Knock-and-announce, in United States law criminal procedure, is an ancient common-law principle, incorporated into the Fourth Amendment, which requires law enforcement officers to announce their presence and provide residents with an opportunity to open the door prior to a search.
The rule is currently codified in the United States Code, which governs Fourth Amendment searches conducted by the federal government. Most states have similarly codified the rule into their own statutes, and remain free to interpret or augment the rule and its consequences in any fashion that remains consistent with Fourth Amendment principles. A state's knock-and-announce rule will govern searches by state actors pursuant to state-issued warrants, assuming that Federal actors are not extensively involved in the search.
In 1995, the United States Supreme Court ruled in Wilson v. Arkansas that a knock-and-announce before entry was a factor that must be considered in reviewing the overall constitutionality of a Fourth Amendment search. After several state attempts to exclude specific categories (e.g. drug crimes) from the knock-and-announce rule, the Supreme Court in Richards v. Wisconsin prohibited the policy, and demanded a return to a case-by-case review scenario. The Richards Court suggested that the knock and announce rule could be dispensed with only in certain circumstances, for example where police have reasonable suspicion that an exigent circumstance exists. The Court read its earlier Wilson opinion to suggest that such circumstances might include those:
- which present a threat of physical violence;
- where there is "reason to believe that evidence would likely be destroyed if advance notice were given"; and
- where knocking and announcing would be dangerous or "futile".
The Court expressly stated that whether reasonable suspicion exists depends in no way on whether police must destroy property in order to enter.
In a similar manner, where officers reasonably believe that exigent circumstances, such as the destruction of evidence or danger to officers will exist, a no-knock warrant may be issued. However, despite police awareness that such future exigencies will exist, they are generally not required to seek such a warrant; in this case, police must have an objectively reasonable belief, at the time of executing the warrant, that such circumstances do in fact exist.
The Supreme Court has given some guidance as to how long officers must wait after knocking and announcing their presence before entry may be made. In U.S. v. Banks, the Supreme Court found 15 to 20 seconds to be a reasonable time where officers received no response after knocking and where officers feared the home occupant may be destroying the drug evidence targeted by the search warrant.

Let me put you an "Understanding" of No Knock Warrants in Ga.
Why? Because there's nothing in the world like an understanding.
How is it Supposed to Be?
First and foremost, No Knock Warrants, without a doubt, violates EVERY CITIZEN'S 4th Amendment Protection. It is the 4th Amendment that made America UNIQUE among all other nations, past and present. No one can enter your home without a search warrant and it requires notice of intent in order to do so. For 18 centuries, this practice was non existent. Then came the United States and we've have this protection for 2 centuries. However, at the end of the 20th century, we have begun to see an erosion of those liberties and freedoms.
In Ga, No Knock Warrants are currently ILLEGAL, as they should be, as required by Our Constitution of these United States.
How did No Knocks Come to Be?
There is this thing called "Judicial Activism" that is responsible. Basically, this is when Judges create new law from the bench in the form of their judicial rulings, and those rulings can be contrary to the Constitution and have not been established by the legislative process.
That said, some Judges at the Federal level decided to exercise some "Judicial Activism", by ruling that "No Knock Warrants" could be issued.
Why did they do this?
This was when the "War on Drugs" was at its peak. Cops argued that Drug Dealers were too dangerous and they needed to be able to deprive them of their right to a "Knock and Announce", in order to prevent "Harm to the Officer" or the "Destruction of Evidence".
However, the use of No Knock Warrants were pulled back. Why? Abuse was rampant.
Why did Judicial Activism at the Federal Level trickle down to the State Level?
In practice, Federal Law, which is SUPPOSED to be Constitutional, supersedes Unconstitutional State Law. Some examples are Slavery and Jim Crow.
However, as of late, we have seen an UNUSUALLY high level of Unconstitutional Federal Legislation, that States have willingly fallen in line with. Some examples are The Departments of Education and the EPA, and The Affordable Care Act.
Notwithstanding, States have the right to refuse to obey Federal Law / Legislation, that they deem Federally Unconstitutional. An example would be States that refused to participate in the Obamacare Health Exchange.
So why is Georgia engaged in the Unconstitutional practice of No Knock Warrants?
