public inquiry can eventually get to the truth."
Shadow home secretary Yvette Cooper backed calls for a public inquiry saying: "For too long there have been serious allegations about the way the miners were treated at Orgreave, but we have never had the truth."
Chris Kitchen, general secretary of the National Union of Mineworkers (NUM), said the union wanted justice: "We want it to come to light what happened so that people can move on and can look to the future."
Former miner Kevin Horne, 64, who was arrested for obstruction, but never charged, said: "I think they've got away with murder really, because the evidence is all there."

He said it was a hot day and they had been playing football, but the police arrived and all "hell let loose."

Chief Constable of South Yorkshire Police David Compton said: "I note the outcome of the in-depth review conducted by the IPCC which concludes that due to both the evidential and public interest considerations in this case there is no requirement for further investigation into these matters."

The UK police watchdog has cleared officers involved in the fatal shooting of unarmed black man, Mark Duggan, in London more than three years ago.
The Independent Police Complaints Commission cleared the officers of any wrongdoing, citing a lack of audio or video material. Mark Duggan 'was throwing gun away' when shot by police
Mark Duggan was probably throwing a handgun away when he was shot by officers, the police watchdog has said.
He was under Metropolitan Police surveillance when he was shot in Tottenham on 4 August 2011, sparking England-wide riots.
The Independent Police Complaints Commission (IPCC) found the operation targeting Mr Duggan was "appropriate".
Its three-and-a-half-year investigation cleared the Metropolitan Police of any wrongdoing.
According to the IPCC's report, the "most plausible explanation" was that Mr Duggan was in the process of throwing the weapon away when a police officer fired two shots at him.
Covert recordings
Officers had attempted to inform Mr Duggan he was required to stop, it said, but without supporting radio or video recordings it was impossible to know whether they had shouted "armed police" or not.
The IPCC said it was "surprising" none of the police saw the gun leaving Mr Duggan's hand but it had found "no credible evidence" to suggest the weapon was planted.
Its report recommended in-car video recordings were made of any future covert operations, and retained for use by the IPCC in the event of death or injury.
All radio communications during covert firearms operations should also be recorded, it said.
Without such material in Mr Duggan's case, it said, it was impossible to know exactly what had happened.

Deputy chairwoman Rachel Cerfontyne said the recommendations would shorten investigations and provide "immediate, accurate and incontrovertible evidence".
Responding to the report, Met Police assistant commissioner Patricia Gallan said it was important to note the IPCC had found no wrongdoing or misconduct by any armed officer involved in the operation.
She urged people to study the report, based on 1,200 documents, 500 witness statements and 340 exhibits.
Ms Gallan said she hoped the report would help people make sense of the events on the day.
Police and other agencies now have 56 days to respond to the IPCC's recommendations.

The Met Police's handling of a child's disappearance on the way home from Prince Charles and Princess Diana's wedding in 1981 is to be investigated.
Eight-year old Vishal Mehrotra was murdered on his way home to Putney.
His father said he had given the police a recording of a man who claimed Vishal had been abducted and killed by "highly placed" paedophiles.
The force has referred itself to the Independent Police Complaints Commission amid corruption allegations.
Vishal, whose father is a retired magistrate, was walking home after watching the royal wedding parade when he disappeared.
The boy's remains were found the following year in remote marshland at a farm in Rogate, near the Hampshire-West Sussex border.
The police force said: "Met were made aware of a complaint alleging corruption relating to the Met Police's original missing person investigation into the disappearance of Vishal Mehrotra via the press."
This complaint has been referred to the Met's Directorate of Professional Standards and would shortly go to the IPCC, it said.

Child abuse investigations - statement from Chief Constable
Essex Police has recently uncovered problems with the effectiveness of 30 investigations into allegations of child abuse.
Most of these investigations relate to the work of the child abuse investigation team that covers the North of Essex and all of them have been referred to the Independent Police Complaints Commission.
I was very disappointed to learn of this and I am now determined that we find out exactly what has happened and to rectify things quickly, not least for the victims.
The force is working hard to put in place new systems to stop this from happening again.
If individuals have failed in their duties then they will be held to account, but we will also look at all possible aspects of why this has happened.
A recovery plan has been developed and many actions are already underway, these include:
An experienced senior retired detective has been brought in from outside to review the live investigations being conducted in the North of Essex.
New officers have taken over all those investigations which have caused concern and additional investigators have been drafted in to assist.
A revised policy is being introduced to ensure that investigations are reviewed on a consistent and regular basis by supervisors at all levels so that enquiries are continually progressed and meet the high standards expected.
New monitoring systems are being put in place across all of our child abuse investigation teams to closely assess the workloads of officers and ensure none of them are stretched too far.
Senior officers and detectives are carrying out briefings to reinforce with supervisors the importance of close management of investigations.
Children's charities, Barnardo’s, the Children's Society and the NSPCC, have been invited to form part of a new Child Abuse Advisory Group to ensure the force has the expert advice and independent assessment it needs.
We have contacted the families of those involved in these investigations to let them know what is happening and apologise for the undoubted distress this has caused them.

