Chief Justice Ma (Chinese: 馬道立) is the incumbent Chief Justice of the Hong Kong Court of Final Appeal. Between 2001 and 2010, he held various positions in the High Court of Hong Kong, as a Judge of the Court of First Instance, a Justice of Appeal and the Chief Judge of the High Court. He was appointed the Chief Justice on 1 September 2010.
Chief Justice Ma graduated with an LL.B from Birmingham University in 1977. He completed his Bar Finals in 1978. He was called to the English Bar (Gray’s Inn) in 1978, the Hong Kong Bar in 1980, the Bar of the State of Victoria in Australia in 1983 and the Bar of Singapore in 1990. He was appointed Queen’s Counsel in 1993 and made an Honorary Bencher of Gray’s Inn in 2004. He was admitted to the degree of Doctor of Laws (honoris causa) by the University of Birmingham in 2011. He was awarded the Grand Bauhinia Medal by the Government in June 2012 and was conferred an Honorary Fellowship by Harris Manchester College of the University of Oxford in November 2012.

The Chief Justice in many countries is the name for the presiding member of a Supreme Court in Commonwealth or other countries with an Anglo-Saxon justice system based on English common law, such as the Supreme Court of Canada, the Constitutional Court of South Africa, the Court of Final Appeal of Hong Kong, the Supreme Court of India, the Supreme Court of Pakistan, the Supreme Court of Nepal, the Supreme Court of Ireland, the Supreme Court of New Zealand, the High Court of Australia, the Supreme Court of the United States, or provincial or state supreme courts. In England and Wales and Northern Ireland, the equivalent position is the Lord Chief Justice and in Scotland the equivalent is the Lord President of the Court of Session.
The Chief Justice can be appointed to the post in many ways, but in many nations the presiding position is commonly given to the senior-most justice in the court, while in the United States it is often the President's most important political nomination, subject to approval by the United States Senate. Although the title of this top American jurist is, by statute, Chief Justice of the United States, the term "Chief Justice of the Supreme Court" is often used unofficially.

The Chief Justice of India is the highest-ranking judge in the Supreme Court of India, and thus holds the highest judicial position in India. As well as presiding in the Supreme Court, the Chief Justice also head its administrative functions.
The current Chief Justice is S. H. Kapadia, who has held the office since 12th May 2010.
As the chief judge, the Chief Justice is responsible for the allocation of cases and appointment of constitutional benches which deal with important matters of law. In accordance with Article 145 of the Constitution of India and the Supreme Court Rules of Procedure of 1966, the Chief Justice allocates work to the other judges, who are bound to refer the matter back to him or her in case they require the matter to be looked into by a bench of higher strength.
On the administrative side, the Chief Justice carries out the following functions:
Article 124 of the Constitution of India provides for the manner of appointing judges to the Supreme Court. However, no specific provision is made as to the appointment of the Chief Justice; as a result, the latter is appointed in the same manner as for the other judges to the Supreme Court.

Beverley McLachlin, PC (born 7 September 1943) is the 17th and current Chief Justice of Canada, the first woman to hold this position. She also serves as a Deputy of the Governor General of Canada.
Born Beverley Gietz in Pincher Creek, Alberta, the eldest child of Ernest Gietz and Eleanora Kruschell, she received a B.A. and a M.A. degree in philosophy and an LL.B. degree (winning the gold medal as top student and serving as Editor-in-Chief of the Alberta Law Review) from the University of Alberta. She was called to the Bar of Alberta in 1969 and to the Bar of British Columbia in 1971. She practised law from 1969 until 1975. From 1974 until 1981 she was an Associate Professor and Professor with tenure at the University of British Columbia.
She has one son from her first marriage to Roderick McLachlin. Her first husband died in 1988 and she remarried in 1992 to Frank McArdle.
In 1981 she was appointed to the County Court of Vancouver and then to the Supreme Court of British Columbia. In 1985 she was appointed to the British Columbia Court of Appeal and in 1988 was appointed Chief Justice of the Supreme Court of British Columbia.. She was appointed to the Supreme Court of Canada on 30 March 1989 and was made Chief Justice of Canada on 7 January 2000.

