Disgraced Pharma CEO Martin Shkreli Removed From House Oversight Committee Hearing on Drug Prices. After less than an hour, Chaffetz dismissed Shkreli from the hearing since he was refusing to say anything. In a brief press conference, Brafman sought to explain Shkreli's dismissive facial expressions, saying his client was just "nervous." Shkreli did not comment. In days before the hearing, he blasted Congress and made sarcastic jokes on Twitter about the subpoena he received to testify. "I'm not going to say anything other than the 5th Amendment," he said recently. "They just want this to be a circus." U.S. Rep. Buddy Carter, R-Georgia, the only pharmacist in Congress, said he supports free-market principles but was "disgusted" by drug-price-hiking companies.
"What was done here was different," Carter said. "Perverse business practices were employed." The charismatic persona that Shkreli has cultivated — paying $2 million for the only copy of a new Wu Tang Clan album and setting up a web cam to film himself working — amplified the tension with Congress. "People in my district are not on the Forbes billionaire list — they can’t buy Wu Tang Clan albums for $2 million," Cummings said. "Like many Americans they struggle every single month to pay for the increasing cost of housing, education and health care. They live from paycheck to paycheck and sometimes from no check to no check." In addition to Shkreli, several other executives were also set to appear before the committee. Howard Schiller, interim CEO of Valeant Pharmaceuticals, which has also come under fire for its business model and drug prices, cited the company's recent price-cutting deal with Walgreens as an example of its responsiveness. "We’re listening and we’re changing," he said. "We have more to do." Schiller pledged that any future drug price increases would be "much more modest" than the increases that enraged Congress. Martin Shkreli smirked as Rep. Elijah Cummings berated the former drug CEO for operating a Ponzi-like scheme. "It's not funny Mr. Shkreli," Cummings snapped at a House Oversight Committee hearing on Thursday. "People are dying and they're getting sicker and sicker." Shkreli's smirk remained. Cummings said Turing Pharmaceuticals, which Shkreli used to run, had been dealing in "blood money." By hiking up the price of Daraprim, a toxoplasmosis treatment used by AIDS patients, by 5000%, Cummings said that Shkreli was taking advantage of Turing's customers. "Like a Ponzi scheme, it appears that Turing might be using profits from Daraprim to invest in new drugs that it would then jack up prices for," Cummings said. Cummings also lashed out at the former CEO for his lavish spending, off the back of the hiked-up drug prices. He cited Shkreli's famous $2 million purchase of the Wu-Tang Clan's single pressing of its new album, "Once Upon a Time in Shaolin." "My constituents. They don't buy Wu-Tang Clan albums," Cummings said. "They live paycheck to paycheck." Shkreli did not give testimony. "On the advice of counsel, I invoke my Fifth Amendment privilege against self-incrimination and respectfully decline to answer your question," Shkreli said repeatedly. Representative Trey Gowdy tried to get an answer out of Shkreli and briefly succeeded when he asked him about the pronunciation of his name. He then asked several questions about the Wu-Tang Clan album.
Shrkeli rolled his eyes during questioning, fiddling with his pencil and refusing to look at the committee members.

Shkreli, widely scorned for hiking the price of a long-established and potentially lifesaving drug by more than 5,000 percent, has said he's exercising his Fifth Amendment right against self-incrimination. The 32-year-old Shkreli faces separate criminal charges of securities fraud related to another drug company. Also going before lawmakers is the interim CEO of Canada's largest drugmaker, Valeant Pharmaceuticals. Both companies have sharply raised prices for drugs taken by patients with heart problems, AIDS, cancer and other conditions.

It is neither expected nor possible that a member of Congress be an expert on all matters and subject areas that come before Congress. Congress divides its legislative, oversight, and internal administrative tasks among approximately 200 committees and subcommittees. Within assigned areas, these functional subunits gather information; compare and evaluate legislative alternatives; identify policy problems and propose solutions; select, determine, and report measures for full chamber consideration; monitor executive branch performance (oversight); and investigate allegations of wrongdoing. While this investigatory function is important, procedures such as the House discharge petition process (the process of bringing a bill onto the floor without a committee report or mandatory consent from its leadership) are so difficult to implement that committee jurisdiction over particular subject matter of bills has expanded into semi-autonomous power. Of the 73 discharge petitions submitted to the full House from 1995 through 2007, only one was successful in securing a definitive yea-or-nay vote for a bill.