Because the Prosecutors and Police Departments want it. Since Judicial Activism had made them available as a quasi legal means of use, they now want them "codified", on the books legally, so that they can use them at will, LEGALLY.
If we stop No Knock Warrants, won't this hurt a cop's ability to stop the destruction of evidence or endanger their lives?
No. In fact, No Knock Warrants actually ENDANGERS the lives of cops.
Secondly, it is much safer to wait until a suspect is out of the house than to enter unannounced.
Third, if a suspect does not know that he is being surveilled, he has no reason to destroy evidence. When he leaves the home, detain him outside and execute the search warrant.
Lastly, cops already have on the books, a provision for exigent circumstances, allowing them to enter without a knock and announce.
Why are No Knock Warrants a problem for Ga?
It is a problem for several reasons.
1. It is usually the victims who pay the price for No Knock Warrants that go awry.
2. There is almost always no accountability in terms of Officer, Prosecutor or Judgeship prosecution for wrong doing when citizens are injured, maimed or killed.
3. Legalizing No Knock Warrants will further exacerbate an already egregious practice.
4. No Knock Warrants generally, impact mostly Blacks and Poor White communities.
5. On the rare occasions that there is a prosecution for a No Knock gone wrong, it is the Taxpayer that foots the bill for damages.
6. Setting this precedence in Georgia will undoubtedly move other States to legalize this practice.
What can we do to Stop this Legislation?
1. Phone and Email YOUR Representatives, asking them to not support this bill.
2. Promise them that they will not receive your vote in the next election if they do.
3. When called upon, show up at the hearings. We need to show them that THEY SERVE US.
4. Lastly, encourage them to do the following
a. Get the Ga Legislature to reject Federal Judicial Activism and stop the use of No Knock Warrants in Georgia altogether.
- Or -
b. Add legislation that provides for punitive civil and criminal liability of judges, prosecutors and officers for when No Knock Warrants go bad. This alone would ensure greater care and limited use.

Judicial activism
Judicial activism refers to judicial rulings suspected of being based on personal or political considerations rather than on existing law. It is sometimes used as an antonym of judicial restraint. The definition of judicial activism, and which specific decisions are activist, is a controversial political issue, particularly in the United States. The question of judicial activism is closely related to constitutional interpretation, statutory construction, and separation of powers.
Origins of the term
Arthur Schlesinger Jr. introduced the term "judicial activism" in a January 1947 Fortune magazine article titled "The Supreme Court: 1947".
The phrase has been controversial since its beginning. An article by Craig Green, "An Intellectual History of Judicial Activism," is critical of Schlesinger's use of the term; "Schlesinger's original introduction of judicial activism was doubly blurred: not only did he fail to explain what counts as activism, he also declined to say whether activism is good or bad."

Supreme court
A supreme court is the highest court within the hierarchy of many legal jurisdictions. Other descriptions for such courts include court of last resort, instance court, judgment court, apex court, and highest court of appeal. Broadly speaking, the decisions of a supreme court are not subject to further review by any other court. Supreme courts typically function primarily as appellate courts, hearing appeals from decisions of lower trial courts, or from intermediate-level appellate courts.
However, not all highest courts are named as such. Civil law states do not tend to have singular highest courts. The Court read its earlier Wilson opinion to suggest that such circumstances might include those:

- where knocking and announcing would be dangerous or "futile".
The Court expressly stated that whether reasonable suspicion exists depends in no way on whether police must destroy property in order to enter.
In a similar manner, where officers reasonably believe that exigent circumstances, such as the destruction of evidence or danger to officers will exist, a no-knock warrant may be issued. How did No Knocks Come to Be?
There is this thing called "Judicial Activism" that is responsible. Basically, this is when Judges create new law from the bench in the form of their judicial rulings, and those rulings can be contrary to the Constitution and have not been established by the legislative process.
That said, some Judges at the Federal level decided to exercise some "Judicial Activism", by ruling that "No Knock Warrants" could be issued.
Why did they do this?
This was when the "War on Drugs" was at its peak. Cops argued that Drug Dealers were too dangerous and they needed to be able to deprive them of their right to a "Knock and Announce", in order to prevent "Harm to the Officer" or the "Destruction of Evidence".
