The District of Columbia Act of 1871
Initial review of the District of Columbia Organic Act of 1871 seems like it only sets up a local government (like Chicago or Seattle); how do you get that they formed a private corporation?
If you take the Act out of its historical context and, from the present looking to the past, imagine who the parties involved are, we might agree. However, we cannot do that; to best understand what really happened we follow our:
Standard for Review
Rule 1: To understand any relationship you must:
1. First understand who the parties are;
a. Always know yourself first
b. Discover the true nature of all other parties second
2. Then you must understand the environmental nature of the relationship; and,
3. Only then do the actual terms of the relationship begin to have meaning and bearing on the relationship.
Rule 2: To have any hope of understanding any particular situation in any relationship you must have first applied Rule 1, only then do the details of the situation in question have any meaning; therefore, review such details in accord with Rule 1 as well.
Thus, to understand the parties involved in the District of Columbia Organic Act of 1871, we must first understand who the parties are involved in the relationship described by the Act. We are not here going to delve into the Act in its entirety, suffice it to say, looking over the situation we find the Act is one made by the original jurisdiction Congress, set by the Constitution for the United States of America. The District of Columbia Organic Act of 1871 describes its venue as: "all that part of the territory of the United States included within the limits of the District of Columbia". The District of Columbia was originally provided for in the Constitution for the United States of America (9-17-1787) at Article 1 Section 8, specifically in the last two clauses. Then, on July 16, 1790, in accord with the provisions of those clauses, the Territory was formed in the District of Columbia Act, wherein the "ten mile square" territory was permanently created and made the permanent location of the country's government, that is to say, the "territory" includes the actual government. Under the Act Congress also made the President the civic leader of the local government in all matters in said Territory. Then on February 27, 1801, under the second District of Columbia Act, two counties were formed and their respective officers and district judges were appointed. Further, the established town governments of Alexandria, Georgetown and Washington were recognized as constituted and placed under the laws of the District, its judges, etc. The United States Supreme Court has repeatedly called this act the "District of Columbia Organization Act" or the "Charter Act of the District of Columbia" and recognized it as the incorporation of the "municipality" known as the "District of Columbia". Then on March 3, 1801 a Supplementary Act to that last Act, noted here, added the authority that the Marshals appointed by the respective District Court Judges collectively form a County Commission with the authority to appoint all officers as may be needed in similarity to the respective State officials in the states whence the counties Washington and Alexandria came, those being Maryland and Virginia, respectively.
According to the United States Supreme Court those charter acts (first acts) were the official incorporation of the formal government of the District of Columbia as chartered by Congress in accord with the Constitution's provision. Again, the Supreme Court called that body of government "a corporation", with the right to sue and be sued. Since 1801 The District of Columbia has been consistently recognized as a "municipal corporation" with its own government.
Congress wrote:
That all that part of the territory of the United States included within the limits of the District of Columbia be, and the same is hereby, created into a government by the name of the District of Columbia, by which name it is hereby constituted a body corporate for municipal purposes ... and exercise all other powers of a municipal corporation

The passage of the Residence Act in 1790 created a new federal district that would become the capital of the United States. Formed from land donated by the states of Maryland and Virginia, the capital territory already included two large settlements at its creation: the port of Georgetown, Maryland and the town of Alexandria, Virginia. A new capital city named in honor of President George Washington was founded to the east of Georgetown in 1791.
Shortly after establishing operations in the new capital, Congress passed the Organic Act of 1801, which organized the federal territory. Congress allowed the cities of Washington and Georgetown to each maintain their own municipal governments. The remainder of the unincorporated territory within the federal district formed the new County of Washington, which was governed by a levy court consisting of three Justices of the Peace appointed by the President. The City of Alexandria and adjacent Alexandria County also maintained their own local governments but were returned by Congress to the state of Virginia in 1846.
The outbreak of the American Civil War in 1861 led to notable growth in the capital's population due to the expansion of the federal government and a large influx of freed slaves.[2] By 1870, the District's population had grown 75% to nearly 132,000 residents.[3] Growth was even more dramatic within County of Washington, where the population more than doubled as people escaped the crowded city.
The individual local governments within the District were insufficient to handle the population growth. Living conditions were poor throughout the capital, which still had dirt roads and lacked basic sanitation. The situation was so bad that some lawmakers in Congress even suggested moving the capital out further west, but President Ulysses S. Grant refused to consider the proposals.
Instead, Congress passed the Organic Act of 1871, which revoked the individual charters of the cities of Washington and Georgetown and combined them with Washington County to create a unified territorial government for the entire District of Columbia.
The new government consisted of an appointed governor and 11-member council, a locally elected 22-member assembly, and a board of public works charged with modernizing the city.
The Seal of the District of Columbia features the date 1871, recognizing the year the District's government was incorporated.
In 1873, President Grant appointed an influential member of the board of public works, Alexander Robey Shepherd, to the post of governor. Shepherd authorized large-scale municipal projects, which greatly modernized Washington. In doing so, however, the governor spent three times the money that had been budgeted for capital improvements, bankrupting the city. In 1874, Congress replaced the District's quasi-elected territorial government with an appointed three-member Board of Commissioners. Direct rule by Congress would continue for nearly a century until the passage of the District of Columbia Home Rule Act in 1973.