"People in my district are not on the Forbes billionaire list — they can’t buy Wu Tang Clan albums for $2 million," Cummings said. "Like many Americans they struggle every single month to pay for the increasing cost of housing, education and health care. They live from paycheck to paycheck and sometimes from no check to no check." In addition to Shkreli, several other executives were also set to appear before the committee. Howard Schiller, interim CEO of Valeant Pharmaceuticals, which has also come under fire for its business model and drug prices, cited the company's recent price-cutting deal with Walgreens as an example of its responsiveness. "We’re listening and we’re changing," he said. "We have more to do." Schiller pledged that any future drug price increases would be "much more modest" than the increases that enraged Congress. "Like a Ponzi scheme, it appears that Turing might be using profits from Daraprim to invest in new drugs that it would then jack up prices for," Cummings said. Cummings also lashed out at the former CEO for his lavish spending, off the back of the hiked-up drug prices. He cited Shkreli's famous $2 million purchase of the Wu-Tang Clan's single pressing of its new album, "Once Upon a Time in Shaolin." "My constituents. They don't buy Wu-Tang Clan albums," Cummings said. "They live paycheck to paycheck." Shkreli did not give testimony. "On the advice of counsel, I invoke my Fifth Amendment privilege against self-incrimination and respectfully decline to answer your question," Shkreli said repeatedly. Hillary was then elected to the U.S. Senate, becoming the first woman senator from New York. She repeatedly worked across the aisle to get things done, including working alongside Republicans after the terrorist attacks of September 11, 2001. When Congress wouldn't do enough for rural areas and small towns, Hillary didn’t back down. She launched innovative partnerships with the tech industry and provided support to local colleges and small businesses. When President Obama asked Hillary to serve as his secretary of state, she answered the call to public service once again. She was a forceful champion for human rights, internet freedom, and rights and opportunities for women and girls, LGBT people and young people all around the globe. Now she’s running for President because everyday Americans need a champion and she want to be that champion.

Tuesday, on Capitol Hill, the House Judiciary Committee heard testimony from FBI Director James Comey on his agency's attempts to get into the locked San Bernardino iPhone. Its questions were pointed.
"You, in the case of Apple in California, are demanding through a court order that Apple invent something. Fair to say? They have to create something. ... Are you testifying today that you and/or contractors that you employ could not achieve this without demanding an unwilling partner do it?" Rep. Darrell Issa asked.
"Correct," Comey responded.
"We spend $4.2 trillion every year. You have a multibillion-dollar budget. Is the burden so high on you that you could not defeat this product either through getting the source code and changing it or some other means?" Issa asked.
"We have engaged all parts of the U.S. government to see 'does anybody have a way,' short of asking Apple to do it ... and we do not," Comey responded.
"Until this, there was no closet in America, no safe in America, no garage in America, no basement in America that could not be entered with a judge's order. We now live in a different world," Comey said.
"We're moving to a place where there are warrant-proof places in our life. ... That's a world that we've never lived in before in the United States. That has profound consequences for public safety," Comey said.
"We can all agree this is not about access to one iPhone," said Apple general counsel Bruce Sewell.
"This is not about the San Bernardino case. ... There's no distinction between an [iPhone] 5C and a 6 in this context. The tool that we're being asked to create will work on any iPhone that is in use today," Sewell said.
And law enforcement intends to take advantage. Should the FBI get its access, New York District Attorney Cyrus Vance has promised to use the tool in any case in which phones are part of criminal proceedings.
"If you put privacy so far over public safety, what you're going to get is a world with lots of privacy, but also a lot of crime. Because criminals understand these devices are warrant-proof," Vance told Charlie Rose.
In the meantime, Apple has officially filed an appeal in the San Bernardino case.