Once you had accumulated sufficient evidence, you would probably report the situation to the Police ... but the response might not be what you'd expect!
in 2008 when Michael Doherty, passed the Metropolitan Police an 86-page dossier of evidence.
Frustrated by a lack of progress, he phoned Hillingdon police station five times to try to speak to a senior officer and establish the status of the investigation.
Three days later, officers arrested him at home on suspicion of harassing a civilian Police worker.
Michael was later cleared at trial and reported the matter to the Independent Police Complaints Commission.
However Deborah Glass, the deputy chair of the IPCC, decided that a “proportionate and appropriate outcome” would be a reminder to officers to keep “accurate and detailed notes”.

She was then appointed to the UK Police Complaints Authority, and in 2004, became a Commissioner of the newly constituted IPCC. She was appointed Deputy Chair in 2008. As simply put, when crime becomes the law, then common law takes jurisdiction, all legal law is null and void until redress occurs.

He has consulted for a range of governments, including the Australian federal government and Victorian government departments, as well as the United Kingdom Foreign and Commonwealth Office. He has also consulted for international organisations and NGOs, writing briefing papers and providing training. Gideon has been pro bono legal counsel for accused war criminal, Radovan Karadžić and has appeared and provided expert advice on extradition and other matters. He has published many books, book chapters and articles on international law, criminal law, evidence and justice.
Gideon appeared late last year in an application in the Magistrates' Court to hold the Governor of the Melbourne Remand Centre in contempt for failing to produce a prisoner under a gaol order.

Two reports released last strong put the issue of deaths in custody right at the top of the political agenda. Although thematically similar, each provides a starkly different prognosis of the issue. On Monday 23/03/15 the Institute of Race Relations (IRR) published Dying For Justice, an examination of the “509 people from BAME, refugee and migrant communities who have died between 1991-2014 in suspicious circumstances in which the police, prison authorities or immigration detention officers have been implicated.”
The report details deaths resulting from undue force and a lack care of care, procedural warnings not heeded and a failure to convict even in light of unlawful killing inquest verdicts. The study also highlights the extent to which the media is complicit with the police and against the families seeking justice and to maintain the reputation of their loved one. Report co-editor Harmit Athwal commented: “ If the Macpherson report was intended as a way of restoring faith in the British police, the issue of deaths in custody is one which is constantly undermining it. As more deaths take place and no one is ever prosecuted, it inevitably sows seeds of incredulity, anger and despair.” Further evidence of this is revealed in 2014 statistics that show that the Metropolitan Police Service (MPS) uphold a mere 0.4% of complaints from the public about racist conduct. From 7963 allegations, 77 have been upheld and just three officers dismissed as a result.
More seeds of incredulity sprouted a mere two days later with the official Independent Police Complaints Commission (IPCC) report into the shooting death at police hands of Mark Duggan in 2011. Coming a year after the “perverse” inquest verdict of unlawful killing, the 500 page IPCC report that considered 1,200 documents, 500 witness statements and 340 exhibits and footage found no misconduct on the part of the police in the operation that lead to Duggan’s death. Writing in The Guardian, campaigner Bro. Stafford Scott reported that the report had been dismissed by Mark’s family as a “whitewash.”
A key element apparently unexplored by the report is the role of the man who allegedly supplied the gun to Mark Duggan, Kevin Hutchinson-Foster, an armed and violent criminal whose charges from gun offences were mysteriously dropped before going to court. The MPS said it could not comment on the issue, while the Crown Prosecution Service said it had lost the records of the case.
Bro. Stafford goes on to outline that both the inquest jury and the IPCC report rejected the police version of the actual shooting, although their general narrative is accepted even though they were not interviewed for the report. He concludes that the IPCC is not fit for purpose and that “anyone serious about justice and impartiality for those killed by the police should demand the body’s abolition.”
So we ask the question:

Should the officer that shot Mark Duggan be allowed to decline an interview for the report?