However, the use of No Knock Warrants were pulled back. Why? Abuse was rampant.
Why did Judicial Activism at the Federal Level trickle down to the State Level?
In practice, Federal Law, which is SUPPOSED to be Constitutional, supersedes Unconstitutional State Law. Some examples are Slavery and Jim Crow.
However, as of late, we have seen an UNUSUALLY high level of Unconstitutional Federal Legislation, that States have willingly fallen in line with. Some examples are The Departments of Education and the EPA, and The Affordable Care Act.
Notwithstanding, States have the right to refuse to obey Federal Law / Legislation, that they deem Federally Unconstitutional. An example would be States that refused to participate in the Obamacare Health Exchange.
So why is Georgia engaged in the Unconstitutional practice of No Knock Warrants?
Because the Prosecutors and Police Departments want it. Since Judicial Activism had made them available as a quasi legal means of use, they now want them "codified", on the books legally, so that they can use them at will, LEGALLY.
If we stop No Knock Warrants, won't this hurt a cop's ability to stop the destruction of evidence or endanger their lives?
No. In fact, No Knock Warrants actually ENDANGERS the lives of cops.
Secondly, it is much safer to wait until a suspect is out of the house than to enter unannounced.
Third, if a suspect does not know that he is being surveilled, he has no reason to destroy evidence. When he leaves the home, detain him outside and execute the search warrant.
Lastly, cops already have on the books, a provision for exigent circumstances, allowing them to enter without a knock and announce.
Why are No Knock Warrants a problem for Ga?
It is a problem for several reasons.
1. It is usually the victims who pay the price for No Knock Warrants that go awry.
2. There is almost always no accountability in terms of Officer, Prosecutor or Judgeship prosecution for wrong doing when citizens are injured, maimed or killed.
3. Legalizing No Knock Warrants will further exacerbate an already egregious practice.
4. No Knock Warrants generally, impact mostly Blacks and Poor White communities.
5. On the rare occasions that there is a prosecution for a No Knock gone wrong, it is the Taxpayer that foots the bill for damages.
6. Setting this precedence in Georgia will undoubtedly move other States to legalize this practice.
What can we do to Stop this Legislation?
1. Phone and Email YOUR Representatives, asking them to not support this bill.
2. Promise them that they will not receive your vote in the next election if they do.
3. When called upon, show up at the hearings. We need to show them that THEY SERVE US.
4. Lastly, encourage them to do the following
a. Get the Ga Legislature to reject Federal Judicial Activism and stop the use of No Knock Warrants in Georgia altogether.
- Or -
b. Add legislation that provides for punitive civil and criminal liability of judges, prosecutors and officers for when No Knock Warrants go bad. This alone would ensure greater care and limited use.

In 1995, the United States Supreme Court ruled in Wilson v. Arkansas that a knock-and-announce before entry was a factor that must be considered in reviewing the overall constitutionality of a Fourth Amendment search. After several state attempts to exclude specific categories (e.g. drug crimes) from the knock-and-announce rule, the Supreme Court in Richards v. Wisconsin prohibited the policy, and demanded a return to a case-by-case review scenario. The Richards Court suggested that the knock and announce rule could be dispensed with only in certain circumstances, for example where police have reasonable suspicion that an exigent circumstance exists. The Court read its earlier Wilson opinion to suggest that such circumstances might include those:
- which present a threat of physical violence;
- where there is "reason to believe that evidence would likely be destroyed if advance notice were given"; and
- where knocking and announcing would be dangerous or "futile".
The Court expressly stated that whether reasonable suspicion exists depends in no way on whether police must destroy property in order to enter.
In a similar manner, where officers reasonably believe that exigent circumstances, such as the destruction of evidence or danger to officers will exist, a no-knock warrant may be issued. However, despite police awareness that such future exigencies will exist, they are generally not required to seek such a warrant; in this case, police must have an objectively reasonable belief, at the time of executing the warrant, that such circumstances do in fact exist.
The Supreme Court has given some guidance as to how long officers must wait after knocking and announcing their presence before entry may be made. In U.S. v. How did No Knocks Come to Be?
