Keynote Lecture by Professor Yochai Benkler (Harvard Law School) at the IASC 2nd Thematic Conference on Knowledge Commons - Engelberg Center, New York University School of Law, September, 2014
According to Professor Yochai Benkler, the past three decades have seen the emergence and growth of rich literature on the commons, which challenged some of the intellectual foundations of financial, dehumanized form of late-twentieth-century capitalism.
In his keynote lecture, Professor Benkler discusses how work on the commons pushed back against five core elements of such ideology. First, work of the Ostrom school beat back Olson-inspired skepticism about the possibility of self-organization, and has been extended to new areas by work of culturally reconstructed commons. Second, the Institutional Analysis and Development Framework pushed back on the plausibility of abstract modeling as the most useful foundation for designing institutional and organizational models, insisting on diversity, complexity and context. Third, work on the information commons and open access models for infrastructure resources refuted the claimed dominance of exclusive property and price-based exchange as the precondition of growth and material well-being. Fourth, the success of commons-based production provided extensive existence proof, which combined with experimental work operated to refute the idea that universal self-interest was a usable model of human behavior to inform institutional and organizational design. Fifth, and finally, the work on global commons combined with investigations of social production to underscore the necessity of, and possible paths towards, a re-embedding of production in social relations.
Professor Benkler concludes that, together, these combine to provide an image of a possible path of humane, socially-embedded
production system for the twenty-first century.

Abstract: Since the 1990's, Yochai Benkler has explored the role of information commons and decentralized collaboration in innovation, information production, and freedom in the networked economy and society. In 2012, he received a lifetime achievement award from Oxford University "in recognition of his extraordinary contribution to the study and public understanding of the Internet and information goods." Additionally, Benkler has advised governments and international organizations on innovation policy and telecommunications, and serves on the boards or advisory boards of several nonprofits engaged in working towards an open society.
Professor Benkler's lecture served as the keynote address of the Publish or Perish conference put on by the Mellon Digital Cultures Initiative on the UC Davis Campus as well as the third lecture in the 2013-2014 Provost's Forms lecture series.

Yochai Benkler is an Israeli-American professor of Law and author. Since 2007, he has been the Berkman Professor of Entrepreneurial Legal Studies at Harvard Law School. He is also a faculty co-director of the Berkman Center for Internet & Society at Harvard University.
In 1984, Benkler was the treasurer of Kibbutz Shizafon. He received his LL.B. from Tel-Aviv University in 1991 and J.D. from Harvard Law School in 1994. He worked at the law firm Ropes & Gray from 1994-1995. He clerked for U.S. Supreme Court Justice Stephen G. Breyer from 1995 to 1996.
He was a professor at New York University School of Law from 1996 to 2003, and visited at Yale Law School and Harvard Law School (during 2002-2003), before joining the Yale Law School faculty in 2003. In 2007, Benkler joined Harvard Law School, where he teaches and is a faculty co-director of the Berkman Center for Internet & Society. Benkler is on the advisory board of the Sunlight Foundation. In 2011, his research led him to receive the $100,000 Ford Foundation Social Change Visionaries Award.

According to Professor Yochai Benkler, the past three decades have seen the emergence and growth of rich literature on the commons, which challenged some of the intellectual foundations of financial, dehumanized form of late-twentieth-century capitalism.
In his keynote lecture, Professor Benkler discusses how work on the commons pushed back against five core elements of such ideology. First, work of the Ostrom school beat back Olson-inspired skepticism about the possibility of self-organization, and has been extended to new areas by work of culturally reconstructed commons. Second, the Institutional Analysis and Development Framework pushed back on the plausibility of abstract modeling as the most useful foundation for designing institutional and organizational models, insisting on diversity, complexity and context. Third, work on the information commons and open access models for infrastructure resources refuted the claimed dominance of exclusive property and price-based exchange as the precondition of growth and material well-being. Fourth, the success of commons-based production provided extensive existence proof, which combined with experimental work operated to refute the idea that universal self-interest was a usable model of human behavior to inform institutional and organizational design. Fifth, and finally, the work on global commons combined with investigations of social production to underscore the necessity of, and possible paths towards, a re-embedding of production in social relations.
Professor Benkler concludes that, together, these combine to provide an image of a possible path of humane, socially-embedded
production system for the twenty-first century.

