Li Jun was labeled as the head
of the Triads by former Chongqing
Party Secretary Bo Xilai.
Recently, the company under his name filed law suit against
Shapingba Branch of Chongqing
Public Security Bureau.
The lawsuit is for illegal seizure of the
company's official seal, and it's property.
Li Jun is currently hiding overseas, and
an arrest warrant for him is still in effect.
More than 30 people associated with Li, including
his relatives and former employees, have been
labeled as gangsters, and were sentenced in
2010.
On behalf of Li Jun, Luo Hao, a legal representative
of Chongqing Junfeng
Real Estate Co., Ltd., filed
a lawsuit against Shapingba Branch of Chongqing
Municipal Public Security Bureau on
February 28.
Beijing lawyer Li Zhuang, as the agent and
deputy general manager of the company, sent
forth two lawyers to deliver the indictment.
It was delivered to Chongqing
Higher People's
Court and the
Intermediate People's Court.
The High Court did not accept the appeal.
The
Intermediate Court kept the appeal, but indicated
the acceptance is contingent upon a superior's approval.
According to the indictment, Li Jun requested canceling
Shapingba Public Security Bureau's two written decisions.
Li also requested confirmation that seizing the company's
official seal was illegal, to return 66.8 million yuan,
and to compensate for the loss of 69.57 million yuan.
Luo Hao, Chongqing Junfeng Real Estate:
"During the investigation, they transferred
66.8 million yuan out the company's account.
There was no court decree. It was done by the
investigation team of the public security bureau.
Then, the
Court determined Li
Xiuwu's
income of 66.8 million yuan as illegal.
But, that was a bond company.
They transferred money out of our real estate
company, which had nothing to do with the case."
Luo Hao indicated Bo's policy of targeting gangsters
cost too much for the local governments to afford.
He believed that Bo Xilai confiscated
private assets to balance the books.
He said, Bo was targeting the entire Junfeng
Real Estate, not just the 66.8 million yuan.
Luo Hao: "Their greatest intention was
to own the entire Junfeng Real Estate.
There are a few acres of land under Junfeng. With those
properties, they can sell for a couple of billion yuan.
That's the money they are after."
Li Jun was arrested on
December 4
2009, on charges of "allegedly bribery".
The Chongqing public security bureau asked
Li to confess that he was the triad boss.
He was forced to admit to committing crimes of
bribery, firearms trafficking, prostitution, loan-sharking
and supporting illegal religious organizations.
Li Jun was brutally tortured.
After weeks of torture, Li Jun was told that to be free from
more torture, he had to pay the military 40 million yuan.
This was to compensate a piece of land he had purchased.
In
March 2010, Li Jun was released after paying the "fine".
Police involved in the interrogation were
rewarded with
100,
000 yuan from the military.
Li Jun is currently hiding overseas. His wife,
family members, and employees were arrested.
His brother and nephew who took over his assets were
sentenced to 18 years and 13 years in prison, respectively.
The rest were sentenced with sentences
of several months to several years.
Luo Hao indicated that Bo labeled Li Jun's company
as "triad" for the purpose of confiscating his assets.
Luo Hao: "It is impossible to form a triad with
just a couple of people.
Triad is an organization.
They purposely put together a couple of dozens
of people by including the company employees
and the security guards to make it look like a gang.
They charged the gang with a crime. That way it
becomes easy for them to seize the property."
Luo Hao said Bo Xilai planned to take over
the company through a managing company.
Wang Lijun's incident slowed down the progress.
After the
18th National Congress, things changed.
On
September 30 last year, the official
seal was returned to the company.
At the end of November, the
company account was released.
Li Jun was one of the richest businessmen in Chongqing.
His investments, ranged from real estate, gas stations,
nightclubs, the financial industry, through to hotels.
He had annual revenue of about one billion yuan. His
estimated total asset at that time was about
4.5 billion yuan.
