Expert on Canon Laws Discusses Changes to Church Law Criminalizing Sexual Abuse by Priests
The Holy Father has unveiled sweeping reform of the book in canon law that covers sanctions related to clergy sexual abuse. Work on the revisions began more than a decade ago. They are considered the biggest change to canon law since the early 1980s. Assistant Professor of Canon Law at the Catholic University of America, Father James Bradley, joins to tell us the significance of the new laws and why it was necessary to make such sweeping changes to this part of Church law. Fr. Bradley shares whether these changes will help the Church deal more effectively with the clergy abuse crisis. He discusses what the reaction has been from Church leaders and lay people. During his final year in the Marines, however, Tim met a Marine who really knew his faith and challenged Tim to study Catholicism from Catholic and historical sources. That encounter sparked a two-year search for the truth. Tim was determined to prove Catholicism wrong, but he ended up studying his way to the last place he thought he would ever end up: the Catholic Church!
He converted to Catholicism in 1988 and spent the following six years in formation for the priesthood, earning a degree in philosophy from St. Charles Borromeo Seminary in Overbrook, Pennsylvania. He then studied theology on a graduate level at Mount St. Mary’s Seminary in Emmitsburg, Maryland, for two years. Realizing that his calling was not to the priesthood, Tim left the seminary in 1994 and has been working in Catholic apologetics and evangelization ever since.

The actual subject material of the canons is not just doctrinal or moral in nature, but all-encompassing of the human condition. It has all the ordinary elements of a mature legal system: laws, courts, lawyers, judges, a fully articulated legal code for the Latin Church as well as a code for the Eastern Catholic Churches, principles of legal interpretation, and coercive penalties. It lacks civilly-binding force in most secular jurisdictions. Those who are versed and skilled in canon law, and professors of canon law, are called canonists (or colloquially, "canon lawyers"). Canon law as a sacred science is called canonistics.
The jurisprudence of canon law is the complex of legal principles and traditions within which canon law operates, while the philosophy, theology, and fundamental theory of canon law are the areas of philosophical, theological, and legal scholarship dedicated to providing a theoretical basis for canon law as legal system and as true law.

Martin is the author of the annually updated Introduction to the English Legal System.

What can faculty and students do to enhance the quality of teaching and learning in law school? What principles define good pedagogical practice in legal education? How can principles of good practice be implemented in the law classroom?
These critical questions are the subject of this 29 minute, 23 second video and written materials. This resource was created for the Institute for Law School Teaching in 2001 by Gerry Hess (Gonzaga), Paula Lustbader (Seattle University), and Laurie Zimet (Hastings).
Interest in and literature about how to improve law school pedagogy have been increasing, especially given the changing demographics of law students. These written materials and the video were created to provoke reflection and generate discussion about how faculty and teaching methods affect today's students and their learning.
The accompanying written materials can be downloaded at: http://lawteaching.org/publications/videos/principlesforenhancing.php
The video features comments from students at seven law schools (Brooklyn, Gonzaga, Hastings, Iowa, New Mexico, North Carolina, and Seattle University). These schools were selected to provide a cross-section (geographic, public/private, demographic, size) of experiences in legal education. A coordinator from each institution selected students who varied in age, ethnicity, gender, learning styles, physical and learning disabilities, race, religion, sexual orientation, socioeconomic status, year in school, and class rank. All of the students were asked to respond to the following questions:
- What occurred in the classroom that interfered with your ability to learn?
- What occurred in the classroom that enhanced your learning?
The students' comments reflect a set of principles of good practice for contemporary higher education. The video and written materials apply the principles to legal education, explore their implications, and describe practical methods to implement them in the law school classroom. The principles, which are not ranked in order of importance, establish that effective learning environments:
- Promote student-faculty contact;
- Articulate clear, high expectations;
- Use time effectively;
- Respect differences among students;
- Foster cooperation;
- Provide prompt feedback; and
- Encourage active learning.
Principles for Enhancing Legal Education and the accompanying materials were produced in 2001 and copyright by Gerald Hess, Paula Lustbader, and Laurie Zimet. This program was made possible under a grant from the Institute for Law School Teaching at Gonzaga University School of Law and is uploaded with permission. What can faculty and students do to enhance the quality of teaching and learning in law school? What principles define good pedagogical practice in legal education? How can principles of good practice be implemented in the law classroom?
These critical questions are the subject of this 29 minute, 23 second video and written materials. This resource was created for the Institute for Law School Teaching in 2001 by Gerry Hess (Gonzaga), Paula Lustbader (Seattle University), and Laurie Zimet (Hastings).
Interest in and literature about how to improve law school pedagogy have been increasing, especially given the changing demographics of law students. These written materials and the video were created to provoke reflection and generate discussion about how faculty and teaching methods affect today's students and their learning.