Two reports released last strong put the issue of deaths in custody right at the top of the political agenda. Although thematically similar, each provides a starkly different prognosis of the issue. On Monday 23/03/15 the Institute of Race Relations (IRR) published Dying For Justice, an examination of the “509 people from BAME, refugee and migrant communities who have died between 1991-2014 in suspicious circumstances in which the police, prison authorities or immigration detention officers have been implicated.”
The report details deaths resulting from undue force and a lack care of care, procedural warnings not heeded and a failure to convict even in light of unlawful killing inquest verdicts. The study also highlights the extent to which the media is complicit with the police and against the families seeking justice and to maintain the reputation of their loved one. Report co-editor Harmit Athwal commented: “ If the Macpherson report was intended as a way of restoring faith in the British police, the issue of deaths in custody is one which is constantly undermining it. As more deaths take place and no one is ever prosecuted, it inevitably sows seeds of incredulity, anger and despair.” Further evidence of this is revealed in 2014 statistics that show that the Metropolitan Police Service (MPS) uphold a mere 0.4% of complaints from the public about racist conduct. From 7963 allegations, 77 have been upheld and just three officers dismissed as a result.
More seeds of incredulity sprouted a mere two days later with the official Independent Police Complaints Commission (IPCC) report into the shooting death at police hands of Mark Duggan in 2011. Coming a year after the “perverse” inquest verdict of unlawful killing, the 500 page IPCC report that considered 1,200 documents, 500 witness statements and 340 exhibits and footage found no misconduct on the part of the police in the operation that lead to Duggan’s death. Writing in The Guardian, campaigner Bro. Stafford Scott reported that the report had been dismissed by Mark’s family as a “whitewash.”
A key element apparently unexplored by the report is the role of the man who allegedly supplied the gun to Mark Duggan, Kevin Hutchinson-Foster, an armed and violent criminal whose charges from gun offences were mysteriously dropped before going to court. The MPS said it could not comment on the issue, while the Crown Prosecution Service said it had lost the records of the case.
Bro. Stafford goes on to outline that both the inquest jury and the IPCC report rejected the police version of the actual shooting, although their general narrative is accepted even though they were not interviewed for the report. He concludes that the IPCC is not fit for purpose and that “anyone serious about justice and impartiality for those killed by the police should demand the body’s abolition.”

David Emmanuel, the British rap star Smiley Culture, died from a single stab wound through his heart, according to a postmortem examination.
The 48-year-old singer died during a Metropolitan police raid at his house. His family have been told he stabbed himself while making a cup of tea.
Emmanuel's family say the postmortem has strengthened their resolve to uncover the truth behind the "most bizarre of circumstances". They say they will employ an independent pathologist to verify the cause of death.
"As a family, we are in a state of deep sorrow and anger," said David Emmanuel, the musician's nephew, at a packed public meeting in Brixton, south London. "My uncle was a father, an uncle, a friend and a mentor to many and is a British icon who died under the most peculiar of circumstances.
"This is not a race issue, although there are suspicions that ethnicity has some relevance in this tragic event. This is a time when the whole British public will stand up to let the police and government know that we will no longer allow any citizen to die in the most bizarre of circumstances. Instead, we will seek the truth, doggedly, until that truth has been exposed."
Emmanuel was stabbed shortly before 8.30am on Tuesday, an hour and a half after four Metropolitan police officers arrived at his house in Warlingham, Surrey, with a search warrant.
A relative, who asked to remain unnamed, said she saw Emmanuel shortly after 8am. He seemed calm, she said, but appeared to indicate that he was confused by the raid. She saw him "surrounded by officers" and when she waved to him, he "shrugged his shoulders, as though to tell me he didn't know what was going on".
It was after this that Emmanuel was allowed to go unaccompanied into his kitchen, his family say. "Why, if Smiley was arrested, was he allowed to go near a kettle full of boiling water and drawers full of knives?" asked Lee Jasper, chair of the London race and criminal justice consortium. "It just doesn't make sense."
At about 8.30am an air ambulance was called by police officers. The helicopter arrived but Emmanuel died at the scene.
The case has been referred to the Independent Police Complaints Commission, which is setting up a community reference group to tell local people and the family of the investigation's progress and channel questions or concerns.
"This investigation is examining the basis on which Metropolitan police service officers went to Surrey to carry out the search warrant on Tuesday, how that was planned, how it was communicated with Surrey police and what happened while officers were at the address," said IPCC commissioner Mike Franklin.
"It is also looking at the response of the officers present to examine what was done in terms of first aid. The independent investigation will be studying forensic evidence and all other possible lines of enquiry to try to establish a factual account of exactly what happened," he added.
"Many of the questions that I know Mr Emmanuel's family and friends have are exactly what we will be examining as part of this investigation. I want to reassure people that we will thoroughly scrutinise this incident and will update all those involved as we progress. I will also make the findings of our investigation public at the earliest opportunity. Until then, I would ask that speculation is avoided."
In September last year Emmanuel appeared before magistrates charged with conspiracy to supply cocaine. He was due in court in the coming days.
Another relative, Merlin Emmanuel, said he refused to believe the singer had taken his own life.
"Smiley had a great deal to look forward to," he said. "It is true that he had an impending case but it is also true that the evidence in relation to this case was minimal and he, along with his legal team, were supremely confident of being acquitted this coming week.
"The police have yet to give an official statement as to what happened," he added. "We haven't had a clear, coherent, official explanation as to what happened to Smiley. The police have a lot to answer to. Until our questions, queries and suspicions have been fully and competently answered to dispel any notion of foul play, we will not rest

