Oral arguments were heard by the Second Circuit Court of Appeals in the case of Fox Television v. Federal Communications Commission. Fox Television was challenging the FCC's indecency standards and the way it punished broadcasters for airing shows that contain profanity. The network argued that the government violated the First Amendment by embarking on a "radical reinterpretation and expansion" of its power to punish broadcasters for indecent speech. The network contended that the FCC sharply changed its standards for profanity, that the standards were vague and made little sense in the face of industry changes. The FCC fined Fox for language used by Cher and Nicole Richie on the live broadcasts of the 2002 and 2003 Billboard Music Awards, respectively.

This week Craig Benzine is going to talk about the structure of the U.S. court system and how exactly it manages to keep things moving smoothly. We’’ll talk about trial courts, district courts, appeals courts, circuit courts, state supreme courts, and of course the one at the top - the U.S. Supreme Court. It’s all quite a bit to manage with jurisdictions and such, but it's important to remember that the vast majority of cases never even make it to court! Most are settled out of court, but also terms like mootness and ripeness are used to throw cases out altogether. Today, we're going to focus on how cases make it to the top, and next week we’ll talk about what happens when they get there.

This is the video from the court hearing concerning extending the restraining order placed on Jared Stevens by the courts pertaining to his ex-wife. Actually it was an emergency hearing since the previous hearing scheduled on 08-13-13 (which we were not granted permission to video tape) Jared's ex-wife did not appear at all and Judge Moore dismissed the motion to extend. Jared's ex-wife was contacted by the court the following day to find out why she did not appear and then a motion by her lawyer was put in asking for an emergency hearing. Listen to this hearing and see what happens this time around.

The U.S. Court of Appeals for the 9th District heard oral argument in the case of Santiago v. Rumsfeld. Sergeant Emiliano Santiago, a member of the Oregon Army National Guard, had two weeks left of an 8-year agreement to serve in the National Guard when was he ordered to Afghanistan for a year or more. Sergeant Santiago sought an injunction to stop his deployment to Afghanistan while he challenged the "stop loss" order that requires him to remain in the military beyond the term of his enlistment contract.
After hearing oral argument, the Ninth Circuit's three-judge panel affirmed the lower court's decision in favor of the government's argument and denied an injunction to stop Sergeant Santiago's deployment to Afghanistan.
The case was heard in the moot courtroom of the University of Washington School of Law.

"You can only imagine, but not experience, what it's like to live in a society where these freedoms are absent."
Born in 1950 to Holocaust survivors, Kozinski grew up as a committed communist in Bucharest, Romania. On his first trip outside of the Iron Curtain, in Vienna, Austria, he experienced forbidden luxuries like bubble gum and bananas. It was his first taste of freedom, and it caused him to become, in his words, "an instant capitalist."
Today, Kozinski is responsible for some of the most influential - and controversial - legal decisions in the United States. Kozinski's rulings have challenged the Obama administration over the issue of same-sex marriage. In a case that tested the limits of parody and artistic expression, he has weighed in on whether a Barbie doll qualifies as a sex object. In one of the most influential dissents in recent memory, he caused federal prosecutors to drop all charges against a defendant who'd been convicted of smuggling of illegal immigrants across the U.S.-Mexican border.
Kozinski sat down with Reason editor-in-chief Matt Welch during Reason Weekend in Las Vegas for a wide-ranging discussion about freedom and the law. How do mobile phones and cloud computing affect our right to privacy? Why do judges interpret the commerce clause of the U.S. Constitution so broadly? What's wrong with the practice of jury nullification?
Kozinski, a self-described libertarian, answers these questions, and many others, with the insight and wry humor that comes from decades of experience on the bench - and a childhood under communism.

Circuit court is the name of court systems in several common law jurisdictions.
King Henry II instituted the custom of having judges ride around the countryside ("ride circuit") each year to hear cases, rather than forcing everyone to bring their cases to London (see Assize of Clarendon). Thus, the term "circuit court" is derived from the practice of having judges ride around the countryside each year on pre-set paths − circuits − to hear cases. Especially on the United States frontier, a judge might travel alone on horseback along with a group of lawyers. Abraham Lincoln was one such attorney who would ride the circuit in Illinois. In more settled areas, a stagecoach would be used. Eventually the legal caseload in a county would become great enough to warrant the establishment of a local judiciary. Most of these local judicial circuits (that is, in terms of the actual routes traveled by judges) have been thus replaced by judges regularly stationed at local courthouses, but in many areas the legacy term remains in use.

