Even in exigent circumstances, while a warrant-less seizure may be permitted, a subsequent warrant to search may still be necessary.

Detective Sandra Aldridge (officer who ripped baby from mother's arms in video) and her supervisor, Sgt. Andy Hamlin have been under Internal Affairs investigation by the VPD Professional Standards Unit for over a year due to numerous complaints. Aldridge alone has IA investigation files totaling well over 1,000 pages representing approximately 20 known citizen complaints, yet she has a perfect record due to VPD's reclassification or determination of all complaints as "UNFOUNDED," "UNSUBSTANTIATED," OR :"INQUIRY". Aldridge's most habitual offenses include perjury, false reporting, fabrication/planting of evidence, suppression/destruction of evidence, witness tampering, unlawful search and seizure, witness intimidation, unlawful surveillance, cyber-stalking, criminal impersonation, harassment and retaliation. The following is an email I sent this morning to Lt. Scott Creager of the VPD Professional Standards Unit, in response to Friday's notice that the year-long investigation of my complaints were determined on April 13th (last Wednesday) to be UNFOUNDED:

As the VPD Professional Standards Unit continues to run interference and provide cover for the continuation of criminal acts by Detective Sandra Aldridge and Sgt. Andy Hamlin, it might be a good exercise in broadening your collective professional perspective to take a look a national/international response through comments to the kind of behavior you deem as an UNFOUNDED or UNSUBSTANTIATED basis for citizen complaints.
The first link (below) had just over 1,500 views on YouTube yesterday afternoon. Overnight, it increased to over 15,000 (and rising). The second link provides a little background into FIVE MORE LIVES forever damaged by the criminal conduct of Aldridge and Hamlin.

Exigent circumstance

Detective Sandra Aldridge (officer who ripped baby from mother's arms in video) and her supervisor, Sgt. Andy Hamlin have been under Internal Affairs investigation by the VPD Professional Standards Unit for over a year due to numerous complaints. Aldridge alone has IA investigation files totaling well over 1,000 pages representing approximately 20 known citizen complaints, yet she has a perfect record due to VPD's reclassification or determination of all complaints as "UNFOUNDED," "UNSUBSTANTIATED," OR :"INQUIRY". Aldridge's most habitual offenses include perjury, false reporting, fabrication/planting of evidence, suppression/destruction of evidence, witness tampering, unlawful search and seizure, witness intimidation, unlawful surveillance, cyber-stalking, criminal impersonation, harassment and retaliation. The following is an email I sent this morning to Lt. Scott Creager of the VPD Professional Standards Unit, in response to Friday's notice that the year-long investigation of my complaints were determined on April 13th (last Wednesday) to be UNFOUNDED:

As the VPD Professional Standards Unit continues to run interference and provide cover for the continuation of criminal acts by Detective Sandra Aldridge and Sgt. Andy Hamlin, it might be a good exercise in broadening your collective professional perspective to take a look a national/international response through comments to the kind of behavior you deem as an UNFOUNDED or UNSUBSTANTIATED basis for citizen complaints.
The first link (below) had just over 1,500 views on YouTube yesterday afternoon. Overnight, it increased to over 15,000 (and rising). The second link provides a little background into FIVE MORE LIVES forever damaged by the criminal conduct of Aldridge and Hamlin.

You have once again given the GREEN LIGHT to bias based policing. Relying on the public safety exception in New York v. Quarles, 104 S. Ct. 2626, 2631 (1984), and State v. O'Neal, 190 N.J. 601, 618 (2007), the trial court admitted inculpatory statements defendant gave in response to officers' questions about the location of the handgun he used to kill his wife. Defendant was in custody and had invoked his right to counsel.
Assuming the claimed "public safety" meets the criteria in State v. Stephenson, 350 N.J. Super. 517, 525 (App. Div. 2002), the court is persuaded by the reasoning in United States v. DeSantis, 870 F.2d 536, 541 (9th Cir. 1989), and hold that the same "exigent circumstances" that permit the pre-Miranda interrogation of a defendant, permit the police to question a defendant after he or she has invoked the right to counsel. Pursuant to Stephenson, the court holds there was an insufficient basis to apply the public safety exception. The court affirms, however, because the trial court correctly found defendant waived his right to counsel, independent of the initially tainted interrogation.