Senate starts impeachment trial Posted on January 16, 2012 03:17:42 PM THE SENATE has formally begun on Monday the impeachment trial against Supreme Court Chief Justice Renato Corona. Mr. Corona arrived at the Senate early, accompanied by his wife, Cristina, and his two children. The senator-judges entered the session hall at past 2 p.m. Senate President Juan Ponce Enrile, who sits as presiding officer, formally started the proceedings. "We convene as a body as jurors to try and render judgment on the chief justice of the Supreme Court filed at the Senate by 188 members of the House of Representatives.," Mr. Enrile said in his opening speech. "The task at hand is a constitutional mandate and duty, which we have no reason to delay," he continued. Former Chief Justice Serafin Cuevas, who heads Mr. Corona's defense panel, was the first to take the stand to give an opening speech. He stressed Mr. Corona's stand that 'he is not guilty', and that the embattled chief justice was denied of due process. Mr. Cuevas explained that an impeachment complaint must be verified and there must be determination of probable cause prior to its signing the complain. He claimed that since the Chief Justice wasn't informed and was not given notice and proper preliminary hearing, he is therefore denied due process. "Due process is not only required by law, but also by the Constitution. [The Chief Justice] is therefore entitled to due process; he is entitled to notice and [preliminary] hearing," Mr. Cuevas said. Representing the prosecution team, Rep. Niel N.C. Tupas (5th district, Iloilo) also took the stand and presented the panel's argument. He asserted that the House of Representatives verified the complaint and that it has exclusive power to initiate the impeachment. In his opening speech, Mr. Tupas discussed the prosecution's allegations that Mr. Corona amassed ill-gotten wealth during the term of former President now Pampanga Rep. Gloria Macapagal-Arroyo (2nd district). "CJ Corona bartered away for pot of porridge independence and honor of Supreme Court," he said, proceeding to enumerate the properties allegedly owned by the chief magistrate. "Hindi na natin dapat ipagkatiwala ang pinakamataas na posisyon ng hudikatura kay Corona (We should no longer entrust the highest judicial position to Corona)," he said. Motions denied After presenting before the impeachment court the opening statements of both the prosecution and defense panels, the impeachment court then addressed motions filed by both parties. The court denied Mr. Corona's motion for preliminary hearing to discuss the verification of the impeachment complaint signed by 188 congressmen last Dec. 12 "for lack of merit." It, likewise, denied the following motion to cite the prosecutors in contempt for premature disclosure of evidence filed by lawyer Fernando P. Perito as it was filed by a private citizen. The trial was adjourned at 3:37 p.m. Sought for comment, Jose M. Roy III, one of the legal counsel's of Mr. Corona, said in an ambush interview that they were "unhappy with [the impeachment court's] decision" to deny their motion for preliminary hearing. He, however, said it was fair for the court to "draw everyone's attention to exercise caution on the merits of the case." "That is part of litigation; we don't expect everything to go our way," Mr. Roy said. For his part, prosecution head Mr. Tupas said in a press briefing that the prosecution team had anticipated what happened. "We had prepared for this for days, and at least, what happened today was good," he said. Moreover, he added that the prosecution team will present "at least two" witnesses before the impeachment court. The Senate earlier in the day cut short the plenary session and adjourned to prepare for the start of the impeachment trial that afternoon. Senate Majority Leader Vicente C. Sotto III said over the weekend that the chamber is eyeing to conclude the trial before the summer recess on March 23. Session will resume on May 7 until June 7. Stanley is needed because General Hummel has stolen some VX gas warheads and has announced that he will launch them onto San Francisco unless his demands are met. Stanley knows how to disarm the bombs, but Stanley needs someone who knows Alcatraz well enough to get him inside. That man is former British intelligence agent John Patrick Mason, who has been in prison for the past 30 years without a trial because he was accused of stealing the private files of 'J. Edgar Hoover' (qv). In 1962, John became the only inmate ever to escape from Alcatraz, and he stayed out of Alcatraz long enough to father a daughter named Jade Angelou. Despite his extreme hatred of the FBI, John agrees to help Stanley. Chief Justice Ma (Chinese: 馬道立) is the incumbent Chief Justice of the Hong Kong Court of Final Appeal. Chief Justice Ma (Chinese: 馬道立) is the incumbent Chief Justice of the Hong Kong Court of Final Appeal. Between 2001 and 2010, he held various positions in the High Court of Hong Kong, as a Judge of the Court of First Instance, a Justice of Appeal and the Chief Judge of the High Court. He was appointed the Chief Justice on 1 September 2010.
Chief Justice Ma graduated with an LL.B from Birmingham University in 1977. He completed his Bar Finals in 1978. He was called to the English Bar (Gray’s Inn) in 1978, the Hong Kong Bar in 1980, the Bar of the State of Victoria in Australia in 1983 and the Bar of Singapore in 1990. He was appointed Queen’s Counsel in 1993 and made an Honorary Bencher of Gray’s Inn in 2004. He was admitted to the degree of Doctor of Laws (honoris causa) by the University of Birmingham in 2011. He was awarded the Grand Bauhinia Medal by the Government in June 2012 and was conferred an Honorary Fellowship by Harris Manchester College of the University of Oxford in November 2012.

