Civil law (or civilian law) is a legal system originating in Europe, intellectualized within the framework of late Roman law, and whose most prevalent feature is that its core principles are codified into a referable system which serves as the primary source of law. This can be contrasted with common law systems whose intellectual framework comes from judge-made decisional law which gives precedential authority to prior court decisions on the principle that it is unfair to treat similar facts differently on different occasions (doctrine of judicial precedent ; stare decisis).
Historically, a civil law is the group of legal ideas and systems ultimately derived from the Code of Justinian, but heavily overlaid by Napoleonic, Germanic, canonical, feudal, and local practices, as well as doctrinal strains such as natural law, codification, and legal positivism.

Food & Water Justice uses the court system to advocate for positive change and provides legal support for Food & Water Watch’s mission to ensure that the food, water and fish we consume is safe, accessible and sustainably produced.
Michele Merkel is co-director of Food & Water Justice, the legal arm of Food & Water Watch. Michele was formerly the Chesapeake Regional Coordinator for Waterkeeper Alliance. At Waterkeeper, Michele helped to develop and implement campaigns that protect the Chesapeake and Coastal Bays. Prior to joining the Waterkeeper, Michele was co-founder and Senior Counsel of the Environmental Integrity Project (EIP). At EIP, she was responsible for developing and implementing legal campaigns under the Clean Air Act and Clean Water Act, focusing on industrial livestock production and municipal sewage issues. Michele previously served as an attorney in the Enforcement Division of the United States Environmental Protection Agency, where she worked closely with the Department of Justice to develop and bring actions for violations of federal environmental laws.

The legal systems of the world today are generally based on one of three basic systems: civil law, common law, and religious law – or combinations of these. However, the legal system of each country is shaped by its unique history and so incorporates individual variations.
Civil law is the most widespread system of law around the world.[citation needed] It is also sometimes known as Continental European law. The central source of law that is recognized as authoritative are codifications in a constitution or statute passed by legislature, to amend a code.
While the concept of codification dates back to the Code of Hammurabi in Babylon ca. 1790 BC, civil law systems mainly derive from the Roman Empire, and more particularly, the Corpus Juris Civilis issued by the Emperor Justinian ca. AD 529. This was an extensive reform of the law in the Byzantine Empire, bringing it together into codified documents. Civil law was also partly influenced by religious laws such as Canon law and Islamic law. Civil law today, in theory, is interpreted rather than developed or made by judges. Only legislative enactments (rather than legal precedents, as in common law) are considered legally binding.

Civil law (legal system)
Civil law (or civilian law) is a legal system originating in Europe, intellectualized within the framework of late Roman law, and whose most prevalent feature is that its core principles are codified into a referable system which serves as the primary source of law. This can be contrasted with common law systems whose intellectual framework comes from judge-made decisional law which gives precedential authority to prior court decisions on the principle that it is unfair to treat similar facts differently on different occasions (doctrine of judicial precedent ; stare decisis). Prior to joining the Waterkeeper, Michele was co-founder and Senior Counsel of the Environmental Integrity Project (EIP). At EIP, she was responsible for developing and implementing legal campaigns under the Clean Air Act and Clean Water Act, focusing on industrial livestock production and municipal sewage issues. Michele previously served as an attorney in the Enforcement Division of the United States Environmental Protection Agency, where she worked closely with the Department of Justice to develop and bring actions for violations of federal environmental laws.

The Lubbock County Bar Association and Texas Legal Services Center today released The Legal System: Helping Yourself, a nine minute self-help video that prepares a pro-se (or self-represented) litigant on what to expect when going to civil court.
The video is available for viewing through the popular website TexasLawHelp.org, which is dedicated to providing free, reliable legal information to those who cannot afford legal help or qualify for legal aid.
"The Legal System: Helping Yourself premieres at a crucial time for low-income Texans who need civil legal assistance," said Judge Judy Parker, Presiding Judge, Lubbock County Court at Law 3, who is featured in the video. "This is a valuable resource for Texans who face the daunting prospect of going to court without an attorney."
Judge Parker points out that according to the American Bar Association, due to a lack of resources, only about 20 to 25 percent of the civil legal needs of low-income and poor Texans are being met.
Gary Bellair of the Lubbock County Bar Association says, "We were careful to reinforce in the video that people should hire a qualified attorney to handle their legal matter, if possible." But he points out that for those who cannot afford an attorney or qualify for legal aid, the video highlights the self-help resources, including a live chat feature with an attorney, available on TexasLawHelp.org.
Administered by Texas Legal Service Center, TexasLawHelp.org is a website visited by more than 300,000 unique visitors last year. It provides video resources such as The Legal System: Helping Yourself, along with free do-it-yourself civil legal forms, and important court information. TexasLawHelp.org also provides "interactive" interviews that help individuals create professional-looking legal documents. Divorce without Children, Divorce with Children, and Protective Order packets are already available on the site.
Judge Parker says the video and TexasLawHelp.org resources will save courts, and pro-se litigants, money. "Better prepared self-represented litigants means less burden on the court system," she said. "We anticipate there will be fewer documents filed incorrectly."
The video, live chat, and interactive forms are part of a Self-Represented Litigants Project (SRLP) grant, funded by the Texas Access to Justice Foundation. The grant also supports two self-help legal workstations in the Lubbock County Law Library, which is adjacent to the Lubbock County Courthouse. The workstations act as a portal to TexasLawHelp.org and enable people without Internet connection to access the website's free legal information.
The SRLP project is part of a national trend to address the growing number of litigants in civil matters who are representing themselves.