There is this thing called "Judicial Activism" that is responsible. Basically, this is when Judges create new law from the bench in the form of their judicial rulings, and those rulings can be contrary to the Constitution and have not been established by the legislative process.
That said, some Judges at the Federal level decided to exercise some "Judicial Activism", by ruling that "No Knock Warrants" could be issued.
Why did they do this?
This was when the "War on Drugs" was at its peak. Cops argued that Drug Dealers were too dangerous and they needed to be able to deprive them of their right to a "Knock and Announce", in order to prevent "Harm to the Officer" or the "Destruction of Evidence".
However, the use of No Knock Warrants were pulled back. Why? Abuse was rampant.
Why did Judicial Activism at the Federal Level trickle down to the State Level?
In practice, Federal Law, which is SUPPOSED to be Constitutional, supersedes Unconstitutional State Law. Some examples are Slavery and Jim Crow.
However, as of late, we have seen an UNUSUALLY high level of Unconstitutional Federal Legislation, that States have willingly fallen in line with. Some examples are The Departments of Education and the EPA, and The Affordable Care Act.
Notwithstanding, States have the right to refuse to obey Federal Law / Legislation, that they deem Federally Unconstitutional. An example would be States that refused to participate in the Obamacare Health Exchange.
So why is Georgia engaged in the Unconstitutional practice of No Knock Warrants?
Because the Prosecutors and Police Departments want it. Since Judicial Activism had made them available as a quasi legal means of use, they now want them "codified", on the books legally, so that they can use them at will, LEGALLY.
If we stop No Knock Warrants, won't this hurt a cop's ability to stop the destruction of evidence or endanger their lives?
No. In fact, No Knock Warrants actually ENDANGERS the lives of cops.
Secondly, it is much safer to wait until a suspect is out of the house than to enter unannounced.
Third, if a suspect does not know that he is being surveilled, he has no reason to destroy evidence. When he leaves the home, detain him outside and execute the search warrant.
Lastly, cops already have on the books, a provision for exigent circumstances, allowing them to enter without a knock and announce.
Why are No Knock Warrants a problem for Ga?
It is a problem for several reasons.
1. It is usually the victims who pay the price for No Knock Warrants that go awry.
2. There is almost always no accountability in terms of Officer, Prosecutor or Judgeship prosecution for wrong doing when citizens are injured, maimed or killed.
3. Legalizing No Knock Warrants will further exacerbate an already egregious practice.
4. No Knock Warrants generally, impact mostly Blacks and Poor White communities.
5. On the rare occasions that there is a prosecution for a No Knock gone wrong, it is the Taxpayer that foots the bill for damages.
6. Setting this precedence in Georgia will undoubtedly move other States to legalize this practice.
What can we do to Stop this Legislation?
1. Phone and Email YOUR Representatives, asking them to not support this bill.
2. Promise them that they will not receive your vote in the next election if they do.
3. When called upon, show up at the hearings. We need to show them that THEY SERVE US.
4. Lastly, encourage them to do the following
a. Get the Ga Legislature to reject Federal Judicial Activism and stop the use of No Knock Warrants in Georgia altogether.
- Or -
b. Add legislation that provides for punitive civil and criminal liability of judges, prosecutors and officers for when No Knock Warrants go bad. This alone would ensure greater care and limited use.

It is a problem for several reasons.
1. It is usually the victims who pay the price for No Knock Warrants that go awry.
2. There is almost always no accountability in terms of Officer, Prosecutor or Judgeship prosecution for wrong doing when citizens are injured, maimed or killed.
3. Legalizing No Knock Warrants will further exacerbate an already egregious practice.
4. No Knock Warrants generally, impact mostly Blacks and Poor White communities.
5. On the rare occasions that there is a prosecution for a No Knock gone wrong, it is the Taxpayer that foots the bill for damages.
6. Setting this precedence in Georgia will undoubtedly move other States to legalize this practice.
What can we do to Stop this Legislation?
1. Phone and Email YOUR Representatives, asking them to not support this bill.
2. Promise them that they will not receive your vote in the next election if they do.
3. When called upon, show up at the hearings. We need to show them that THEY SERVE US.
4. Lastly, encourage them to do the following
a. Get the Ga Legislature to reject Federal Judicial Activism and stop the use of No Knock Warrants in Georgia altogether.