Senate starts impeachment trial

THE SENATE has formally begun on Monday the impeachment trial against Supreme Court Chief Justice Renato Corona.
Mr. Corona arrived at the Senate early, accompanied by his wife, Cristina, and his two children.
The senator-judges entered the session hall at past 2 p.m. Senate President Juan Ponce Enrile, who sits as presiding officer, formally started the proceedings.
"We convene as a body as jurors to try and render judgment on the chief justice of the Supreme Court filed at the Senate by 188 members of the House of Representatives.," Mr. Enrile said in his opening speech.
"The task at hand is a constitutional mandate and duty, which we have no reason to delay," he continued.
Former Chief Justice Serafin Cuevas, who heads Mr. Corona's defense panel, was the first to take the stand to give an opening speech. He stressed Mr. Corona's stand that 'he is not guilty', and that the embattled chief justice was denied of due process.
Mr. Cuevas explained that an impeachment complaint must be verified and there must be determination of probable cause prior to its signing the complain. He claimed that since the Chief Justice wasn't informed and was not given notice and proper preliminary hearing, he is therefore denied due process.
"Due process is not only required by law, but also by the Constitution. [The Chief Justice] is therefore entitled to due process; he is entitled to notice and [preliminary] hearing," Mr. Cuevas said.
Representing the prosecution team, Rep. Niel N.C. Tupas (5th district, Iloilo) also took the stand and presented the panel's argument. He asserted that the House of Representatives verified the complaint and that it has exclusive power to initiate the impeachment.
In his opening speech, Mr. Tupas discussed the prosecution's allegations that Mr. Corona amassed ill-gotten wealth during the term of former President now Pampanga Rep. Gloria Macapagal-Arroyo (2nd district).
"CJ Corona bartered away for pot of porridge independence and honor of Supreme Court," he said, proceeding to enumerate the properties allegedly owned by the chief magistrate.
"Hindi na natin dapat ipagkatiwala ang pinakamataas na posisyon ng hudikatura kay Corona (We should no longer entrust the highest judicial position to Corona)," he said.
Motions denied
After presenting before the impeachment court the opening statements of both the prosecution and defense panels, the impeachment court then addressed motions filed by both parties.
The court denied Mr. Corona's motion for preliminary hearing to discuss the verification of the impeachment complaint signed by 188 congressmen last Dec. 12 "for lack of merit."
It, likewise, denied the following motion to cite the prosecutors in contempt for premature disclosure of evidence filed by lawyer Fernando P. Perito as it was filed by a private citizen.
The trial was adjourned at 3:37 p.m.
Sought for comment, Jose M. Roy III, one of the legal counsel's of Mr. Corona, said in an ambush interview that they were "unhappy with [the impeachment court's] decision" to deny their motion for preliminary hearing.
He, however, said it was fair for the court to "draw everyone's attention to exercise caution on the merits of the case."
"That is part of litigation; we don't expect everything to go our way," Mr. Roy said.
For his part, prosecution head Mr. Tupas said in a press briefing that the prosecution team had anticipated what happened.
"We had prepared for this for days, and at least, what happened today was good," he said.
Moreover, he added that the prosecution team will present "at least two" witnesses before the impeachment court.
The Senate earlier in the day cut short the plenary session and adjourned to prepare for the start of the impeachment trial that afternoon. Senate Majority Leader Vicente C. Sotto III said over the weekend that the chamber is eyeing to conclude the trial before the summer recess on March 23. Session will resume on May 7 until June 7.

Chief Justice Dr. Willy Mutunga is asking the government to dig up the 11 graves at Kamiti prison and identify the remains of freedom fighter Dedan Kimathi. Dr. Mutunga made the call while presenting certified copies of the late freedom fighter's files to his family. The file was recently obtained from the Senate House Library of the University of London in the United Kingdom. -

President Obama has announced he will nominate federal appeals court judge Merrick Garland for a seat on the Supreme Court. This sets up an epic political battle over the replacement of Justice Antonin Scalia, Garland is the chief justice of the U.S. Court Court of Appeals for the D.C. Circuit. He has served on the bench for almost 20 years. Politically, he is a centrist. Garland has a long way to go before he takes the oath and serves on the bench. WASHINGTON — Merrick Garland almost made it to the Supreme Court six years ago, but he was saved for a time when President Obama might need someone palatable to Republicans to replace a conservative justice.
A time like now.
Garland, chief judge of the U.S. Court of Appeals for the D.C. Circuit — the most common stepping-stone to the Supreme Court — comes straight out of central casting.
Like five current justices as well as the late Antonin Scalia, who he would replace, Garland attended Harvard Law School. Like Samuel Alito and Sonia Sotomayor, he's a former prosecutor. Like Scalia, Chief Justice John Roberts, Clarence Thomas and Ruth Bader Ginsburg, he comes from the powerful D.C. Circuit court. Like Ginsburg, Stephen Breyer and Elena Kagan, he is Jewish.
Garland isn't even the first Supreme Court nominee to earn undergraduate and law degrees from Harvard, clerk for Judge Henry Friendly of the U.S. Court of Appeals for the 2nd Circuit, work at the Justice Department, become a partner at a major Washington, D.C., law firm, and serve on the D.C. Circuit . Roberts did all that.
Faced with the opportunity to nominate the court's first Asian American, third African American or fifth woman in history, Obama opted for a mild-mannered judge from Chicago who may be the most difficult of all the potential nominees for Republicans to rebuff.
In his brief Rose Garden remarks Wednesday, a choked-up Garland described his early years as a prosecutor seeking to convince scared mothers and grandmothers to testify against violent gang members.
“Trust that justice will be done in our courts without prejudice or partisanship is what in large part distinguishes this country from others," he said. His job then as now, he added, was to make sure that "the rule of law would prevail."

