The online/digital world has changed many of the ways that music is licensed as well as the amount of royalties that songwriters, composers and music publishers receive.
This new world has created many new areas of exploitation and opportunity including music in apps, video games, e-cards, digital jukeboxes and interactive dolls and toys, to name but a few. In addition, many new forms of mechanical licensing and performances have come into existence - locker services, downloads, bundled services, ringtones and ringbacks, subscription and streaming services - all with new royalty rates.
This seminar will discuss the types of deals, the negotiating process and the actual royalties being generated by songwriters and publishers in the online world. It will also cover many of the traditional areas of music licensing (radio, tv and live performances; film, television and advertising song licensing; record sales; songs in musicals, etc.) and tell you how the online world has changed the structure and royalties of all types of music licensing deals.
Todd Brabec
Todd Brabec, former ASCAP Executive Vice President and Worldwide Director of Membership, is an Entertainment Law attorney, a Deems Taylor Award winning author of the best selling music business book "Music, Money and Success: the Insider's Guide to Making Money in the Music Business" (7th edition, 560 pages), an Adjunct Associate Professor at USC where he teaches the course on Music Licensing, Music Publishing and Film, Television and Video Game scoring and song contracts and a Governing Committee member of the American Bar Association Forum on the Entertainment and Sports Industries.
During his 37 year career at ASCAP, he was responsible for signing most of ASCAP 's successful songwriters, songwriter/artists and film and television composers in addition to significantly changing ASCAP's payment and distribution systems resulting in an increase in annual license fees from 60 million dollars to 995 million dollars and a market share increase from 20% to market share dominance in all major media.

Publisher Scams - Music Publishing Companies - Watch out for BS!! An LW Music Business Consultant, Speaker & Author Music Promotion Blog Video.
I know there are a great deal of publishing scams out there. I also want to say right off the bat, I know both personally and indirectly about some amazing music publishing companies and music publishers who do right by their work and their representation of artists, their songs and their catalogs.
Still, today, I was asked by an artist that I have been consulting for to review some information from a potential publishing deal.
The deal was highway robbery, pathetic, abusive and flat out unprofessional. It was one of those publishing contracts coming from a two bit company and some one that knows the basic legalities of music publishing with little to no ability to both publish or license music on any kind of level.
It is not that the contract was all that bad if it was a reputable publishing company or group that had that reputation, connections and success. But, no, this was some one that studied publishing music, copied a contract to make it seem like publishing your music with them had all these amazing opportunities and money just around the corner.
The truth ends up revealing someone that uses this contract to gain long term control of as much music as possible to shop it through many of the same channels an independent artist can do very easily.
The music business has changed and so has the publishing companies. If you sign a template contract with a record label that owns you but has no money to push you, it is right in the same ball park as signing away all your songs to someone who does not have the potential to place them at all.
The best thing you can do is ask for the references. Ask to speak with other artists who have materials published with these people. As them how much they have made, how things have gone as well as the communication, the efforts, the results and the revenues.
It sucks that you have to deal with the publisher scams that are out there, but if you ask the questions before you sign the contracts, raise the red flags before you give the green flags to letting people control your material and songs, you have that much better of a chance of not being taken for the fool or being taken like a fool.

Are You Making this critical music publishing Royalties Mistake? Lets face it, every musician singer rapper writer wants to get paid for their hard work of making music but many people don't really know how the music industry really works let alone how they are suppose to get paid.
Split Sheets
What I want to talk about today is Split Sheets. What are split sheets? I'm glad that you asked.
A split sheet is simply a document that is a signed agreement between everyone who has contributed to the creation of a song. It has been filled out and signed by everyone that is involved and a copy of it is made out for each person at bare minimum. Now why is this important? This split sheet is what every one will need to submit to their respective performing rights agency (ASCAP,BMI,SESAC) ect. so that each person will get the credit for the work they did on the song. Each party is responsible to make sure that this happens other wise they won't get the credits therefore they won't get any royalties payed out that are collected by their Performing Rights Agency (PRA).
Example:
Here is a example of how this would work:
Lets say that you have a writing/recording session scheduled tomorrow.
This session will include producer one singer and one rapper.
At the beginning of the session one of you should pull out a split sheet and say hey guys before we get started lets decide on who's going to do what on this song. Once that has been communicated and agreed upon then at bare minimum you would fill out that information on to the sheet along with everyones contact info and mailing address. This stuff is really important because if you don't do this companies won't know where or to whom to send your checks. I know that this may seem like a inspiration killer when you are trying to do this at the beginning of a session but believe me it is much less awkward to do this up front rather than trying to hunt everyone down later. http://bit.ly/1CXdX1j

Before you go out and get yourself a publishing deal, it would be good to know what they do. Publishers handle three things: First, they'll collect your royalties. Once you land that song on the radio, they'll collect all of the money owed to you. Second, they protect you legally. They copyright your songs and if anyone comes after you, they'll have a team of lawyers ready. Finally, they market you and your songs. Co-writes, film and TV, and as many placements as possible.