Regis Blahut, a CIA security official assigned to the HSCA, was interviewed regarding a security breach in the Committee's secure room. Autopsy photographs had been found out of the safe and in one case out of its plastic sleeve, and Blahut became the focus of the investigation. In the first interview, Blahut admitted to leafing through the autopsy photo booklet on one occasion. In the second interview, he admitted to additional occurrences, and also that he had discussed his observations with CIA personnel. Apple Inc (AAPL.O) and the U.S. Federal Bureau of Investigation will make their cases before a congressional panel on Tuesday regarding a court order to force the technology company to give the FBI data from the iPhone belonging to one of the San Bernardino shooters.
On Thursday, Apple filed a motion to vacate the court order, maintaining its stance that Apple Chief Executive Tim Cook said he would be willing to take all the way to the Supreme Court.
A federal judge handed Apple a major victory in a phone unlocking case in Brooklyn on Monday, ruling that he did not have the legal authority to order Apple to disable the security of an iPhone that was seized during a drug investigation.
Apple's general counsel, Bruce Sewell, will argue Tuesday that creating a tool to unlock the phone would weaken the security of hundreds of millions of Apple devices, according to Sewell's prepared remarks before the U.S. House of Representatives Judiciary Committee.
"Hackers and cyber criminals could use this to wreak havoc on our privacy and personal safety," he said in those remarks.
Sewell will testify directly after FBI Director James Comey, who told lawmakers last week that creating an unlocking technique would "unlikely to be a trailblazer" for setting a legal precedent and would not be useful for breaking into later generation Apple devices.
Attorney General Loretta Lynch called for greater cooperation between tech companies and the U.S. government in prepared remarks for the RSA Cybersecurity conference in San Francisco on Tuesday, saying "we don’t necessarily have to be locked in perpetual and perfect agreement – but we do have to be engaged in open dialogue."
Comey will tell the House Judiciary Committee that the FBI is "not asking to expand the government’s surveillance authority," but rather to maintain its ability to obtain electronic information under legal authorities that Congress has already provided, according to his prepared remarks.
Comey told a congressional panel on Thursday that the phone could have "locator services" that would help the agency fill in a gap in its knowledge of the route that Rizwan Farook and Malik Tashfeen traveled as they fled police after their shooting rampage in December that killed 14 and wounded 22 in San Bernardino, California.
"We've looked at every gas station camera, every intersection camera, we have the whole route, but we're missing 19 minutes before they were finally killed by law enforcement," Comey said. "The answer to that might be on the device."
"Many members" of the House Judiciary Committee believe Congress, rather than the courts, should decide how to balance security and privacy concerns in such cases, according to a Democratic aide on the committee.
Manhattan District Attorney Cyrus Vance will also testify in support of the FBI, arguing that default device encryption "severely harms" criminal prosecutions at the state level, including in cases in his district involving at least 175 iPhones.
Vance's office has drafted legislation it wants Congress to enact that would go beyond the single court case and require companies like Apple to ensure that their devices could be accessed in unencrypted form.
"My colleagues from jurisdictions around the country have been running into the same road blocks in their efforts to investigate and prosecute serious crimes," Vance said in prepared remarks.
The U.S. Justice Department has sought court orders to force Apple to extract data from 15 devices in the past four months, beginning with a case in Brooklyn in which Apple declined to cooperate with investigators in October.

On Thursday, Apple filed a motion to vacate the court order, maintaining its stance that Apple Chief Executive Tim Cook said he would be willing to take all the way to the Supreme Court.
A federal judge handed Apple a major victory in a phone unlocking case in Brooklyn on Monday, ruling that he did not have the legal authority to order Apple to disable the security of an iPhone that was seized during a drug investigation.
Apple's general counsel, Bruce Sewell, will argue Tuesday that creating a tool to unlock the phone would weaken the security of hundreds of millions of Apple devices, according to Sewell's prepared remarks before the U.S. House of Representatives Judiciary Committee.
"Hackers and cyber criminals could use this to wreak havoc on our privacy and personal safety," he said in those remarks.
Sewell will testify directly after FBI Director James Comey, who told lawmakers last week that creating an unlocking technique would "unlikely to be a trailblazer" for setting a legal precedent and would not be useful for breaking into later generation Apple devices.
Attorney General Loretta Lynch called for greater cooperation between tech companies and the U.S. government in prepared remarks for the RSA Cybersecurity conference in San Francisco on Tuesday, saying "we don’t necessarily have to be locked in perpetual and perfect agreement – but we do have to be engaged in open dialogue."
Comey will tell the House Judiciary Committee that the FBI is "not asking to expand the government’s surveillance authority," but rather to maintain its ability to obtain electronic information under legal authorities that Congress has already provided, according to his prepared remarks.
Comey told a congressional panel on Thursday that the phone could have "locator services" that would help the agency fill in a gap in its knowledge of the route that Rizwan Farook and Malik Tashfeen traveled as they fled police after their shooting rampage in December that killed 14 and wounded 22 in San Bernardino, California.
"We've looked at every gas station camera, every intersection camera, we have the whole route, but we're missing 19 minutes before they were finally killed by law enforcement," Comey said. "The answer to that might be on the device."
"Many members" of the House Judiciary Committee believe Congress, rather than the courts, should decide how to balance security and privacy concerns in such cases, according to a Democratic aide on the committee.
Manhattan District Attorney Cyrus Vance will also testify in support of the FBI, arguing that default device encryption "severely harms" criminal prosecutions at the state level, including in cases in his district involving at least 175 iPhones.
Vance's office has drafted legislation it wants Congress to enact that would go beyond the single court case and require companies like Apple to ensure that their devices could be accessed in unencrypted form.
"My colleagues from jurisdictions around the country have been running into the same road blocks in their efforts to investigate and prosecute serious crimes," Vance said in prepared remarks.
The U.S. Justice Department has sought court orders to force Apple to extract data from 15 devices in the past four months, beginning with a case in Brooklyn in which Apple declined to cooperate with investigators in October.