Question of evidence: How much proof is needed for impeachment trials?

Do the rules of evidence in criminal cases apply to impeachment cases? Or will the lighter burden of proof in simple administrative cases do instead?
On Tuesday upon the suggestion of Senator-judge Miriam Defensor Santiago, the Senate decided to hold a caucus to determine the standard of evidence the House prosecution panel must attain to convince the senator-judges trying the case to convict impeached Chief Justice Renato Corona.
The Supreme Court has held in a long line of cases that when it comes to standards of evidence, "proof beyond reasonable doubt is at the highest level, followed by clear and convincing evidence, then by preponderance of evidence, and lastly by substantial evidence, in that order."
Which standard of evidence applies depends on the nature of the case. So, the impeachment case against Corona -- are the proceedings criminal, civil or administrative?
'Akin to criminal proceedings'
On the first day of trial last week, the Presiding Officer of the Senate sitting as the Impeachment Court, Senate President Juan Ponce Enrile, expressed the opinion that impeachment was "akin to criminal proceedings" and that statement alarmed the House prosecution panel and appeased Corona's defense team.
On Tuesday, lead defense counsel Serafin Cuevas, a former SC associate justice, said that since Corona faces the accessory penalty of perpetual disqualification from holding public office, which was like a criminal penalty, then the quantum of evidence in the impeachment trial should be proof beyond reasonable doubt like in criminal cases.
Proof beyond reasonable doubt is "that degree of proof which produces conviction in an unprejudiced mind" which arises from moral certainty and not absolute certainty that the person to be convicted is guilty of the crime.
The constitutional provisions on impeachment speak of "conviction" while the Senate Rules of Procedure in Impeachment Proceedings speak of a "plea of guilty" or a "plea of not guilty."
But Corona wrote in his Separate Opinion to the Supreme Court's November 2003 decision dismissing the second impeachment complaint lodged against then Chief Justice Hilario Davide Jr. that "[b]ecause of its peculiar structure and purpose, impeachment proceedings are neither civil nor criminal."
Corona then quoted Justice Joseph Story of the United States Supreme Court: "The design of impeachment is to remove the impeachable officer from office, not to punish him. An impeachable act need not be criminal. That explains why the Constitution states that the officer removed shall be subject to prosecution in an ordinary criminal case."
'Substantial' or 'preponderance'?
In response to the statement Cuevas made on Tuesday, House lead prosecutor Rep. Niel Tupas Jr. argued that impeachment is just administrative proceedings to remove an impeachable officer from office and not to punish the official.
The standard of evidence in administrative cases is only substantial evidence -- the easiest level of evidence to be reached by a prosecutor. Substantial evidence refers to such amount of relevant evidence which a reasonable mind might accept as adequate to justify a conclusion.
Higher than the standard of substantial evidence in administrative proceedings in quasi-judicial bodies is the standard of preponderance of evidence in civil cases in courts.
Preponderance of evidence pertains to "probability of the truth." It is evidence of the side that the court finds more convincing and worthy of belief.
The Rules of Court explain how to determine preponderance of evidence.
Section 1 of Rule 133 states that "the court may consider all the facts and circumstances of the case, the witnesses' manner of testifying, their intelligence, their means and opportunity of knowing the facts to which they are testifying, the nature of the facts to which they testify, the probability or improbability of their testimony, their interest or want of interest, and also their personal credibility so far as the same may legitimately appear upon the trial."
'Clear and convincing proof,' 'overwhelming preponderance'
Also on Tuesday, Senator-judges Santiago and Alan Peter Cayetano called attention to that level of evidentiary standard between civil cases and criminal proceedings. They were referring to "clear and convincing proof" -- a more stringent standard than preponderance of evidence but less than proof beyond reasonable doubt.