Judge Alex Kozinski: From Communist Romania to the 9th Circuit Court of Appeals
"Those of you who've had the good fortune to be born in the United States simply have not known the absence of freedoms," says Judge Alex Kozinski, Chief Judge of the U.S Court of Appeals for the Ninth Circuit. "You can only imagine, but not experience, what it's like to live in a society where these freedoms are absent." Born in 1950 to Holocaust survivors, Kozinski grew up as a committed communist in Bucharest, Romania. On his first trip outside of the Iron Curtain, in Vienna, Austria, he experienced forbidden luxuries like bubble gum and bananas. It was his first taste of freedom, and it caused him to become, in his words, "an instant capitalist." Today, Kozinski is responsible for some of the most influential - and controversial - legal decisions in the United States. Kozinski's rulings have challenged the Obama administration over the issue of same-sex marriage. In a case that tested the limits of parody and artistic expression, he has weighed in on whether a Barbie doll qualifies as a sex object. In one of the most influential dissents in recent memory, he caused federal prosecutors to drop all charges against a defendant who'd been convicted of smuggling of illegal immigrants across the U.S.-Mexican border. Kozinski sat down with Reason editor-in-chief Matt Welch during Reason Weekend in Las Vegas for a wide-ranging discussion about freedom and the law. How do mobile phones and cloud computing affect our right to privacy? Why do judges interpret the commerce clause of the U.S. Constitution so broadly? Actually it was an emergency hearing since the previous hearing scheduled on 08-13-13 (which we were not granted permission to video tape) Jared's ex-wife did not appear at all and Judge Moore dismissed the motion to extend. Jared's ex-wife was contacted by the court the following day to find out why she did not appear and then a motion by her lawyer was put in asking for an emergency hearing. Listen to this hearing and see what happens this time around.

On Monday, Jury selection began for a $75 million civil lawsuit by Fox Sports reporter Erin Andrews, who has accused a Nashville hotel of negligence for allowing a stalker to take nude videos of her in her room. Thomas David House Of Deegan Supporter's Reactions To Court Room Tyranny
Friends and family of Thomas David House of Deegan came to support him during his hearing in Wood County Circuit Court in Parkersburg, WV. Thomas was arrested last September and is being charged by the state of WEST VIRGINIA (incorporated) for threat of acts of terrorism. The hearing today was supposed to be for alleged violation of home confinement but the 2 charges seem to be intermingled together. The hearing today has been continued until March 15, the same day of Thomas's trial for alleged threat of acts of terrorism. The 2 cases will now apparently be brought simultaneously. Thomas challenged the state on 6 different demands centering on the court's purported jurisdiction and authority. Judge Jeff Reed defined these demands as motions and allegations. Each of them were denied and dismissed. We walked into the courtroom with Bibles raised high, signifying the Almighty authority of our Heavenly Father. Afterwards, some reactions were given. Bad news for Ted Cruz: his eligibility for president is going to court. The Circuit Court of Cook County in Chicago has agreed to hear a lawsuit on Sen. Ted Cruz's eligibility for president — virtually ensuring that the issue dominates the news in the runup to the South Carolina primary. Cruz was born in Canada to a US citizen mother and a noncitizen father. The Constitution requires presidents be "natural-born citizens," but what exactly that requires hasn't been settled in court. Now, perhaps, it will be. The lawsuit in Illinois aims to resolve the question by challenging Cruz's eligibility for the presidency. It was filed by Lawrence Joyce, an attorney who has told local media that he supports Dr. Ben Carson and has had no connection with the Trump campaign. "Joyce said his concern is that the eligibility issue lie unresolved during Republican primaries, thus letting the Democrats take advantage of it after a potential Cruz nomination, when it’d be too late," reports the Washington Examiner. When this question initially came up, the conventional wisdom among constitutional lawyers was that it was a nonissue: Cruz was obviously eligible. But as the debate has heated up among candidates (with Donald Trump, in particular, fanning the flames), it's also begun to heat up among constitutional law scholars. -