The video is available for viewing through the popular website TexasLawHelp.org, which is dedicated to providing free, reliable legal information to those who cannot afford legal help or qualify for legal aid.
"The Legal System: Helping Yourself premieres at a crucial time for low-income Texans who need civil legal assistance," said Judge Judy Parker, Presiding Judge, Lubbock County Court at Law 3, who is featured in the video. "This is a valuable resource for Texans who face the daunting prospect of going to court without an attorney."
Judge Parker points out that according to the American Bar Association, due to a lack of resources, only about 20 to 25 percent of the civil legal needs of low-income and poor Texans are being met.
Gary Bellair of the Lubbock County Bar Association says, "We were careful to reinforce in the video that people should hire a qualified attorney to handle their legal matter, if possible." But he points out that for those who cannot afford an attorney or qualify for legal aid, the video highlights the self-help resources, including a live chat feature with an attorney, available on TexasLawHelp.org.
Administered by Texas Legal Service Center, TexasLawHelp.org is a website visited by more than 300,000 unique visitors last year. It provides video resources such as The Legal System: Helping Yourself, along with free do-it-yourself civil legal forms, and important court information. TexasLawHelp.org also provides "interactive" interviews that help individuals create professional-looking legal documents. Divorce without Children, Divorce with Children, and Protective Order packets are already available on the site.
Judge Parker says the video and TexasLawHelp.org resources will save courts, and pro-se litigants, money. "Better prepared self-represented litigants means less burden on the court system," she said. "We anticipate there will be fewer documents filed incorrectly."
The video, live chat, and interactive forms are part of a Self-Represented Litigants Project (SRLP) grant, funded by the Texas Access to Justice Foundation. The grant also supports two self-help legal workstations in the Lubbock County Law Library, which is adjacent to the Lubbock County Courthouse. The workstations act as a portal to TexasLawHelp.org and enable people without Internet connection to access the website's free legal information.
The SRLP project is part of a national trend to address the growing number of litigants in civil matters who are representing themselves.

As members of the legal profession, lawyers serve three roles: representative of clients, officer of the legal system and public citizen having special responsibility for the quality of justice. This event titled "" Is there Justice Outside God's Law?: Making Sense of the Boundaries of the Sharīʿah in Islamic Civilization" was given by Professor Jonathan Brown (Alwaleed bin Talal Chair of Islamic Civilization, Georgetown University) as part of the Centre of Islamic Studies' Distinguished Speakers' Lecture Series at SOAS University of London on 29 February 2016.
A key tenet of belief in Islamic civilization was that God's law, the Shariah, was the most just and perfect system of law for mankind. The primacy of the Shariah in the minds of many Muslims today remains strong, and an enduring tension in Muslim communities is negotiating the legitimacy of legal systems outside of the Shariah. This presentation will explore how classical Muslim scholars understood the relationship of the Shariah to justice, and how they reconciled their belief in the rule of law with the urgings of equity.