Asking Location of Handgun Permitted if Exigent Circumstances. State v. Melendez 423 NJ Super. 1 (App. Div. 2011)
Relying on the public safety exception in New York v. Quarles, 104 S. Ct. 2626, 2631 (1984), and State v. O'Neal, 190 N.J. 601, 618 (2007), the trial court admitted inculpatory statements defendant gave in response to officers' questions about the location of the handgun he used to kill his wife. Defendant was in custody and had invoked his right to counsel.
Assuming the claimed "public safety" meets the criteria in State v. Stephenson, 350 N.J. Super. 517, 525 (App. Div. 2002), the court is persuaded by the reasoning in United States v. DeSantis, 870 F.2d 536, 541 (9th Cir. 1989), and hold that the same "exigent circumstances" that permit the pre-Miranda interrogation of a defendant, permit the police to question a defendant after he or she has invoked the right to counsel. Pursuant to Stephenson, the court holds there was an insufficient basis to apply the public safety exception. The court affirms, however, because the trial court correctly found defendant waived his right to counsel, independent of the initially tainted interrogation.

The Missouri Court of Appeals held that the trial court erred, but that the case represented a departure from current case law; it transferred the case to the Missouri Supreme Court. The Supreme Court of Missouri affirmed the trial court's decision.

Does the Fourth Amendment prevent the taking of a warrantless blood sample under exigent circumstances?
Conclusion:
Yes. Justice Sonia Sotomayor delivered the opinion of the 5-4 plurality. The Supreme Court held that the Fourth Amendment’s protection against warrantless searches applies to blood alcohol tests unless specific exigent circumstances exist. Because each case must be considered based on its individual facts, there are cases in which the natural dissipation of alcohol in the blood would be considered an exigent circumstance, but there is no reason to create a categorical rule. The Court also held that the Fourth Amendment’s protection against bodily intrusions outweighs the state’s interest in gaining evidence quickly.
In his partial concurrence, Justice Anthony M. Kennedy wrote that the case in question does not provide the basis for any categorical rule on the issue of conducting a blood alcohol test without a warrant. He also wrote that the Fourth Amendment does not allow the warrant requirement to be entirely ignored in drunk driving arrests. Chief Justice John G. Roberts, Jr. wrote an opinion concurring in part and dissenting in part in which he argued that there must be a categorical rule on this issue to provide appropriate guidance to law enforcement officials. He argued that exigent circumstances exist and justify a warrantless blood test if the officer believes there is not sufficient time to obtain a warrant before critical evidence is lost through natural metabolic processes. If there is time to secure a warrant, the officer must do so. Justice Stephen G. Breyer and Justice Samuel A. Alito, Jr. joined in the partial concurrence and partial dissent.
Justice Clarence Thomas wrote a dissenting opinion in which he argued that the body’s natural metabolization of alcohol constitutes an the destruction of evidence and represents an exigent circumstance. The importance of obtaining evidence allows the police to conduct a warrantless blood alcohol test without violating the Fourth Amendment.

The Kentucky Court of Appeals affirmed the conviction, holding that exigent circumstances supporting the warrantless search were not of the police's making and that police did not engage in deliberate and intentional conduct to evade the warrant requirement. In January 2010, the Kentucky Supreme Court reversed the lower court order, finding that the entry was improper. The court held that the police were not in pursuit of a fleeing suspect when they entered the apartment, since there was no evidence that the original suspect even knew he was being followed by police.

Does the exclusionary rule, which forbids the use of illegally seized evidence except in emergency situations, apply when the emergency is created by lawful police actions?
Conclusion:
The Supreme Court reversed and remanded the lower court order in a decision by Justice Samuel Alito. "The exigent circumstances rule applies when the police do not create the exigency by engaging or threatening to engage in conduct that violates the Fourth Amendment," Alito wrote for the majority. Justice Ruth Bader Ginsburg dissented, contending that "the Court today arms the police with a way routinely to dishonor the Fourth Amendment's warrant requirement in drug cases. "

The Kentucky Court of Appeals affirmed the conviction, holding that exigent circumstances supporting the warrantless search were not of the police's making and that police did not engage in deliberate and intentional conduct to evade the warrant requirement. In January 2010, the Kentucky Supreme Court reversed the lower court order, finding that the entry was improper. The court held that the police were not in pursuit of a fleeing suspect when they entered the apartment, since there was no evidence that the original suspect even knew he was being followed by police.
Question:
Does the exclusionary rule, which forbids the use of illegally seized evidence except in emergency situations, apply when the emergency is created by lawful police actions?
Conclusion:
The Supreme Court reversed and remanded the lower court order in a decision by Justice Samuel Alito. "The exigent circumstances rule applies when the police do not create the exigency by engaging or threatening to engage in conduct that violates the Fourth Amendment," Alito wrote for the majority. Justice Ruth Bader Ginsburg dissented, contending that "the Court today arms the police with a way routinely to dishonor the Fourth Amendment's warrant requirement in drug cases. "