One of the more successful states at Miss USA, the District of Columbia is one of 15 states to win Miss USA more than once and one of only twelve states to win the Miss Congeniality award twice. Knowing the government of the District of Columbia was already "created into a government" and so formed into a municipal incorporation in 1801 under the District of Columbia Acts, we wonder, even with Congress' constitutional authority to pass any law within the ten mile square of the District, how do you create, or incorporate, for the first time a municipal government that has already been in existence as a municipal corporation for over 70 years? The obvious answer is, "It's impossible!" There is no way to pass an "Organic Act" when the Charter Act is already in place, because the two words (organic and charter) have the same meaning—The First Act. Even Congress cannot change history; though historians can make it appear to change by rewriting it for those unwilling to study the past from the records. The records speak for themselves only if we study them.
When you consider the historical facts, the only meaning left for the terms given in the opening paragraph of the District of Columbia Organic Act of 1871 (and that which follows) is, the municipal corporation that was created is a private corporation owned by the actual government. And the only government created in that Act was the same government any private corporation has within the operation of its own corporate construct. Thus, we call it Corp. U.S. We also note Congress reserved the right, granted them in the Constitution, to complete dictatorial authority over their Corp. The District of Columbia's city council voted on Tuesday (February 4) to decriminalize marijuana in a move that would make smoking a joint in the U.S. capital a violation comparable to a parking ticket. The proposal would eliminate criminal penalties for marijuana possession. The proposed $25 fine for having less than an ounce of pot is smaller than most city parking tickets. People smoking in public would be fined $100, and minors would have a letter sent to their parents. The bill passed 11-1 in the first of two council votes. The second vote could take place as soon as February 18, or at the next scheduled hearing on March 4, a spokesman for Councilmember Tommy Wells said.
To become law, the bill must also be approved by Democratic Mayor Vincent Gray, who has voiced support for the measure. Supporters have portrayed decriminalization in Washington as a way to cut law enforcement costs and increase fairness. A study by the American Civil Liberties Union has shown that eight times more black people are arrested for pot possession in the nation's capital than people of other races.
"We've had a long period of social and racial injustice related to the war on drugs, especially when it comes to marijuana. Ninety-one percent of the arrests in D.C. related to small amounts of marijuana are African Americans. And you can't tell me with six universities, not to stereotype, that the only people smoking pot are African American youth," City Councilmember Tommy Wells, who sponsored the bill, said.
Possession of marijuana in Washington is now a misdemeanor carrying up to six months in jail and a $1,000 fine, except for the handful of patients who use medical marijuana. The starting price for medical marijuana in the District is about $300 an ounce. If the proposed measure gets final approval, Washington would join 15 U.S. states and a handful of cities that have removed the threat of arrest for possession of small amounts of marijuana Spencera Simpkins said she was humiliated when she was arrested for possession of marijuana. "The undercovers just jumped out and just told me to get up against the car and when they searched me, and upon searching me, they found a marijuana J. And then I was arrested and I was taken to First District, where I was processed," Simpkins said in an interview outside the hearing room.
Stuart Anderson, who heads an organization called Family and Friends of Incarcerated people, gathered with other activists outside the D.C. government building before the vote. He said the real problem with being arrested for possession of small amounts of marijuana is that it can easily change the course of a young person's life.
"The average kid is going to have a joint. Two or three of them are going to get together and buy a bag, a five dollar bag. And if the police run down on them, they're going to lock those kids up, they're going to get a record, that's their first possession. They're going to lock them up again, that's their second possession, and then their third possession, depending on their age, they're going to some juvenile facility or they're going to jail," Anderson said.
While applauding the council vote, Adam Eidinger, of the D.C. Cannibis Campaign, said it doesn't go far enough. "This is long overdue. It's a shame it's 2014 and we're finally getting decrim. We need legalization. That's what we need," Eidinger said. Marijuana is illegal under federal law, but 20 U.S. states and the District of Columbia allow medical marijuana use. Colorado and Washington state have legalized recreational use. President Barack Obama said in a New Yorker magazine interview last month that smoking marijuana was a "bad habit," but thought penalties fell disproportionately on minorities. States legalizing pot should go ahead with their plans, he said.