As members of the legal profession, lawyers serve three roles: representative of clients, officer of the legal system and public citizen having special responsibility for the quality of justice. The Preamble to the Nebraska Rules of Professional Conduct requires lawyers to be “mindful of deficiencies in the administration of justice and of the fact that the poor, and sometimes persons who are not poor, cannot afford adequate legal assistance.” Pro bono legal service is considered a traditional duty of the legal profession. Nebraska lawyers should devote professional time and resources and use civic influence to ensure equal access to our system of justice for all those who because of economic or social barriers cannot afford or secure adequate legal counsel. This CLE focuses on the Nebraska Rules of Professional Conduct that govern pro bono legal services:

This CLE will also present an overview of the Nebraska State Bar Association’s Volunteer Lawyers Project (VLP). Created in the early 1980s, VLP is place of last resort for persons who, because of economic or social barriers, cannot afford or secure adequate legal counsel.
Volunteer lawyers assist the legal profession in pursuing equal access to the legal system for these persons.
Carol A. Cleaver is the Director/Managing Attorney of the Nebraska State Bar Association’s Volunteer Lawyers Project. A 2006 graduate of Creighton University School of Law, Carol is admitted to practice in Nebraska, Missouri and Kansas. She has been active in promoting and providing pro bono legal services to persons who cannot afford an attorney and to volunteer staffed nonprofit organizations. Carol is an appointed member of the Nebraska Supreme Court Minority Justice Committee. Before joining the Volunteer Lawyers Project in April 2015, Carol served the NSBA in various volunteer roles. ONE OF our better judges, the Hon Ray Finkelstein QC, noted in an Australian Tax Office organ, Targeting Tax Crime (March 2012):
'As a general rule the judge's rationale in sentencing [white-collar criminals] is different from sentencing TRUE criminals ... imprisonment, when available, is regarded as a last resort.'
That need not surprise. Over the centuries, quite a number of common law judges seem to have been white collar criminals — for example, Sir Garfield Barwick.
Organised white collar crime in England dates from 1066, when William the Bastard (1027-87), became king. He franchised 90 per cent of the country to 300 "magnates" (the "great men of the realm"), and instituted a feudal system of trickle-down extortion. The magnates franchised land to freemen and extorted goods and services from them. The freemen in turn franchised land to its original owners, now peasants, and extorted from them.
His son, William II (c. 1056-1100) institutionalised white collar crime in the trade of authority. Professor John Gillingham said every public office was for sale; investors in turn extorted bribes from people who dealt with the office. He said the system was still operating in the reign of Edward I (1272-1307).
Judges and lawyers thus tended to be white collar criminals after the common law began in 1166 ― you bribed the king to become a judge and then extorted from litigants. Lawyers were the natural bagmen for extorting judges.
Judging is different from lawyering, but common law judges have never been trained as judges. They are lawyers trained in sophistry -- a technique of lying by false arguments, trick questions (and so on) -- one day and then judges the next. Professor Alan Dershowitz said
'...lying, distortion, and other forms of intellectual dishonesty are endemic among judges.'
Justice Russell Fox said the common law was originally designed to benefit landowners, and was 'later adjusted to the requirements of the wealthy and the powerful'. In 1275, Edward I made it a crime, Scandalum Magnatum, to accuse the magnates of vile practices, such as extortion. This form of libel law was enlarged in 1378 to protect judges, prelates and certain officials, many of whom were also white collar criminals.
Judges initially controlled evidence. On a fixed wage (plus the graft), they had no incentive to prolong the process; trials took a few hours. Lawyers do have an incentive -- $5 plus a minute today -- to spin the process out. The civil adversary system dates from 1460, when judges began to lawyers control civil evidence. The criminal adversary system dates from the 18th century, when lawyers first began to defend criminals.
Covering up a crime is a crime in itself ― the perversion of justice. Since 1792, judges have invented five rules which hide evidence and make it difficult to charge -- let alone convict -- white collar and other rich criminals.

Judging is different from lawyering, but common law judges have never been trained as judges. They are lawyers trained in sophistry -- a technique of lying by false arguments, trick questions (and so on) -- one day and then judges the next. Professor Alan Dershowitz said
'...lying, distortion, and other forms of intellectual dishonesty are endemic among judges.'
Justice Russell Fox said the common law was originally designed to benefit landowners, and was 'later adjusted to the requirements of the wealthy and the powerful'. In 1275, Edward I made it a crime, Scandalum Magnatum, to accuse the magnates of vile practices, such as extortion. This form of libel law was enlarged in 1378 to protect judges, prelates and certain officials, many of whom were also white collar criminals.
Judges initially controlled evidence. On a fixed wage (plus the graft), they had no incentive to prolong the process; trials took a few hours. Lawyers do have an incentive -- $5 plus a minute today -- to spin the process out. The civil adversary system dates from 1460, when judges began to lawyers control civil evidence. The criminal adversary system dates from the 18th century, when lawyers first began to defend criminals.
Covering up a crime is a crime in itself ― the perversion of justice. Since 1792, judges have invented five rules which hide evidence and make it difficult to charge -- let alone convict -- white collar and other rich criminals.
