Veteran Bollywood actor and Padma Bhushan awardee Anupam Kher slammed the Congress party and the entire intolerance brigade while speaking at ‘The Telegraph National Debate’ on March 5.
Kher started by taking on Justice Asok Kumar Ganguly who spoke before him and had called the Supreme Court judgement in Afzal Guru case wrong. “I am shocked, ashamed and saddened by what you said being a judge you say that SC judgement was wrong,” Kher said to Justice Ganguly.
He also said that if Congress Vice-President Rahul Gandhi became even one-tenth of what Prime Minister Narendra Modi was, he would vote for him.
He also lashed out at Kanhaiya Kumar, who he said was being projected as a hero, for being a participant at the event in which anti-India slogans were raised.

In the cloistered chambers of the Supreme Court, Justice Antonin Scalia’s days were highly regulated and predictable. He met with clerks, wrote opinions and appeared for arguments in the august courtroom on a schedule set months in advance.
Yet as details of Scalia’s sudden death trickled in Sunday, it appeared that the hours afterward were anything but orderly. The man known for his elegant legal opinions and profound intellect was found dead in his room at a hunting resort by the resort’s owner, who grew worried when Scalia didn’t appear at breakfast Saturday morning.
It then took hours for authorities in remote West Texas to find a justice of the peace, officials said Sunday. When they did, Presidio County Judge Cinderela Guevara pronounced Scalia dead of natural causes without seeing the body — which is permissible under Texas law — and without ordering an autopsy.
As official Washington tried to process what his demise means for politics and the law, some details of Scalia’s final hours remained opaque. As late as Sunday afternoon, for example, there were conflicting reports about whether an autopsy should have been performed. A manager at the El Paso funeral home where Scalia’s body was taken said that his family made it clear they did not want one.
One of two other officials who were called but couldn’t get to Scalia’s body in time said that she would have made a different decision on the autopsy.

The Supreme Court of the United States is the highest judicial body in the United States. Its membership consists of the Chief Justice of the United States and eight Associate Justices. The Justices are nominated by the President of the United States and appointed after confirmation by the United States Senate. Justices of the Supreme Court have life tenure and receive a salary which is currently set at $223,500 per year for the Chief Justice and at $213,900 per year for each Associate Justice. On August 7, 2010, Justice Elena Kagan became the 112th justice to have served on the Court.
The Supreme Court was created in 1789 by Article III of the United States Constitution, which stipulates that the "judicial Power of the United States, shall be vested in one supreme Court" together with any lower courts Congress may establish. Congress organized the Court that year with the passage of the Judiciary Act of 1789. It specified the Court's original and appellate jurisdiction, created thirteen judicial districts, and fixed the number of justices at six (one Chief Justice and five Associate Justices).

A supreme court is the highest court within the hierarchy of many legal jurisdictions. Other descriptions for such courts include court of last resort, instance court, judgment court, apex court, and highest court of appeal. Broadly speaking, the decisions of a supreme court are not subject to further review by any other court.
In a few places, the court named the "Supreme Court" is not in fact the highest court; examples include the Supreme Court of the State of New York and the former Supreme Court of Judicature of England and Wales. Conversely, the highest court in some jurisdictions is not named the "Supreme Court"; for example, the High Court of Australia.
Supreme courts typically function primarily as appellate courts, hearing appeals from decisions of lower trial courts, or from intermediate-level appellate courts.
Some countries have multiple "supreme courts" whose respective jurisdictions have different geographical extents, or which are restricted to particular areas of law. In particular, countries with a federal system of government typically have both a federal supreme court (such as the Supreme Court of the United States), and supreme courts for each member state (such as the Supreme Court of Nevada), with the former having jurisdiction over the latter only to the extent that the federal constitution extends federal law over state law; the US states of Texas and Oklahoma also split the functions of a supreme court between separate courts for criminal and civil cases. Jurisdictions with a civil law system often have a hierarchy of administrative courts separate from the ordinary courts, headed by a supreme administrative court. A number of jurisdictions also follow the "Austrian" model of a separate constitutional court (first developed in the Czechoslovak Constitution of 1920).