Handling of a child sex abuse complaint against a former British prime ministe ~ BBC
Britain’s policing watchdog on Monday announced that it will investigate a claim that detectives failed to follow up a complaint of child sex abuse made against former Prime Minister Edward Heath in the nineties.
As Conservative prime minister between 1970 and 1974 he secured the UK’s entry into the European Community.
He lost the leadership of his party in 1975 to Margaret Thatcher but stayed on as an MP.
He was knighted in 1992 and eventually stood down from parliament in 2001, dying four years later.
The Independent Police Complaints Commission said the accusation had been made to Wiltshire police in southwest England where Heath had lived for many years.
The IPCC gave no details about who made the complaint nor who was allegedly abused.

Britain's police watchdog revealed on Monday that a former British prime minister was accused of sex abuse involving children in the 1990s.
The Independent Police Complaints Commission said it was investigating Wiltshire Police force's handling of claims against Edward Heath. Heath — who died in 2005 — was never prosecuted.
The IPCC said in a statement that it was looking into allegations that a criminal prosecution was not pursued and whether Wiltshire Police "took any steps to investigate" claims against Heath. The watchdog said it was investigating whether a criminal prosecution was dropped against a person who threatened to make claims taht Heath "may have been involved in offences concerning children." It also said it was looking into whether that individuals' claims against Heath were ever investigated.

Sir Edward Heath named in child sex abuse investigation
The Independent Police Complaints Commission (IPCC) is to investigate Wiltshire Police's handling of an alleged claim of child sexual abuse made about former Prime Minister Sir Edward Heath.
The probe was launched following allegations that were made about the force's handing of the original investigation, which dates back to the 1990s.
The complaint is understood to have been made by a retired senior police officer. Wiltshire Police is now appeal for anyone who thinks they might have been a "victim" to come forward.
An IPCC spokesman said: "It is alleged that a criminal prosecution was not pursued, when a person threated to expose that Sir Edward Heath may have been involved in offences concerning children.
"In addition to this allegation, the IPCC will examine whether Wiltshire Police subsequently took any steps to investigate these claims."

The British police watchdog investigating the shooting of a Brazilian man mistaken for a terrorist has the information it needs to complete its investigation, the group''s head said Wednesday, rejecting media suggestions that key evidence had been erased.
Nick Hardwick, chairman of the Independent Police Complaints Commission, said that his investigators had crucial closed circuit footage from the subway station where Jean Charles de Menezes was shot seven times in the head.
He didn''t elaborate on whether that included footage from all cameras in the station, but called what he had "very helpful."
"I''m not aware of any information that we are missing," Hardwick told reporters after meeting with a senior Brazilian delegation that came to London to find answers to the Menezes shooting.
"I believe that I have all the information that I need ... but I''m not going to believe anything until our own investigation has established it."
Menezes was killed July 22, the day after failed bomb attacks hit the London transit system.
Those attacks came exactly two weeks after similar bombings killed 52 commuters and four suspected bombers.