Michael Joseph Jackson (August 29, 1958 – June 25, 2009) was an American recording artist, entertainer, and businessman. Todd Brabec, former ASCAP Executive Vice President and Worldwide Director of Membership, is an Entertainment Law attorney, a Deems Taylor Award winning author of the best selling music business book "Music, Money and Success: the Insider's Guide to Making Money in the Music Business" (7th edition, 560 pages), an Adjunct Associate Professor at USC where he teaches the course on Music Licensing, Music Publishing and Film, Television and Video Game scoring and song contracts and a Governing Committee member of the American Bar Association Forum on the Entertainment and Sports Industries.
During his 37 year career at ASCAP, he was responsible for signing most of ASCAP 's successful songwriters, songwriter/artists and film and television composers in addition to significantly changing ASCAP's payment and distribution systems resulting in an increase in annual license fees from 60 million dollars to 995 million dollars and a market share increase from 20% to market share dominance in all major media.

I know there are a great deal of publishing scams out there. I also want to say right off the bat, I know both personally and indirectly about some amazing music publishing companies and music publishers who do right by their work and their representation of artists, their songs and their catalogs.
Still, today, I was asked by an artist that I have been consulting for to review some information from a potential publishing deal.
The deal was highway robbery, pathetic, abusive and flat out unprofessional. It was one of those publishing contracts coming from a two bit company and some one that knows the basic legalities of music publishing with little to no ability to both publish or license music on any kind of level.
It is not that the contract was all that bad if it was a reputable publishing company or group that had that reputation, connections and success. But, no, this was some one that studied publishing music, copied a contract to make it seem like publishing your music with them had all these amazing opportunities and money just around the corner.
The truth ends up revealing someone that uses this contract to gain long term control of as much music as possible to shop it through many of the same channels an independent artist can do very easily.
The music business has changed and so has the publishing companies. If you sign a template contract with a record label that owns you but has no money to push you, it is right in the same ball park as signing away all your songs to someone who does not have the potential to place them at all.
The best thing you can do is ask for the references. Ask to speak with other artists who have materials published with these people. As them how much they have made, how things have gone as well as the communication, the efforts, the results and the revenues.
It sucks that you have to deal with the publisher scams that are out there, but if you ask the questions before you sign the contracts, raise the red flags before you give the green flags to letting people control your material and songs, you have that much better of a chance of not being taken for the fool or being taken like a fool.

Are You Making this critical music publishing Royalties Mistake? Lets face it, every musician singer rapper writer wants to get paid for their hard work of making music but many people don't really know how the music industry really works let alone how they are suppose to get paid.
Split Sheets
What I want to talk about today is Split Sheets. What are split sheets? I'm glad that you asked.
A split sheet is simply a document that is a signed agreement between everyone who has contributed to the creation of a song. It has been filled out and signed by everyone that is involved and a copy of it is made out for each person at bare minimum. Now why is this important? This split sheet is what every one will need to submit to their respective performing rights agency (ASCAP,BMI,SESAC) ect. so that each person will get the credit for the work they did on the song. Each party is responsible to make sure that this happens other wise they won't get the credits therefore they won't get any royalties payed out that are collected by their Performing Rights Agency (PRA).
Example:
Here is a example of how this would work:
Lets say that you have a writing/recording session scheduled tomorrow.
This session will include producer one singer and one rapper.
At the beginning of the session one of you should pull out a split sheet and say hey guys before we get started lets decide on who's going to do what on this song. Once that has been communicated and agreed upon then at bare minimum you would fill out that information on to the sheet along with everyones contact info and mailing address. This stuff is really important because if you don't do this companies won't know where or to whom to send your checks. I know that this may seem like a inspiration killer when you are trying to do this at the beginning of a session but believe me it is much less awkward to do this up front rather than trying to hunt everyone down later. http://bit.ly/1CXdX1j