Anupam Kher (born 7 March 1955) is an Indian actor who has appeared in nearly 450 films and 100 plays. Though mainly appearing in Bollywood films, he has had roles in some films from other nations as well. He has held the post of Chairman of the Censor Board and National School of Drama in India.
Anupam Kher was born into a Kashmiri Pandit family and lived in Shimla and was educated at D.A.V. School there. He is an alumnus and a former chairperson of the National School of Drama. Some of his early acting was in plays performed at the Himachal Pradesh University.
Kher made his acting debut in the 1982 Hindi movie Aagman. Then in 1984 came Saaransh, where 28-year old Kher played a retired man who has lost his son. He hosted TV shows such as Say Na Something To Anupam Uncle, Sawaal Dus Crore Ka and the recent Lead India. He has had many comic roles but has also played the villain such as his acclaimed role as terrorist Dr. Dang in Karma (1986). For his role in Daddy (1989) he received the Filmfare Critics Award for Best Performance. Kher has won the Filmfare Award for Best Performance in a Comic Role five times, more than any other actor.

He met with clerks, wrote opinions and appeared for arguments in the august courtroom on a schedule set months in advance. Yet as details of Scalia’s sudden death trickled in Sunday, it appeared that the hours afterward were anything but orderly. The man known for his elegant legal opinions and profound intellect was found dead in his room at a hunting resort by the resort’s owner, who grew worried when Scalia didn’t appear at breakfast Saturday morning. It then took hours for authorities in remote West Texas to find a justice of the peace, officials said Sunday. When they did, Presidio County Judge Cinderela Guevara pronounced Scalia dead of natural causes without seeing the body — which is permissible under Texas law — and without ordering an autopsy. As official Washington tried to process what his demise means for politics and the law, some details of Scalia’s final hours remained opaque. As late as Sunday afternoon, for example, there were conflicting reports about whether an autopsy should have been performed. A manager at the El Paso funeral home where Scalia’s body was taken said that his family made it clear they did not want one. One of two other officials who were called but couldn’t get to Scalia’s body in time said that she would have made a different decision on the autopsy. -

In the cloistered chambers of the Supreme Court, Justice Antonin Scalia’s days were highly regulated and predictable. He met with clerks, wrote opinions and appeared for arguments in the august courtroom on a schedule set months in advance.
Yet as details of Scalia’s sudden death trickled in Sunday, it appeared that the hours afterward were anything but orderly. The man known for his elegant legal opinions and profound intellect was found dead in his room at a hunting resort by the resort’s owner, who grew worried when Scalia didn’t appear at breakfast Saturday morning.
It then took hours for authorities in remote West Texas to find a justice of the peace, officials said Sunday. When they did, Presidio County Judge Cinderela Guevara pronounced Scalia dead of natural causes without seeing the body — which is permissible under Texas law — and without ordering an autopsy.
As official Washington tried to process what his demise means for politics and the law, some details of Scalia’s final hours remained opaque. As late as Sunday afternoon, for example, there were conflicting reports about whether an autopsy should have been performed. A manager at the El Paso funeral home where Scalia’s body was taken said that his family made it clear they did not want one.
One of two other officials who were called but couldn’t get to Scalia’s body in time said that she would have made a different decision on the autopsy.