'Battle of Orgreave': Probe into policing of 1984 miners' clash ruled out
Police will not be investigated over one of the most violent clashes of the 1984-5 miners' strike, the Independent Police Complaints Commission has ruled.
The passage of time meant allegations of assault and misconduct at Orgreave coking plant in South Yorkshire "could not be pursued", the watchdog said.
About 10,000 strikers and 5,000 police were involved in what became known as the "Battle of Orgreave", in June 1984.
Campaigners said they were disappointed and have called for a public inquiry.
South Yorkshire's Police and Crime Commissioner Alan Billings described the decision as a missed opportunity that did "disservice" to former miners, police and Independent Police Complaints Commission (IPCC).
The IPCC said its decision could be reviewed if further evidence emerged. South Yorkshire Police referred itself to the IPCC after a BBC documentary in 2013 claimed officers may have colluded in writing court statements.
IPCC deputy chair Sarah Green said: "These are events from more than 30 years ago, and I have considered the impact such a passage of time could have on an IPCC investigation and possible outcomes.
In addition, because the miners arrested at Orgreave were acquitted or no evidence offered, there are no miscarriages of justice due to alleged police failures for the IPCC to investigate.
"Allegations of offences amounting to minor assaults could not be prosecuted due to the passage of time; and as many of the police officers involved in events at Orgreave are retired, no disciplinary action could be pursued."
'Not fit for purpose'
Mark Metcalf, spokesman for the Orgreave Truth and Justice Campaign (OTJC), said its members were disappointed by the decision, but not surprised.
He said: "The fact the IPCC, described rightly in our view by many prominent individuals as 'not fit for purpose', is stepping aside will not deter the OTJC from continuing its campaign.
"The IPPC report recognises the limitations of what the organisation can do and that only a Hillsborough-style public inquiry can eventually get to the truth."
Shadow home secretary Yvette Cooper backed calls for a public inquiry saying: "For too long there have been serious allegations about the way the miners were treated at Orgreave, but we have never had the truth."
Chris Kitchen, general secretary of the National Union of Mineworkers (NUM), said the union wanted justice: "We want it to come to light what happened so that people can move on and can look to the future."
Former miner Kevin Horne, 64, who was arrested for obstruction, but never charged, said: "I think they've got away with murder really, because the evidence is all there."
Eyewitness account:
Dave Smith, a former miner and former president of Dinnington NUM was at Orgreave on 18 June 1984.
He said it was a hot day and they had been playing football, but the police arrived and all "hell let loose."
"Horses came out, short shields came out; we tried to defend ourselves as best we could.
"Most of us were running like hell. We finished up down embankments, on to railway lines with dogs chasing us.
"People were seriously injured and I mean seriously injured, and left by the police.
"That's not helping, that's attacking, and we were attacked."
The watchdog's decision follows a two-year "scoping exercise" during which thousands of documents, film and photographs were analysed.
Ms Green said she accepted there were "concerns about some of the actions of individual officers" but said it was difficult to go back and apply current thinking and standards to the events at Orgreave.
"If this happened now, absolutely the IPCC would be investigating it," she said."But what we can't do is wind back time to go back 30 years and redo what perhaps should have been done then."
Chief Constable of South Yorkshire Police David Compton said: "I note the outcome of the in-depth review conducted by the IPCC which concludes that due to both the evidential and public interest considerations in this case there is no requirement for further investigation into these matters."

Outcry Over Decision Not To Probe Orgreave
After more than two years considering its decision, the Independent Police Complaints Commission has announced it will not conduct an inquiry into a notorious clash between South Yorkshire Police and striking miners 31 years ago.
The decision has been condemned by many former coal miners who were there on the day.
Police faced claims that officers used "excessive force" against picketing miners, manipulated statements and gave false evidence in court.
The Battle of Orgreave, as it became known, involved a mass gathering of miners trying to prevent supplies leaving a coking plant in Rotherham.
It came to symbolise the industrial relations conflict of the Thatcher era and resulted in injuries to 51 picketers and 72 policemen.
Political activist and former miner Dave Douglass described the confrontation as "absolutely terrifying".
He claims police had been politically manipulated in an effort to help defeat the miners.
"It was to teach us a lesson. It was to come into our backyard. It was to injure as many people as possible, terrify as many people as possible so that we wouldn't picket again," he said.
He said he was disappointed with the IPCC decision, although not surprised.
South Yorkshire Police referred the Orgreave case to the IPCC in 2012 amid growing claims that its officers had perverted the course of justice in the failed prosecutions of 94 miners on charges of riot and unlawful assembly.
But the IPCC says its decision followed "an extensive scoping exercise" into allegations of police misconduct.
It concludes:
:: The passage of time means that allegations of assault and of misconduct could not now be pursued
:: Some matters were subject to complaints and civil proceedings at the time
:: Detailed analysis has not revealed any other issues in relation to individual officers which could now be investigated

"I recognise the seriousness of the allegations and their continuing effect on public confidence in the affected communities.