Kaja Scheliga had the chance to interview Yochai Benkler after the Colloquium. She asked him about current developments centered on issues related to internet and society, what conditions are needed for commons-based peer production to flourish, how the discussion of selfishness versus human capabilities to cooperate translate into the realm of science and whether openness in science provides us with a new degree of freedom.
These were the questions:
In your 2005 TED talk on the new open-source economics you say that decisions are being made about the "future of the freedom to be as social beings with each other, and the way information, knowledge and culture will be produced". You also say that a battle is being fought about how difficult it will be for new models of production to develop alongside the industrial information economy.
Since then, we have seen a lot of development and many power-shifts. Where do we stand now in the battlefield?
Erich Fromm, in his book To Have or to Be, describes two states of man: the having mode which focuses on material possessions and power, and is the source of evil; and the being mode which is centered on love, sharing and productive activity. Fromm describes the conditions for human change and the features of the new man. One of these features is the "joy that comes from giving and sharing, not from hoarding and exploiting".
Where do you see the balance between the having mode and being mode in our contemporary society? What conditions are needed for commons-based peer production to flourish? Where do you see threats?
In your latest book the Penguin and the Leviathan, you discuss selfishness versus human capabilities to cooperate. You argue that even though people behave selfishly some of the time, they are not concerned with self-interest all of the time. You claim that people care about what is right and fair and normal and that human potential for cooperation is in fact greater than we assume. How does the discussion about selfishness and the potential to cooperate translate to the realm of science?
Let's talk about Open Science. The Open Access movement has gained momentum. There are experiments around new forms of scientific publication models. There is an increasing pressure to share data. If we consider Open Science in the sense of making the whole research process - not just its end results - more transparent and accessible, where do you see the up- and downsides? Does openness in Science provide us with a new degree of freedom?
Do you have a vision of a future centered on Internet and Society? Where are the current development taking us?

Yochai Benkler was the speaker of the WZB Berlin Colloquium "Rethinking Law in a Global Context: Private Ordering and Public Authority" on 11 June 2013. There Professor Benkler discussed his recent paper "Practical Anarchism: Peer Mutualism, Market Power, and the Fallible State".
Kaja Scheliga had the chance to interview Yochai Benkler after the Colloquium. She asked him about current developments centered on issues related to internet and society, what conditions are needed for commons-based peer production to flourish, how the discussion of selfishness versus human capabilities to cooperate translate into the realm of science and whether openness in science provides us with a new degree of freedom.
These were the questions:
In your 2005 TED talk on the new open-source economics you say that decisions are being made about the "future of the freedom to be as social beings with each other, and the way information, knowledge and culture will be produced". You also say that a battle is being fought about how difficult it will be for new models of production to develop alongside the industrial information economy.
Since then, we have seen a lot of development and many power-shifts. Where do we stand now in the battlefield?
Erich Fromm, in his book To Have or to Be, describes two states of man: the having mode which focuses on material possessions and power, and is the source of evil; and the being mode which is centered on love, sharing and productive activity. Fromm describes the conditions for human change and the features of the new man. One of these features is the "joy that comes from giving and sharing, not from hoarding and exploiting".
Where do you see the balance between the having mode and being mode in our contemporary society? What conditions are needed for commons-based peer production to flourish? Where do you see threats?
In your latest book the Penguin and the Leviathan, you discuss selfishness versus human capabilities to cooperate. You argue that even though people behave selfishly some of the time, they are not concerned with self-interest all of the time. You claim that people care about what is right and fair and normal and that human potential for cooperation is in fact greater than we assume. How does the discussion about selfishness and the potential to cooperate translate to the realm of science?
Let's talk about Open Science. The Open Access movement has gained momentum. There are experiments around new forms of scientific publication models. There is an increasing pressure to share data. If we consider Open Science in the sense of making the whole research process - not just its end results - more transparent and accessible, where do you see the up- and downsides? Does openness in Science provide us with a new degree of freedom?
Do you have a vision of a future centered on Internet and Society? Where are the current development taking us?

Emily Castor believes authentic communication can build meaningful communities around transportation. Emily is an original Lyft team member who has helped develop the ride sharing service into what it is today as the Director of Community Relations. Along the way, she honed her expertise in the shared economy through work with Congress, political candidates, and Universities. She learned the importance of having a presence on social media, and has turned her social presence into grassroots mobilization and community outreach. From here, she is working to pass laws on Capitol Hill, and encourage policy makers to adopt ridesharing as an environmentally-conscious and community-based alternative form of transportation.
In her free time, Emily hosts Collaborative Chats, a monthly panel discussion for citizens, entrepreneurs, academics, and thought leaders to build community and discuss emerging issues of relevance to the sharing economy.