Their insights are surprising and enlightening from a variety of perspectives. Their comments bring up pressing questions for us today:
1.) Should the Supreme Court 'create' law in the way they interpret and apply the constitution?
2.) Was Roe correctly decided in the first place, or was there a better way to decide that case?
3.) Should Roe be overturned?
Roe v Wade was the SCOTUS decision in January of 1973 that along with Doe v Bolton overturned the laws in every state that were protecting the human in the womb by prohibiting/restricting abortion. The Roe decision created a trimester framework that prevented the peoples representatives at the state and federal level from passing laws prohibiting abortion and thereby protecting the human in the womb prior to the 3rd trimester. Planned Parenthood v Casey was decided in 1992 and changed the standard from a trimester framework to a viability standard, allowing states to prohibit abortion only after the human in the womb was deemed viable, based on the technology at the time. Viability is generally agreed to be somewhere between 22-24 weeks, near the end of the second trimester. The question today is, should the people through their representatives be determining the law on abortion (in which case Roe would need to be overturned) or should SCOTUS prevent the people from deciding these laws (in which case Roe should stand)? Currently, there are over 1 million abortions each year. If abortion were added to the CDC leading cause of death list, it would be the leading cause of death. This statistic suggests the question for us today: Is there a better way than Roe?
The Supreme Court is today the last branch of gov't where even though differences clearly exist, the Justices are cordial and even encouraging to one another. I have a great deal of respect for their civility, mutual respect and deep legal insight, even when I don't agree with their decisions. I am grateful for their willingness to share their insights with all of us and I hope their comments will help all of us gain a better appreciation and understanding of the pivotal and powerful role of the Supreme Court.

According to a report, Scalia, an associate justice, arrived at the ranch Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.
The veil of privacy was lifted Saturday off a remote West Texas ranch where Supreme Court Justice Antonin Scalia suddenly died.
Cibolo Creek Ranch, a luxury compound built around three 19th-century forts, has played host to movie stars and European royalty lured by the spare beauty of the desert.
Now, it will be known as the place where Scalia, a firebrand conservative whose vacancy on the Supreme Court launched an immediate political fight, spent his final hours.
The 30,000-acre resort, located less than an hour from the Mexican border crossing at Ojinaga, is tucked into the Chinati Mountains, 33 miles south of Marfa, Tex.
For the well-heeled, getting to the ranch is convenient by private jet: four miles from the main office, it offers a private airport.

The combination of convenience and privacy has attracted celebrities, reportedly including Mick Jagger, Jerry Hall, Bruce Willis and Tommy Lee Jones, to Cibolo over the years.
Jones used the property, which is located inside the crater of an extinct volcano, to shoot scenes for his 2005 film, “The Three Burials of Melquiades Estrada,” according to IMDB.com.
A tabloid-worthy legal brawl adds to the resort’s Hollywood allure. In 2010, the ranch sued Randy Quaid, an actor best known for supporting roles in National Lampoon’s “Vacation” films and “Independence Day,” for an unpaid bill totaling $24,859 after a 10-month stay.
Hollywood figures are among a wider group of international jet-setters who frequent the ranch, once featured in Vogue magazine, where rooms can cost above $500 per night.
In 2010, according to local news source CultureMap Houston, 53 members of an international hunting society gathered at Cibolo to take advantage of its shooting. (Minor royalty was on hand: Archduke Andreas Salvatore Hapsburg-Lothrengin, the Prince of Tuscany and Royal Prince of Hungary and Bohemia, “came in from Spain for the festivities,” the site reported.)
Guests can organize bird hunts — pheasant and chukar are plentiful on the property — as well as pursue bigger game, from deer and elk to buffalo, javelinas and mountain lions.
The ranch is named after a Spanish term for bison used in the Old West, the era that most informs the rustic atmosphere of the resort.
[Why it’s unusual for a justice to die in office]
In addition to the old forts, which have been converted to luxury accommodations, the compound is comprised of low-lying buildings surrounded by stone-built walls that give way to desert scrub.
It is unclear where on the compound Scalia was staying when he died. He was at the ranch for a private event.
Owner John Poindexter obtained the property in 1988 and undertook an extensive renovation of the forts and outbuildings. A third-generation Texan, Poindexter runs a Houston-based manufacturing company, J.B. Poindexter & Co. and is a leader in the Order of St. Hubertus, the 17th-century hunting society whose members gathered at the resort in 2010.
Poindexter has occasionally made political donations to Democrats, according to the Federal Election Commission. Beneficiaries of his wealth included former representatives Ciro Rodriguez (D-Tex.) and Pete Gallego (D-Tex.), the latter of whom was defeated by Rep. Will Hurd (R-Tex.) in 2014.
In 2009, President Obama presented a Presidential Unit Citation, the highest military honor for a U.S. military unit, to a force commanded by Poindexter in Vietnam. The award was made for the unit’s “extraordinary heroism” in rescuing more than 70 soldiers from a North Vietnamese force in March 1970, the New York Times reported.