"In addition, because the miners arrested at Orgreave were acquitted or no evidence offered, there are no miscarriages of justice due to alleged police failures for the IPCC to investigate."

He said: "We're always in favour of openness and transparency where it's required.
"We're talking about 31 years ago. Where do we draw the line? Do we investigate something that happened during the Second World War next?

Former Metropolitan Police chief Lord Stevens is being investigated over claims he failed to disclose information to the Macpherson inquiry into the Stephen Lawrence murder probe.
The Independent Police Complaints Commission (IPCC) confirmed it was investigating the peer following a referral from the London force.
The probe was launched by the watchdog after a complaint by the murdered teenager’s father Neville Lawrence last October.
The Met said the complaint was in relation to Lord Stevens' role when he was deputy commissioner and disclosure to the Macpherson Inquiry 17 years ago.
Sky' crime correspondent Martin Brunt said: "The accusation is when he was deputy commissioner in 1998 he had told Lord Macpherson in the course of his inquiry that no officer or former officer involved in giving evidence to that inquiry had been under investigation for corruption."
Brunt added he spoken to someone very close to Lord Stevens and he was "very angry he was subject to this investigation".

The UK police watchdog has cleared officers involved in the fatal shooting of unarmed black man, Mark Duggan, in London more than three years ago.
The Independent Police Complaints Commission cleared the officers of any wrongdoing, citing a lack of audio or video material. The commission said it was impossible to know with certainty what exactly happened when the 29-year-old was gunned down by Metropolitan Police in Tottenham in 2011. Representatives from the Duggan family dismissed the report as plainly wrong. Duggan's killing sent shockwaves across Britain and triggered the worst protests in modern English history. Last year, Britain's high court sparked outrage among Duggan's family by ruling that his death at the hands of police was lawful.

Mark Duggan 'was throwing gun away' when shot by police
Mark Duggan 'was throwing gun away' when shot by police
Mark Duggan was probably throwing a handgun away when he was shot by officers, the police watchdog has said.
He was under Metropolitan Police surveillance when he was shot in Tottenham on 4 August 2011, sparking England-wide riots.
The Independent Police Complaints Commission (IPCC) found the operation targeting Mr Duggan was "appropriate".
Its three-and-a-half-year investigation cleared the Metropolitan Police of any wrongdoing.
According to the IPCC's report, the "most plausible explanation" was that Mr Duggan was in the process of throwing the weapon away when a police officer fired two shots at him.
Covert recordings
Officers had attempted to inform Mr Duggan he was required to stop, it said, but without supporting radio or video recordings it was impossible to know whether they had shouted "armed police" or not.
The IPCC said it was "surprising" none of the police saw the gun leaving Mr Duggan's hand but it had found "no credible evidence" to suggest the weapon was planted.
Its report recommended in-car video recordings were made of any future covert operations, and retained for use by the IPCC in the event of death or injury.
All radio communications during covert firearms operations should also be recorded, it said.
Without such material in Mr Duggan's case, it said, it was impossible to know exactly what had happened.
'Surprising'
Deputy chairwoman Rachel Cerfontyne said the recommendations would shorten investigations and provide "immediate, accurate and incontrovertible evidence".
Responding to the report, Met Police assistant commissioner Patricia Gallan said it was important to note the IPCC had found no wrongdoing or misconduct by any armed officer involved in the operation.
She urged people to study the report, based on 1,200 documents, 500 witness statements and 340 exhibits.
Ms Gallan said she hoped the report would help people make sense of the events on the day.
Police and other agencies now have 56 days to respond to the IPCC's recommendations.
Last year, an inquest jury found Mr Duggan had been lawfully killed - but did not have a gun in his hand when he was shot in Ferry Lane.
The firearm was found behind railings in a grassed area about 14ft (4.2m) away.

Once you had accumulated sufficient evidence, you would probably report the situation to the Police ... but the response might not be what you'd expect!
in 2008 when Michael Doherty, passed the Metropolitan Police an 86-page dossier of evidence.
Frustrated by a lack of progress, he phoned Hillingdon police station five times to try to speak to a senior officer and establish the status of the investigation.
Three days later, officers arrested him at home on suspicion of harassing a civilian Police worker.
Michael was later cleared at trial and reported the matter to the Independent Police Complaints Commission.
However Deborah Glass, the deputy chair of the IPCC, decided that a “proportionate and appropriate outcome” would be a reminder to officers to keep “accurate and detailed notes”.
Outraged by the blatant 'whitewash', Michael Doherty launched a private prosecution and the Crown Prosecution Service took over the case in November 2011. The CPS later tried to drop the case, leading Mr Doherty to launch a judicial review.