The video features comments from students at seven law schools (Brooklyn, Gonzaga, Hastings, Iowa, New Mexico, North Carolina, and Seattle University). These schools were selected to provide a cross-section (geographic, public/private, demographic, size) of experiences in legal education. A coordinator from each institution selected students who varied in age, ethnicity, gender, learning styles, physical and learning disabilities, race, religion, sexual orientation, socioeconomic status, year in school, and class rank. All of the students were asked to respond to the following questions:
- What occurred in the classroom that interfered with your ability to learn?
- What occurred in the classroom that enhanced your learning?
The students' comments reflect a set of principles of good practice for contemporary higher education. The video and written materials apply the principles to legal education, explore their implications, and describe practical methods to implement them in the law school classroom. The principles, which are not ranked in order of importance, establish that effective learning environments:
- Promote student-faculty contact;
- Articulate clear, high expectations;
- Use time effectively;
- Respect differences among students;
- Foster cooperation;
- Provide prompt feedback; and
- Encourage active learning.

Society gains twice: disadvantaged people get valuable legal aid and are empowered while the legal community is enriched with knowledge, sensitivity and comprehension of the unique skills necessary to protect and further human rights.
A great advantage of the Clinics is that it avoids all bureaucracy, often a characteristic of organizations which offer help to the underprivileged. The students and lawyers provide their clients legal assistance throughout the process; from the first consultation until the final outcome. Emphasis is placed on providing a high quality service to those of limited means in order to give them equal opportunities in relation to those who can afford the high prices of good legal services.
One third of the student body of the Law Faculty is active in the Law Clinics. In addition to six hours per week of practical work, students participate in weekly classes where they are taught the essential legal knowledge and tools necessary for clinical work in the field. These classes also provide a platform to discuss the social, cultural and ethical aspects of their work. In addition, the students gain further insights into their work through cooperation with professionals from other disciplines, such as community activists, social workers and physicians. A number of individual states are moving forward with marijuana legalization because they are still under marijuana law from the early prohibition days. Some prohibition laws came as part of the nationwide trend to restrict cannabis, but now there’s a nationwide trend to legalize cannabis. Some states are now pioneers in marijuana legalization, but they also have a history of restricting the drug. In government contracting, a prevailing wage is defined as the hourly wage, usual benefits and overtime, paid to the majority of workers, laborers, and mechanics within a particular area. Prevailing wages are established by regulatory agencies for each trade and occupation employed in the performance of public work, as well as by State Departments of Labor or their equivalents.
"Prevailing wages" were first established shortly after the Civil War when US Congress passed the National Eight Hour Day law. Although the Congress had not yet established its authority to regulate private economic matters because of prevailing legal doctrines, it could regulate its own contracts and the targeted public works as a means to indirectly influence other labor markets. Because construction workers at the time were paid on a daily rather than hourly basis, the establishment of an eight-hour day without a reduction of the daily wage rate formally incentivized public works contractors to improve the efficiency and productivity of their workforce rather than the length of their day in order to complete their projects on time.
In 1891 Kansas was the first state to pass a "prevailing wage" for its own public works projects, and over the next thirty years was followed by seven other states (New York 1894, Oklahoma 1909, Idaho 1911, Arizona 1912, New Jersey 1913, Massachusetts 1914, and Nebraska 1923) in establishing minimum labor standards for public works construction. In the midst of the Great Depression, beginning in 1931 and prior to the end of World War II, twenty additional states passed their own prevailing wage laws. In 1931 Congress passed the Davis–Bacon Act after 14 earlier attempts, the Federal Prevailing Wage law that remains in force, bar a few suspensions, to this day.
Prevailing wage may include both wages, benefits, and other payments such as apprenticeship and industry promotion. It encompasses the compensation for a worker given for performed labor.
The Federal Davis-Bacon Act and Related Amendments pertain to federally funded projects. There are also 32 states that have state prevailing wage laws, also known as "little Davis-Bacon Acts". The rules and regulations vary from state to state.
Federal rates are calculated based on regulations established by the US Department of Labor. According to Code of Federal Regulations, "The prevailing wage shall be the wage paid to the majority (more than 50 percent) of the laborers or mechanics in the classification on similar projects in the area during the period in question. If the same wage is not paid to a majority of those employed in the classification, the prevailing wage shall be the average of the wages paid, weighted by the total employed in the classification." State level rates are calculated using various methods including an average of all wage rates paid, the mode, or based on collectively bargained rates.
The H-1B visa program requires employers to “pay the prevailing wage or the actual wage paid by the employer to workers with similar skills and qualifications, whichever is higher”.
In the Davis–Bacon Act all federal government construction contracts, and most contracts for federally assisted construction over $2,000, must include provisions for paying workers on-site no less than the locally prevailing wages and benefits paid on similar projects. The Streamlining Claims Processing for Federal Contractor Employees Act (H.R. 2747; 113th Congress), if passed, would make the United States Department of Labor responsible for enforcing this act (instead of the Government Accountability Act) and ensuring that federal contractors did receive the prevailing wage.