Obama is searching for a replacement for long-serving conservative Justice Antonin Scalia, who died on Feb. 13. With Scalia's death, the court is divided 4-4 between conservatives and liberals.
Obama's nominee could move the court to the left for the first time in decades.
Republicans, who control the U.S. Senate, have vowed not to hold confirmation hearings or an up-or-down vote on any nominee picked by the Democratic president for the lifetime position on the court. Senate confirmation is required for any nominee to join the bench.
Senate Majority Leader Mitch McConnell has suggested there might be no point even in holding the traditional "courtesy call" meetings with whomever Obama nominates, infuriating Senate Minority Leader Harry Reid and his fellow Democrats.
Republicans, hoping a candidate from their party wins the Nov. 8 presidential election, want the next president, who takes office in January, to make the selection. Billionaire Donald Trump is the leading Republican presidential candidate; Obama's former secretary of state, Hillary Clinton, is the front-runner on the Democratic side.
Srinivasan, 49, and Garland, 63, serve together on the U.S. Court of Appeals for the District of Columbia Circuit. That appeals court has served as a springboard to the Supreme Court for several justices including Scalia in recent decades.
Srinivasan, who was born in India and grew up in Kansas, would be the first Asian-American and first Hindu on the high court. Obama appointed him to the appeals court in 2013. The Senate confirmed him in a 97-0 vote.
He could appeal to the president's long-declared interest in bringing more diversity to the bench.
Srinivasan has served in the Justice Department under Democratic and Republican presidents and worked as a clerk to the first woman to serve on the Supreme Court, Sandra Day O'Connor, a Republican appointee.
Garland, who has earned praise from lawmakers of both parties, is the chief judge of the Washington appeals court, where he has served since being appointed by Democratic President Bill Clinton in 1997, winning confirmation in a 76-23 vote. Prior to that, he served in the Justice Department under Clinton.
With Senate Republicans vowing to turn their backs on anyone he picks to fill the vacancy, Obama may be looking for a nominee who could convince the Republicans to change course. Garland could fit that bill with moderate record, background as a prosecutor and a history of drawing Republican support.

President Barack Obama says he'll announce his Supreme Court nominee in a Rose Garden ceremony on Wednesday morning.
Obama will name the pick at an 11 a.m. In the subject line of an email to supporters, the president said: "I've made my decision."
Sources have told The Associated Press that Obama has narrowed the list to three appeals court judges: Merrick Garland, the chief judge of the appeals courts in Washington, D.C.; Sri Srinivasan, a judge on that court; and Paul Watford of the appeals courts based in San Francisco.
Obama is likely to announce either Srinivasan or Garland, a source told Reuters.
Obama is searching for a replacement for long-serving conservative Justice Antonin Scalia, who died on Feb. 13. With Scalia's death, the court is divided 4-4 between conservatives and liberals.
Obama's nominee could move the court to the left for the first time in decades.
Republicans, who control the U.S. Senate, have vowed not to hold confirmation hearings or an up-or-down vote on any nominee picked by the Democratic president for the lifetime position on the court. Senate confirmation is required for any nominee to join the bench.
Senate Majority Leader Mitch McConnell has suggested there might be no point even in holding the traditional "courtesy call" meetings with whomever Obama nominates, infuriating Senate Minority Leader Harry Reid and his fellow Democrats.
Republicans, hoping a candidate from their party wins the Nov. 8 presidential election, want the next president, who takes office in January, to make the selection. Billionaire Donald Trump is the leading Republican presidential candidate; Obama's former secretary of state, Hillary Clinton, is the front-runner on the Democratic side.
Srinivasan, 49, and Garland, 63, serve together on the U.S. Court of Appeals for the District of Columbia Circuit. That appeals court has served as a springboard to the Supreme Court for several justices including Scalia in recent decades.
Srinivasan, who was born in India and grew up in Kansas, would be the first Asian-American and first Hindu on the high court. Obama appointed him to the appeals court in 2013. The Senate confirmed him in a 97-0 vote.
He could appeal to the president's long-declared interest in bringing more diversity to the bench.
Srinivasan has served in the Justice Department under Democratic and Republican presidents and worked as a clerk to the first woman to serve on the Supreme Court, Sandra Day O'Connor, a Republican appointee.
Garland, who has earned praise from lawmakers of both parties, is the chief judge of the Washington appeals court, where he has served since being appointed by Democratic President Bill Clinton in 1997, winning confirmation in a 76-23 vote. Prior to that, he served in the Justice Department under Clinton.
With Senate Republicans vowing to turn their backs on anyone he picks to fill the vacancy, Obama may be looking for a nominee who could convince the Republicans to change course. Garland could fit that bill with moderate record, background as a prosecutor and a history of drawing Republican support.