Geoffrey Sawer was the first Professor of Law at the Australian National University, appointed in 1950 at the age of 40. His fluid and incisive writing, especially on Australian constitutional law and politics, has had a significant impact on succeeding generations of academics, practitioners and judges. In 1998, two years after Sawer’s death in 1996, in honour of this pioneering scholar, the Dean of the ANU College of Law, Michael Coper, with then Centre for International and Public Law Director Hilary Charlesworth, inaugurated the annual Sawer Lecture. Since then, the annual lecture has been delivered by such luminaries as Sir Ninian Stephen, Sir Gerard Brennan, and Professor Leslie Zines.
Ms Deborah Glass OBE is the current Victorian Ombudsman. She was appointed in March 2014; the appointment is for a term of 10 years.
Deborah has recently stepped down as Deputy Chair of the Independent Police Complaints Commission (IPCC) of England and Wales, completing a 10-year term with the IPCC in March 2014. She was also the IPCC Commissioner for London, responsible for many high profile criminal and misconduct investigations.

She was then appointed to the UK Police Complaints Authority, and in 2004, became a Commissioner of the newly constituted IPCC. She was appointed Deputy Chair in 2008. I was met with sheer ignorance, arrogance and complete disrespect by the members of staff of ECCLES GATEWAY who were unruly and completely unreasonable.
It is a criminal offence under Section 8 of the Accessories and Abettors Act 1861 to Pay Tax to the Government as the British Government is Complicit in Treason and Sedition at Common law.
As simply put, when crime becomes the law, then common law takes jurisdiction, all legal law is null and void until redress occurs.

Dr Bronwyn Naylor is an Associate Professor in the Law Faculty at Monash University, with degrees in Arts and Law from Monash University, and a Doctorate in Criminology from Cambridge University. She has been teaching, researching and publishing in criminal law, corrections, regulation, and criminal justice and gender for over 20 years. Dr Naylor is the lead Investigator on an ARC-funded project on human rights in prisons and other places of detention. She has presented papers and published articles on this research, and is a contributor to and co-editor of the new Federation Press publication Human Rights in Closed Environments.
Dr Gideon Boas
Dr Gideon Boas is an Associate Professor in the Monash Law Faculty and a Barrister at the Victorian Bar. He was a Senior Legal Officer at the International Criminal Tribunal for the former Yugoslavia, where he was the senior adviser to the Trial Chamber in the Milošević case. He has consulted for a range of governments, including the Australian federal government and Victorian government departments, as well as the United Kingdom Foreign and Commonwealth Office. He has also consulted for international organisations and NGOs, writing briefing papers and providing training. Gideon has been pro bono legal counsel for accused war criminal, Radovan Karadžić and has appeared and provided expert advice on extradition and other matters. He has published many books, book chapters and articles on international law, criminal law, evidence and justice.
Gideon appeared late last year in an application in the Magistrates' Court to hold the Governor of the Melbourne Remand Centre in contempt for failing to produce a prisoner under a gaol order.