Marion Shepilov Barry, Jr. (March 6, 1936 – November 23, 2014) was an American politician who served as the second Mayor of the District of Columbia from 1979 to 1991, and again as the fourth mayor from 1995 to 1999. A Democrat, Barry had served three tenures on the Council of the District of Columbia, representing as an at-large member from 1975 to 1979 and in Ward 8 from 1993 to 1995, and again from 2005 to 2014. In the 1960s he was involved in the African-American Civil Rights Movement, first as a member of the Nashville Student Movement sit-ins and then serving as the first chairman of the Student Nonviolent Coordinating Committee (SNCC).
Barry came to national prominence as mayor of the national capital, the first prominent civil rights activist to become chief executive of a major American city.[3] He gave the presidential nomination speech for Jesse Jackson at the 1984 Democratic National Convention. His celebrity was transformed into international notoriety in January 1990, when he was videotaped smoking crack cocaine and was arrested by Federal Bureau of Investigation (FBI) officials on drug charges. The arrest and subsequent trial precluded Barry seeking re-election, and he served six months in a federal prison. After his release, he was elected to the Council of the District of Columbia in 1992. He was elected again as mayor in 1994, serving from 1995 to 1999.
Despite his history of political and legal controversies, Barry was a popular and influential figure in Washington, D.C. The alternative weekly Washington City Paper nicknamed him "Mayor for life", a designation that remained long after Barry left the mayoralty. The Washington Post once stated that "to understand the District of Columbia, one must understand Marion Barry".

Dr. April Massey, for the Dr. Marjorie Holloman Parker Distinguished Educator's Award, presented to that individual whose laudable contributions as an educator have made a discernable difference in the city or nation's schools, colleges, universities or private institutions of learning. (The Dr. Marjorie Holloman Distinguished Educator's Award is named in honor the former University of District of Columbia Board of Trustees Chairwoman, University Professor and D.C. Legislator.)
Dr. Marie Racine, for the Dr. Paul Phillips Cooke Lifetime Achievement Award, presented to that faculty or staff member who has consistently demonstrated exceptional loyalty and extraordinary commitment, dedication, and service to the advancement of the University and its goals and objectives. (The Paul Phillips Cooke Lifetime Achievement Award is named in honor of the former President District of Columbia Teachers College.)
Lt. Donald Whiting, for the Dr. Cleveland L. Dennard Distinguished Service Award, presented to an individual who has demonstrated a long-term commitment and outstanding service to the University of the District of Columbia.(The Cleveland L. Dennard Service Award is named in honor of the former President of Washington Technical Institute.)
Dr. Alfred Taylor, Jr., for The Honorable Ronald H. Brown Distinguished Leadership Award, awarded to that individual who has demonstrated outstanding leadership in his/her profession and whose work has contributed to the betterment of our community and its citizens on a local, national or international level. (The Honorable Ronald H. Brown Distinguished Leadership Award is named in honor of former U.S. Secretary of Commerce and Chairman of the University of the District of Columbia Board of Trustees.)
Carrington Smith, Distinguished Alumni of the Year Award, presented an active member of the Alumni Association for 5 years or more who has demonstrated extraordinary participation in the association through contributing to the betterment of the Alumni Society, increasing membership participation, enhancing the image of the association, showing professional ethics of the highest caliber, and active involvement in the community.
The Myrtilla Miner Award for Exceptional Service to Society is bestowed on a person/s the President of the University determines has demonstrated exceptional lifetime services to the residents of the District of Columbia and the nation. This year's award is presented posthumously to Myrtilla Miner, an abolitionist who founded Normal School for Colored Girls (aka Normal Miner School, Normal Teachers College in Washington, D.C.). The school was eventually merged with other educational institutions to form the University of the District of Columbia. Ms. Charlotte Payne Wright, Treasurer of the Thomas Minor Society, will accept the award.

The University of the District of Columbia celebrated its Annual Founders' Day Convocation and Awards Program, in the Theatre of the Arts on the University's Van Ness Campus. This year's theme is "Honoring our Legacy, Blazing New Trails." The keynote speaker is Dr. George Cooper, former President of South Carolina State University and currently the Executive Director of the White House Initiative on Historically Black Colleges and Universities.