The top court’s larger bench will hear former president Pervez Musharraf’s plea, seeking one-time permission to go abroad for medical treatment.
The three-judge bench, headed by Chief Justice of Pakistan Anwar Zaheer Jamali, took up Musharraf’s application on Tuesday to grant him one-time exemption to go abroad.
Musharraf’s counsel Barrister Farogh Naseem apprised the apex court that in its April 8, 2013 order the apex court had directed the federation and all relevant functionaries to ensure that Musharraf does not leave Pakistan till the final decision. Naseem added that the court had directed the secretary interior to place Musharraf’s name on the ECL forthwith. However, the order did not reflect in the final judgment of the august court, passed on 3rd July, 2013, he added.
The counsel further informed that the Sindh High Court on June 12, 2014 had ordered the removal of Musharraf’s name from the ECL, but allowed the federal government two weeks’ time to file an appeal against its decision.
But on the federal government’s plea, the top court’s five-judge bench had suspended the SHC order on June 23, 2014 to remove Musharraf’s name from the ECL and adjourned the hearing for one month to address five questions.
In the four-page verdict, written by former CJP Nasirul Mulk, the apex court had raised five questions: (1) Was the court’s April 8, 2013, decision interim? (2) On the basis of the integration of the law, was the interim decision included in the final decision? (3) Can the Sindh High Court (SHC) suspend the April 5, 2013, decision to put Musharraf’s name on the ECL? (4) Can Musharraf be allowed to travel abroad without changing the court order? (5) Is the government’s decision to put Musharraf’s name on the ECL according to the 2010 rules?
The judgment is still awaited over these questions. During the hearing, the chief justice remarked that the bench did not want the matter to remain pending. Farogh Naseem informed the court that the matter is different from 2013 as at that time Musharraf wanted to go abroad to visit his ailing mother. But this time the situation is of an urgent nature as he needed one-time exemption to go abroad for medical treatment. The counsel also submitted Musharraf’s fresh medical report.

A group of conservative leaders has signed a letter pledging to back Republican senators in their effort to prevent President Barack Obama from naming another liberal justice to the Supreme Court.
The letter was sent by the Conservative Action Project and signed by more than 100 people, including Edwin Meese, former Attorney General to President Ronald Reagan, and Becky Norton Dunlop, who chairs CAP and is a former Reagan adviser.
The letter is aimed at letting senators know that they stand behind them as they face intense pressure to confirm a nominee before Obama leaves office.
Senate Democrats already have put political pressure on Senate Judiciary Chairman Charles Grassley of Iowa, who is in charge of whether confirmation hearings will be held, Roll Call notes.
Grassley, Majority Leader Mitch McConnell and other Republicans have said they believe the vacancy should not be filled until voters choose a new president.
The letter voices agreement with that sentiment.
The death of conservative Justice Antonin Scalia on February 13 left a vacancy that would cause a shift in the balance of the court if Obama names a liberal justice to replace him.
"Let there be no mistake about it: President Obama will nominate a liberal to this vacancy," the letter reads. "Press leaks about potential 'moderate' candidates should be interpreted as simply misdirection from the White House."
The goal of Obama and his fellow Democrats is to change the country by quashing political speech and gun rights as well as imposing abortion up to the point of birth funded by taxpayer dollars, they say.
"We are committed to acting with the same unity the GOP Senate has demonstrated to date in order to bring these issues to the forefront, to make clear to the American people what is at stake and to rally our fellow citizens to the cause of saving the Constitution," the letter says.
Signers include Gary L. Bauer, president of American Values, former GOP presidential candidate Herman Cain, former Majority Leader Tom DeLay, radio broadcaster James Dobson, Phyllis Schlafly of Eagle Forum, Grover Norquist of Americans for Tax Reform, Jenny Beth Martin of Tea Party Patriots, David Bossie of Citizens United, Brent Bozell of Media Research Center and former congressmen Bob McEwen of Ohio and David McIntosh of Indiana.

