Reasonable suspicion is a legal standard of proof in United States law that is less than probable cause, the legal standard for arrests and warrants, but more than an "inchoate and unparticularized suspicion or 'hunch'"; it must be based on "specific and articulable facts", "taken together with rational inferences from those facts", and the suspicion must be associated with the specific individual. If police additionally have reasonable suspicion that a person so detained is armed and dangerous, they may "frisk" the person for weapons, but not for contraband like drugs. Reasonable suspicion is evaluated using the "reasonable person" or "reasonable officer" standard, in which said person in the same circumstances could reasonably suspect a person has been, is, or is about to be engaged in criminal activity; it depends upon the totality of circumstances, and can result from a combination of particular facts, even if each is individually innocuous.
In Terry v. Ohio, the U.S. Supreme Court ruled that a person can be stopped and briefly detained by a police officer based on a reasonable suspicion of involvement in a punishable crime. If the officer has reasonable suspicion the detainee is armed, the officer may perform a "pat-down" of the person's outer garments for weapons. Such a detention does not violate the Fourth Amendment prohibition on unreasonable searches and seizure, though it must be brief. Reasonable suspicion does not provide grounds for arrest; however, an arrest can be made if facts discovered during the detention provide probable cause that the suspect has committed a crime.
Kevin Jerome Gilyard (born February 5, 1986), known by his stage name Kevin Gates, is an American rapper, singer, and entrepreneur from Baton Rouge, Louisiana.
Born Kevin Jerome Gilyard, Gates was born in New Orleans and raised in Baton Rouge, Louisiana. Growing up Gates often listened to rappers such as Master P and Hot Boy$. Gates started rapping at 14 years old. Later with Boosie Badazz, and Webbie.
Kevin first began rhyming in 2007, when he began making music with fellow Louisiana natives Webbie and Lil Boosie. Gates first received attention with his 2008 single "Get in the Way" featuring Lil Boosie. Soon after, he and Boosie would be incarcerated in separate cases. Gates would then be released in 2011 and immediately returned to recording music. He would soon earn the attention of Lil Wayne and would start being managed by Young Money Entertainment's management wing. In early 2013, Gates released a mixtape, The Luca Brasi Story which was called "easily the best rap-related thing" in February 2013 by Spin Magazine, who also said he has "been a rapper to watch for a few years now".The Luca Brasi Story has been downloaded from popular mixtape sharing site, DatPiff, over 274,000 times. On February 15, 2013, it was announced that Kevin Gates is in a partnership with Atlantic Records. Gates was also featured on Pusha T's 2013 mixtape Wrath of Caine on the song "Trust You" and was featured on frequent collaborator Gudda Gudda's mixtape Guddaville 3 on the song "Hustle All Day" also featuring Flow.
In United States criminal law, probable cause is the standard by which police authorities have reason to obtain a warrant for the arrest of a suspected criminal. The standard also applies to personal or property searches.
Probable cause, in conjunction with a preponderance of the evidence, also refers to the standard by which a grand jury believes that a crime has been committed. The term comes from the Fourth Amendment of the United States Constitution:
"Probable" in this case may relate to statistical probability or to a general standard of common behavior and customs. The context of the word "probable" here is not exclusive to community standards and does not predate statistics, as some have suggested.
In the criminal code of some European countries, notably Sweden, probable cause is a higher level of suspicion than "justifiable grounds" in a two level system of formal suspicion. The latter refers only to the suspect being able to and sometimes having a motive to commit the crime and in some cases witness accounts, whereas probable cause generally requires a higher degree of physical evidence and allows for longer periods of detention before trial.