Two reports released last strong put the issue of deaths in custody right at the top of the political agenda. Although thematically similar, each provides a starkly different prognosis of the issue. On Monday 23/03/15 the Institute of Race Relations (IRR) published Dying For Justice, an examination of the “509 people from BAME, refugee and migrant communities who have died between 1991-2014 in suspicious circumstances in which the police, prison authorities or immigration detention officers have been implicated.”
The report details deaths resulting from undue force and a lack care of care, procedural warnings not heeded and a failure to convict even in light of unlawful killing inquest verdicts. The study also highlights the extent to which the media is complicit with the police and against the families seeking justice and to maintain the reputation of their loved one. Report co-editor Harmit Athwal commented: “ If the Macpherson report was intended as a way of restoring faith in the British police, the issue of deaths in custody is one which is constantly undermining it. As more deaths take place and no one is ever prosecuted, it inevitably sows seeds of incredulity, anger and despair.” Further evidence of this is revealed in 2014 statistics that show that the Metropolitan Police Service (MPS) uphold a mere 0.4% of complaints from the public about racist conduct. From 7963 allegations, 77 have been upheld and just three officers dismissed as a result.
More seeds of incredulity sprouted a mere two days later with the official Independent Police Complaints Commission (IPCC) report into the shooting death at police hands of Mark Duggan in 2011. Coming a year after the “perverse” inquest verdict of unlawful killing, the 500 page IPCC report that considered 1,200 documents, 500 witness statements and 340 exhibits and footage found no misconduct on the part of the police in the operation that lead to Duggan’s death. Writing in The Guardian, campaigner Bro. Stafford Scott reported that the report had been dismissed by Mark’s family as a “whitewash.”
A key element apparently unexplored by the report is the role of the man who allegedly supplied the gun to Mark Duggan, Kevin Hutchinson-Foster, an armed and violent criminal whose charges from gun offences were mysteriously dropped before going to court. The MPS said it could not comment on the issue, while the Crown Prosecution Service said it had lost the records of the case.
Bro. Stafford goes on to outline that both the inquest jury and the IPCC report rejected the police version of the actual shooting, although their general narrative is accepted even though they were not interviewed for the report. He concludes that the IPCC is not fit for purpose and that “anyone serious about justice and impartiality for those killed by the police should demand the body’s abolition.”

David Emmanuel, the British rap star Smiley Culture, died from a single stab wound through his heart, according to a postmortem examination.
The 48-year-old singer died during a Metropolitan police raid at his house. His family have been told he stabbed himself while making a cup of tea.
Emmanuel's family say the postmortem has strengthened their resolve to uncover the truth behind the "most bizarre of circumstances". They say they will employ an independent pathologist to verify the cause of death.
"As a family, we are in a state of deep sorrow and anger," said David Emmanuel, the musician's nephew, at a packed public meeting in Brixton, south London. "My uncle was a father, an uncle, a friend and a mentor to many and is a British icon who died under the most peculiar of circumstances.
"This is not a race issue, although there are suspicions that ethnicity has some relevance in this tragic event. This is a time when the whole British public will stand up to let the police and government know that we will no longer allow any citizen to die in the most bizarre of circumstances. Instead, we will seek the truth, doggedly, until that truth has been exposed."
Emmanuel was stabbed shortly before 8.30am on Tuesday, an hour and a half after four Metropolitan police officers arrived at his house in Warlingham, Surrey, with a search warrant.
A relative, who asked to remain unnamed, said she saw Emmanuel shortly after 8am. He seemed calm, she said, but appeared to indicate that he was confused by the raid. She saw him "surrounded by officers" and when she waved to him, he "shrugged his shoulders, as though to tell me he didn't know what was going on".
It was after this that Emmanuel was allowed to go unaccompanied into his kitchen, his family say. "Why, if Smiley was arrested, was he allowed to go near a kettle full of boiling water and drawers full of knives?" asked Lee Jasper, chair of the London race and criminal justice consortium. "It just doesn't make sense."
At about 8.30am an air ambulance was called by police officers. The helicopter arrived but Emmanuel died at the scene.
The case has been referred to the Independent Police Complaints Commission, which is setting up a community reference group to tell local people and the family of the investigation's progress and channel questions or concerns.
"This investigation is examining the basis on which Metropolitan police service officers went to Surrey to carry out the search warrant on Tuesday, how that was planned, how it was communicated with Surrey police and what happened while officers were at the address," said IPCC commissioner Mike Franklin.
"It is also looking at the response of the officers present to examine what was done in terms of first aid. The independent investigation will be studying forensic evidence and all other possible lines of enquiry to try to establish a factual account of exactly what happened," he added.
"Many of the questions that I know Mr Emmanuel's family and friends have are exactly what we will be examining as part of this investigation. I want to reassure people that we will thoroughly scrutinise this incident and will update all those involved as we progress. I will also make the findings of our investigation public at the earliest opportunity. Until then, I would ask that speculation is avoided."
In September last year Emmanuel appeared before magistrates charged with conspiracy to supply cocaine. He was due in court in the coming days.
Another relative, Merlin Emmanuel, said he refused to believe the singer had taken his own life.
"Smiley had a great deal to look forward to," he said. "It is true that he had an impending case but it is also true that the evidence in relation to this case was minimal and he, along with his legal team, were supremely confident of being acquitted this coming week.
"The police have yet to give an official statement as to what happened," he added. "We haven't had a clear, coherent, official explanation as to what happened to Smiley. The police have a lot to answer to. Until our questions, queries and suspicions have been fully and competently answered to dispel any notion of foul play, we will not rest