Thurgood Marshall (July 2, 1908 -- January 24, 1993) was an Associate Justice of the United States Supreme Court, serving from October 1967 until October 1991. Marshall was the Court's 96th justice and its first African American justice.
Before becoming a judge, Marshall was a lawyer who was best known for his high success rate in arguing before the Supreme Court and for the victory in Brown v. Board of Education, a decision that desegregated public schools. He served on the United States Court of Appeals for the Second Circuit after being appointed by President John F. Kennedy and then served as the Solicitor General after being appointed by President Lyndon Johnson in 1965. President Johnson nominated him to the United States Supreme Court in 1967.
On June 13, 1967, President Johnson nominated Marshall to the Supreme Court following the retirement of Justice Tom C. Clark, saying that this was "the right thing to do, the right time to do it, the right man and the right place." Marshall was confirmed as an Associate Justice by a Senate vote of 69--11 on August 30, 1967.[15] He was the 96th person to hold the position, and the first African American. President Johnson confidently predicted to one biographer, Doris Kearns Goodwin, that a lot of black baby boys would be named "Thurgood" in honor of this choice.[16]
Marshall served on the Court for the next twenty-four years, compiling a liberal record that included strong support for Constitutional protection of individual rights, especially the rights of criminal suspects against the government. His most frequent ally on the Court (the pair rarely voted at odds) was Justice William Brennan, who consistently joined him in supporting abortion rights and opposing the death penalty. Brennan and Marshall concluded in Furman v. Georgia that the death penalty was, in all circumstances, unconstitutional, and never accepted the legitimacy of Gregg v. Georgia, which ruled four years later that the death penalty was constitutional in some circumstances. Thereafter, Brennan or Marshall dissented from every denial of certiorari in a capital case and from every decision upholding a sentence of death.
Although best remembered for jurisprudence in the fields of civil rights and criminal procedure, Marshall made significant contributions to other areas of the law as well. In Teamsters v. Terry he held that the Seventh Amendment entitled the plaintiff to a jury trial in a suit against a labor union for breach of duty of fair representation. In TSC Industries, Inc. v. Northway, Inc. he articulated a formulation for the standard of materiality in United States securities law that is still applied and used today. In Cottage Savings Association v. Commissioner of Internal Revenue, he weighed in on the income tax consequences of the Savings and Loan crisis, permitting a savings and loan association to deduct a loss from an exchange of mortgage participation interests. In Personnel Administrator MA v. Feeney, Marshall wrote a dissent saying that a law that gave hiring preference to veterans over non-veterans was unconstitutional because of its inequitable impact on women.
Among his many law clerks were attorneys who went on to become judges themselves, such as Judge Douglas Ginsburg of the D.C. Circuit Court of Appeals; Judge Ralph Winter of the United States Court of Appeals for the Second Circuit; Supreme Court Justice Elena Kagan; as well as notable law professors Dan Kahan, Cass Sunstein, Eben Moglen, Susan Low Bloch, Martha Minow, Rick Pildes, Paul Gewirtz, and Mark Tushnet (editor of Thurgood Marshall: His Speeches, Writings, Arguments, Opinions and Reminiscences); and law school deans Paul Mahoney of University of Virginia School of Law, and Richard Revesz of New York University School of Law.