- Or -
b. Add legislation that provides for punitive civil and criminal liability of judges, prosecutors and officers for when No Knock Warrants go bad. This alone would ensure greater care and limited use.

In October 2010, Deputies Christopher Conley and Jennifer Pederson of the Los Angeles County Sheriff’s Department responded to a tip from an informant that wanted parolee Ronnie O’Dell had been seen in front of the nearby residence of Paula Hughes. The officers were informed that Angel Mendez and Jennifer Lynn Garcia lived together in the backyard of the Hughes residence. Although they did not have a search warrant, other officers directed Deputies Conley and Pederson to search the backyard. After determining that O’Dell was not in any of the three storage sheds in Hughes’ backyard, the deputies proceeded to a wooden shed surrounded by an A/C unit, clothes locker, clothes, and other belongings. The deputies did not knock and announce their presence. Deputy Conley, upon opening the door, saw the silhouette of a person holding a rifle through a curtain in the shed. Conley yelled “Gun!” and both deputies proceeded to shoot Mendez and Garcia. Whether Mendez was merely moving the gun or was pointing it at the deputies was subject to conflicting testimony at trial. As a result, Mendez required amputation of his right leg below the knee, and Garcia was shot in the back.
Mendez and Garcia sued Conley and Pederson and alleged that the deputies, in their official capacity, deprived them of their Fourth Amendment rights by performing an unjustified warrantless search and that the deputies failed to adhere to the knock-and-announce rule, which requires that officers announce their presence before they enter a home. The district court found for the plaintiffs on both these allegations and also held that, although the officers’ use of force was reasonable under the circumstances, they were liable for the shooting under the Ninth Circuit’s provocation rule. That rule holds an officer liable for use of deadly force where the officer intentionally or recklessly provokes a violent confrontation via a Fourth Amendment violation. The U.S. Court of Appeals for the Ninth Circuit affirmed the lower court’s determination that the search violated the Fourth Amendment but reversed the knock-and-announce rule holding that because there was no controlling Ninth Circuit precedent on whether officers must announce themselves again at a separate residence on the same property. The appellate court also held that the officers were liable under the provocation rule because their unjustified search of the occupied shed led to the shooting.

Facts:
In October 2010, Deputies Christopher Conley and Jennifer Pederson of the Los Angeles County Sheriff’s Department responded to a tip from an informant that wanted parolee Ronnie O’Dell had been seen in front of the nearby residence of Paula Hughes. The officers were informed that Angel Mendez and Jennifer Lynn Garcia lived together in the backyard of the Hughes residence. Although they did not have a search warrant, other officers directed Deputies Conley and Pederson to search the backyard. After determining that O’Dell was not in any of the three storage sheds in Hughes’ backyard, the deputies proceeded to a wooden shed surrounded by an A/C unit, clothes locker, clothes, and other belongings. The deputies did not knock and announce their presence. Deputy Conley, upon opening the door, saw the silhouette of a person holding a rifle through a curtain in the shed. Conley yelled “Gun!” and both deputies proceeded to shoot Mendez and Garcia. Whether Mendez was merely moving the gun or was pointing it at the deputies was subject to conflicting testimony at trial. As a result, Mendez required amputation of his right leg below the knee, and Garcia was shot in the back.
Mendez and Garcia sued Conley and Pederson and alleged that the deputies, in their official capacity, deprived them of their Fourth Amendment rights by performing an unjustified warrantless search and that the deputies failed to adhere to the knock-and-announce rule, which requires that officers announce their presence before they enter a home. The district court found for the plaintiffs on both these allegations and also held that, although the officers’ use of force was reasonable under the circumstances, they were liable for the shooting under the Ninth Circuit’s provocation rule. That rule holds an officer liable for use of deadly force where the officer intentionally or recklessly provokes a violent confrontation via a Fourth Amendment violation. The U.S. Court of Appeals for the Ninth Circuit affirmed the lower court’s determination that the search violated the Fourth Amendment but reversed the knock-and-announce rule holding that because there was no controlling Ninth Circuit precedent on whether officers must announce themselves again at a separate residence on the same property. The appellate court also held that the officers were liable under the provocation rule because their unjustified search of the occupied shed led to the shooting.