William Smith, a veteran Florence attorney, former Lauderdale County Commissioner, and current Lauderdale County License Commissioner is a Republican candidate for Lauderdale County Circuit Court Judge, Place #1 in the Republican Primary set for March 1, 2016. The office is being vacated by Judge Billy Jackson and is an open seat. Smith said, “I have accomplished my goal of transforming the Lauderdale County License Commissioner’s Office into a 21st century digital office. I have been a practicing attorney and student of the law for over a quarter of a century. It is now time for me to return to my true passion, the law. I have the experience the people of Lauderdale County can trust to be their next Circuit Court Judge. With guidance from the Lord and the approval of the voters, I hope to bring my God-given talents to the office of Lauderdale County Circuit Judge so I can continue serving the people of Lauderdale County by fairly and impartially administering the law.” If elected, Smith would like to pursue the possibility of establishing a Veterans’ Treatment Court in Lauderdale County. Veterans’ Treatment Courts are designed for veterans who have returned from serving our county in a combat zone and have extreme difficulty readjusting to civilian life. Some of our military heroes unfortunately return home with issues relating to their mental health, substance abuse, family turmoil, unemployment, and homelessness. Often times the difficulty of readjusting to life back home has led to some of our veterans being in the criminal justice system and incarcerated. A Veterans’ Treatment Court can help these wounded veterans readjust to civilian life and help connect them to the programs, benefits, and services they have earned. William’s family roots in Lauderdale County date back to the 1820s where his forefathers and ancestors were farmers, soldiers, and some of the earliest settlers in the Greenhill and Killen communities. A fifth generation Lauderdale County resident, William is a product of the Florence City School System, and a graduate of the University of North Alabama where he received both his undergraduate and Masters of Business Administration degrees. Smith received his law degree from Cumberland School of Law of Samford University in Birmingham in 1992. He is licensed to practice law in Alabama and Georgia, as well as the federal courts. His previous work experiences include everything from working on a farm to working as a substitute teacher in public schools to serving as an adjunct professor of Business Law at both Northwest Shoals Community College and the University of North Alabama. Thomas was arrested last September and is being charged by the state of WEST VIRGINIA (incorporated) for threat of acts of terrorism. The hearing today was supposed to be for alleged violation of home confinement but the 2 charges seem to be intermingled together. The hearing today has been continued until March 15, the same day of Thomas's trial for alleged threat of acts of terrorism. The 2 cases will now apparently be brought simultaneously. Thomas challenged the state on 6 different demands centering on the court's purported jurisdiction and authority. Judge Jeff Reed defined these demands as motions and allegations. Each of them were denied and dismissed. We walked into the courtroom with Bibles raised high, signifying the Almighty authority of our Heavenly Father. Afterwards, some reactions were given. In this video, Carl Swenson from Atlanta, GA is moderating. Reactions are given by Phil Hudok (2016 Constitution Party candidate for the governorship of WVa), Joseph Cannon (ladm.us), Pastor Butch Paugh from Nettie, Leonard from California, and last but certainly not least is Thomas's mother Darlene Deegan, who was emotionally charged. The Circuit Court of Cook County in Chicago has agreed to hear a lawsuit on Sen. Ted Cruz's eligibility for president — virtually ensuring that the issue dominates the news in the runup to the South Carolina primary.
Cruz was born in Canada to a US citizen mother and a noncitizen father. The Constitution requires presidents be "natural-born citizens," but what exactly that requires hasn't been settled in court.
Now, perhaps, it will be. The lawsuit in Illinois aims to resolve the question by challenging Cruz's eligibility for the presidency. It was filed by Lawrence Joyce, an attorney who has told local media that he supports Dr. Ben Carson and has had no connection with the Trump campaign.
"Joyce said his concern is that the eligibility issue lie unresolved during Republican primaries, thus letting the Democrats take advantage of it after a potential Cruz nomination, when it’d be too late," reports the Washington Examiner.

Often times the difficulty of readjusting to life back home has led to some of our veterans being in the criminal justice system and incarcerated. A Veterans’ Treatment Court can help these wounded veterans readjust to civilian life and help connect them to the programs, benefits, and services they have earned.
William’s family roots in Lauderdale County date back to the 1820s where his forefathers and ancestors were farmers, soldiers, and some of the earliest settlers in the Greenhill and Killen communities. A fifth generation Lauderdale County resident, William is a product of the Florence City School System, and a graduate of the University of North Alabama where he received both his undergraduate and Masters of Business Administration degrees. Smith received his law degree from Cumberland School of Law of Samford University in Birmingham in 1992. He is licensed to practice law in Alabama and Georgia, as well as the federal courts. His previous work experiences include everything from working on a farm to working as a substitute teacher in public schools to serving as an adjunct professor of Business Law at both Northwest Shoals Community College and the University of North Alabama.

Arar v. Ashcroft Oral Arguments - U.S. Court of Appeals - 282779-1-DVD - 2008-12-09 - Second Circuit Court of Appeals heard oral argument in Arar v. Ashcroft. All 12 appeals judges sat in an en banc session to hear the appeal to the 2 to 1 ruling in June 2008 by a Second Circuit three-judge panel that the federal courts lacked jurisdiction to hear Mr. Arar's complaint. Maher Arar is challenging his rendition by the U.S. government to Syria, where he alleges he was tortured and released after one year without being charged. Maher Arar, a Syrian-born, Canadian citizen was detained during a layover at the J.F.K. Airport in New York City in September 2002 on his way home to Canada. He was held in solitary confinement for nearly two weeks. At the time, the U.S. government thought he was a member of al-Qaeda and sent him to Syria, not Canada, the country of his citizenship. Mr. Arar's suit charges that his Fifth Amendment due process rights were violated when he was confined without access to an attorney, both domestically and in Syria.
